ESPLE-5282 (027) From- David H. Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY The City is the recipient of $1,850,000 in federal economic stimulus funds, allocated specifically for the federally funded Transportation Enhancement ("TE") Program, for the Gene Autry Trail Gateway Landscape Improvement Project, City Project 06-03. The construction documents (Plans, Specifications and Estimate) are completed and, in accordance with 7.03.040 of the Procurement and Contracting Code the Council is required to approve and adopt plans, specifications and working details, and authorize the bid request for all public projects in excess of $100,000. Approval of this project will allow staff to proceed with this public project with an estimated cost of $1,700,000. RECOMMENDATION: Approve the plans, specifications, and working details, and authorize bidding for the Gene Autry Trail Gateway Landscape Improvement Project, (City Project 06-03). STAFF ANALYSIS: On June 8, 2005, the Riverside County Transportation Commission (RCTC) released a Call for Projects using federal funds made available through the Transportation Enhancement (TE) Program. The TE Program provides federal funds for transportation related projects that enhance the quality of life, in or around transportation facilities. RCTC received $17.6 million in TE funds, which were made available in RCTC's first call for TE funded projects since October 1999. The Public Works and Engineering Department realized the value of the TE funds, as the TE Program provides funding for transportation improvements that would be difficult to otherwise fund with gas tax, Measure A, or other local funding. The Department previously applied for and received TE funds for the Gene Autry Trail and Ramon Road median landscaping project, which was completed in 2004. In response to the 2005 City Council Staff Report July 1, 2009 - Page 2 Gene Autry Trail Gateway Landscape Improvement Project(CP06-03) RCTC call for TE projects, Department staff reviewed opportunities for other landscaping or "transportation enhancement" improvements, and applied for TE funding for installation of landscaping the median and parkways on Gene Autry Trail between Vista Chino and Via Escuela and creating a "Gateway" entry monument sign and landscaped area at the southwest corner of Vista Chino and Gene Autry Trail (now considered a "pocket park"). After a competitive process among other Riverside County agencies, RCTC ultimately awarded the City $1,374,755 in TE funds for this project. Subsequently, the City solicited landscape architectural services and awarded a design contract to David Evans and Associates (DEA) on December 6, 2006. DEA prepared conceptual plans for the street scape landscaping and the park site, and on February 13, 2008, the City Council approved the conceptual plans. Please refer to the February 13, 2008, staff report (Attachment 1) for a more detailed project history. A color copy of the approved conceptual plans is included as Attachment 2. Following Council's approval of the conceptual plans, DEA prepared the final construction plans and specifications. As this project is federally funded (and administered by Caltrans as the custodian of the federal funds), we are required to submit a request for authorization to proceed with construction to Caltrans for review and approval. The request for authorization was originally submitted to Caltrans in November 2008. The original federal TE grant funds awarded for this project are also subject to funding allocation approval by the California Transportation Commission (CTC). As part of the process to obtain Caltrans authorization for construction, the allocation of the federal TE grant funds must be scheduled for a CTC vote. The allocation was listed on the January 2009 CTC agenda, however, at that meeting the CTC deferred all allocations of state and federal funding, indefinitely suspending hundreds of transportation projects throughout the state. The CTC's action was in response to the state's on-going budget crisis.' It appeared that this project was indefinitely postponed until the state's budget crisis would be resolved. However, passage of the federal economic stimulus package provided an opportunity to obtain federal funding that would not be affected by the state's on-going budget crisis. Certain federal funds have been allocated to Riverside County for discretionary spending by RCTC (subject to federal law associated with the funding). Staff coordinated with RCTC to switch the original federal TE grant funds for this project with federal economic stimulus funding. Since the City's original federal TE grant funds will, at some point, be available to RCTC for other projects when the CTC The CTC deferred allocation of federal funds because the state must front the funds reimbursed to the City. As the City incurs eligible expenses (paid out of the City's own funds), the City submits invoices for reimbursement to Caltrans. Caltrans in turn reimburses the City with state funds, and subsequently invoices the Federal Highway Administration for reimbursement of its payment to the City. The state's budget crisis eliminated the state's ability to front the funds to be allocated for the City's and many other federally funded projects. 