Dear Sirs:
I am opposed to the conditional use permit for THE
WELL IN THE DESERT. My opposition is based on the
following:
1. SAFETY ISSUE;
a. EXCESSIVE TRAFFIC on a minor street
linking to Palm Canyon and the 10 Freeway.
This area has become a high density area with
new condo development already begun on
Indian Canyon and San Rafael plus a proposal
for additional condos on San Rafael and Puerta
del Sol. The existing San Rafael industrial
area has had an expansion of new industrial
building that further contributes to the
excessive traffic in this area. San Rafael Road
was not built to accommodate the added stress
of people corning to pick up their food at this
location.
i. NO ADEQUATE PARKING
AVAILABLE for the excessive traffic
created by vehicles congregating at this
location.

HIGH CRIME AREA already exists in this location.
Loitering, break-ins and trespass onto private property
could be accelereated_
SANITATION could be an issue of an already on-
going problem of the homeless camping on the empty
lots and using the bushes as a public restroom.
LITTERING is a problem in this area with beer cans,
food wrappers, trash thrown on the side of the road on
San Rafael and in the residential property on Santa
Catalina.
FIRE is a concern with people smoking in these areas
and throwing cigarettes in the bushes along the south
side of San Rafael.
PROPERTY VALUES would deteriorate if this
problem is allowed to develop.
BURDEN TO THE POLICE. More police
surveillance would be needed to make the area safe.
I am sensitive to the needs of the needy. I have
provided legal assistance , helped them obtain shelter,
clothing, food and jobs and have represented many of
them in court hearings for additional governmental
help. 202 San Rafael Road is not the proper location
to establish this needed assistance.

In response to a couple of questions I've received, staff contacted the local office of the County of Riverside
Department of Environmental Health about any County Health permits required for the food distribution facility.
They reported that there is a case opened on the Well's proposal, however, the case worker was not available
and there is no specific status they could report today. Nevertheless, it does appear that the Well's application
will be evaluated by the County, and if they determine that it falls under their jurisdiction they will regulate it
accordingly. I hope this information is helpful.

RE: Well in the Desert proposal near our property at 400 E San Rafael Rd. (Case 0.2826-MAJ)
Dear City of Palm Springs Council Members and Plamung Dept:
We were very alarmed to learn From a neighboring business on E. San Rafael Road that the City is considering
allowing the non-profit organization, 'GVell in the Desert"to establish a "feed the homeless"operation in close
proximity to our approved development site at the above-captioned address-
We did not receive a notice about a public hearing on this proposed use.
Upon completing a lengthy and costly process, we received approval from the Planning Commission in March, 2007 to
build a 53-unit business park on our 6.5 acre parcel. We have been diligently moving forward with this major
development project. It will provide jobs and additional tax revenue to the City of Palm Springs, and enhance the North
Palm Springs neighborhood.
This letter stands as formal notice to all relevant City departments that while we support the efforts of helping
disadvantaged populations, we do not support the establishment of this non-profit enterprise near our property for
reasons of safety, trash, and the potential for crime that accompanies the transient population that seeks such services-
Although these types of enterprises provide a valuable service to disadvantaged populations, experience has also
shown they attract crowds that come early and linger long after they have been fed. Often they engage in illicit
activity, panhandle, drink, urinate, sleep, etc. in public view, and pose an uncom£ortable, threatening presence to
neighbors.
We have already witnessed a great amount of suspicious (drug?) activity at the adjacent parcel, "Manna Ole's Soul
Food", over the past year. The addition of this feed-the-homeless program will only increase the questionable traffic at
this property.
This type of activity near our site will negatively impact the value oFproperty in the area, the desirability among

potential buyers to purchase our industrial condo units, and the level of security among everyone in this newly-
emerging business and residential community.
We are baffled that,throughout our many conversations with Planning Dept. employees and the Board approval, no
mention was ever made to us of this proposed use near our site which clearly impacts the viability of our project.
As impending members of the Palm Springs business community, we look forward to being active financial supporters
of many charitable causes—including programs that feed indigent populations—but we do not support the installation
of such services within shouting distance of our recently approved business development site.

