Dear Mayor and Council Members,
As a point of history, this is the third set of plans proposed for the Cahuilla streetscape.
The first was in response to the 2003 appeal the neighborhood filed and won regarding
the streetscape. This plan included a weathered, curved sidewalk, colored concrete
and lush landscaping. The second plan was submitted in 2007 after a neighborhood
meeting where the KOR Group informed the neighborhood that the 2003 plan was too
expensive. This second plan removed the weathered look and reduced the plantings.
Now this third plan removes the meandering sidewalks, retains the colored concrete
and proposes minimal planting. They have eliminated the Belardo road improvements
completely.
Furthermore, the Viceroy owners have proposed an utterly ridiculous rollout plan that
involves their average room rate revenue, putting the city in the role of revenue
administrator- The Planning Commission rejected the Viceroy rollout plan and proposed
the following schedule:
. Phase 1 (June 1, 2009 — October 31, 2009) Cahuilla Road hardscape
improvements (for pedestrians and parking areas) and paving of Cahuilla Road;
this work should be in accordance with the street improvement plans approved by
the city in July of 2007.
. Phase 2 (November 1, 2009 —April 30, 2010): Landscaping improvements
. Phase 3 (May 1, 2010 through December 31, 2010) Belardo Road improvements;
this work should be constructed in accordance with the street improvement plans
approved by the city in July of 2007. -
So effectively, the Planning Commission is telling the Viceroy to utilize the 2007 plans
under a specific construction schedule- J 7-

Note, that in 2007, when the neighborhood met regarding the 'downsized' plans, the KOR
Group had already spun off the hotel into a local limited partnership, which has no access to
KOR Group funds, of which there are plenty, and supposedly is living on its own revenues.
This ownerhip transfer was never pointed out to the neighbors.
Furthermore, the 'downsized' proposal in 2007 did NOT include the entire Cahuilla
streetscape. They eliminated landscaping the property in front of La Serena saying they
couldn't afford it. Our 2007 meeting was PRIOR to their requesting demolition for La Serena,
so it is obvious now that they did not want to landscape La Serena because they planned to
demolish it. When the KOR Group received the CUP, they also were granted a parking
variance. They are short 15 spaces and could use another lot, particurly for the big film shoots
they do where there are rigs parked along Cahuilla for blocks, so demolishing La Serena would
give them the parking they need now. The 2007 meeting speaks to their continuing
disingenuousness with the neighborhood and the city of Palm Springs.
I question if the KOR Croup can transfer a CUP to a limited partnership. Was this a legal
transfer?
AT A MINIMUM, the Planning Commission's recommendation should be upheld, but frankly, I
would revoke the CUP because they have not met up to their responsibilities under the CUP.
