September 19, 2007 Honorable Mayor and City Council members: The board of PSPF supports the Class One designation of the Dr. William Scholl House. We respectfully ask that careful consideration be given to include the detached cabana kitchen and outdoor ramada as well as the pool. These features are essential to the "setting" and their loss would severely endanger the integrity of the site as a whole. We feel that allowing any demolition at this site would compromise historic preservation's true purpose, especially for one of Palm Springs' last remaining examples of an untouched Spanish Revival estate. SCHOLL RESIDENCE AT 211 EAST MORONGO ROAD, A CLASS 1 HISTORIC SITE BY: The Planning Department SUMMARY Under Section 8.05 of the Palm Springs Municipal Code (Historic Resources), the City Council may designate properties as "Class V historic sites. The City's Historic Site Preservation Board (HSPB) has recommended such a designation for the Dr. Scholl Residence at 211 East Morongo Road, The Council will conduct a public hearing and determine if the site and building should be designated. Class 1 designation would place the building under the guidance of Municipal Code Section 8.05 "Historic Preservation". RECOMMENDATION Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DESIGNATING THE DR. SCHOLL RESIDENCE AT 211 EAST MORONGO ROAD, A CLASS ONE HISTORIC SITE." PROJECT DESCRIPTION The City of Palm Springs, via the Historic Site Preservation Board has filed an application requesting the structure at the subject property be designated a Class I historic site. Such designation would: 1. Place the subject property under the guidance of Municipal Code Section 8.05 2. Require present and subsequent owners to maintain the site consistent with that ordinance, Item No. 1 .C. City Council Staff Report September 19, 2007 Case. HSPB No, 57 211 E. Morongo Road Page 2 of 5 3. Grant possible property tax reduction opportunities to the owner under the State of California Mills Act. A full project description, historic assessment report and Staffs findings and recommendations can be found in the attached staff report to the Historic Site Preservation Board dated July 10, 2007. RECENT PRIOR ACTIONS On Tuesday, July, 2007, the Historic Site Preservation Board voted 4-2-0 to recommend that City Council designate the house and naturalized landscape in the front yard at 211 East Morongo a Class I Historic Site in accordance with Municipal Code Section 8.05. HSPB Resolution #52 is attached. ANALYSIS The Spanish Colonial Revival home at 211 Last Morongo Road was constructed in 1941 as a vacation home for Dr. William M. Scholl. Dr. Scholl is the founder of the internationally known company that bears his name and produces foot care products. The home is considered reflective of the type of residence common in Palm Springs during its "golden era" of the 1930's and 1940's when it was a preferred resort destination for well-known and affluent families and individuals. The home was built on two lots and is surrounded by another eight contiguous lots forming a two-acre estate. The lots were never merged and remain with individual APN numbers except the two on which the house is sited. The site is lushly planted with desert-native trees and plant species and represents a naturalized setting similar to that found at Smoke Tree Ranch. It was common at the time for affluent or notable families who built vacation homes in Palm Springs to create private and secluded enclaves like the Scholl property. Most large tracts such as this no longer exist because they have been subdivided, sold off and developed. The Scholl property remains one of the last of its kind within the urbanized area of Palm Springs and thus is historically significant as a remaining example of the type of development that occurred during that period. The Board carefully considered the historic qualities of the Scholl residence, including the setting of desert-native landscape of the adjoining eight lots. The Board identified the historic significance of the naturalized landscape and open space, however concluded that a recommendation to designate all ten lots would create a condition that could unreasonably deny the owner the right to use, enjoy, develop or sell the lots. ' Therefore, the Board elected to recommend that only the house and the desert-native landscape on the two lots on which the house is sited be designated. Preservation of the desert-native landscape and the house on the two lots allows an understanding of .