ORDINANCE NO. AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,ADDING SUBSECTION G TO SECTION 11 AND SUBSECTION G TO SECTION VI OF ORDINANCE NO. 1632 OF THE CITY OF PALM SPRINGS, RELATING TO PARK FEES FOR RESIDENTIAL DEVELOPMENT IN THE CENTRAL BUSINESS DISTRICT. City Attorney Summary This Ordinance establishes an alternative park fee requirement for residential development in the Central Business District. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ORDAINS: SECTION 1. Subsection G is added to Section 11 of Ordinance No. 1632 to read: G. Central Business District. Means all property zoned "G-B-D," Central Business District ,Zone, as provided in the Palm Springs Zoning Code. SECTION 2. Subsection G is added to Section VI of Ordinance No. 1632 to read: G. In lieu of dedicating land or paying fees as determined through the process identified in Section VII and Subsections A through F of this Section VI, a developer of property in the Central Business District may elect to pay the fees for each residential dwelling unit in the Central Business District in an amount as the City Council may establish by resolution. SECTION 3. The City Council finds and determines that an alternative park fee requirement for residential development in the Central Business Districtwill encourage and promote the development of mixed use projects in the area of the City intended for compact, lively, active, and intensive uses thatwill caterto pedestrians and allowthe urban environment recognized by the City's General Plan to flourish. Residents of homes in the Central Business District will support and use the amenities and activities associated with an urban downtown environment. SECTION 4. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage. Ready, City Manager BY: Community & Economic Development SUMMARY The City Council will consider the introduction and adoption of an ordinance that will allow the Council to establish an alternative park fee required for development in the City's Central Business District. RECOMMENDATION. 1. Waive the reading of text in its entirety and read by title only. 2. Introduce on first reading Ordinance No. , "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADDING SUBSECTION G TO SECTION II AND SUBSECTION G TO SECTION VI OF ORDINANCE NO. 1632 OF THE CITY OF PALM SPRINGS, RELATING TO PARK FEES FOR RESIDENTIAL DEVELOPMENT IN THE CENTRAL BUSINESS DISTRICT." STAFF ANALYSIS: In 2003 the City Council adopted a park land and in-lieu fee ordinance that provided for park land dedication and/or park land fee in lieu of dedication as a required condition of approval of residential development in the City. The current ordinance provides a process for determining dedication and fee requirements for standard, suburban residential development. The current process, however, is not easily adapted to mixed use projects, ITEM NO. 22--- =--- City Council Staff Report July 25, 2007 — Page 2 of 2 Park Fee/Central Business District The proposed ordinance would enable the Council to adopt an alternative method of establishing park land dedication fees for residential units on property zoned "C-B-D" Central Business District, property that is generally urban in character and potentially capable of being developed for mixed uses. Staff contends that an alternative park fee requirement for residential development in the Central Business District will encourage and promote the development of mixed use projects in the area of the City intended for compact, lively, active, and intensive uses that will cater to pedestrians and allow the urban environment recognized by the City's General Plan to flourish. Residents of homes in the Central Business District will support and use the amenities and activities associated with an urban downtown environment. If the Council introduces the proposed ordinance on July 25, staff will present a Resolution establishing the fees for Council's consideration at the meeting of September 5, the time the ordinance is adopted with its second reading. FISCAL IMPACT: Establishing an alternative park fee for residential development in the Central Business District may result in a reduction in the amount of funds collected for park land acquisition from that which could have been collected under the current provisions of the City's park land dedication ordinance.