Dear Mr. Ewing:
1 am writing this letter on behalf of the Azul at Palm Springs Homeowners Association,
to oppose the conditional use permit under discussion for the Well in the Desert to
relocate to 202 San:ILafael.
We are a small development of four homes on the corner of Indian and San Carlos built
in 7004. All of us purchased our homes here as opposed to other neighborhoods in the
City because of the uniqueness of the area. Indeed, when my partner and myself first
began looking for a home in Palm Spriggs some six years ago, we saw much potential for
the neighborhood. The old Alexanders on the other side of Indian were beginniag to be
rediscovered and restored. The 7 famous Wexler steel frame houses were getting
attention and being refurbished. h1 the three short years since we've located to this
neighborhood we have seen a genuine rebirth in the area.We've had new,quality
developments such as Palermo, The Towers,43 c@Racquet Club, and a little further down
the street,Murano. W e have the old mini-estates and old Spanish style homes being
restored and rebuilt alongside the newer modern style homes such as outs. The Racquet
Club itself is being redeveloped and the historic Bamboo room restored. The entire area
is undergoing a revitalization that stands to be derailed if this conditional use permit is
granted.
We all applaud the noble cause that the Well in the Desert serves. We have the utmost
compassion,for their clients. However,the location does not appear well thought out to
benefit either the clients of the Well in the Desert or the neighborhood it will be located
in.
It is difficult to believe the Staff report was authored by anyone familiar with San Rafael
Road. San Rafael is a small two lane street with no curbs or sidewalks and building with
little setback from the street. With the new development in the area the traffic has

increased dramatically. With the addition of Palermo, Murano and the planned expansion
of Four Seasons down on Sunrise,traffic will continue to increase and create an extreme
danger to both the clients walking to the Well as well as the vehicular traffic, As soon as
someone is maimed or killed the City will be the first to be sued.
Aside from the traffic safety issue there is the inevitable issue of neighborhood safety and
appearance.While we are told the clients are families in need, our understanding is that
food is also distributed to transient people, some of whom have severe mental problems
and difficulty functioning in a rational manner. I note from the Commission report there
is a recommendation to require the site be locked and secured when not in use and
loitering prohibited, Where do you think the loiterers will go if they are run offsite? I can
hazard a guess it will be tho vacant lot behind out homes, the stretch of our property on
Indian or perhaps even in our back yards. Where will the homeless consume their meals7
Again, my guess would be in the vacant lots behind our homes or in our yards. Where
will the refuse wind up?Again,behind our homes our in our yards.
The final concern is that there is absolutely nothing in the Plant-ling Commission report
that addresses the effect this will have on our neighborhood or proposes any conditions
that would alleviate our fears. A few blocks down from us we have a family shelter.
Another block over is a drug rehab house. This isn't an issue of`hot in our backyard"but
an issue of"not everything in our backyard'. While we believe in the importance and
legitimacy of these social service organizations, do not kill the rebirth of our
neighborhood by locating in our neighborhood every social agency that other areas
refuse, Indeed,I can't believe your recommendation would be the same should this
conditional use permit be requested for Las Palmas or even Aeepwell.

1) we have enough problems with some of the activities in Desert Highlands,and
adding this element will simply multiply those problems creating more issues for the
neighborhood and the law enforcement agencies already dealing with them
2) the entire neighborhood is being redeveloped with such developments as Murano,
Palermo, Avalon, Racquet Ciub,Riviera,eta and allowing the operation of a thrift
shop and food distribution center will bave a negative impact on the current residents
along with the future residents the developers are looking to invest in some very nice
new communities
3) developers who have not broken ground may be tinned off by having this operation
in such a high pmfile location which means the current momentum fur
redevelopment may be thwarted with some developers walking away
4) the north end location is not centrally located for the economically challenged
families to pick up their supplies, which could mean walking long distances to pick
up the food-
I know the Well in the Desert provides some wonderful l services,but there must he a more
appmpriate location for this facility that would better serve their clientele and not be a step
backwards for a neighborhood that will be rapidly increasing its contributions to the tax base of
the City of palm Springs through its redevelopment efforts in the near future-
Please do not allow this facility to relocate;to West San Rafael Road.

