Dear Gidty Clerk: This letter and attachments are submitted for consideration by the City Council at its July 18, 2007, meeting. My comments assume that the property owners voted on July 16, 2006 against increassing the assessment, and the Council is meeting to approve the Council's Staff's request to reduce the existing maintenance contract's cost by 2/3rds. My question is, why is a maintenance contract needed? The attached pictures (with descriptions) and the maps of District 6B are submitted to support the lack of any need for a maintenance contract. It is assumed that the original need for the agreement was that the back yards of most of the houses on Nueva Vista, in the new tract development, border on part of Calle San Raphael on the north and on Avenida Evelita on the east. The pictures show that concrete block walls and paved sidewalks exist on those portions of San Rafael and Evelita where the Nueva Vista backyards border on those streets. The wall on San Rafael ends one lot west from the corner of the two streets, leaving board fencing and dirt walk way for about 100 feet on Raphael. There is no parkway improvement on Evelita from address 821 on the north west corner of Evellta to `L� 903 Evelita, where another block wall and sidewalk resume up to the last empty lot on the south intersection of Evelita and Mesquite. The existing walls and sidewalks do not show any damage, and it is difficult to understand why a yearly maintenaance agreement is required. Adoption of the Resolutions authorize the levy and collection of assessments for the 2007/2008 fiscal year. Street Lighting Maintenance District No. 4 (Eagle Way Area- 43 Properties) 5, Parkway Maintenance District No. 6A (Fairport Development - 23 Properties) 6. Parkway Maintenance District No. 6B (Parkside Estates - 93 Properties) 7. Parkway Maintenance District No. 6C (Park Sonora Tract - 30 Properties) 8. Parkway Maintenance District No. 7 (Sunrise Norte Tract - 53 Properties) 9. Parkway Maintenance District No. 8 (Vintage Palms Tract- 62 Properties) 10.Parkway Maintenance District No. 9 (Flora Vista Tract - 77 Properties) 11.Parkway Maintenance District No. 10, Zone 1, (Mountain Gate — 308 Properties) Parkway Maintenance District No. 10, Zone 2 (Mountain Gate 2 — 196 Properties) City Council directed the City Engineer to schedule Property Owner Protest Ballot Proceedings for fiscal year 2006/2007 for a second attempt to address increased assessments for those Maintenance Districts that required continued subsidy of General Fund revenues. Staff had previously held Property Owner Protest Ballot Proceedings for the 2004/2005 fiscal year, but none of the proceedings were successful. On July 19, 2006, a Public Hearing was conducted at which Proposition 218 balloting and elections for seven of the eleven Maintenance Districts were held. Parkway Maintenance District No. 6C (Park Sonora Tract) was the only Maintenance District wherein the property owners agreed to an increased special assessment, fixed at $412.26 annually with no consumer price index inflator. Following is a summary of the various Maintenance Districts, and staffs final recommendations: Regarding Lighting District No. 1, the improvements within this District are continually failing, as the lighting system was constructed 40 years ago, and as this District has an existing deficit, there is no surplus of funds available with which a new lighting system may be designed and installed. Eventually, this system will become inoperable, and as the neighborhood has not supported an increase to the special assessment, replacement of the lighting system (estimated at $500,000 or more) would require budgeting of City funds, or the lighting system could be abandoned and the District dissolved. Staff's recommendation at this time that the lighting system be turned off for 1 month of the year. Repair and replacement of the lighting system will be deferred. Regarding Lighting District No. 2, this District was established to cover expenses for operating and maintaining a few street lights along McManus Drive between Saturmino Drive and Sunset Way, for 25 properties. The estimated 2007/2008 expense for electricity (taken from existing SCE utility bills) is $8,127 or almost twice the total maximum assessment of $4,250 levied in the District. Staff has confirmed with SCE that the type of utility rate charged for this system has had significant rate increases over the last year. Therefore, to ensure that costs do not exceed the maximum assessment received, it is staffs recommendation that the lighting system be turned off for 7 months of the year. Regarding Lighting District No. 3, this District was established to cover expenses for operating and maintaining street lights along Lawrence Street and Marguerite Street within the Crossley Tract, for 75 properties. Estimated 2007/2008 costs do not exceed the maximum assessment received; the District is functioning within operating revenue. Regarding Lighting District No. 4, this District was established to cover expenses for operating and maintaining street lights along Birdie Way, Divot Lane, Eagle Way and 12 The $2,863 deficit estimated for 2007/2008 will be funded by existing reserve funds in the District budget. 