- 1000002 City Council Staff Report September 19,2007 Case, HSPB No. 57 211 E. Morongo Road Page 3 of 5 the unique setting of the home during the Scholl period of ownership without placing any restrictions or encumbrances on the remaining eight parcels. The Board carefully considered the owners' request to demolish the pool in order to remove it as an encroachment on two of the adjoining vacant lots so that they may be sold separately. Since the pool was not constructed during the Scholl period of ownership, the Board concluded that pool could be removed without impacting the historic integrity of the site. The pool therefore is not part of the designation recommendation. The Board also considered the owner's request to demolish the barbeque cabana. The barbeque cabana is from the historic period of the home, built for Dr. Scholl shortly after the construction of the house and is in original condition. It too is believed to encroach on another of the adjoining lots. There was not sufficient information at the time of the Board hearing to determine the exact location of the barbeque cabana relative to the side lot line.' Thus to avoid hindering the owner's desire to sell the adjoining lot; the Board did not recommend designation of the barbeque cabana. The Board further stated that it would cooperate with the owner on future driveway and garage re-configuration that may be needed if the adjacent lots were sold separately, since the existing driveway encroaches on adjoining lots. The owner, who lives out of state, has been contacted by staff on several occasions regarding the process of the historic preservation analysis and the benefits and encumbrances of passible historic designation. The owner has stated she does not support the potential designation of her property as a historic site. REQUIRED FINDINGS The Municipal Code Section 8.05.020 provides the definition of a historic site and identifies the criteria that are used in determining the eligibility of a site for historic designation. The criteria that apply to 211 East Morongo Road are summarized below. Criterion 1: The Scholl Residence at 211 East Morongo Road reflects or exemplifies a particular period of the national, state or local history; The Scholl Residence reflects a particular period - Palm Springs' first "Golden Age" - from the 20's through the 40's when Palm Springs was transformed from a quiet desert town to a world-renown celebrity resort destination. Affluent and notable families chose Palm Springs as a vacation get-away and developed modest homes on expansive sites such as the one at 211 East Morongo Road. The Scholl Residence, built in 1941, is t If it can be determined that the barbeque cabana does not encroach on the adjoining lot, it could remain as a non-conforming structure because it is constructed in the side yard setback of the lots on which the main house is located. Morongo Road Page 4 of 5 one of the few remaining sites in which both the home and the landscaped site exist in their original condition from this period. Criterion 2: The Scholl Residence at 211 East Morongo Road embodies the distinctive characteristics of a type, period or method of construction; The Scholl Residence conforms to this finding because it embodies the type, period, and method of construction prevalent during Palm Springs' boom years of the twenties through the forties, when modest Spanish revival and ranch style homes, popular in the southwestern United States, were built by those choosing Palm Springs for a vacation destination. Criterion 3: The Scholl Residence at 211 East Morongo Road is associated with lives of persons who made meaningful contribution to national, state or local history; The home at 211 Morongo Road was built for Dr. William Scholl, who was the founder of the internationally known foot care products company that bears his name. Thus the home at this site is associated with a person who has made a meaningful contribution to national, state, and local history. CONCLUSION Based upon the foregoing, the Historic Site Preservation Board recommends that the City Council designate the Scholl Residence and the naturalized desert landscape in the front yard at 211 East Morongo Road, Palm Springs, California (lots 43 and 44 which comprise assessor parcel number 508-302-007) as a Class 1 Historic Site subject to the following conditions; 1. The Historic Site Preservation Board shall work cooperatively with the Owner on any modifications necessary to relocate the driveway and garage access onto the subject parcels. 2. The Owner shall be permitted to proceed with a demolition request for the existing pool and barbeque cabana at the subject site. 3. This designation does not apply to any of the other eight vacant parcels adjacent to the subject parcel on which the house is sited. ENVIRONMENTAL_ EVALUATION Pursuant to CEQA, the designation of the building at 211 East Morongo Road' as a Class 1 historic site is categorically exempt from environmental review pursuant to Section 15331 whereby this designation is for the preservation of a historical resource. 000004 City Council Staff Report September 19,2007 Case! All future exterior modifications including but not limited to building, site, landscaping, lighting, walls, and fences shall require Architectural Approval pursuant to Section 94.04.00 of the Palm Springs Zoning Ordinance and Historic Site Preservation Board review pursuant Municipal Code Ordinance 8.05,180. 