HomeMy WebLinkAbout1718 - ORDINANCES - 9/5/2007 ' ORDINANCE NO. 1718 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,ADDING SUBSECTION G TO SECTION II AND SUBSECTION G TO SECTION VI OF ORDINANCE NO. 1632 OF THE CITY OF PALM SPRINGS, RELATING TO PARK FEES FOR RESIDENTIAL DEVELOPMENT IN THE CENTRAL BUSINESS DISTRICT. City Attorney Summary This Ordinance establishes an alternative park fee requirement for residential development in the Central Business District. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ORDAINS: SECTION 1. Subsection G is added to Section II of Ordinance No. 1632 to read: G. Central Business District. Means all property zoned "C-B-D," Central Business District Zone, as provided in the Palm Springs Zoning Code. SECTION 2. Subsection G is added to Section VI of Ordinance No. 1632 to read: G. In lieu of dedicating land or paying fees as determined through the process identified in Section VII and Subsections A through F of this Section VI, a developer of property in the Central Business District may elect to pay the fees for each residential dwelling unit in the Central Business District in an amount as the City Council may establish by resolution. SECTION 3. The City Council finds and determines that an alternative park fee requirement for residential development in the Central Business District will encourage and promote the development of mixed use projects in the area of the City intended for compact, lively, active, and intensive uses that will caterto pedestrians and allowthe urban environment recognized by the City's General Plan to flourish. Residents of homes in the Central Business District will support and use the amenities and activities associated with an urban downtown environment. SECTION 4. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