13 The $2,298 deficit estimated for 2007/2008 will be funded by existing reserve funds in the District budget. 000006 City Council Staff Report July 18, 2007- Page 7 2007/2008 Citywide Maintenance Districts Par Drive, for 43 properties. The estimated 2007/2008 expense for electricity (taken from existing SCE utility bills) is $715, however, District administration and maintenance is estimated at $1,495. It is staff's recommendation that this District be abandoned and dissolved, but that the lighting system remain operational, to be paid for by the General Fund. Regarding Parkway District No. 6A ("Fairport Development"), this is a Parkway Maintenance District for landscape maintenance of the existing parkway along the west side of Gene Autry Trail (Highway 111) between Tachevah Drive and Chia Road, for 31 properties. Estimated 2007/2008 costs do not exceed the maximum assessment received; the District is functioning within operating revenue. Regarding Parkway District No. 6B ("Parkside Estates"), this is a Parkway Maintenance District for landscape maintenance of existing parkways along Avenida Evelita and Calle San Raphael, where homes have rear yards abutting these streets (a total distance of approximately 1,000 feet). It appears that at the time this District was established in 1980, more extensive parkway landscaping may have existed along these streets. However, at some point in the past, a new sidewalk was constructed along the parkway, removing most of the previous landscaping. The only landscaping that remains, and is maintained as a part of this District, are ten street trees. Annual operating expenses include approximately $1,800 for the City's landscape maintenance Contractor (currently Merchant Landscape Services, Inc.) and $125 for irrigation, as well as incidentals and administrative costs, for a total of approximately $3,025. The current maximum annual assessment is $1,818, It is staffs recommendation to coordinate with the City's landscape maintenance Contractor to reduce services by two-thirds such that maintenance costs are reduced to $600, and ensure that costs do not exceed the maximum assessment received. Alternatively, the District could be abandoned and dissolved. Regarding Parkway District No. 6C ("Park Sonora Tract"), this is a Parkway Maintenance District for landscape maintenance of the existing parkway along the east side of El Cielo Road between Sonora Road and San Martin Circle, for 30 properties. This is the one and only District that approved an increased assessment from $8,262 to $12,368 (from $275.40 to $412.27 per parcel annually) last year. Estimated 2007/2008 costs are $12,140. The District is functioning within operating revenue. Regarding Parkway District No. 7 ("Sunrise Norte"), this is a Parkway Maintenance District for landscape maintenance of the existing parkway along the north side of San Rafael Drive between Mountain Shadow Drive and Sunrise Way, for 53 properties. Sunrise Norte was a City initiated low-income development. This District was established in 1990, prior to Proposition 218, and did not include an automatic escalator (Le. Consumer Price Index) to the maximum assessment, and beginning with the 2005/2006 fiscal year, annual expenses exceeded the total maximum assessment received. Estimated 2007/2008 costs are $27,094; it is staff's recommendation to 00gg1q'7 City Council Staff Report July 18, 2007 - Page 8 2007/2008 Citywide Maintenance Districts reduce contract landscape maintenance services by 15% to ensure that costs do not exceed the maximum assessment received. Regarding Parkway District No. 8 ("Vintage Palms"), this is a Parkway Maintenance District for landscape maintenance of the existing parkways along the east side of Avenida Caballeros, north of San Rafael Drive, and the north side of San Rafael Drive, east of Avenida Caballeros adjacent to the Vintage Palms development, for 62 properties. This District was established in 1990, prior to Proposition 218, and did not include an automatic escalator (i.e. Consumer Price Index) to the maximum assessment. The total maximum assessment of $6,878 that can be levied in this District is well below the actual costs for landscape