Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY The City of Palm Springs has received federal aid funds for reconstruction of the existing damaged culvert on Golf Club Drive at Palm Canyon Wash. Approval of this item will award a contract services agreement to Bonadiman-McCain, Inc., to construct this Emergency Relief Project. RECOMMENDATION: 1) Adopt Minute Order No. "DETERMINING THAT CEDAR DEVELOPMENT INC. IS NOT A "RESPONSIBLE BIDDER" UNDER THE DEFINITION IN PALM SPRINGS MUNICIPAL CODE SECTION 7.01.040." 2) Adopt Minute Order No. "APPROVING AGREEMENT NO. IN THE AMOUNT OF TWO HUNDRED SIXTY-FIVE THOUSAND ONE HUNDRED THIRTEEN DOLLARS AND NO CENTS ($265,113.00) WITH BONADIMAN- McCAIN, INC., FOR THE GOLF CLUB DRIVE CULVERT RECONSTRUCTION PROJECT, CITY PROJECT 05-18" and 3) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: In January 2005 the Golf Club Drive culvert was damaged by heavy rains (Declared Federal and State Emergency) at the Palm Canyon Wash low water crossing. The Federal Highway Administration of the U.S. Department of Transportation has approved Emergency Relief (ER) federal aid funds, and on October 19, 2005 issued Authorization for Preliminary Engineering. ITEM NO, The project will accomplish the reconstruction of the culvert system with more pipes of a larger size to pass a grater flow under the roadway, and will provide a capacity nearly equal to the actual storm flow measured on January 11, 2005 which caused the failure of the existing culvert system. The new culvert will eliminate frequent roadway closures on Golf Club Drive (between November 2004 and February 2005 the road was closed five times). The work consists of removal and reconstruction of concrete slope protection, concrete culvert inlet structure, removal of the existing three 18" pipes, installation of nine 42"x 29" arch pipes and street improvements. Caltrans' Authorization for Construction was received on March 26, 2007. The project design has been prepared by Department staff, and on May 2, 2007, the City Council approved the plans and specifications and authorized staff to advertise for construction bids. The project was advertised for bids on May 15 and May 22, 2007, and at 2:00 p.m. on June 12, 2007, the Procurement and Contracting Division received construction bids from the fallowing contractors: 1. Cedar Development Corporation $228,150.00 2. Bonadiman-McCain, Inc. $265,113.00 3. WEKA, Inc. $294,186.00 4. 4-Con Engineering, Inc. $297,615.00 5. J. D. Stine Constructors, Inc. $298,450.00 6. Harris Construction Engineering, Inc. $321,940.00 7. Jacobsson Engineering Construction, Inc. $328,324.00 8. Tri-Star Contracting, Inc. $389,390.00 9. Granite Construction Company $399,790.00 10. Dateland Construction Company, Inc. $425,747.50 11. Contreras Construction Co. $434,3%00 Refer to Attachment 1 for Bid Summary. The Engineer's Estimate was $330,540. The low bid was submitted by Cedar Development Corporation (C.D.C), located in Mira Loma with its principal officer Serghon Gabriel Afram CEO/President. As required by the bid forms, C.D.C. has listed two references for completed projects, but none of the projects were related to culvert construction. One reference could not be contacted, and the other has described C.D.C. as a contractor with "inexperienced, unknowledgeable crew, with many problems, working mostly with subcontractors". Under the City's Procurement Ordinance, this contractor does not fit the definition of responsible and may therefore not be awarded the contract. Staff recommendation is to reject the bid submitted by Cedar Development Corporation, and award the contract to the second lowest bidder, Bonadiman-McCain, Inc. Bonadiman McCain, Inc. from San Bernardino has storm drain and culvert related experience and good references. Its principal officers are Jeff Bonadiman, President, k��L it Bradley Austin, Vice President and Carlo Bonadiman, Secretary/Treasurer. The bid amount is $265,113.00, FISCAL_ IMPACT! Finance Director Review: Sufficient funds for this project are available in account 261-4491-50254 for the 88.53% federal funds and Gas Tax account 133-4298-50254 for the 11.47% local match. David J.
