PALM SPRINGS SKATE PARK
RECOMMENDATION:
It is recommended that the City Council approve and adopt the plans, specifications and
working details, and authorize advertisement for construction bids for the following two
projects:
1) Palm Springs Skate Park Construction, City Project 02-23
2) Swim Center, Pool House & Concession Stand Improvements, City Project 98-21
SUMMARY:
Section 7.03.040 of the Procurement and Contracting Code requires that Council approve
and adopt plans, specifications and working details, and authorize the bid request for all
public projects in excess of $100,000. Approval of these two projects will allow staff to
proceed with these public projects, with a total estimated cost of$1,600,000.
BACKGROUND:
Widespread community support for, as well as previous Council endorsement of
construction of a community skate park facility within the Sunrise Park grounds led to the
award of a design contract with Site Design Group on April 24, 2002. Development of the
conceptual plans forthe skate park facility, designed by Interactive Design Group,following
months of community involvement and review by the Parks & Recreation Commission,
Planning Commission, as well as previous City Council study session reviews,have resulted
in development of plans and specifications for construction bidding of this facility.
The City has successfully received over $500,000 in state grants toward the construction
of the skate park facility. Due to the fact that the use of state funds requires contract
provisions for prevailing wages, staff has divided the construction of this facility into two
separate projects. The skate park portion of the project where state grant funds will be used
and where prevailing wage rates will apply has been entitled: Palm Springs Skate Park
Construction, City Project 02-23; whereas, the swim center renovations and new pool
house/concession stand building construction where general funds will be used, and thereby
prevailing wage rates will not apply (and by extension, lower construction costs will result),
has been entitled: Swim Center, Pool House & Concession Stand Improvements, City
Project 98-21.
The Palm Springs Skate Park Construction project includes within its scope of work the
following:
• Removal of existing concrete sidewalk and concrete masonry block walls;
• Demolition and removals,and associated hazardous material handling and disposal
of the existing pool house building;
• Clearing, grubbing, removals and grading of the skate park site;

• Construction of a complete Portland cement concrete skate park with various
ledges, basins, pools, bowls, and other elements, including decorative coping,
ceramic tile treatment, and steel edging;
• Construction of new decorative Portland cement concrete walkways, concrete
masonry block walls, and retaining walls;
• Construction of decorative wrought iron fencing and gates; and
• Installation of landscaping, irrigation, and lighting and electrical systems
Following review of the skate park project by Council at its December 11 Study Session,
staff was made aware of the fact that the custom cable and canopy system originally
conceived by Ralph Raya and presented to the Council would not function appropriately
within the skate park itself. On closer inspection of the structural plans, staff was made
aware of the fact that additional support columns would be necessary within the skate park
area and not limited to its perimeter, representing an obstacle and safety hazard to skate
park users. Although Council supported this canopy concept, the structural requirements
to support the weight of the canopy and lights are not consistent with the layout of the skate
park area.
In order to move forward with construction of the skate park, staff has included in the bid
documents the following alternative options relating to the park lighting system:
1) Install only the infrastructure (conduit, footings, and basic electrical system)for the
traditional 25-feet high pole and 1000-watt flood light system, but with no poles and
lights, implying that the City, at least initially, would not operate the park at night.;
2) Install the complete traditional flood light system;
3) A revision to Ralph Raya's original concept, includes only poles and cables to
support hanging direct cut-off flood lights, but without the canopy system; and
4) A cantilever canopy system identical to the type installed at the parking structure,
providing shade around the perimeter of the skate park facility, (to be included, if
structural plans are available for inclusion into the bid documents prior to bidding).
The fourth concept is one that would continue to include a canopy-type structure that has
received strong Planning Commission and Council support, and allows for the ability of
"tying together" the canopy-type forms found at the airport and the new parking structure.
Another optional item to be included, in response to Council direction received at the
December 11 Study Session, will relate to construction of either a wrought iron fence or
masonry block wall along the property line between the skate park and high school.
The Swim Center, Pool House & Concession Stand Improvements project includes within
its scope of work the following:
1) Construction of a new bath and locker room facility and concession/administration
building, complete with all required fixtures; and
2) Removal and replacement of existing swim center filtration, heating and chemical
equipment and systems

This action is being brought before Council to be in compliance with the Procurement and
Contracting Code. The plans and specifications are continuing to undergo final review by
City staff through the plan-check process, and minor modifications relating to technical
details and specifications may be required following Council's formal approval of the plans
and specifications. Upon Council's approval with this action and final plan-check
corrections, as required to ensure compliance with applicable building codes and other
related issues, staff will schedule bid advertisements, with a tentative bid opening date of
January 28, 2003.

