DATE: September 5, 2007 PUBLIC HEARING
SUBJECT: APPEAL OF DECISION BY THE PLANNING COMMISSION TO DENY
CASE NO. 5.0931 PD 279 — AN AMENDMENT FOR FINAL
DEVELOPMENT PLANS TO ALLOW A REDUCED FRONT YARD
SETBACK FOR THE TWELVE REMAINING VACANT LOTS LOCATED
WITHIN THE MOUNTAIN GATE DEVELOPMENT AT 900 GATEWAY
DRIVE.

SUMMARY:
The applicant for the above-referenced project has requested that the City Council
continue the public hearing for Case No. 5.0931 PD-279, to the meeting of September
19, 2007. According to the applicant, the continuation is necessary due to a scheduling
conflict.
RECOMMENDATION:
1. Continue the Public Hearing to September 19, 2007, without public testimony;
and
2. Direct the City Clerk to post a Notice of Continued Public Hearing.
FISCAL IMPACT:
None.

Dear Mr.Thompson,
Pursuant to the Palm Springs Municipal Code we request that the Planning Commission's July 11,
2007 decision on Elie above case be appealed to the City Council. We base our appeal on the fact
that our request fora 15' front yard setback is not unreasooable and in fact has been granted by the
Planning Commission on a va fiery of projects through out Palm Springs. We are sure that after
review of the photo package submitted to the Planning Deparvncnt, as parr of our initial application,
showing various projects with setbacks less than 20', some with setbacks less than the 15'we request,
you will agree. We also contend that minor site changes within Planned Development Districts is
not unusual and is in fact specifically designed for small limited applications such as ours. Fos these
reasons we ask Char you place this matter before 61C City Council for a Final determination on this
minor site change request