6. No permit for the alteration of the exterior, including signage and any and all of the defining elements and characteristics shall be issued without prior approval by the Historic Site Preservation Board. 7. That the City Clerk submits the Council Resolution to the County recorder for recordation within 90 days of the effective date of this resolution. 8. Williams reported- 1) A "Thank you" letter was sent to the Desert Sun regarding the a s published about the historic markers and other historic properties. 2) The summer issue of the Atomic Ranch has an article on Don Wexler's ste houses. 3) Time Magazine published an article about glass houses and also talks about servation of modern houses. 4) The City Council denied the new fee of$1,619.00 for Historic Site Class 1 Designation. 5) The Board thanked staff for all their work during the past year. 8. PUBLIC HEARINGS: A. Case No. HSPB #57 Class 1 Designation of the Dr. Wm. M. Scholl House 211 East Morongo Road, Palm Springs, CA Possible Action: Recommend Class 1 Historic Site Designation to City Council On May 8, 2007, HSPB reviewed an application for demolition of a house, cabana, and pool at the Wm. Scholl residence and placed a 120-day Stay of Demolition on the property in order to investigate its significance. Dr. Scholl of the Dr. Scholl Foot Care Products Company built the house in 1941, prior to 1945 which automatically makes it a Class 3 Historic Site, and the age allows HSPB to evaluate the property to determine If it should be designated to a higher level of historic classification. It is a one-story, 2,200 s.f., Spanish Colonial Revival home situated on a group of ten lots. The house sits on two lots, the pool straddles four of the lots, and the cabana (barbecue house) straddles two lots and may encroach into the side yard of another lot- The owner wishes to demolish the structures in order to facilitate sale of all ten lots, and she does not support this possible designation (letter in Board packet)- The findings in Chapter. 8.05 are noted in the Staff Report. PUBLIC COMMENTS: Jeff Wilson, 454 Avenida Palmera, a 30-year P.S. resident, knows the house very well and stated he is not in favor of the demolition, and all the neighbors he has talked with are not in favor of the demolition either- Robert Imber, P S Modern Tours, urged the Board to recommend that this property be designated a Class 1 Historic Site. PUBLIC COMMENTS CLOSED. Board member J. Williams reported that he and Board member Nelson's findings (Subcommittee for this project) note that the cabana barbecue may not straddle lots 42 and 43 as shown on page 4 of the Staff Report. The Staff Report photo does not appear to show the lot lines accurately. 000011 Historic Site Preservation Board Page 3 of 11 Minutes from the July 10,2007 Mecting Craig Ewing, Director of Planning, joined the meeting and explained that this property has ten individual lots and there is no City authority to prevent the sale of one or more of the separate lots. The staff recommendation is based on those other lots being sold and owned separately. If the Board wants to include the setting and cover the garden on a separate lot and the new owners wanted to build on that separate lot, there would be a potential dilemma. Staff is recommending that the Board only focus on the lots on which there are structures and not the larger setting — not because setting is not important, but because there are ten lots involved and each of them could be sold individually. Board member Strahl pointed out that Lot 1 contains the driveway to get to Lots 2 and 3 where the house is situated —so if the house and its buildings are designated, how does one access it? Director Ewing advised that the applicant could apply for a new driveway if an alternative driveway is possible by petitioning Public Works for a new encroachment for a separate driveway located within the lots on which the structure sits and give up the driveway on the other lot. Staff member Lyon explained that "setting" is the notion of existing conditions around a building that are reflective of the historic period for which the building is significant. Board member Saunders asked staff, in prior situations such as this, have letters been received from homeowners telling staff that they are not interested in their properties being designated and how has this situation been handled? In some instances the property owner supports the designation and some owners do not support designations. In the Dr. Scholl case, HSPB initiated the study and the stay of demolition to have time to consider the site. It came about because the home owner had submitted a demolition application. There have been instances where the City has proceeded with historic designation