1, �� City Council Staff Report July 1, 2009- Page 3 Gene Autry Trail Gateway Landscape Improvement Project(CP06-03) commences allocating federal funds, staff argued to RCTC that the City's project should receive full funding through economic stimulus funds, as opposed to limiting it to the original amount of federal funds which required a local match using Quimby Funds. RCTC supported the City's position, and approved allocation of $1,850,000 in federal economic stimulus funds for this project. The funds will cover 100% of the estimated construction cost of $1,700,000 with an additional $150,000 for construction inspection and administration. A revised request for authorization to proceed with construction was submitted to and approved by Caltrans (see Attachment 3). The City is now authorized to proceed with this project. The plans and specifications have been prepared by DEA and are ready for Council approval and the subsequent advertisement for construction bids. Section 7.03.O40 of the Procurement and Contracting Code requires that for public projects in excess of $100,000 Council approve and adopt the plans, specifications and working details, and authorize staff to advertise for construction bids. The Engineer's Estimate for this project is $1,700,000. Approval of the recommended action will allow staff to proceed with bidding of this project. Specifics Regarding Federal Economic Stimulus Funds: Some residents have already questioned why or how the City would want to construct the Gene Autry Trail Gateway Landscape Project with federal economic stimulus funds (or at all), when the overall economic slowdown is causing cities (including Palm Springs) to layoff employees and reduce services, and forcing the state to close parks, close prisons and hospitals, and other unfortunate measures to address the growing budget deficit. The simple answer is that the federal economic stimulus funds are earmarked for specific purposes, and can only be used for that purpose. Transportation investment funds can not be transferred and used for education, health care or other purposes. In our case, the federal funds allocated to the City can only be used for projects funded under the TE Program. As indicated above, the City previously received federal funds under this program which were used to install the median landscaping on Gene Autry Trail between Vista Chino and Dinah Shore Drive. Some facts about the federal economic stimulus funds: The American Recovery and Reinvestment Act of 2009 ("ARRA") was signed into law by President Barack Obama on February 17, 2009. The ARRA is intended to provide a stimulus to the U.S- economy in the wake of the economic downturn. The measures are nominally worth $787 billion. The ARRA is not only about transportation and infrastructure investment, but includes funding for federal tax relief, expansion of unemployment benefits and other social welfare provisions, and domestic spending in education, health care, and infrastructure, including the energy sector. Only 10.3% (or $80.9 billion) is budgeted for spending on infrastructure investment- s City Council Staff Report July 1, 2009 - Page 4 Gene Autry Trail Gateway Landscape Improvement Project(CP06-03) The $80.9 billion for infrastructure investment made possible by the ARRA is a one-time cash infusion into existing infrastructure programs. In this case the'existing law is the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), which was signed into law August 10, 2005. SAFETEA-LU initially provided $244.1 billion over 5 years for funding for highways, highway safety, and public transportation in a variety of infrastructure programs until its pending expiration on September 30, 2009. SAFETEA-LU has a wide range of programs funding infrastructure improvements, including the Transportation Enhancement (TE) Program. The TE Program, under which the City's Gene Autry Trail Gateway Landscape Project is funded, has a primary purpose, stated as: To strengthen the cultural, aesthetic, and environmental aspects of the Nation's intermodal transportation system. SAFETEA-LU establishes funding for the TE Program in California by setting aside a specific percentage of the federal funds allocated to California for the TE