ADDENDUM NO. 1
To all prospective bidders under Specifications for the Palm Springs Skate Park Construction;
City Project No. 02-23, which are to be received by the City of Palm Springs at the office of
the Director of Procurement and Contracting at 3200 E. Tahquitz Canyon Way, Palm Springs,
CA 92262, until 2:00 p.m. on Tuesday, February 25, 2003:
I. The following change shall be made in Part I - Bidding and Agreement Forms and
Bonds:
A. Paragraph N-7 "Contractor's License Classification" shall be revised to read: The
Contractor shall possess a valid Class A or Class B license at the time of submitting
bids.
11. The following change shall be made in Part II - Conditions of the Contract,
Supplementary General Conditions:
A. Article 6.4 "Concerning Subcontractors, Suppliers, and Others", subparagraph (e)
is revised to require that the Contractor shall perform not less than 0% (zero
percent) of the Work included in the original Contract Price with its own forces.
III. The following changes shall be documented and considered as revisions to the project
drawings:
A. Sheet C-4.1 (9a of 37), Sheet C-4.2 (9b of 37) and Sheet E-2 (32 of 37) have been
revised. The original sheets shall be discarded and the revised sheets, dated
February 10, 2003, shall be used.
IV. The Special Provisions as originally issued shall be used in submitting bids, and an
acknowledgment of receipt of this Addendum No. 1 shall be entered on Page 2 of the
Bid forms. Failure to provide such acknowledgment shall render the bid as non-

ADDENDUM NO. 2
To all prospective bidders under Specifications for the Palm Springs Skate Park Construction;
City Project No. 02-23, which are to be received by the City of Palm Springs at the office of
the Director of Procurement and Contracting at 3200 E. Tahquitz Canyon Way, Palm Springs,
CA 92262, until 2:00 p.m. on Tuesday, February 25, 2003:
I. The following changes and clarifications shall be documented and considered as
revisions to the project drawings:
A. Sheet C-1 .1 (2 of 37) does not indicate an existing Verizon phone booth located
immediately west of the existing administration building on the pool deck, nor
existing light poles and lights around the perimeter of the pool deck, nor existing
lockers along the perimeter of the pool deck and adjacent to the existing block
walls, nor required demolition and removals of the existing pool deck. Sheet C-1 .1
shall be revised to indicate the following items:
1. The Contractor shall be responsible for removing and relocating (to a location
approved by the City adjacent to the new pool house building to be constructed
under separate contract as part of City Project 98-21) the existing Verizon
phone booth (and associated conduit and service lines), including required
coordination with Verizon.
2. The Contractor shall be responsible for removing and relocating the existing
lights (and associated conduit/conductors) that are within the demolition and
removal area required for construction of the meandering cast-in-place concrete
retaining wall/seat wall (as shown on Sheet C-2.1 [3 of 371)•
3. The Contractor shall be responsible for removing and disposing of the existing
locker facilities located within the pool deck area.
4. The Contractor shall be responsible for demolition and removal of the existing
pool deck required for construction of the meandering cast-in-place concrete
retaining wall/seat wall (as shown on Sheet C-2.1 [3 of 371), including
replacement of pool deck between the point where removal of existing pool
deck occurred and the new meandering cast-in-place concrete retaining
wall/seat wall.
The cost of items 1, 2, and 3 shall be considered as included in the bid item price
for Bid Item 8 "Building Demolition & Removals (includes hazardous materials
handling and disposal)" of Bid Schedules A, B, C, or D, and no additional
compensation shall be allowed therefore. The cost of item 4 shall be considered
as included in the bid item price for Bid Item 18 (Construct Concrete Cast-in-Place
Seatwall) of Bid Schedules A, B, C, or D, and no additional compensation shall be
allowed therefore.

