RECOMMENDATION During its meeting of October 10, 2001, the Planning Commission unanimously voted to recommend that the City Council amend the text as proposed. SUMMARY The proposed text amendment reflects changes to the Palm Springs Flood Hazard Reduction Standards so as to reflect the changes recommended by the Federal Emergency Management Agency. The proposed text amendment result in a change in the elevation of a structure in some flood zones and requires the elevation of mechanical units. BACKGROUND The flood hazard areas of the City of Palm Springs are subject to periodic inundation which results in loss of life and property, health and safety hazards, disruption of the commerce and governmental services, extraordinary public expenditures for flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety and general welfare. Flood losses are caused by the cumulative effect of obstructions in areas of special flood hazards which increase flood heights and velocities, and when inadequately anchored, damage uses in other areas. Uses that are inadequately flood proofed, elevated or otherwise unprotected from flood damage also contribute to the flood loss. In order to address these concerns, the City of Palm Springs has certain requirements for building in the flood plain. These regulations are periodically reviewed by the Federal Emergency Management Agency (FEMA) to ensure consistency with federal guidelines. During a recent review, FEMA recommended the following changes to clarify the regulations. With the proposed changes, in an unnumbered A zone as well as in an Al - A30 or an AE zone, the lowest floor of a residential structure must be elevated one and one-half (1-1/2) feet above the base flood elevation. Currently, the A zone is elevated at least two (2) feet above the base flood elevation and all other zones are elevated at least one foot above the base flood elevation. All other requirements associated with development in the flood plain will remain the same. The proposed amendments include mechanical equipment in the matters to be addressed. In all areas of special (all "A, Al-30, and AO"Zones) flood hazards, the following standards are required in addition to the requirements found in Title 8 of the Palm Springs Municipal Code. 3. Elevation and Floodproofing. (See Section 93.17.04 definitions for "basement," "lowest floor," "new construction," "substantial damage' and "substantial improvement'.) a. Residential construction, new or substantial improvement shall have the lowest floor, including basement and all mechanical units (including but not limited to air conditioning heater, water heater, etc ) established as follows: 1. In an AO zone, elevated above the highest adjacent grade to a height exceeding the depth number specified in feet on the FIRM by at least one foot, or elevated at least three feet above the highest adjacent grade if no depth number is specified. 2. In an A zone elevated at least two feet above the base flood elevafion-- -Wien-no-ba�e elevation to the Gity Engineef���. In an unnumbered A zone elevated to at least one and one-half(1-1/2) feet above the base flood elevation The developer shall submit a study determining the base flood elevation to the city engineer for approval 3. 11 hood elevation to the Sity-Engheet���. Upon the completion of the structure, the elevation of the lowest floor including basement shall be certified by a registered professional engineer or surveyor, and verified by the community building inspector to be properly elevated. Such certification or verification shall be provided to the Floodplain Administrator. PLANNING COMMISSION ACTION During its meeting of October 10, 2001, the Planning Commission unanimously voted to recommend that the City Council change the ordinance as proposed.
