YEAGER CONSTRUCTION CO. RECOMMENDATION: That the City Council approve Construction Change Order No. 4 to E.L. Yeager Construction Co., for an increase of $45,150.54 for the East Palm Canyon/Gene Autry Trail Widening, City Project No. 92-36 SUMMARY: Balancing change orderforall bid items that went over and under contract quantities and providing 8 each, 36 in. box trees, to Summerset Springs complex. BACKGROUND: On May 17, 2000, City Council of the City of Palm Springs awarded E.L. Yeager Construction Co. "the contract for the E. Palm Canyon/Gene Autry Trail Widening project. All increased and decreased bid items were field measured by both the City Inspector and Contractor. Total quantities were agreed by both parties. For bid item 13, AC pavement (Type B), this increase was due to Caltrans. They required the pavement section to be 6 in. thick in lieu of 4 in. thick, per the plan. This pavement section change was only in the Caltrans right-of-way. The City proposes to provide the Summerset Springs complex with 8 African Sumac trees, 36 in. box, due to the major landscape changes between existing and proposed that resulted in open areas between the reduced parkway and the residences. The Association agrees to continue to maintain the irrigation and landscape from the property line along E. Palm Canyon to the new aligned curb, including the eight new trees. The Association will conform with the following conditions: (1) The contractor will deliver the 8 trees to the site where the Association will designate the unloading area for these trees. The Association will inspect the condition of these trees prior to unloading them. (2) The Association will unload the trees. (3) The Association will excavate and plant the trees, including any soil amendments they need to provide for each tree. (4) The Association will provide all the necessary irrigation for these trees. (5) The Association will maintain the new trees. (6) The City and the City's contractorwill be held harmless of any liability if these trees are damaged when they are unloaded and if any of the new trees die after they are planted. The City will not provide any maintenance on these new trees. Funds are available in Measure A Regional Share account number 4497-50174 (E. Palm Canyon/Gene autry Trail Widening). C. REASON FOR CHANGE: All increased and decreased bid items were field measured by both the City Inspector and the Contractor. Total quantities were agreed upon by both parties. For bid item 13 (AC Pavement (Type B),this increase was due to Caltrans. They required the pavement section to be 6 in. thick in lieu of 4 in. thick per plan. This pavement section change was only in the Caltrans R/W. ITEM N The City agreed to provide the Summerset Springs complex with 8 African Sumac trees, due to the major landscape changes between exising and proposed that left open areas. The City will provide these trees per the following conditions: 3 40450ft C.P.#92-36, EPC/GAT Widening Change Order No. 4 Page 3 of 3 1) The City delivers the 8 trees but the complex unloads the trees from the truck 2) The complex installs the trees, including trenching and adding soil amendments 3) The complex will provide irrigation for these trees 4) The City will be held harmless of any liability for any tree conditions that might occur 5) The City will not provide any maintenance period for these trees D.
