Subject: AMENDMENT NO. 2 TO THE GENE AUTRY TRAIL. FROM INTERSTATE
10 TO VISTA CHINO (CITY PROJECT NO. 01-04 AND 02-03) CVAG
REIMBURSEMENT AGREEMENT

SUMMARY
Approval of Amendment No. 2 to the City of Palm Springs and the Coachella Valley
Association of Governments ("CVAG") Reimbursement Agreement (Agreement No.
4393) increases the total authorized Measure A amount by $1,750,437.93 to
$9,625,437,93 for the widening of Gene Autry Trail between Interstate 10 and Vista
Chino.
RECOMMENDATION-
1) Approve Amendment No. 2 to Agreement No. 4393, increasing the total
authorized Measure A amount by $1,750,437.93 to $9,625,437.93 for the
widening of Gene Autry Trail between Interstate 10 and Vista Chino; and
2) Authorize the City Manager to execute all necessary documents.
STAFF ANALYSIS:
On September 5, 2001, the City Council approved the original Reimbursement
Agreement with CVAG (Agreement No. 4393) for the widening of Gene Autry Trail
between Interstate 10 and Vista Chino. The agreement funds the construction of the
Gene Autry Trail Widening Project, consisting of two separate City projects: City Project
01-04 will widen Gene Autry Trail from two to six lanes from Salvia Road/Micro Place
across the Union Pacific Railroad bridge; and City Project 02-03 widened Gene Autry
Trail from two to four lanes through the Whitewater River and from two to six lanes
between Vista Chino and Via Escuela.
The original total project cost was estimated at $6,086,000 funded by the standard 75%
Regional Measure A / 25% Local Agency funding commitment. The Public Works and

Engineering Department was successful in obtaining a federal grant to widen the Gene
Autry Trail bridge over the Union Pacific Railroad in the amount of $4,340,000 which is
being used to offset the City's 25% local agency share for the two Gene Autry Trail
widening projects.
The first of these projects, the Gene Autry Trail Widening (Vista Chino to UPRR Bridge),
City Project 02-03, was completed last year. The final total cost of City Project 02-03
was $5,853,917.24, The second of these projects, the Gene Autry Trail UPRR Bridge
Widening, City Project 01-04, is ready to go to construction and has a final estimated
total cost of$6,980,000.
Amendment No. 2 to the Reimbursement Agreement with CVAG for the widening of
Gene Autry Trail between Interstate 10 and Vista Chino is necessary to obligate
additional Measure A funds to cover the final estimated costs of the two projects. The
CVAG Executive Committee approved Amendment No. 2 on July 27, 2009.
FISCAL IMPACT:
The final total cost for the Gene Autry Trail Widening (Vista Chino to UPRR Bridge), City
Project 02-03, was $5,853,917.24. Using the standard 75% Regional Measure A / 25%
Local Agency funding commitment, CVAG's share of the cost is $4,390,437.93 and the
City's share of the cost is $1,463,479.31.
The final estimated cost for the Gene Autry Trail UPRR Bridge Widening, City Project
01-04, is $6,980,000. Using the standard 75% Regional Measure A / 25% Local
Agency funding commitment, CVAG's share of the cost is estimated at $5,235,000 and
the City's share of the cost is estimated at $1,745,000. However, the City's $4,340,000
federal grant for City Project 01-04 more than offsets the City's share, providing an
estimated "credit" of$2,595,000 after applying the federal grant to the City's $1,745,000
estimated share. This credit will be applied to the City's share of City Project 02-03
($1,463,479.31), thereby reducing the City's costs for either of these projects to $0.
After applying the $2,595,000 credit to the City's $1,463,479.31 share of City Project 02-
03, an estimated remaining "credit" of $1,131,520.69 remains available. Staff has
requested that this estimated remaining credit be applied towards the City's local share
of the Palm Dr. / Gene Autry Trail Interstate 10 Interchange Project. Amendment No. 2
includes a provision allowing the remaining credit to be applied as requested.
The City's estimated share of the Palm Drive/Gene Autry Trail 1-10 Interchange project
cost is $3,100,000. Applying the estimated remaining credit will reduce this cost to
approximately $2,000,000.