Program itself. Federal TE funds can only be used on those transportation projects that meet the requirements of the program as identified by 12 specific categories. California's ARRA infrastructure apportionment was $2,569,568,320 (equivalent to 3.2% of the overall $80.9 billion of ARRA funding for infrastructure investment). The ARRA specifically set aside 3% (or $77,000,000) of California's infrastructure investment funds for the TE Program. RCTC received an allocation of $71,075,000 for highway investment funding through the ARRA for transportation projects in Riverside County, equivalent to 0.09% of the overall $80.9 billion of ARRA funding for infrastructure investment, and has allocated these funds to the construction of five various freeway interchanges, including two in the Coachella Valley (Interstate 10 at Gene Autry Trail/Palm Drive and Bob Hope/Ramon Road). Although the ARRA budgeted an historic amount of public funds, despite providing $787 billion for a variety of programs, as can be seen, once the funding is divided into its specific categories and allocated to the states, the amounts seen at the local level are a mere fraction of the overall funding. From the $77,000,000 in ARRA funds set aside for the TE Program in California, RCTC received an allocation of $2,198,000, As the intent of the ARRA was to fund "shovel ready" projects, the City's Gene Autry Trail Gateway Landscape Project met that criteria (in addition to having all necessary federal environmental approvals). Having applied to the state in January to secure its prior federal funding, and having had the state freeze and defer any allocation of those funds given the state's on-going economic crisis, our project was the first of only three existing TE Program projects in Riverside County that was considered "shovel ready" — ready to bid and construct but lacking the funding. The ARRA funds have allowed this project to proceed, and the goal of the ARRA to immediately put people to work will be realized as a result. It should also be noted that the ARRA has specific "use it or lose it" provisions, requiring the state and the Metropolitan Planning Organizations receiving the subsequent allocation (such as RCTC) to "obligate" a certain amount of ARRA funds received within 120 days of federal apportionment. This ARRA requirement meant that the state and 03—1 City Council Staff Report July 1, 2009 - Page 5 Gene Autry Trail Gateway Landscape Improvement Project (CP06-03) regions receiving ARRA funds were required to identify and commit a certain amount of the ARRA funds to specific projects by June 17, 2009. The remaining amount of ARRA funds must be obligated within 1 year of the federal apportionment. In the event ARRA funds are not obligated by the state or regions in the time required, the funds are then made available to other states that have met their obligation requirements. The City, through RCTC, acted quickly to obligate the $1,850,000 of ARRA funds for this project, to ensure that these funds did not lapse and become available to another region or state.2 While the City may certainly desire to use the $1,850,000 of ARRA funds to supplement its General Fund to avoid layoffs or reductions in service, the fact is that the funding (whether used by Palm Springs or another agency or state), can only be used for Transportation Enhancement activities as stipulated by the ARRA. FISCAL IMPACT: The 2009/2010 fiscal year budget includes a capital expenditure account for the $1,860,000 federal grant, however, the account itself is not yet established. The formal Caltrans obligation of the federal funds was received by letter dated June 8, 2009 (see Attachment 3). The obligation Form FNM-76 (Version E-76) included with the Caltrans letter is the instrument by which Caltrans encumbers the federal funds in its financial system on behalf of the City. GENE AUTRY TRAIL GATEWAY LANDSCAPING IMPROVEMENTS, CITY PROJECT 06 03 From: David H. Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY The City received a $1,374,755 Transportation Enhancement(TE) grant for construction of a new, landscaped gateway entry at the Gene Autry Trail/Vista Chino intersection. Conceptual plans, prepared by David Evans and Associates, have been approved by the City's Architectural Advisory Committee and have been reviewed by the El Rancho Vista Estates neighborhood. Approval of conceptual plans by the City Council will allow staff to proceed with final design of the proposed improvements. RECOMMENDATION: 1) Provide staff direction, as appropriate, on considerations raised by the El Rancho Vista Estates neighborhood, and subject to any final modifications (if any), approve the conceptual plans for parkway and median landscaping of Gene Autry Trail, from