I am responding to the notice of public planning commission slated for June
13.
I am the executor and possibly new owner of property located a 202 W
Santa Catalina in Pahn Springs adjacent to property where the Well in the
Desert Lease is being considered.
I wish to voice my objection to this use of that property. It is an area where
upscale homes are being developed and which has been subject to property
invasions and breakins. Use of the adjoining property as homeless use
including using property as a bathroom and dumping ground for
miscellaneous trash.
Limited parking is available due narrow streets and much parking is being
done on private property adjoining the street_
The area is zoned for single family private homes and further use of
businesses of any type is an invasion of private property and will result in
decreasing the property value of any existing structures as well as any
additional building in the future_

SUMMARY
Well in the Desert, lessee, has requested a Conditional Use Permit (Type II), to operate
an institution of philanthropic or charitable nature. The use would be operated by Well
in the Desert which would distribute food baskets to economically challenged families
on Saturdays only between 7:00 A.M. to 10:30 A.M. The proposed location is an
existing 1,125 square foot tenant space within a multi-tenant commercial / industrial
building located at 202 San Rafael Drive Drive.
RECOMMENDATION:
1. Open the public hearing and receive public testimony.
2. Staff will report the Planning Commission recommendation following their public
hearing of June 13, 2007.
PRIOR ACTIONS:
On June 13, 2007, the Planning Commission will be reviewing the project prior to the
City Council meeting.
STAFF ANALYSIS:
The applicant has proposed a food distribution center to the economically challenged
families at 202 San Rafael Drive. Pursuant to Section 94.02.00(A)(2)(j) of the Palm
Springs Zoning Code (PSZC), institutions of a philanthropic or charitable nature require
a Type II Conditional Use Permit and are permitted with the necessary findings.

A notice was mailed to all property owners within four hundred feet of the subject site as

BACKGROUND:
The Well in the Desert has been occupying a temporary location at 181 North Indian
Canyon Drive for approximately one year and now wishes to relocate to an existing
mixed-use complex located on San Rafael Drive. The project will occupy approximately
1,125 square feet and will be located in unit#202-F.
Table 1: The surrounding Land Uses are tabled below:

ANALYSIS:
The General Plan designation of the subject site is IND (Industrial). Objective 3.30.6 of
the IND designation states, "allow for the development of storage, distribution,
assembly, service commercial and research and office facilities." The proposed use is
the distribution of food baskets to economically challenged families.
The site is located within the M-1 zone. Pursuant to Section 94.02.00(A)(2)0) of the
Palm Springs Zoning Code (PSZC), institutions of a philanthropic or charitable nature
are allowed in any zone except where expressly prohibited. Pursuant to Section
92.17.03 of the PSZC, this use is not prohibited within the M-1 zone.
The subject location is within a mixed-use commercial industrial building and the
applicant has reported that the center has approximately 33,000 square feet overall.
The tenant space to be used by the Well in the Desert is approximately 1,125 square
feet or twenty-eight feet by forty feet. Currently, there is a vacant unit to the west and a
metal welding and polishing business occupying the unit to the east.
The site consists of two rectangular-shaped buildings that are parallel with San Rafael
Drive. There is pedestrian and vehicular access to the rear of the site by two driveways,
one in the center and the other at the eastern end of the site. There is no sidewalk
between San Rafael Drive and the existing buildings. There is paving between the
buildings and San Rafael Drive which is not part of the street and appears to be used as

