Dear Mr. Ready:
Thank you for taking my call this afternoon regarding the upcoming hearing on potential designation of the
Oasis Building in downtown Palm Springs as a Cl2SS I historic site. As I advised you, I represent the
owners of the building who are adamantly opposed to a Class I designation. The owners were just
notified less than 2 weeks ago of this hearing and I was contacted only yesterday afternoon. Pursuant to
our earlier conversation, I request a continuance of at least 30 days so that 1 may have the appropriate
time to evaluate the building and provide convincing authority to City Council why the building should not
be so classified. For example; I am advised that the building owners have an LOY from a very reputable
restaurant chain, the terms and conditions of which would require the construction of an outdoor dining
patio similar to what exists at Okura. Under a Class I designation this modification would be unlawful. I
am also advised that the building has undergone numerous and significant modifications over the years
so that the building has lost most, if not all, of its historic significance, if any historical significance exists. I
need time to research these modifications, when they were done, and what was modified. I will be
bringing forth other legal arguments but have not had time to fully evaluate the situation.
Thank you so much for your courtesy in continuing this hearing and giving the property owner adequate
time to prepare for such an important hearing.

as Class 1 Historic Site 55 and Notice of Exemption from CEQA
Applicant: The City of Palm Springs
NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold a
public hearing at its meeting of June 17, 2009. The City Council meeting begins at 6:00 p.m-, in the
Council Chamber at City Hall, 3200 East Tahquitz Canyon Way, Palm Springs.
The purpose of the hearing is to consider a recommendation of the Historic Site Preservation Board
to designate the building at 101-121 South Palm Canyon Drive (The Oasis Commercial Building) as a
Class 1 Historic Site.
ENVIRONMENTAL DETERMINATION: This request is categorically exempt from review pursuant to
Section 15331 (Historical Resource Restoration/Rehabilitation) of the California Environmental
Quality Act (CEQA), as the proposed designation meets the conditions outlined for preservation of a
Nstoric resource- The application is available for public review in the Planning Services Department,
City Hall, 3200 East Tahquitz Canyon Way, Palm Springs, between the hours of 8:00 a.m. and 6:00
p.m., Monday through Thursday.
REVIEW OF PROJECT INFORMATION: The staff report and other supporting documents regarding
this project are also available for public review at City Hall between the hours of 8:00 a-m- and 6:00
p.m. Monday through Thursday. Please contact the Office of the City Clerk at (760) 323-8204 if you
would like to schedule an appointment to review these documents.
COMMENT ON THIS APPLICATION: Response to this notice may be made verbally at the Public
Hearing and/or in writing before the hearing. Written comments may be made to the Historic Site
Preservation Board and/or the City Council by letter (for mail or hand delivery) to.-
