James Thompson, City Clerk SUMMARY The City Council will conduct a public hearing and take public testimony with respect to modifications to certain fees for the Aviation, Planning and Parks and Recreation Departments, implementing the Cost of Living Adjustment, and modifying the Comprehensive Fee Schedule for Fiscal Year 2007-08. RECOMMENDATION: 1, Open the public hearing and receive public testimony. 2. Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CERTAIN USER FEES AND CHARGES AND MODIFYING THE COMPREHENSIVE FEE SCHEDULE ADOPTED BY RESOLUTION NO. 21578 FOR FISCAL YEAR 2007-08." STAFF ANALYSIS: Local governments are funded from a variety of sources, with the primary sources being taxes, subventions, fees, special charges, fines and grants. As the traditional provider of basic services, cities are relying more and more heavily on user fees that are charged for various public services. ITEM NO, - G City Council Staff Report June 27, 2007-- Page 2 Comprehensive Fee Schedule State law requires that fees charged by local agencies be reasonably related to the actual cost of providing the service. User fee services are those services performed by a governmental agency on behalf of a private citizen or group. The assumption underlying most fee recommendations is that the cost of services benefiting individuals, and not society as a whole, should be borne by the individual receiving the benefit(s). In 2004 for the Development Services Departments, and in 2005 for other Departments; the City retained a consultant, MuniFinancial, to prepare a User Fee Study. These studies were to ensure that the City was recovering the full cost of providing various public services and that fees were reasonably related to the estimated reasonable cost of providing the type of service for which the fee is charged. Fees were substantially updated at those times. It is the City's intent to retain a consultant approximately every five-years to prepare a comprehensive User Fee Study and thoroughly review all fees. These time/material studies and overhead calculations and allocations are expensive and very time- consuming for staff. During the interim, staff requests all fees be increased (or decreased) by the local CPI index, to ensure fees remain reasonably related to costs and keep pace with increased costs without having to prepare a comprehensive study each year. Resolution No. 21578 unanimously adopted by the City Council on May 17, 2006, provides that each year on July 15 all fees shall be adjusted by the Consumer Price Index for this region, the CPI adjustment due at this time is 3.8%. However, some fees are not subject to a CPI increase for various reasons such as: the fee is set by contractual requirements of the City, the fee is set by another Agency and is only collected by the City, or the fee is at a maximum allowable under law. The Library has requested that none of their fees be increased by the CPI, as industry practice. Additionally, every year, each Department Director, reviews the current fee schedule and may recommend modifications to certain fees. This year the Aviation, Planning and Parks and Recreation Departments are requesting modifications to certain user fees. Each Department prepared a Departmental Fee Request and Justification, which outlines the particulars of each request, and are attached to this report for individual review and consideration. At the time this report was written the City had received letters from the Building Industry Association, and the Tribal Council of the Agua Caliente Band of Cahuilla Indians, recommending approval of the Planning Departments proposed fees modifications. FISCAL IMPACT: All proposed modifications to fees were incorporated in the Fiscal Year 2007-08 Budget. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CERTAIN USER FEES AND CHARGES AND MODIFYING THE COMPREHENSIVE FEE SCHEDULE ADOPTED BY RESOLUTION NO. 21578 FOR FISCAL YEAR 2007-08 WHEREAS, the City, under various statutory provisions under California Government Code, may set and collect fees For the costs of providing various public services to the community; and WHEREAS, from time to time, the City Manager has recommended and the City Council desires to approve certain amendments to said user fees; and WHEREAS, a duly-noticed public hearing was held on June 27, 2007 in accordance with the provisions of the California Government Code; and WHEREAS, the supporting data was available for public inspection and review for ten (10) days prior to the public hearing; and WHEREAS, the City Council has considered any verbal and/or written testimony, and has reviewed and considered the information provided at the public hearing by staff and the public. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY FINDS AND DETERMINES THAT: Section 1: Findings. A. City staff has completed an analysis of certain user fees. B. The current user fees are insufficient to cover all the City's costs and expenses associated with providing the various public services. C. The cost of such services should be borne by those who are the special beneficiaries rather than the citizenry at large. D. There is a reasonable relationship between the amount of the fee and the estimated reasonable cost of providing the type of services for which the fee is imposed. E. The fees do not exceed the estimated reasonable cost of providing the . service for which the fee is charged. Resolution No. Page 2 Section 2: Fees Imposed. A. The City Clerk is hereby instructed, directed and authorized to automatically adjust all service fees and charges by 3.8% pursuant to Subsection D of Section 2 of Resolution No. 21578 with the exception of those fees set forth in Exhibit A attached to this Resolution. B. The City Council modifies