SEWER SERVICE SOUTH OF ACANTO DRIVE
RECOMMENDATION:
That the City Council authorize extension of sewer service to the South Palm
Canyon properties located in an unincorporated area adjacent to and outside the
City limits, south of Acanto Drive and east of the southerly extension of S. Palm
Canyon Drive.
SUMMARY:
In response to a request from the Agua Caliente Band of Cahuilla Indians, this
action would allow a maximum equivalent to 400 single family units on land
outside the City limits to connect to City sewer. The connection fee is currently
$4,816 per unit for properties outside the City limits.
BACKGROUND:
The Municipal Code provides that sewer service may be extended to properties
outside the City limits. The current fee for such properties as established by City
Council Resolution is $4,816 per unit, which is double the fee for properties within
the City. This provision goes back to 1967 where Council approved a double fee
by ordinance for properties not within the City limits.
The Tribal Planning Director, on behalf of the Tribe, has requested the City
consider providing sewer service to properties outside the City limits, south of
Acanto Drive.The Tribal Planning Director reports that the maximum development
potential on this property is equivalent to 400 dwelling units. Although there are
no environmental issues specific to these properties which would make sanitary
sewer connection the only option, providing sanitary sewer to developable
properties is of general benefit, not only to the proposed area, but to the City and
its adjacent areas in terms of precluding spills and contamination resulting when
septic systems eventually fail. Although not within the City's sewer master
planned area, the proposed amount of dwelling units added to the treatment plant
is considered negligible, as the flow is estimated at 0.1 million gallons per day
(MGD). Flow at the treatment plant currently averages between 7.5 and 8.5
MGD, so a 0.1 addition would not be significant.
In order for this area to connect to the City sewer, the Tribe would need to
construct approximately a quarter mile of City sewer main in South Palm Canyon
Drive, from its current terminus near Bogert Trail south to the City limit at Acanto,
in addition to the sewer on the property itself. The Tribe is not asking for any
changes to the current city sewer fee schedule.

OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AUTHORIZING THE EXTENSION OF SEWER
SERVICE TO THE SOUTH PALM CANYON PROPERTIES
LOCATED IN AN UNINCORPORATED AREA ADJACENT TO
AND OUTSIDE THE CITY LIMITS, SOUTH OF ACANTO DRIVE,
AND EAST OF THE SOUTHERLY EXTENSION OF SOUTH
PALM CANYON DRIVE
WHEREAS, the Municipal Code provides that sewer service may be extended to
properties outside the City limits; and
WHEREAS, the Tribal Planning Director, on behalf of the Tribe, has requested the City
consider authorizing sewer service to properties adjacent to and outside the City limits,
south of Acanto Drive; and
WHEREAS, the Tribal Planning Director reports that the maximum development
potential on this property is 400 equivalent dwelling units, a portion of which is proposed
to be tribal-owned development; and
WHEREAS, providing sanitary sewer to developable properties is of benefit, not only to
the proposed development, but environmentally to the City and its adjacent areas; and
WHEREAS, the area is not within the City's sewer master planned area, the proposed
amount of flow added to the treatment plant is not significant; and
WHEREAS, in order for this area to connect to the City sewer, the Tribe would need to
construct approximately a quarter mile of City sewer main in South Palm Canyon Drive,
from its current terminus near Bogert Trail south to the City limit at Acanto.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, that providing sewer service to the South Palm Canyon
properties located outside the City limits, south of Acanto Drive and east of the southerly
extension of S. Palm Canyon Drive is authorized, provided all fees as authorized by the
Municipal Code and Fee Resolution are paid, and further provided that any tribal-owned
development shall be charged the fee schedule applicable to development within City
limits.
