Subject: AWARD OF CONTRACT FOR THE VISTA CHINO (STATE HIGHWAY
111)/SUNRISE WAY STREET IMPROVEMENTS, CITY PROJECT NO.
06-06

SUMMARY
The Vista Chino (State Highway 111)/Sunrise Way Street Improvements, City Project
06-06, is a project being undertaken by the City on behalf of Vista Sunrise Apartments,
L.P., a partnership between McCormack Baron Salazar, Inc., and Desert AIDS Project.
The original project, Vista Sunrise Apartments (now the Rick Weiss Apartments) had
participation from the Desert Healthcare District, Riverside County and the Community
Redevelopment Agency in the development. Award of this contract will allow staff to
proceed with the planned widening of Vista Chino at Sunrise Way.
RECOMMENDATION:
1) Adopt Resolution No. , "A RESOLUTION OF THE COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF PALM SPRINGS APPROVING
AGREEMENT NO. IN THE AMOUNT OF $344,044.50 WITH DATELAND
CONSTRUCTION COMPANY, INC., FOR THE VISTA CHINO (STATE
HIGHWAY 111)/SUNRISE WAY STREET IMPROVEMENTS, CITY PROJECT
N0. 06-06;" and
2) Authorize the Executive Director to execute all necessary documents.
STAFF ANALYSIS:
On July 16, 2003, the City Council approved Case 5.0934, PD-281, ("Vista Sunrise
Project"), an application by McCormack Baron Salazar, Inc., for the construction of 85
transitional housing units and family care center on property owned jointly by the City of
Palm Springs, Desert Health Care District, and the Desert AIDS Project. The.original
project also included the development of Riverside County Department of Health's
Family Care Center, which is now under construction by Riverside County as a
Item RA1 .

separately entitled project. The apartment property is located west of the Desert AIDS
Project, located at the southwest corner of Vista Chino (State Highway 111) and
Sunrise Way.
Included with the City's approval of the original Vista Sunrise Project was the
requirement to widen Vista Chino (State Highway 111) to the full General Plan width for
a major thoroughfare, across the frontage of the property extending to Sunrise Way.
This widening would match the existing street width of Vista Chino adjacent to the Palm
Springs Marketplace (Stater Brothers) Shopping Center east of Sunrise Way, and
significantly improve traffic circulation at this major intersection. In addition, there were
traffic improvements along Sunrise Way. Both elements of the plan, the apartments
and the health care clinic, contributed traffic impacts to the site, therefore requiring the
improvements.
On May 18, 2005, the City Council and Community Redevelopment Agency approved a
Public Improvement Reimbursement Agreement between the City and the Housing
Authority of Riverside County, as well as an Implementation Agreement with Vista
Sunrise Apartments, L.P., to separate the required off-site street widening
improvements from other property transfer issues associated with the Disposition and
Development Agreement approved for the Vista Sunrise Project. Given that Riverside
County had determined to proceed separately with construction of its medical center,
the Reimbursement Agreement allowed the City to take on the responsibility of
constructing the project's required off-site improvements, with reimbursement of half of
the project cost, up to a maximum of$126,000, to be reimbursed to the Agency from the
County once the medical center has been constructed.
The original Implementation Agreement and subsequent DDA Amendments reserved
$125,000 of the original $1,300,000 Agency cash contribution toward the estimated
$250,000 cost of the offsite improvements, to be shared with the County of Riverside.
The design and entitlement costs for the off-site improvements have been charged to
this "hold back." The Agency agreed to bear the cost if the bids exceeded the original
estimated amount.
McCormack Baron Salazar, Inc., contracted with DMC Design Group, to prepare the
plans, specifications and estimates for the widening of Vista Chino (State Highway 111),
extending to Sunrise Way. The project includes street widening, and relocation of the
existing traffic signal at Sunrise Way. The plans have been reviewed and approved by
Caltrans, having jurisdiction over State Highway 111, and the City has received an
Encroachment Permit to proceed with the project.
On May 2, 2007, the City Council approved the plans and specifications and authorized
construction bidding. On May 8 and 15, the project was advertised for bids, and at 2:00
P.M. on June 6, 2007, the Procurement and Contracting Division received construction
bids from the following contractors:

The Engineer's Estimate was $300,000. The low bid was submitted by Dateland
Construction Company, Inc. The company is a California corporation, and its principal
officers are James Richert, President, and Judi Claytor, Secretary.
FISCAL IMPACT:
Funding for this project is available through Community Redevelopment Agency funds,
in account $82 8382-65146,

PALM SPRINGS APPROVING AGREEMENT NO.
IN THE AMOUNT OF $344,044.50 WITH
DATELAND CONSTRUCTION COMPANY, INC.,
FOR THE VISTA CHINO (STATE HIGHWAY
111)/SUNRISE WAY STREET IMPROVEMENTS,
CITY PROJECT NO. 06-06
WHEREAS, the Community Redevelopment Agency of the City of Palm Springs,
California, ("Agency"), is constituted under the Community Redevelopment Law
(California Health and Safety Code Section 33000 (et. seer.) to carry out the
purpose of redevelopment in the City of Palm Springs, ("City"); and
WHEREAS, pursuant to Section 33447 of the Community Redevelopment Law,
the Agency may finance the construction of public improvements that will
enhance the environment of residential neighborhoods containing housing for
persons and families of low or moderate income, including very low income
households; and that will be of benefit to the project area; and
WHEREAS, pursuant to Section 33447 of the Community Redevelopment Law,
public improvements eligible for financing including street improvements; and
WHEREAS, on July 16, 2003, the City Council approved Case 5.0934, PD-281,

THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF PALM
SPRINGS, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. Agreement No. , in the amount of $344,044.50 with Dateland
Construction Company, Inc., for the Vista Chino (State Highway 111)/Sunrise
Way Street Improvements, City Project No. 06-06, is hereby approved.
Section 2. The Executive Director of the Agency, and/or his designee, is
authorized to execute all necessary documents.