and approves the user fees and charges as set forth in Exhibit B attached to this Resolution. C. Each person requesting a service in the City of Palm Springs for which a user fee or charge is imposed shall pay the new fees as set forth in the City's Comprehensive Fee Schedule. E. The user fees and charges may also be adjusted if the City conducts a public hearing to implement a new or revised fee or fees based upon a new study or analysis. F. The adoption of this Resolution does not affect the ability of the City to request an agreement between an applicant and the City to pay extraordinary processing costs and to establish deposit accounts. Section 3. Severability. Each component of the fees and all portions of this Resolution are severable. Should any individual component of the fee or other provision of this Resolution be adjudicated to be invalid and unenforceable, the remaining provisions shall be and continue to be fully effective, and the fee shall be fully effective except as to that portion that has been judged to be invalid. Section 4, Effective Date. A. The CPI adjustment pursuant to Subsection A of Section 2 of this Resolution shall be effective July 1, 2007. B. All new fees and charges subject and pursuant to California Government Code Section 66000 et. al. shall be effective sixty (60) days after the adoption of this resolution. C. All new fees and charges other than those identified in Subsection B of Section 4 above shall be effective July 1, 2007. Resolution No. Page 3 Section 5. Comprehensive Fee Schedule. The City Clerk is hereby authorized and directed to incorporate said fees, charges and modifications into the Comprehensive Fee Schedule, adopted by Resolution No. 21578, as amended. The Retail Concessionaire would have the option of using the Airport trash service or continuing to contract directly with PSDS. Sincerely, Fred Bell Executive Director To: Members of City Council From: Historic Site Preservation Board Re: New fees for Preservation actions in the Comprehensive Fee Schedule Date: June 14, 2007 ++++++++++++++++++. -+++++++++++++++++ The HSPB believes that the new fees associated with Historic Preservation Applications and Mills Act Contracts that are being considered by the City Council would be detrimental to efforts to promote and encourage historic preservation in our city and are contrary to the Council's stated goals of supporting preservation efforts. Since the creation of the Preservation Ordinance in the 1980's these application services have been provided by the City at no charge to the applicant. At the May 23, 2007 joint study session of the City Council and the Board, the Council encouraged the Board to educate property owners of significant historic sites and work to encourage those owners to come forward and seek Class I designation. By invoking these fees, this will create a disincentive that may discourage historic site owners from seeking designation. The preservation of historic properties is a benefit to the City - economically, aesthetically and educationally, The Board therefore would respectfully request that the Council exclude these two items from the comprehensive fee schedule and continue the practice of processing such applications at no charge to the applicant. Animal Placement Fees: Any of the animal placement fees may be waived in whole or in part by the City Manager, or his designee, under special circumstances as he may determine where the public and City's interest may be served thereby. 7. Drainage fees shall apply to all existing vacant properties which are not part of an existing subdivision or that are legal lots of record having been part of a subdivision recorded prior to the effective date of this Resolution. For properties smaller than one (1) acre, a per-square-foot fee shall be established based on the acreage fee for a given subdrainage area. A drainage fee shall be required for all developed properties when an addition of hard surfaced area exceed 50% of the existing hard surfaced area. 8. If it is found upon review and revision of the Master Drainage Plan, that the revised plan can be implemented at lesser cost than the original plan, then the base fee will be lowered. In cases where developments have previously been assessed the higher fee, the difference between the fee paid and such revised fee will be refunded The developer will be granted credit towards drainage fees for actual costs which City validates developer has incurred for associated design and/or construction of on-site and/or of f-site I 0-ye2r retention/detention, or other measures which directly reduce the design and/or construction costs of the master storm drainage system of the City of Palm Springs. In those cases where the developer elects to construct the improvements, actual costs which City validates developer has incurred for design and/or construction of storm and/or drainage improvements as shown in the Master Drainage Plan, shall be credited towards the drainage fee otherwise due. In the event such costs exceed the fee otherwise due, the City will enter into an agreement to reimburse the developer for the excess cost. Such reimbursement shall be made from drainage fees when collected from other projects within the basin area within which the development occurred. 9. When any property owner not within the City limits requests approval for sewer connection, whether existing prior to May 18, 1983 or constructed thereafter, this will result in the contribution of sewage flows to Lift Station No. 1, that Sewer Surcharge Lift Station No. I Fees be determined by the City Manager, and that such fee be approved by the City Council in conjunction with the issuance of authorization to connect to the City's sewer system; and 10.