over the objection of the property owner(s) — if the City has deemed the property important enough to be preserved as a significant asset to the community. After further Board discussion, Board member Grattan moved to approve Option 3 of the Staff Repo rt..."Designate only the house and naturalized landscape on the two lots on which the house is sited a Class 1 Historic Site, and allow the demolition of the pool and cabana such that the remaining lots may be sold separately." HSPB#55—Class 1 Designation of the Oasis Commercial Building, 1-121 South Palm Canyon Drive, Palm Springs, CA Posst ction: Recommend Class 1 Historic Site Designation to City Council On January 8, 2007, PB initiated the study and investigation of the site for possible recommendation to the City CCootrni;_ The Oasis Commercial Building was included as one of the 200 historic properties in the 2004 Histon Resources Survey of Palm Springs properties. On January 11, 2006, a demolition permit was issued to�J olish two one-story hotel structures on the west side of the site and the area was paved for additional parking. April 11, 2006, HSPB identified the Oasis Commercial Building as one of 53 properties having char terjs�s that may qualify it for local, state, or national historic designation. Staff has evaluated this propert7-.avnd found that it does possess qualities possible for historic designation. At that hearing the Board reviewed the demolition application and initiated proceedings to reclassify the site to Class 1 designation in accordance with Municipal Code Sections 8.05.125 and 8.05.166. The Board also placed a stay of demolition of 120 days on the property to allow it time to investigate the significance of the property in accordance with Section 8.05.170. BACKGROUND AND SETTING The demolition application for a Class 3 site requires review and approval by the HSPB. The Board has authority through that review process to enact a stay of demolition. The stay is intended to afford the Board time to initiate studies to determine if the site should be recommended for reclassification to a higher, more protective historic classification or, allow it to be demolished. Definition of a Class 3 Site. Municipal Code Section 8.05.125 provides the definition for the three classifications of historic sites in Palm Springs; Class 1, Class 2, and Class 3. Class 3 sites are defined as follows: Structure/site was constructed before 1945, or a year to be determined by the City Council, or construction date cannot be confirmed. Eligible for a six-month stay of demolition Action of the HSPB may include recommendation to reclassify. All structures built prior to the subject date would be automatically so classified. The Scholl residence at 211 East Morongo Road was built in 1941 and therefore is automatically designated a Class 3 Historic Site subject to HSPB review of the demolition application. It currently has no other historic or protective status. Designation of Historic Sites. The Historic Site Preservation Board may recommend to the City Council that certain sites be designated as Historic Sites in accordance with Section 8.05.135 and 8,05.166 of the Municipal Code. The City Council is authorized to consider the recommendation and designate Historic Sites. The Board may initiate studies, surveys and investigations it deems necessary to adequately gather information in consideration of a recommendation. That has yielded or may be likely to yield Information important to national, slate or local history or prehistory. The analysis of the Board resulted in findings that the Scholl residence possesses sufficient historic value to recommend designation as a Class 1 site. Those findings are outlined in the analysis below, Conditions and requirements that apply to Class 1 Historic Sites_ According to Section 8.05 of the Municipal Code, the following shall apply to a Class 1 Historic Site; 1. It shall meet the definition of an historic site as outlined in Municipal Code Section 8.05.020. 2. An archival file shall be maintained on the property by the City. 3. It may be qualified as `historic' at the federal, state, and/or county level. 4. The structure/site may not be modified nor objects removed without the approval of the City Council. 