Pursuant to Section 94.02.00(B)(6)(e) of the PSZC, the proposed use gives the
Planning Commission the opportunity to impose conditions and minor site modifications
which are deemed necessary to protect the public health, safety and general welfare.
The proposed use and other current and future uses may pose safety concerns for

pedestrian access to the front entrances of the buildings. Parking in these areas may
have to be adjusted for a pedestrian access path along the front of the building.
The proposed center should have approximately one parking space for each five
hundred square feet of floor area for manufacturing and industrial uses pursuant to
Section 93.06.00(D)(17) of the PSZC. With this calculation, the center should have a
total of sixty-six parking stalls, including three handicap parking stalls. Staff has
recommended Condition of Approval No. 1, which requires the owner to submit a
parking plan that will bring the parking areas (including pedestrian access) within or
near conformance as determined by the Director of Planning and re-stripe all parking
areas. Pursuant to Section 93.06.00(3)(a) regarding non-conforming parking lots, the
center was parking compliant at the time of its establishment, and therefore, the existing
number of parking spaces provided is sufficient. Staff determines that the existing
number of parking spaces is sufficient for the use as it does not represent an
intensification of use and the location will be operable to the public for three and one-
half hours on Saturday mornings only.
REQUIRED FINDINGS:
The Conditional Use Permit process outlined in Section 94.02.00 of the Zoning Code
requires the Planning Commission to make a number of findings for approval of the
permit. Those findings are analyzed by staff in order below:
1) That the use applied for at the location set forth in the application is properly one
for which a conditional use permit is authorized by this Zoning Code.
Pursuant to Section 94.02.00(A)(2)(f) of the Palm Springs zoning Ordinance, an
institution of charitable nature is authorized within the CBD zone with the

Objective 3.30.6 of the IND designation states, "allow for the development of
storage, distribution, assembly, service commercial and research and office
facilities." The proposed use is the distribution of food baskets. It is necessary
for the community because it serves economically challenged families and may
help prevent homelessness.
3) That the site for the intended use is adequate in size and shape to accommodate
such use, including yards, setbacks, walls or fences, landscaping, and other

The project does not propose any exterior changes to the site. However, the

CONCLUSION:
The proposed project is consistent with the use on the site and is compatible with the
General Plan and Zoning Ordinance land uses. Staff recommends the required findings
necessary for the issuance of a Conditional Use Permit and is therefore recommending

WHEREAS, Well in the Desert ("Applicant") has filed an application with the City

WHEREAS, notice of public hearing of the Planning Commission of the City of Palm
Springs to consider Case No. 5.1157 — CUP was given in accordance with applicable

WHEREAS, on June 13, 2007, a public hearing on the Conditional Use Permit No.
5.1157 application was held by the Planning Commission in accordance with applicable
law; and
WHEREAS, the proposed project is considered a "project' pursuant to the terms of the
California Environmental Quality Act ("CEQA"), and has been determined to be
Categorically Exempt as a Class 1 exemption (Existing Facilities) pursuant to Section
15301 of the CEQA Guidelines; and
WHEREAS, the Planning Commission has carefully reviewed and considered all of the
evidence presented in connection with the hearing on the project, including, but not
limited to, the staff report, and all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to the requirements of Section 94.02.00(13)(6), the Planning
Commission finds:
1) That the use applied for at the location set forth in the application is properly one
for which a conditional use permit is authorized by this Zoning Code.