maintenance ($9,500) and SCE bills ($1,100) and DWA bills ($2,200). Estimated 2007/2008 costs are $14,806. SunCal Companies, the developer of the adjacent "Avalon" project, is subject to a Court-ordered Settlement Agreement with the Vintage Palms neighborhood. One of the conditions of the Settlement Agreement includes an obligation to remove and replace the existing parkway landscaping along the east side of Avenida Caballeros with similar landscaping they will install along the west side of the street (which will be maintained by the Avalon HOA). Although it is SunCal Companies' financial obligation to install the new parkway landscaping, the maintenance obligation is the City's, and it is expected that the maintenance costs associated with the improved parkway landscaping will be higher than the costs associated with the current landscaping. It is staff's recommendation to significantly reduce contract landscape maintenance services to ensure that costs do not exceed the maximum assessment received. The result of this recommendation will be an 80% or more reduction in landscape maintenance services because after payment of DWA and SCE bills, and District administration costs, approximately $2,100 remains in the District budget for landscape maintenance. Since the estimated contractual maintenance fee is $9,500, reducing this cost to $2,100 will necessitate an 80% reduction in landscape maintenance services. Regarding Parkway District No. 9 ("Flora Vista"), this is a Parkway Maintenance District for landscape maintenance of the existing parkway along the west side of Sunrise Way between Via Escuela and Racquet Club Road, for 77 properties. Estimated 2007/2008 costs do not exceed the maximum assessment received; the District is functioning within operating revenue. Regarding Parkway District No. 10, Zone 1 ("Mountain Gate"), this is a Parkway Maintenance District for landscape maintenance of the existing parkways around the Mountain Gate development, for 308 properties. MUMS ,, u_ _iS" RESOLUTION NO. 21910 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DECLARING ITS INTENTION TO CONDUCT A PUBLIC HEARING ON STREET LIGHTING MAINTENANCE DISTRICT NO. 1 ("BELARDO AREA"); AND TO LEVY AND COLLECT ANNUAL ASSESSMENTS RELATED THERETO FOR FISCAL YEAR 2007/2008 WHEREAS, the City Council has, by previous Resolutions, formed the Palm Springs Street Lighting Maintenance District No. 1 (hereafter referred to as "District No. 1") pursuant to the provisions of Street Lighting Act of 1931, Part 2 of Division 14 of the Streets and Highways Code of the State of California, beginning with §18300 (hereafter referred to as the "Act"), that provides for the levy and collection of assessments by the City of Palm Springs to pay the maintenance and services of improvements and all appurtenant facilities and operations related thereto; and WHEREAS, the Engineer has prepared and filed with the City Clerk a Report for District No. 1, and the levy of assessments for Fiscal Year 2007/2008 (July 1, 2007 and ending June 30, 2008) in accordance with the Act; and the Council did by previous Resolution preliminarily approve such Engineer's Report. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council hereby declares its intention to levy and collect annual assessments against parcels of land within District No. 1 for fiscal year 2007/2008. Section 2. The boundaries of District No. 1 are generally located within the area between Tahquitz Canyon Way on the north, Tahquitz Drive on the west, Belardo Road on the east, and Baristo Road on the south, and is designated as District No. 1. Section 3. The improvements include the operation, maintenance and servicing of street lighting improvements and appurtenant facilities to be provided by the City of Palm Springs in connection with the street lighting and electrical system installed within public streets within District No. 1. Detailed maps and descriptions of the location and extent of the improvements to be maintained are on file in the Office of Public Works and by reference are made part of this Resolution. Section 4. The proposed assessments for District No. 1 are outlined in the Engineer's Report. The Engineer's Report details the assessments necessary to provide for the annual operation, administration, services and maintenance of the improvements described in Section 3 of this Resolution. Section 3. The Engineer's Report and assessment as presented to the City Council and on file in the office of the City Clerk are hereby confirmed as filed. Section 4. The City Council hereby orders the proposed improvements to be made, which improvements are briefly described as the maintenance, operation, administration and servicing of the improvements related to street lighting and all appurtenant facilities related thereto_ Section 5. The maintenance, operation and servicing of the street lighting and appurtenant facilities shall be performed pursuant to the Act and the County Auditor of Riverside County shall enter on the County Assessment Roll opposite each parcel of land the amount of levy, and such levies shall be collected at the same time and in the same manner as the County taxes are collected. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING AND/OR APPROVING THE FINAL ENGINEER'S ANNUAL LEVY REPORT FOR FISCAL YEAR 2007/2008 FOR THE PALM SPRINGS STREET LIGHTING MAINTENANCE DISTRICT NO. 2 WHEREAS, the City Council, pursuant to the provisions of the Street Lighting Act of 1931, Part 2 of Division 14 of the Streets and Highways Code of the State of California, beginning with beginning with §18300 (hereafter referred to as the "Act"), did by previous Resolution order the City Engineer to prepare and file an Engineer's Annual Levy Report (hereafter referred to as the "Engineer's Report") in accordance with the Act, in connection with the levy and collection of assessments for the Palm Springs Street Lighting Maintenance District No. 2 (hereafter referred to as "District No. 2") for the fiscal year commencing July 1, 2007, and ending June 30, 2008; and, WHEREAS, the City Engineer has prepared and filed the Engineer's Report with the City Clerk, and the City Clerk has presented to the City Council the Engineer's Report; and, WHEREAS, the City Council has carefully examined and reviewed the Engineer's Report as presented, and is satisfied with each and all of the items and documents as set forth therein, and finds that the levy has been spread in accordance with the special benefits received from the improvements, operation, maintenance and services to be performed, as set forth in the Engineer's Report. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The above recitals are all true and correct. Section 2. The Engineer's Report as presented consists of the following: a) A Description of District No. 2 and Improvements. b) The Annual Budget (Costs and Expenses of Services, Operations and Maintenance) c) A Description of the Method of Apportionment resulting in an Assessment Rate per Levy Unit within District No. 2 for fiscal year 200712008. Section 3. Based upon its review (and amendments, as applicable) of the Engineer's Report, a copy of which has been presented to the City Council and which has been filed with the City Clerk, the City Council hereby finds and determines that: a) The land within District No. 2 will receive special benefit by the operation, maintenance and servicing of street lighting and appurtenant facilities within the boundaries of District No. 2. b) District No. 2 includes all of the lands receiving such special benefit. c) The net amount to be assessed upon the lands within District No. 2 is in accordance and apportioned by a formula and method which fairly distributes the net amount among all eligible parcels in proportion to the special benefit to be received by each parcel from the improvements and services for the fiscal year commencing July 1, 2007, and ending June 30, 2008. d) The assessment amounts described in the Engineer's Report are less than or equal to the maximum assessment amounts previously approved by property owner petition or balloting. Section 3. The Engineer's Report and assessment as presented to the City Council and on file in the office of the City Clerk are hereby confirmed as filed. Section 4. The City Council hereby orders the proposed improvements to be made, which improvements are briefly described as the maintenance, operation, administration and servicing of the improvements related to street lighting and all appurtenant facilities related thereto. Section 5. The maintenance, operation and servicing of the street lighting and appurtenant facilities shall be performed pursuant to the Act and the County Auditor of Riverside County shall enter on the County Assessment Roll opposite each parcel of land the amount of levy, and such levies shall be collected at the same time and in the same manner as the County taxes are collected. After collection by the County, the net amount of the levy shall be paid to the City Treasurer. Section 6. The City Treasurer shall deposit all money representing assessments collected by the County for District No. 2 to the credit of a fund for the Palm Springs Street Lighting Maintenance District No. 2, and such money shall be expended only for the maintenance, operation and servicing of the street lighting and appurtenant facilities as described in Section 4. 000019 Resolution No. Page 3 Section 7.
