' AUTHORIZING PREPARATION OF ORDINANCE CODE
AMENDMENTS CONCERNING ZONING PROVISIONS
BE IT RESOLVED AND IT IS HEREBY ORDERED that, following hearing thereon
in this Council meeting of January 11, 1956, in which hearing no protests
were voiced, the City Attorney shall proceed with preparation of such
Ordinance Code amendments concerning zoning provisions as will more clearly
define the location of:
Cabaret - Cocktail Lounge, Restaurants, etc. , including service of
alcoholic beverages;

Commercial uses - as to parking required for cabarets and cocktail
bars; and
Guest Ranch Zone District uses to include accessory uses, parking
requirements, building height, lot area coverage, front and side
yards, etc.

METER OPERATION

New time limit for meters in following locations:

844 North Palm Canyon (Palm Springs Water Company) three
12-minute meters to be installed.

from 24 minutes to 1 hour.

MINUTE ORDER NO. 41
PROTESTING ISSUANCE OF RETAIL PACKAGE OFF-
SALE BEER AND WINE LICENSE
' WHEREAS, the State Department of Alcoholic Beverage Control has notified
this City Council of an application by William W. Markham and Muriel A.
Markham, dba Ramon Market, for a retail package off-sale beer and wine
license at said place of business situated at 1441 East Ramon Road in said
city; and
W , +AS, this City Council is opposed to and protests the issuance S said
license applied for by the said applicants at the premises hereinabove des-
cribed for the reason that the issuance of such applied-for licalse will
not comport with nor accord with the public convenience and necessity of the
City of Palm Springs as hereinafter more specifically set forth;
NOW THEREFORE, IT IS HEREBY ORDERED that the City Attorney of the City of
Palm Springs shall lodge a protest with the heretofore named State Alcoholic
Beverage Control Board with regard to the hereinabove referred to license
application upon the ground that the issuance of said license will not ac-
cord with the public convenience and necessity of the City of Palm Springs
fox, the following reasons:
(a) That the structure located upon the prenises at 1441 East
Ramon Road was built without issuance of a City building
permit and the present use of said premises does not conform
with the zoning provisions of the Palm Springs Ordinance Code
in that said structure is presently being used for commercial
market purposes although located in an area zoned "R-2" which
provides for multiple family residence only.
(b) The structure is not set back off Ramon Road the required
set-back distance imposed by the provisions of the Palm
Springs Ordinance Code.

(c) No off-street parking has been provided or is now being pro-
vided by the applicants, which said off-street parking is '
required by the zoning provisions of the Patin Springs Ordinance
Code.
(d) That by virtue of the provisions of Section 23790 of the
Business and Professions Code, this protest is lodged because
the zone in which the building now exists is "R-211, which
provides for multiple family use but prohibits commercial uses
such as that of applicants.
(e) That said zoning ordinance has been in effect since July 1953,
which said time is prior to the exercise of any rights or
privileges granted by the State Alcoholic Beverage Control
Board to the applicants or to any of applicants' predecessors.

SEMI-ACTUATED SIGNAL IS WARRANTED
BE IT RESOLVED AND IT IS HEREBY ORDERED that, as recommtended by tlx: Chief
of Police and State Traffic Engineer as part of City°s Public Safety
Committee Program, a semi-actuated signal would be feasible at Sunrise
Way and Highway 111 to be installed at a cost of approximately $7500,
one-third (1/3) of such cost being paid by the City at this "T" inter-
section; such installation to be made and the proportionate one-third
(1/3) cost thereof to be paid by the City after the State Engineering
Department shall have made such traffic count at this location as will
determine whether such installation is warranted.

BE IT RESOLVED that, as recommended by the City Manager, Off-Street Parking
Copunittee report of September 6, 1956, said report reviewed in detail in
this Council meeting of September 11, 1956, recoimnending-
1) Reaffirming recommendation that meter. rates be changed from 5¢ per
hour to 5¢ per half hour for both one-hour and iwo-lAour meters;
future expansion of metered area to be accomplished through
purchase of new meters and transfer of existing meters.
2) Fifty per cent. of meter revenues to be earmarked for land acquisition
only - esturated return due to increased rates, approximately $25,000
per annum.
3) Proposed Parking District: According to Planning Direcotr°s
findings and because of procedure under 1951 .Act and resultant •
necessary increase in taxes, plan is not feasible as a solution
to our immediate problem.
4) Lease Agreements: Recommended continued negotiation for. leasing
Oasis Hotel Lot for term of five years; City agreeing to meter and
enforce parking in the lot and to pay taxes on the parking area -
an estimated $300 per year.