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to
the satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the
Fire Chief or their designee, depending on which department recommended the
condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
PROJECT SPECIFIC CONDITIONS:
1. The owner shall submit a parking plan to the Department of Planning Services
that will bring the parking lot within or near conformance as determined by the
Director of Planning.
2. The owner shall be required to re-stripe all parking areas within thirty days of
occupancy as required by Condition of Approval No. 1 .
PLANNING DEPARTMENT:
3. The proposed development of the premises shall conform to all applicable
regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other
City Codes, ordinances and resolutions which supplement the zoning district
regulations.
3a. The owner shall defend, indemnify, and hold harmless the City of Palm Springs,
its agents, officers, and employees from any claim, action, or proceeding against
the City of Palm Springs or its agents, officers or employees to attach, set aside,
void or annul, an approval of the City of Palm Springs, its legislative body,
advisory agencies, or administrative officers concerning Case 5.1157 — CUP.
The City of Palm Springs will promptly notify the applicant of any such claim,
action, or proceeding against the City of Palm Springs and the applicant will
either undertake defense of the matter and pay the City's associated legal costs
or will advance funds to pay for defense of the matter by the City Attorney. If the

City of Palm Springs fails to promptly notify the applicant of any such claim,
action or proceeding or fails to cooperate fully in the defense, the applicant shall
not, thereafter, be responsible to defend, indemnify, or hold harmless the City of
Palm Springs. Notwithstanding the foregoing, the City retains the right to settle
or abandon the matter without the applicant's consent but should it do so, the
City shall waive further indemnification hereunder, except, the City's decision to
settle or abandon a matter following an adverse judgment or failure to appeal,
shall not cause a waiver of the indemnification rights herein.
4. Non-compliance with any of the conditions of this approval, or with City codes
and ordinances, State laws; any valid citizen complaints or policing and safety
problems (not limited to excessive alcohol consumption, noise, disturbances,
signs, etc) regarding the operation of the establishment; as determined by the
Chief of Police or the Director of Planning and Building, may result in
commencement of proceedings to revoke the Conditional Use Permit pursuant to
Section 9402.001 of the Zoning Ordinance. In addition, violations of City Codes
and Ordinances will result in enforcement actions which may include citations,
arrest, temporary business closure, or revocation of this permit in accordance
with law.
5. Commencement of the Conditional Use Permit approval shall be valid for a period
of two (2) years. Extensions of time may be granted by the Planning Commission
upon demonstration of good cause.
6. The appeal period for a Conditional Use Permit application is 15 calendar days
from the date of project approval. Permits will not be issued until the appeal period
has concluded.
7. Separate architectural approval and permits shall be required for all signs.
8. The street address numbering/lettering shall not exceed eight inches in height.
9. No sirens, outside paging, music speaker system or any type of signalization will be
permitted, except approved alarm systems.
10. No outside storage of any kind shall be permitted except as approved as a part of
the proposed plan.
11. This use shall comply with the provisions of Section 11.74 Noise Ordinance of
the Palm Springs Municipal Code. Violations may result in revocation of this
Conditional Use Permit.
12. The applicant shall be required to maintain the opening hours as stated on the
Conditional Use Permit application. Hours of operation will be from 7:00

a.m. to 10:30 a.m. on Saturdays only. Any future modifications to the hours of
operation shall require prior approval by the Planning Commission and the City
reserves the right to modify or restrict the business hours based upon
documented operational circumstances.
13. The applicant/owner shall notify the Director of Planning and Building in writing
30 days in advance of any changes in the operation of business. Any
transference of this Conditional Use Permit upon change of ownership is subject
to review and approval by the City.
14. The owner and/or tenant shall monitor outdoor parking areas, walkways, and
adjoining properties and shall take all necessary measures to ensure that
customers do not loiter, create noise, litter, or cause any disturbances while on-
site. The owner and operator shall ensure that at closing time all customers
leave the property promptly and that the property is clean and secure before the
owner/operator leaves the premises. The Police Chief, based upon complaints
and/or other cause, may require on-site security officers to ensure compliance
with all City State, and Federal laws and conditions of approval. Failure to
comply with these conditions may result in revocation of this permit, temporary
business closure or criminal prosecution.
15. The applicant will provide all buyers with a copy of this Conditional Use Permit.

16. The applicant will comply with all requirements of the Palm Springs Fire
Department.
BUILDING
17. The applicant will obtain permits for all construction involved with the site.