B. Bid Item 17 "Construct 6' Wrought Iron Skate Park Perimeter Fence (includes
gates)" of Bid Schedules A, B, C, or D, includes the Swim Center entry/exit gate
located between the new locker room/rest room building and the
administration/concession stand building; and includes the Skate Park separate
entrance and exit gates, as shown on Sheet C-2.1 (3 of 37), Sheet C-4.1 (9a of 37)
and most clearly on Sheet C-4.2 (9b of 37). The Contractor shall include the cost
of furnishing and installing these gates, in coordination with construction of the
associated buildings and 8' high walls to be constructed under separate contract
as part of City Project 98-21. Shop drawings for these gates shall be provided to
the City prior to fabrication, as is indicated for the gate identified by Materials Key
Note 27 on Sheet C-2.1 (3 of 37). Four total gates are required for this project; all
gates shall be provided with hardware to allow them to be locked.

N-1 NOTICE IS HEREBY GIVEN that sealed bids for the Palm

Contracting of the City of Palm Springs, California, until
2 : 00 P.M. on February 25, 2003, at which time they will be

N-2 DESCRIPTION OF THE WORK: The Work comprises the

other contractors that will be using portions of the job site
that is, as part of this contract, to be prepared in advance
of, concurrent with, or after their work.
N-3 PRE-QUALIFICATION OF CONTRACTORS: All prospective
bidders are directed to review the "Contractor Pre-
Qualification Package" issued by the Department of
Procurement and Contracting on November 8, 2002 , regarding
pre-qualification of contractors for this project . Award of
this contract will ONLY be made to a pre-qualified Class A
general contractor committing to perform the structural
concrete work with its own forces or a Class A general
contractor utilizing a structural concrete (Class C-8) sub-
contractor who has successfully pre-qualified with the City
for this project via the pre-qualification process . Bidders
are encouraged to submit pre-qualification packages at the
earliest opportunity, or to obtain a listing of pre-qualified
Class C-8 sub-contractors, to ensure compliance with the pre-
qualification requirement. Information regarding the pre-
qualification process, or a listing of pre-qualified

Bid proposals submitted by general contractors that have
failed to successfully pre-qualify, or do not use a pre-
qualified Class C-8 licensed sub-contractor, will be
considered as non-responsive and rejected.
N-4 AWARD OF CONTRACT:
(a) The Work hereunder is set forth in four separate Bid
Schedules A, B, C, and D. Bidders are required to submit
bids on all four Bid Schedules . only one Bid Schedule will
be awarded, however, and the City reserves the right to award
to the lowest responsive, responsible bidder on the basis of
the Bid Schedule chosen for award by the City Council, and
reject all other bids, as it may best serve the interests of
the City. The City further reserves the right after opening
bids to reject any or all bids, and to waive any minor
informality (non-responsiveness) in a bid.
(b) As a condition of award, the successful bidder will
be required to submit payment and performance bonds and
insurance.
N-5 BID SECURITY: each bid shall be accompanied by a
certified or cashier' s check or Bid Bond in the amount of 10
percent of the total bid price payable to the City of Palm
Springs .
N-6 BIDS TO REMAIN OPEN: The Bidder shall guarantee the
Total Bid Price for a period of 60 calendar days from the
date of bid opening.
N-7 CONTRACTOR'S LICENSE CLASSIFICATION: The Contractor
shall possess a valid Class A Contractor license at the time
of submitting bids.
N-8 CALIFORNIA WAGE RATE REQUIREMENTS: The Contractor
shall pay the general prevailing rate of per diem wages as
determined by the Director of the Department of Industrial
Relations of the State of California for the locality where
the work is to be performed. A copy of said wage rates is on
file at the office of the City Engineer. The Contractor and
any subcontractors shall pay not less than said specified
rates and shall post a copy of said wage rates at the project
site.
N-9 RETAINAGE FROM PAYMENTS: The Contractor may elect to
receive 100 percent of payments due under the Contract
Documents from time to time, without retention of any portion
of the payment by the City, by depositing securities of
equivalent value with the City in accordance with the
provisions of Section 22300 of the Public Contract Code.

changed in order to accommodate supplementa-
tion of incomplete submissions, or late suhmis-
sions.Where a timely and completed application
results in a rating below that necessary to pre-
qualify, an appeal can be made. An appeal is
begun by the Contractor delivering notice to City
of Palm Springs of its appeal of the decision with
respectto its pre-qualification rating,no laterthan
ten business days prior to the closing time for the
receipt of bids for this public works project.
Without a timely appeal, the Contractor waives
any and all rights to challenge the decision of City