Vista Chino to Via Escuela; approve the conceptual plan for a Gateway Entry Sign; and approve the conceptual plans for construction of a pocket park located at the southwest corner of Gene Autry Trail and Vista Chino. STAFF ANALYSIS: Background: On December 14, 2005, the City Council approved staffs submittal of an application for federal Transportation Enhancement (TE) grant funding for the Gene Autry Trail Gateway Landscaping Improvements Project ('Project"), (see Attachment 1)_ On June 7, 2006, the City Council appointed Council Member Chris Mills to serve on the "Project Team" for the Project (see Attachment 2); and on December 6, 2006, the City Council awarded a design contract to David Evans and Associates ("DEA") to prepare plans for the Project. ITEIv, NO. City Council Staff Report February 13,2008-Page 2 Gene Autry Trail Gateway Landscaping Conceptual Plans For over the last year, City staff has coordinated the preparation of conceptual plans for the Project by DEA, with direct oversight and review by the Project Team. In addition to Council Member Chris Mills, Planning Commissioner Leo Cohen was appointed by his fellow Commissioners to the Project Team, and has assisted staff in the development of the conceptual plans presented to the City Council for final approval. The Project consists of the following main components: 1. Parkway and median landscaping of Gene Autry Trail, from Vista Chino to Via Escuela; 2. A Gateway Entry Sign; and 3. A pocket park located at the southwest comer of Gene Autry Trail and Vista Chino, adjacent to the El Rancho Vista Estates neighborhood The conceptual plans for the parkway and median landscaping incorporates desert landscape plant materials, such as: Mexican blue palm trees, California fan palm trees, Palo Verde trees, and Yellow trumpet flower trees; with a variety of desert shrubs, such as: agave, red bird of paradise, feathery cassia, ocotillo, red yucca, and others. Natural desert rock materials, gravels, and decomposed granite are proposed to provide hardscape improvements within the landscaped areas. Plant materials are laid out in this design in a manner where one plant type "flows" across from one parkway through the median to the other parkway; and the quantity and size of materials are proposed to ensure the plants at maturity will not become too dense. The new Gateway Entry Sign is proposed at the southwest corner of Gene Autry Trail and Vista Chino. The City Council previously reviewed and approved a conceptual sign program for City entry signs, and had recommended that each sign be unique rather than identical, but that a consistent theme should be present with each entry sign_ The proposed Gateway Entry Sign is the second of the City's new entry signs, and the Project Team proposes to incorporate the modern iconic text of "Palm Springs" taken from the approved entry sign recently constructed near the Visitor's Center on N. Palm Canyon Dr. The uniqueness of the proposed entry sign is facilitated by incorporating freestanding round steel posts of differing heights in a curved alignment to create a backdrop to the "Palm Springs" script of the entry sign. The freestanding steel post concept is taken from the perimeter fence design installed at the adjacent Escena project, which consists of freestanding rectangular steel posts; however, the freestanding round posts behind the entry sign are proposed to be painted a natural copper or brown finish to coordinate with the desert landscape hardscape palette. A dense grove of California fan palms are proposed within the pocket park, which will further add to the backdrop to the "Palm Springs" modern iconic text of the entry sign. The entry sign will be appropriately lighted for viewing at night. The conceptual plans for the proposed pocket park located at the southwest corner of Gene Autry Trail and Vista Chino also incorporates desert landscape plant materials, such as: California fan palm trees, Palo Verde trees, Kidneywood trees, Feather Bush trees, Honey Mesquite trees, and Oak trees; with a variety of desert shrubs, such as: City Council Staff Report February 13, 2008-Page 3 Gene Autry Trail Gateway Landscaping Conceptual Plans blue grama, Sierra Star fairy duster, brittle bush, turpentine bush, red yucca, ocotillo, and others, Natural desert rack materials, gravels, and decomposed granite are proposed to provide hardscape improvements within the landscaped areas. The Project Team focused much attention on the conceptual plan for the pocket park. The original theme used in this design was taken from an idea of the type of habitat one would see within an alluvial fan / desert arroyo environment located at slightly higher elevations above the desert floor. Berming is proposed within the pocket