Ready, City Manager BY: Planning Department SUMMARY Francis LaBranche has requested a one-year time extension for Tentative Tract Map (TTM) 31230 located at the northwest corner of Zanjero Road and Via Olivera Road, Zone PDD-296, Section 3. This time extension is one of two requests by the applicant and is from July 21, 2006 to July 20, 2007 (see other staff report for extension ending in 2008). RECOMMENDATION 1. Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A ONE-YEAR TIME EXTENSION FROM JULY 21, 2006 TO JULY 20, 2007 FOR TENTATIVE TRACT MAP 31230 FOR THE UPTOWN VILLAGE DEVELOPMENT (ASSOCIATED CASE N0. 5.0999 PDD 296) LOCATED AT THE NORTHWEST CORNER OF ZANJERO ROAD AND VIA OLIVERA ROAD, ZONE PDD-296, SECTION 3." PRIOR ACTIONS TAKEN ON THE PROJECT On July 14, 2004, the Planning Commission recommended approval of the project to the City Council. On July 21, 2004, the City Council approved Tentative Tract Map 31230 and PD-296. ITEM NO.al City Council Staff Report September 19, 2007 TTM 31230 Time Extension On August 9, 2006, the Planning Commission approved a one year time extension for PD-296 and recommended approval of a one-year time extension to the City Council for TTM 31230. The extension is from July 21, 2006 to July 20, 2007. On July 25, 2007, the Planning Commission approved another one year time extension for PD-296 and recommended approval of a one-year time extension to the City Council for TTM 31230. The extension is from July 21, 2007 to July 20, 2008. BACKGROUND The entitled project, Uptown Village, consists of a Planned Development District to construct a cluster residential development consisting of seven (7) single-family attached residences within two clusters; one of three units and another of four units on approximately 0.79 acres. The Tentative Tract Map is proposed to allow the sale of each unit. The project will include a common pool recreation area with each unit having a private spa. ANALYSIS The City Council may extend the tentative map a maximum twelve months pursuant to Section 9.63.110 of the Municipal Code. Therefore, staff has kept the two requests as separate actions with separate staff reports and resolutions. According to the applicant, the reason for the time extension request is to allow time to resolve impacts that include street improvements, street access, and street vacations that are being worked out between the City and the proponents of an adjacent project, the Palm Springs Art Colony. There are no specific findings for extension of the map. In reviewing the request, staff considered if the following circumstances have changed such that the map's approval might need reconsideration: • The project's overall plan and lot configuration, • The uses and development of the surrounding area, and • The applicable policies of the General Plan, zoning ordinance and other regulations. The applicant has not requested any changes to the originally entitled plans. The uses and development in the surrounding areas have not had significant change. The Art Colony project was recently approved, but the adjacent proposed uses will be similar to this project. No significant changes have occurred in the above-mentioned factors to warrant reconsideration of the map's approval and staff recommends approval of the extension request. WHEREAS, Francis LaBranche ("Applicant") has filed an application with the City pursuant to Chapter 9,63.110 of the Palm Springs Municipal Code for a one-year time extension to Tentative Tract Map 31230 to allow a subdivision of the following APNs 504-260-004 & 504-260-005; and WHEREAS, on August 9, 2006 the Planning Commission held a public meeting and voted to recommend that the City Council approve a one-year time extension of Tentative Tract Map 31230; and WHEREAS, on September 5, 2007, the City Council held a public meeting to consider the applicant's request for a one-year time extension of Tentative Tract Map 31230; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report and all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1: A notice of exemption was previously prepared for this project in accordance with the requirements of the California Environmental Quality Act (CEQA). There is no new information or any change in circumstance that would change the status of the exemption and, as a result, no further environmental review is necessary for the requested extension. RECOMMENDATION: That the Planning Commission recommend to the City Council approval of a one-year time extension for TTM 31230 and Case No. 5.0982-PD-296 until July 21, 2007, BACKGROUND: Tentative Tract Map 31230 and PD-296 were approved on July 21, 2004 by the City Council. Also, details are being worked out between the applicant and the proponents of an adjacent project, the Palm Springs Art Colony, regarding access and site improvements for bath projects. However, neither of these potential changes are proposed at this time. Based on these reasons, staff has determined that the extension request dated July 10, 2006, can be considered as applying to both the Planned Development and the Tentative Tract Map. ANALYSIS: Pursuant to Section 94.03.00(H) of the City of Palm Springs Zoning Code, extensions of time for a Planned Development District may be allowed by demonstration of good cause. And according to Chapter 9.63.110 of the Municipal Code, there are no specific findings or determinations that need to be made to grant the time extension for the map. The Municipal Code does limit all time extensions to one-year and that requirement is being carried forward in staff's recommendation. Staff has reviewed the project, surrounding area and underlying zoning regulations and determined that no significant changes have occurred that would suggest that the project is no longer in keeping with the City's development policies. ENVIRONMENTAL DETERMINATION: This project is categorically exempt from CEQA review as an in-fill development project per California Environmental Quality Act, Section 15332. EMI and O. Case SP 06-046 - An application by Jim Symons of Superior Signs requesting approval of a revised sign program for the Destination Ramon Shopping Center located 5601 East Ramon Road, Zone M1, Section 20, APN 680-170-034. Assistant Planner, David Newell, gave background information as outlined in the staff report dated August 9, 2006. Vice Chair Hochanadel requested clarification on the allocated square footage for the sign program. Commissioner Caffery requested clarification on the difference between the signage at the Palm Springs Mall and this application. He commented that the amount of signs for this program seems excessive. The Commission discussed, at length, the number of approved signs in the original sign program, placing a cap on additional signage, reduction of the sign area and illumination of signs. Vice Chair Hochanadel commented that a sign count would be appropriate with the elimination of some signs to accommodate for others. 5 000009 July 10, 2006 Francis LaBranche 25 Bay Street Northfield,N.H. 0327 To: Edward Robertson Principal Planner City of Palm Springs Re: request for an extention Dear Ed, In reference to our conversation on July 10, 1 am writing this letter to request an extension of an approved development on Via Ulivera, parcel number 504260004-1 and 504260005.2, for the following reasons: 1. Confusion exists and clarification is needed regarding a map from Warner Engineering showing that this is a condo development when in fact it is fit zero lot line, (PUD) project. The amended plat of zero lot line has been, shown and discussed with you by Jinn Westford, the general manager of the project The revised site plan actually works better then the approved project, allowing more units within the existing approval. 2. A proposed adjacem project known as the Palm Springs Art Colony, is seeking a vacation of Via San Janiiro, and wants our cooperation with the submival. This changes the off site improvements, which if done at present would he unnecessary in addition,the redesign would give more open space and landscaping For the project. These important factors need to be studied and this takes time. So For us and the City. we need an extension to explore these factors.