5. The use may be limited by the City Council to the extent that it may impair the integrity of the site. 6. Compliance with all rules and regulations for Historic Sites and Historic Districts under Article IV of Chapter 8.05 of the Municipal Code shall be required. The Board has conducted investigation of the Scholl residence to determine its eligibility for reclassification to a Class 1 site. The analysis is outlined below and in a Board subcommittee report, attached. DESCRIPTION AND ANALYSIS The William Scholl estate is comprised of ten lots of Palos Verdes Tract #3 and located in the Tahquitz River Estates neighborhood. Five of the lots (nos. 41 thru 45) front on Morongo Road, and five front on Sonora Road (lots 61 thru 65). The neighborhood surrounding the roughly 2.5 acre Scholl estate is a fully built out subdivision of single family homes on quarter acre lots. Many of the homes were built in the same period as the Scholl house and others to the east were built in the 1950's and 1960's. The home is located on lots 43 & 44 and a swimming pool straddles four lots, 43 and 44 as well as lots 62 and 63. A separate barbeque cabana behind the house straddles lots 42 and 43. The ten lots are heavily landscaped with mature plantings in a naturalized landscape design. The driveway for the home enters from the street on lot 45, a separate lot from the two on which the home is sited. The Spanish style ranch home at this site was originally built in 1941 by Dr. William Mathias Scholl (1882 — 1968), founder of the company that bore his name that manufactured foot care products. William Mathias Scholl, graduated from Illinois Medical School In 1904, thereby becoming a doctor (podiatrist). Scholl and his company invented a number of foot care products, including the Foot Eazer, the Zino Pad, rubberless stockings, Foot Wings arch supports, and Ball-O-Foot Cushions. The first company retail store was opened in 1928, When Scholl died, the Dr. Scholl Company was turned over to his nephews, William H. Scholl (1920-2002) and Jack E. Scholl (1926-2006). The home at 211 E Morongo Road was used by Mr. Scholl as a vacation residence. It was owned by Scholl until his death in 1968. The 2,555 square Foot wood frame home and attached garage, constructed with a two- piece barrel vault clay tile roof and smooth stucco walls, are in very good condition. The windows are original steel sash casement single glazed windows with the exception of one replacement window on the east facade. This window, while not original, does not significantly affect the historic integrity of the structure because it is on a secondary facade and could be replaced with a window unit that would match the others in the house. A front covered porch and open breezeway between the house and garage have exposed wood timbers and wood posts stained a dark brown. aa,00rs Historic Site Preservation Board Staff Report Page 5 of 8 Case HSPB 57 Date July 10,2007 A sun room addition and trellis-like shade structure were constructed on the back side of the house some time in the last twenty years or so. These structures, while not from the historic period of the home, do not significantly affect the historic integrity of the structure. This is because they are on the rear of the house, do not detract from the defining architectural characteristics of the house, are complementary in color, material, and quality to that of the original house and could be removed without materially affecting the historic elements of the structure. A "barbeque house", or cabana is located behind the house and appears to have been built at the same time as the main house. The cabana is comprised of a covered patio with an outdoor barbequeifireplace and a full 'catering kitchen' in an enclosed stucco- clad portion of the cabana. The roof is two piece barrel clay tile, similar to the main house. The pool is not original and was installed by the present owners. Although in good condition and complementary to the house, it is not a defining historic element. A tennis court, which straddles four of the ten lots on the western side of the house Is in fair condition but does not contribute to the historic significance of the site. The present owner purchased the property from the Scholl estate in 1969, after Mr. Scholl's death. The owner is not in support of the subject Class I designation recommendation. As noted above, the owner has submitted an application to demolish the house, pool and cabana to enable the ten lots to be sold and redeveloped by others. The tennis court would not be demolished as part of that application. REQUIRED FINDINGS The following excerpt from section 8.05.020 'Definitions' provides the findings to consider when evaluating and determining whether a structure should be classified (or reclassified) as 'historic'. To assist the Board in its determination, staff has evaluated Scholl estate against the findings and definition In Section 8,05.020 and makes the following findings 8.05.125 Class 3 Site- Structure/site was constructed before 1945, or a year to be determined by the City Council, or construction date cannot be confirmed. Eligible for a six-month stay of demolition. Action of the MSPB may include recommendation to reclassify. All structures built prior to the subject date would be automatically So classified. These three findings are further evaluated below. (2) It is associated with lives of persons who made meaningful contribution to the national, state, or local history, The 211 East Morongo site conforms to this finding because it is acknowledged to have been built and occupied as a vacation home by Dr. William Scholl who built the internationally recognized foot care products company"Dr Scholl's", (3 It reflects a particular type, period of the national, state, or local history. The 211 East Morongo site conforms to this finding because it is reflective of the type of home common in Palm Springs during the thirties and forties. This period is recognized as Palm Springs' "first golden era" in which celebrities and other internationally notable personalities chose Palm Springs as their "vacation get-away Many such individuals and families built modest homes throughout Palm Springs similar to the one at this site however few remain in such intact and original condition. 