Ready, City Manager BY: Public Works and Engineering Department SUMMARY Palm Springs Classic, LLC (Escena), was required to construct certain segments of Palm Springs Master Drainage Plan (MDP) Lines 31 and 32. These segments of Lines 31 and 32 extend through Cathedral City. The developer entered into a Cooperative Agreement with Riverside County Flood Control and Water Conservation District (RCFC) and Cathedral City related to the use, repair, operation, and maintenance of Lines 31 and 32. A very small portion of Lines 31 and 32 extend into Palm Springs, and RCFC has requested that the City execute Quitclaim Deeds providing RCFC with appropriate rights to operate and maintain those portions of Lines 31 and 32 within the City. RECOMMENDATION: 1. Approve the transfer to Storm Drain Easements for RCFC Parcel No. 6184-500 and RCFC Parcel No. 6185-500 within the Palm Springs Classic (Escena) Development to Riverside County Flood Control and Water Conservation District; and 2. Authorize the City Manager to execute the Quitclaim Deeds. STAFF ANALYSIS: In a letter from Riverside County Flood Control and Water Conservation District (RCFC), dated January 16, 2009, RCFC advised the City of its intent to accept Palm Springs Master Drainage Plan (MDP) Lines 31 and 32 for operation and maintenance in City Council Staff Report March 4, 2009— Page 2 QuitClaim to RCFCD (MDP Line 31) accordance with the terms of a Cooperative Agreement entered into between RCFC, Palm Springs Classic, LLC (the developer of Escena), and the City of Cathedral City. There are two small subdivisions identified as Tracts 32557 and 32558 located within Cathedral City, but, for all intent and purpose these subdivisions are a part of the Palm Springs Escena development entirely having access from within Escena, and were developed by Palm Springs Classic. Off-site and on-site stormwater runoff is directed to the Escena golf course, and in a flooded condition, outlets to the Whitewater River through Palm Springs MDP Lines 31 and 32 extended within the two subdivisions located in Cathedral City. RCFC required Palm Springs Classic to dedicate to the public, on behalf of RCFC, a storm drain easement for Palm Springs MDP Lines 31 and 32. These dedications to RCFC are located within Palm Springs, and RCFC has requested that the City execute Quitclaim Deeds for each of the dedicated easements located within Palm Springs to ensure that RCFC has been provided with all of the rights granted in favor of it by the Irrevocable Offers of Dedication to the public, on behalf of RCFC, by Palm Springs Classic that happen to be located in Palm Springs.