park with large boulder outcroppings and oak tree plantings. These landscaped berms provide significant landscape enhancement to both traffic on Gene Autry Trail, as well as the El Rancho Vista Estates neighborhood to the west. A natural desert rock hardscape is proposed to "flow" along the walking paths adjacent to the landscaped berms with the walkways constructed of exposed aggregate and accent colors to mimic the look of a desert arroyo. A major consideration for the design of the pocket park is its relationship to the adjacent El Rancho Vista Estates neighborhood_ Currently, three of the neighborhood's streets dead end into the vacant property, which has became a wasteland of overgrown plants, illegal dumping, and reported vagrant use. If constructed, the pocket park should become a significant benefit to the neighborhood; therefore, the Project Team determined its design should extend into and became part of the neighborhood. To extend into the neighborhood, the conceptual plan proposes removing portions of the hard edges of the existing dead end streets, and installing natural desert rock materials, gravels, decomposed granite, and desert landscape shrubs, in a pattern that flows from one side of the street to the other. Street drainage will be accommodated through storm drain and drywell improvements to be incorporated into the final design. Spherical concrete bollards are proposed at the ends of each street to prohibit traffic from entering the pocket park. Depending upon the final construction estimate, it is proposed that the existing Perimeter fencing between the adjacent neighborhood (which is a variety of wood, block and metal fences) be replaced with split face masonry block walls consistent with the type of wall that has been recently constructed on Gene Autry Trail north of Vista Chino; however, it is unknown if all adjacent property owners will agree to have their existing walls or fences replaced, or if the project budget will support the cost of a new perimeter wall. It is proposed that pedestrian access into and out of the park from the adjacent neighborhood be free and unrestricted. Given that the City has budgeted the use of park funds generated by the Quimby Fee ordinance to supplement the federal grant for this project, the Project Team determined that it was important to add a recreational amenity into the pocket park. The recreational opportunity for this location is limited, given the small size and odd shape of the property, and lack of parking facilities. As a result, the Project Team ultimately City Council Staff Report February 13, 2008-Page 4 Gene Autry Trail Gateway Landscaping Conceptual Plans recommended inclusion of two bocce ball courts within the pocket park. Bocce ball is a precision sport closely related to bowling and p6tanque with a common ancestry from ancient games played in the Roman Empire. Developed into its present form in Italy, it is played on soil or asphalt courts approximately 66 to 89 feet in length and 8 to 13 feet wide. A game can be contested between two players, or two teams of two, three, or four. Bocce ball has recently gained in popularity in the United States, and if constructed, this would be the first bocce ball courts in Palm Springs. The Project Team expects that use of the bocce ball courts will not draw from a large surrounding area, such as a dog park, basketball court, or athletic field. Therefore, it is expected that only a small amount of residents outside the neighborhood will use the bocce ball courts, and not appreciably increase the volume of traffic into the neighborhood, contributing to parking problems on neighborhood streets. The Project Team expects that the majority of use or this pocket park will come from the adjacent neighborhood. Construction of parking facilities, or extension of the existing neighborhood streets with cul-de-sac's or turn-around areas, is not proposed. Parks and Recreation Commission Review: Sharon Heider, the Director of Parks and Recreation, has also been a member of the Project Team, and has been instrumental in directing the preparation of the conceptual plans being presented to the City Council for review and approval. On October 10, 2007, the Parks and Recreation Commission approved the conceptual plan for the pocket park, including the bocce ball courts. Architectural Advisory Committee Review: On November 26, 2007, the Architectural Advisory Committee (AAC) unanimously voted (7-0) to approve the conceptual plans and to recommend approval by the City Council. Substantive comments made by the AAC in their deliberation included_ 1. Appears over planted, consider less quantity of plant material, seems like too much; 2. Consider making park more of an oasis, add more palms to cluster behind