000018 Histono Site Preservation Board Staff Report Page 7 of 8 Case HSPB 57 Date July 10,2007 (4) That embodies the distinctive characteristics of a type, period or method of construction; The Scholl estate and home conform to this finding because it is typical of the type, period, and method of construction prevalent during Palm Springs' boom years of the thirties and forties, when modest Spanish revival and ranch style homes, popular in the southwestern United States, were built by those choosing Palm Springs for a vacation destination. Affluent families seeking the quiet natural character of the desert would often purchase several lots in a subdivision and create a single 'estate'-sized parcel, further affording them seclusion, separation from neighbors, and privacy. The Scholl property is now particularly rare in that the entire ten-lot parcel still remains under the ownership of one individual with its naturalized landscape and un-developed grounds still intact- Most large estates of this type have been subdivided, sold off to separate owners and developed with new homes. The native desert plantings of Filifera Palms, agave, smoke tree, mesquite, and other desert-native plant species have reached maturity and present a lush, but and landscape. A minimal area of lawn was planted and maintained adjacent to the pool, but otherwise the site exists with its native sandy soil. The site characteristics of the Scholl estate are similar to that of the landscape standards of the Smoke Tree Ranch Colony, in which desert-native plant species and a more naturalized landscape palette with minimal grass and formal plantings are required standard of development. The pool was installed by the present owner It is not from the historic period that Mr. Scholl owned the house and is not reflective of a pool from that historic period. Therefore Staff does not recommend it be given any historic significance or protective status. The barbeque cabana appears to have been constructed shortly after the house, however exact date of construction has not been confirmed. It does appear to be from the historic period that Scholl owned the site and therefore could be considered for possible reclassification consistent with the main house and a contributing part of the 'setting' of the historic period of the site. The Board has at least four possible actions it could consider: 1. Conclude that the Scholl residence and related structures are not adequately sufficient to merit Class 1 or Class 2 designation and allow them to be demolished. 2. Determine that the Scholl House and related structures are historically significant, recommend reclassification of the site to Class 2, require the structures be fully documented and photographed and a permanent file established, and then allow the structures to be demolished and an informative historic marker installed at the site explaining its significance. 000019 Historic Site Preservation Board Staff Report Page 8 of 8 Case HSPB 57 Date July 10,2007 3. The homes were modest, usually embodying traditional revival architectural styles and often sited on large heavily landscaped sites to afford privacy and seclusion for the owners. This home exists in nearly its original condition with extensive naturalized landscaping on a 2.5 acre site. Today, these large 'estates' are exceedingly rare, because most have been subdivided, sold off and redeveloped with housing and other uses. Staff member Lyon explained that Planning received an application for the demolition of the home, swimming pool, and casita known as the Dr. Scholl Estate Staff's analysis and findings are provided in the Staff Report- Sub-committee report was presented by Board member Jade Nelson and copies were distributed to Board and Staff members. Please refer to that report for broader details. He also asked the Board to consider it for a Class 1 nomination. Frank Tyson, 175 South Cahuilla, spoke in opposition to the demolition request. PUBLIC COMMENTS CLOSED. Board member Jade Nelson responded to speakers comments. A neighbor to this property wrote a short letter and asked that it be read at this meeting which stated, in part,-- "(1) home of noteworthy