RECOMMENDATION
Thatthe City Council considerthe adoption of a Resolution of Convenience and Necessity in order
to sell beer and wine at an existing meat market located at 1750 North Sunrise Way.
SUMMARY
The applicant currently owns and operates an existing meat market at 1750 North Sunrise Way.
The applicant desires to sell beer and wine at this location. The applicant has an existing license
that they plan to downgrade to a C-21 which is beer and wine only. The existing license allows for
the sale of beer, wine, and hard alcohol. The applicant is downgrading by choice and not at the
request of any regulatory agencies. The State Department of Alcoholic Beverage Control will not
issue a license forsuch a sale unless the City Council provides a letter indicating thatthe premises
will provide for the public convenience and necessity.
BACKGROUND
The subject property is in a commercial area. Abutting uses are as follows
north: retail (Gossip House, 7-Eleven)
south: Chevron
east: vacant bank building used as office space
west: Albertson's Shopping Center
The Desert Son-Shine Pre-School and Kindergarten is located within 600 feet of the subject site.
In accordance with Section 23958.4 of the Business and Professions Code which took effect on
January 1, 1995,the State Department of Alcoholic Beverage Control will not issue a license forthe
sale of beer and wine at this location without a letter from the City Council indicating the premises
will provide for the public convenience and necessity.

Afinding of"Public Convenience and Necessity"means thatthe applicant premises will provide for
the convenient patronage of the public whereby the convenience does not already existing in the
immediate area. Necessity implies that the premises is needed by the community.

Dear Mr. Shernock:
Our application with the Department of Alcoholic Beverage Control requires a
letter of public convenience and necessity by the Palm Springs City Council.
Please be advised that we already have an existing license ( 21-General License)
that we plan on downgrading to a C-21 which is beer and wine only. ABC
advised us to bring to your attention that the number existing licenses and the
number of licenses allowed will not change as we are giving up our 21-General
License.
Our store is currently located at 1750 N. Sunrise Way Palm Springs California. It
is located within 600 feet from the Desert Son-Shine Pre-School & Kindergarten.
The storage area used to store beer and wine is approximately five percent (5%).

RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, ADOPTING A RESOLUTION OF CONVENIENCE
AND NECESSITY IN ORDER TO SELL BEER AND WINE AT AN
EXISTING RETAIL STORE LOCATED AT 1750 NORTH SUNRISE
WAY, C1 ZONE, SECTION 1.
WHEREAS, Chiran Chandrasena ("applicant") has requested the adoption of a Resolution of
Convenience and Necessity in order to sell beer and wine at an existing retail store at 1750 North
Sunrise Way, C1 Zone, Section 1; and
WHEREAS, the City Council is being asked to adopt a Resolution of Convenience and Necessity
pursuant to the requirements of the Alcoholic Beverage Control Board; and
WHEREAS,the City Council has carefully reviewed and considered all of the evidence presented
in connection with the project, including but not limited to the staff report; and
WHEREAS,all Conditions of Approval established atthe time the use was established are to remain
in full force and effect; and
WHEREAS, the applicant has a license to sell alcohol and is seeking to downgrade the license so
as to limit it to the sale of beer and wine;
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby
adopts a Resolution of Convenience and Necessity.