sign; 3_ Consider opportunities for educational palette for public; 4. Ensure entry sign is appropriately lit so lettering is visible and not lost in the background; 5_ Include doggy bag dispenser in park for residents walking dogs. The Project Team considered the AAC's comments, and is recommending to the City Council that the quantity of plant material not be reduced, that the quantity will allow for natural growth of plant materials into a density and spacing that the material can support at maturity. The Project Team also agrees with the AAC that more California fan palms should be added to the palm cluster behind the entry sign, as may be City Council Staff Report February 13, 2008-Page 5 Gene Autry Trail Gateway Landscaping Conceptual Plans possible. The entry sign is proposed to be lit, which will address the AAC's concern; and it is not recommended that doggy bag dispensers be installed in the park as they can become a continued City expense to maintain over time, and as with most other City parks, staff expects park users to self-police themselves for complying with City ordinances regarding pet waste in public spaces. El Rancho Vista Estates Neighborhood Review: Following approval of the conceptual plans by the AAC, the Project Team coordinated review of the project by the adjacent El Rancho Vista Estates neighborhood. Staff scheduled a neighborhood workshop on January 11, 2008, and mailed a notice of the workshop to all property owners in the neighborhood on December 11, 2007. A subsequent mailing was made to all property owners on December 21, 2007, and included reduced copies of the conceptual plans and a Questionnaire requesting that the property owners provide feedback on the following issues: 1. Do you support the City's proposal to develop the vacant parcel into a pocket park? 2. Do you support the City's conceptual landscape plan for the pocket park? 3. Do you believe the dead end streets should be extended?' A total of 112 notices were mailed to the neighborhood, and 25 responses were returned (see Attachment 3). Of these 25 responses, 22 were in favor of the conceptual plan for the pocket park, two responses were not in favor of the conceptual plan, and one e-mail response did not specifically state a position for or against the park. The two residents not in favor of the pocket park noted the lack of space on the parcel for an adequate park, noise from adjacent traffic on Gene Autry Trail, and in one response, the need to place a higher priority on addressing the existing dead-end streets. Specifically in response to the three questions listed above, the following total responses were received: Question 1 "Do you support the City's proposal to develop the vacant parcel into a pocket park?": 22 "YES", 2 "NO", 1 (unstated) ' The wording of this question was not intended to mislead, but to address one resident's concerns that the City should place a higher priority on constructing a full cul-de-sac or turn-around at the end of each street than developing a park. The City's cover letter mailed with the Questionnaire to the residents included the following statement, Question:What about the dead end streets? Answer: The federal TEA grant does not fund construction of roads, only landscaping enhancements to roadways. Extending the dead and streets, or constructing a cul-de-sac or turn around requires a large amount of space, greatly decreasing the area available for park use. We have prepared an additional exhibit showing the result of constructing a cul-de-sac or turn around at the end or each street, and its impact on the park site, An exhibit directly related to this question was included In the Questionnaire, showing the Impact on the park space that is caused if a full cul-de-sac or turn-around were constructed City Council Staff Report February 13,2008-Page 6 Gene Autry Trail Gateway Landscaping Conceptual Plans Question 2 "Do you support the City's conceptual landscape plan for the pocket park?": 22 "YES", 2 "NO", 1 (unstated) Question 3 "Do you believe the dead end streets should be extended?": 21 "NO", 2 (unstated), 1 "YES" On January 11, 2008, staff conducted a neighborhood workshop from 2:00 to 5:00 P.M., and 25 residents attended. During the workshop, full size conceptual plans of the project were presented, an overview of the project was discussed, and comments were solicited from the attendees. A summary of the comments noted during the workshop included: • Where would people park? • What about homeless/vagrant activities? • What about security after the park closes? • Can the park close earlier than 10 p.m.? • How about fencing the park? • Eliminate the bocce ball court/recreational activity. • Did anyone think about haw popular bocce ball is? • How about one