FUNDING
THIS AMENDMENT NUMBER TWO is made and entered into this day of
2009, by and between the Coachella Valley Association of Governments, a
California joint powers agency, ("CVAG'), and the City of Palm Springs ("Agency"), and is
made with reference to the following background facts and circumstances:
This Amendment Number Two obligates and authorizes for expenditure, funds not
previously authorized under the terms of the original Reimbursement Agreement, executed
September 5, 2001, with a total project cost estimated at $6,086,000 (CVAG 75% Share =
$4,564,500), and Amendment Number One, executed August 14, 2006, which added additional
project costs of $4,414,000 (CVAG 75% Share = $3,310,500) . All other provisions in the
existing Reimbursement Agreement shall remain in force.
This Amendment Number Two shall memorialize the distribution of funds for this project,
accounting for a grant to the City of Palm Springs for the Railroad Bridge Construction Project
which shall be credited against the 25% Local Share of project costs for the entire length of the
Gene Autry Trail Project, which includes the segment of Gene Autry Trail from Vista Chino Drive
to the Railroad Bridge, the segment of the Railroad Bridge and the portion of Gene Autry Trail to
the Interstate 10 Interchange, and the final segment of the Interstate 10 Interchange project.
The impact of this Amendment Number Two will be to increase the 75% CVAG Share of ihis
total project to $9,625,437.93, For further detail please see Amendment Number Two, Exhibit
"B" - "Estimate of Cost".

EXHIBIT A - AMENDMENT NUMBER TWO
SCOPE OF SERVICES
GENE AUTRY TRAIL FROM INTERSTATE 10 TO VISTA CHINO DRIVE INCLUDING WHITE
WATER RIVER WASH CROSSING AND THE RAILROAD CROSSING BRIDGE
Provide all technical and professional services including labor, material, equipment,
transportation, supervision, administration, review and expertise to prepare and process an
Environmental Document, Project Report, Right-of-way engineering documents and Plans,
Specifications, & Estimates for the project.
Environmental:
Environmental services shall include the following. Preparation of technical studies, reports and
all other documents necessary to obtain environmental clearance for this project, and
processing of all environmental documents for approval.
The Environmental Document will meet the requirement of NEPA.
Construction:
Widen roadway from two to six lanes, except for the segment through the Whitewater River,
which will be widened from two to four lanes.

ESTIMATE OF COST
GENE AUTRY TRAIL FROM INTERSTATE 10 TO VISTA CHINO DRIVE INCLUDING WHITE
WATER RIVER WASH CROSSING AND THE RAILROAD CROSSING BRIDGE
A. Establish the CVAG Regional Share (75%) of Costs for the Project to Widen
Gene Autry Trail, from the Railroad Crossing Bridge to Vista Chino Drive, as
$4,390,437.93 (Local Share $1,463,479.31), and;
B, Establish the CVAG Regional Share (75%) of Costs for the Project to Improve
the Gene Autry Trail Railroad Crossing Bridge, and the intervening portion of
Gene Autry Trail to the Interchange on Interstate 10, as $5,235,000 (Local Share
$1,745,000), and;
C. Allow a Credit from the Palm Springs Grant Funds ($4,340,000) toward the
Local Share of the Project Costs to Widen Gene Autry Trail, from the Railroad
Crossing Bridge to Vista Chino Drive, as well as a Credit toward the Local Share
of the Project Costs to Improve the Railroad Crossing Bridge, and;
D. Allow a Credit from the Remainder of Palm Springs Grant Funds ($1,131,520.69)
toward the Local Share of the Project Costs to Improve the Gene Autry Trail/ Palm
Drive/ Interstate 10 Interchange Project.