American entrepreneur; (2 reflects the origins of Palm Springs for architecture and lifestyle; (3) one of the few remaining structures from a meaningful time in the history of Palm Springs; and (4) preserves open space." The letter was also signed by ten other neighbors adjacent to this property. (copy attached for reference) Board member Brian Strahl stated that the properly is widely known in the real estate market, a substantial amount of time and money has been spent on marketing this property, it's been on the market over a year as a 2.3 acre parcel valued at $4.2 million. This owner has done an extensive marketing program trying to sell this property. Board member Jade Nelson reported that the garage is original, the pool was added in 1969, and a sunroom was added in 1952. There was no roof permit on file, and the file is superior quality so conceivably is original to the house. A call has been made to the file company—awaiting response. Board member John Williams commented that he is intrigued by the letter from the neighbor Ms. Hayes and asked if the Survey referred to in the IPtter is available (Staff will research.) If that survey is available there may be documentation about this house — asked for Board members to have a copy of the 1987 survey. Ike was met well known in the village as a kindly man and he did an excellent job of maintaining the home and preserving open space by preserving more than half of the property in a natural state. The older man often pointed out the wildlife and vegetation and they enjoyed watching the quail in the spring. BACKGROUND AND SETTING The Spanish style ranch home at this site was originally built in 1941 by Dr. William Mathias Scholl (1882 — 1968), founder of the company that bore his name that manufactured foot care products. William Mathias Scholl, graduated from Illinois Medical School in 1904, thereby becoming a doctor (podiatrist). Scholl and his company invented a number of foot care products, including the Foot Eazer, the Zino Pad, rubberless stockings, Foot Wings arch 000033 Historic Site Preservation Board Staff Report Case Date supports, and Ball-0-Foot Cushions. The first company retail store was opened in 1928. When Scholl died, the Dr. Scholl Company was turned over to his nephews, William H. Scholl (1920- 2002) and Jack E. Scholl (1926-2006). The home at 211 E Morongo Road was not Mr. Scholl's primary residence. It was owned by Scholl until his death in 1968. The William Scholl estate is comprised of ten lots of Palos Verdes Tract #3 and located in the Tahquitz River Estates neighborhood. Five of the lots (nos. 41 thru 45) front on Morongo Road, and five front on Sonora Road (lots 61 thru 65). The neighborhood surrounding the roughly 2.5 acre Scholl estate is a fully built out subdivision of single family homes on quarter acre lots, many built in the same period as the Scholl house and others to the east, built in the 1950's and 1960's. The home is located on lots 43 & 44 and the swimming pool straddles four lots, 43 and 44 as well as lots 62 and 63. The ten lots are heavily landscaped with mature plantings in a naturalized landscape design. The driveway for the home enters from the street on lot 45, a separate lot from the two on which the home is sited. The 2,555 square foot wood frame home, constructed with a two-piece barrel vault clay tile roof and smooth stucco walls, is in very good condition. The windows are original steel sash casement single glazed windows. A front covered porch and open breezeway have exposed wood timbers and wood posts stained a dark brown. A sun room addition and trellis-like shade structure were constructed on the back side of the house some time in the last twenty years or so. The current pool is not original and was installed by the present owners. A tennis court straddles four of the ten lots on the western side of the house. The present owner purchased the property from the Scholl estate in 1969, after Mr. Scholl's death. The owner desires to demolish the house, pool and cabana to enable the ten lots to be sold and redeveloped by others. The tennis court would not be demolished. ANALYSIS Section 8,05,125 of the Municipal Code designates historic sites Into three classifications, the subject property is Class 3 by the fact that it was originally constructed prior to 1945. The HSPB authority on Class 3 properties is limited to two actions: a motion to initiate proceedings for designation of the property to Class 1 or Class 2 status and a motion to enact a 120 day stay of demolition to afford time to conduct necessary studies, hearings, and determinations on whether such site should be reclassified to a higher designation. REQUIRED FINDINGS The following excerpt from section 8.05.020 'Definitions' provides the findings to consider when evaluating and determining whether a structure should be classified (or reclassified) as 'historic'. To assist