bocce ball court instead of 2? • Look at the cancer survivors park in Rancho Mirage for ideas. • Eliminate the ability for people in the park to go into the neighborhood. • Could there be gates at the end of the streets? • Place trash receptacles at the end of the streets. • Could there be parking on Chia? + The streets in the neighborhood should take precedent over the park. • What will happen to the existing walls/fences along the property lines? + Why weren't the neighbors involved earlier? • Feel this is being dumped back on the people who live there. • It's a better plan than what currently exists. • Appreciate someone has an interest in Palm Springs. • It's a 100 percent improvement. As a result of the community participation, staff has determined that the neighborhood has three main concerns: 1. Parking /Dead End Streets; 2. Access into and out of the park to the neighborhood; and 3. Including a recreational activity in the park. Regarding the first issue, as previously stated, it is staff's opinion that the generation of a need for parking due to the proposed park is minimal, and can be accommodated by on-street parking within the neighborhood. Admittedly, a potential exists for some residents outside of the El Rancho Vista Estates neighborhood to park their vehicles in front of homes located towards the ends of the existing streets when visiting the park. City Council Staff Report February 13, 2008-Page 7 Gene Autry Trail Gateway Landscaping Conceptual Plans However, the ability to provide any off-site parking facilities within the proposed pocket park does not exist without using a large amount of park space that is currently available. An exhibit showing the result of constructing a cul-de-sac or turn around at the end of each street is included as Attachment 4. Regarding the second issue, it is the Project Team's opinion that the pocket park will be a direct benefit for and be used by the El Rancho Vista Estates neighborhood. In order for this benefit to exist, access into and out of the park into the neighborhood must be unrestricted, similar in other City parks. Restricting access by extending walls across the ends of the streets will close off the park from use by the neighborhood, requiring residents to walk along Vista Chino (which lacks sidewalks) to Gene Autry Trail to access the park. Although an option to consider is eliminating access from one or two of the three streets, it is not an option recommended by the Project Team. Regarding the third issue, it is the Project Team's recommendation that some form of recreational use be incorporated into the park, given the use of Quimby Fee park funds with this project. Although there are other recreational activities that could be proposed within the limited space available, bocce ball is proposed due to the fact that it is mainly played by adults and won't draw use by children, a safety consideration given the proximity to Gene Autry Trail. Other recreational uses, such as a basketball court or tennis court, are not recommended due to the maintenance costs associated with the use, the lighting required for night play, and safety considerations. The Project Team recommends that the City Council approve the conceptual plans as submitted and approved by the Architectural Advisory Committee. City Council Staff Report December 14, 2005-Page 2 2005 TE Grant programming in the STIP. However, three previously approved TE funded projects totaling $1.2 million will be funded with the new STIP funding, leaving $17.8 million available in RCTC's first call for TE funded projects since October 1999, The Public Works and Engineering Department realized the value of the TE funds, as the TE Program provides funding for transportation improvements that would be difficult to otherwise fund with gas tax, Measure A, or other local funding. The Department previously applied for and received TE funds for the Gene Autry Trail and Ramon Road median landscaping project, which was completed in 2004. Similarly, Department staff reviewed opportunities for other landscaping or "transportation enhancement" improvements, and prepared two project applications; Indian Canyon Drive Landscaped Median Improvements, and Gene Autry Trail Gateway Landscaping Improvements. The first project application was for TE funding of a new landscaped median on Indian Canyon Drive from Granvia Valmonte to Vista Chino; and the second project application was for TE funding of landscaping the new median to be constructed on Gene Autry Trail between Vista Chino and Via Escuela (as part of the Gene Autry Trail widening project), including the adjacent parkways, as well as creating a `Gateway" entry monument sign and landscaped area at the southwest corner of Vista Chino and Gene Autry