SUBJECT: ESTABLISHING RATES AND CHARGES FOR OFFICIAL POLICE TOW
SERVICES PROVIDERS

SUMMARY
The City Council will consider a Resolution that establishes rates and charges for
towing and storage that official Police Tow Services Providers may charge the public
pursuant to PSMC 11.82.070 (b).
STAFF RECOMMENDATION:
1. Adopt Resolution No. , "A RESOLUTION OF THE CITY OF PALM
SPRINGS, CALIFORNIA, ESTABLISHING RATES AND CHARGES FOR
TOWING AND STORAGE OF VEHICLES THAT OFFICIAL TOW SERVICES
PROVIDERS CAN CHARGE THE PUBLIC PURSUANT TO PSMC 11.82.070.
ISSUE ANALYSIS:
In 2006, City Council adopted Ordinance 1686 which added Section 11.82 to the Palm
Springs Municipal Code_ This section establishes the standards for official police
services in the City, and it requires that the City Council set the amount of the taw rates
and charges by resolution.
On December 20, 2006, City Council adopted Resolution 21792, approving agreements
with three tow operators to tow vehicles for the City of Palm Springs. On April 18, 2007
City Council added Brothers Towing to the list of approved tow operators.

Establish Taw Rates and Charges
PSMC Section 11.82.70 (b) requires the fee to be based upon the average tow fee
allowed by the California Highway Patrol, Indio Bureau. That rate has been determined
to be $155 per tow and $50 a day for storage. That amount is the proposed rate that
staff recommends for this resolution. The tow operators are also allowed to charge $125
per official police tow to recover the VTACR fee that they pay the City to be part of the
program.
In addition to allowing the tow operators to recover the payment they have to make to
the City to participate in the tow contract, these rates also provide consistency to the
people who get their cars towed as they will pay the same amount no matter who is
called to tow their vehicle.
The tow operators will be required to post the rates at their place of business, and
Police Department staff will provide a fee schedule to anyone who has had their vehicle
towed so they can know what to expect to pay.
FISCAL IMPACT.
None. The proposed action will regulate the allowable charges that the tow operators
can charge the public at large.

A RESOLUTION OF THE CITY OF PALM SPRINGS, CALIFORNIA, ESTABLISHING
RATES AND CHARGES FOR TOWING AND STORAGE OF VEHICLES THAT
OFFICIAL TOW SERVICES PROVIDERS CAN CHARGE THE PUBLIC PURSUANT
TO PSMC 11,82.070 (b).
WHEREAS, pursuant to PSMC Section 11.82.070 (b) the City Council of the City of Palm Springs
shall establish rates and charges for towing and storage of vehicles under the police tow services
standards.
WHEREAS, the City of Palm Springs has entered into a contract with four local Operators allowing
them to participate in a rotational taw list, and to tow vehicles for traffic accidents, abandoned
vehicles, and other City-related business.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The City Council does hereby establish the tow rates pursuant to PSMC Section
11.82.070 (b) to be $155 per tow and $50 per day storage.
SECTION 2. If any provision, clause, sentence, or paragraph of this Resolution or the application
thereof to any person or circumstances, shall be invalid, such invalidity shall not affect the other
provisions of this Resolution which can be given effect without the invalid provision or application,
and to this end, the provisions of this Resolution are hereby declared to be severable.
ADOPTED this 25th day of July, 2007.