the Board in its determination of this demolition request, Staff has evaluated Scholl estate against the findings and definition in Section 8.05.020 and makes the following findings 8.05.020 (a) Historic Site. An historic site is any real property such as: a building, a structure, including but not limited to archways, tiled areas and similar architectural elements, an archaeological excavation or object that is unique or significant 000034 2 Historic Site Preservation Board Staff Report Case Date because of its location, design, setting, materials, workmanship or aesthetic effect and: (1) That is associated with events that have made a meaningful contribution to the nation, state or community,- or (2) That is associated with lives of persons who made meaningful contribution to national, state or local history; or (3) That reflects or exemplifies a particular period of the national, state or local history; or (4) That embodies the distinctive characteristics of a type, period or method of construction; or (5) That presents the work of a master builder, designer, artist, or architect whose individual genius influenced his age; or that possesses high artistic value; or (6) That represents a significant and distinguishable entity whose components may lack individual distinction; or (7) That has yielded or may be likely to yield information important to national, state or local history orprehistory. Staff has evaluated the subject property based on the above required findings and has concluded the home is eligible for designation at the local level relative to items 2, 3, and 4 above. These three findings are further evaluated below. (2) It is associated with lives of persons who made meaningful contribution to the national, state, or local history, The home at 211 East Morongo conforms to this finding because it is acknowledged to have been built and occupied by Dr. William Scholl who built the internationally recognized foot care products company "Dr Scholl's", (3) It reflects a particular type, period of the national, state, or local history The home at 211 East Morongo conforms to this finding because it is typical of the type of home common in Palm Springs during the thirties and forties. This period is recognized as Palm Springs' "first golden era" in which celebrities and other internationally notable personalities chose Palm Springs as their "vacation get-away". Many such individuals and families built modest homes throughout Palm Springs similar to the one at this site. (4) That embodies the distinctive characteristics of a type, period or method of construction; The Scholl estate and home conform to this finding because it is typical of the type, period and method of construction prevalent during Palm Springs' boom years of the thirties and forties, when modest Spanish revival and ranch style homes, popular in the southwestern United States, were built by those choosing Palm Springs for a vacation destination. Affluent families seeking the quiet natural character of the desert would often purchase several lots in a subdivision and create a single 'estate'-sized parcel, further affording them seclusion, separation from neighbors, and privacy. The Scholl property is now particularly rare in that the entire ten-lot parcel still remains under the ownership of one individual with its naturalized landscape and un-developed grounds still intact. Most large estates of this type have been subdivided, sold off to separate owners and developed with new homes. The native desert 000035 3 Historic Site Preservation Board Staff Report Case Date plantings of Filifera Palms, agave, smoke tree, mesquite, and other desert-native plant species have reached maturity and present a lush, but arid landscape. A minimal area of lawn was planted and maintained adjacent to the pool, but otherwise the site exists with its native sandy soil. The site characteristics of the Scholl estate are similar to that of the landscape standards of the Smoke Tree Ranch Colony, in which desert-native plant species and a more naturalized landscape palette with minimal grass and formal plantings are required standard of developement. In considering these findings and the demolition application, Staff has identified the following as possible actions that the Board could take; 1. Take no action and allow the demolition application to be processed. 2. Initiate proceedings to recommend designation of the site to Class 2 status, recognizing its significance, but allowing the owner to proceed with demolition. 3. Place a 120-day stay of demolition on the property and initiate proceedings to recommend designation of the site to Class 1 status. Staff recommends option 3. Pursuant to Municipal Code 8,05,170 a stay of demolition of 120 days may be enacted by the Board "to afford time for necessary studies, hearings and determinations whether such site should be designated as a historic site."