Trail. RCTC established project criteria and guidelines, allowing agencies within Riverside County to submit a maximum of three projects with a minimum TE request per project of $325,000 and a maximum of $1.5 million. On August 29, RCTG received 32 project applications requesting $32 million in TE funds — $14.4 million over the TE funds available. On October 3, 2005, the RCTC Technical Advisory Committee (TAC) met to evaluate all of the submitted project applications. At the TAC meeting, representatives of each agency presented their projects, and all projects were evaluated using the RCTC evaluation criteria,with final scoring approved by the TAC on a consensus basis. After an exhaustive and competitive process at the TAC meeting, following final scoring or the submitted project applications, a recommendation was made for TE Funding of 18 project applications, including the Gene Autry Trail Gateway Landscaping Improvements, submitted by the City of Palm Springs (see Attachment 1). In order to fund the 18 selected projects, a 5.58% reduction to proposed TE funding was made to all 18 projects. On November 9, 2005, RCTC formally approved the listing of 2005 TE projects, as recommended by the RCTC TAC. Following RCTC's approval, the City's application for TE funding to create a new'Gateway" at Gene Autry Trail and Vista Chino will be submitted to Caltrans for inclusion into the STIP and funding authorization by the California Transportation Commission (CTC). The proposed project has been estimated to cost $2,220,000 (including design, construction administration and contingencies). The approved TE funding was established at $1,374,755 requiring a City "local match" of $845,245. However, $400,000 of this amount has been conservatively estimated as the cost to acquire the vacant parcel at the southwest corner of Gene Autry Traif and Vista Chine. This parcel, identified by Assessor's Parcel Number 677-220-016 (included in Attachment 1), is City Council Staff Report December 14,2005-Page 3 2005 TF Grant irregular in shape and size, and is zoned as "P", or Professional Zone, However, due to its proximity to the adjacent residential neighborhood and two major arterials, required setbacks render this parcel relatively useless, In light of the General Plan Policy 5.25.2 (e), which states "Establish and/or maintain, as feasible, primary entry improvements at Gene Autry Trail @ Vista Chino", the 2005 TE Program funding is a key opportunity to implement the Policy to provide an aesthetic entry into Palm Springs on Gene Autry Trail. It is proposed that the acquisition of the parcel be funded entirely with local funds, using Quimby Act park fees, as the parcel would be acquired for use as a landscaped pocket park, with provisions for a future entry monument sign, Following issuance of bonds associated with Community Facilities District 2005-2 (Escena), estimated to occur by June 2006, approximately$2.8 million in Quimby Act park fees will be made available to the City. I may not be in town for the meeting on January 11,2008, but wanted to make a couple of comments about the project. I live in the neighborhood, El Rancho Vista Estates. I think it's great the city is doing something with that strip of land. My concemlcomplaint is about something that I've mentioned to the clty before, and that Is 3 of the streets that dead end into this property-Paseo Barbara,Avenida Fey Norte,and Camino Rojos. These streets just end,with absolutely no room for vehicles to turn around. While I'm not saying the city should build a full scale cul-de-sac,surely the city could have accounted some type of improvement in the design. The only choice when reaching the end of these streets is to turn around in the homeowners driveways. This Includes garbage trucks,school buses,delivery vehicles, etc. This neighborhood was built starting In 1960,so surely by now the city could have done something to improve this situation. Have either of you personally come into this neighborhood that adjoins this property? If not, 1 ask that you please take the time to observe what I'm referring to. I think these homeowners at the end of these streets deserve some relief after all these years. No, I don't live at the end, I live in the middle of the neighborhood,but I don't think it's fair to these homeowners who've tolerated this situation for the last 47 or so years. I'm just asking for you to please consider this before the plans become final. Perhaps instead of bocce ball court, whatever that Is,you could shave a little sliver of land to improve these 3 streets, or whatever it would take to make the Improvement. Overall, I'm in favor of the improvement for the land, especially if the neighborhood streets could benefit as well. Thank you for your time.
