This letter is notice to you that the public hearing on your appeal in the above matter
has been scheduled for the City Council meeting of Wednesday, June 13, 2007. The
meeting will be held beginning at 6 p.m. in the Council Chambers of City Hall, 3200 E.
Tahquitz Canyon Way. A staff report on the matter will be forwarded to you
approximately five (5) days prior to the hearing.
It is the City Council's policy to allow comments by an appellant not to exceed 10
minutes. Please plan your presentation accordingly. Please also advise the City Clerk
or myself if you intend to use any electronic media in your presentation (PowerPoint, for
example). Such programs must be provided to the City on a CD no later than the Friday
prior to the scheduled hearing.

David Barakian, City Engineer, provided background information as outlined in
the staff report dated June 15, 2005.
The City Council discussed and/or commented on the following issues and
concerns regarding the traffic calming measures: interested parties awareness of
the cost and their willingness to fund the measures, the fact that property owners
willing to fund the measures are behind in their development and the potential
delays before these measures are approved and implemented, the private street
that was vacated and the portion of the private street that would need property
owner consent prior to proceeding with a final plan, requested clarification on the
requested action "in-concept" only.

NOTICE 13 HEREBY GIVEN that the Planning Commission of the City of Palm Springs, California, will
hold a public hearing at its meeting of February 8, 2006. The Planning Commission meeting begins at
1.30 p.m. in the Council Chamber at City Hall, 3200 East Tahquitz Canyon Way, Palm Springs.
The purpose of the hearing is to consider an application by Pacifica Colony Palms, LLC for a Conditional
Use Permit to reconstruct a pre-existing one-story building with partial basement which will house a
restaurant and spa in conjunction with the Colony Palms Hotel located at 572 North Indian Canyon Drive,
Zone R3,Section 11.
ENVIRONMENTAL DETERMINATION: A Mitigated Negative Declaration of environmental impact was
previously approved by the Planning Commission on March 9, 2005, in conjunction with the approval for
the remodel of the Colony Palms Hotel, and adequately addresses all known environmental impacts.
Pursuant to Section 15162 of the California Environmental Quality Act (CEQA), the preparation of a
Subsequent Negative Declaration, Addendum Negative Declaration, or further documentation is not
necessary because the changed_ circumstances of the project will not result in any new significant
environmental effects or a substantial increase in the severity of previously identified significant effects.
These changes could not result in any new environmental impacts beyond those already assessed in the
adopted Mitigated Negative Declaration.
REVIEW OF PROJECT INFORMATION:The proposed application, site plan and related documents are
available for public review at City Hall between the hours of 8:00 a.m. and 5.00 p.m. Monday through

PROJECT DESCRIPTION
An application by Pacifica Colony Palms LLC for a Conditional Use Permit to
reconstruct a pre-existing one-story building with partial basement to house a 75-seat
restaurant and accessory use spa in conjunction with the Colony Palms Hotel located at
572 North Indian Canyon Drive, Zone R-3, Section 11.
RECOMMENDATION
That the Planning Commission approve a Conditional Use Permit for a 75-seat
restaurant and accessory use spa at 572 North Indian Canyon Drive.
PRIOR ACTIONS TAKEN ON THE PROJECT
On November 9, 2004, the Historic Site Preservation Board voted 6-0 (1 absent) to
approve the architectural plans for the remodel, in concept, and addition of 13 rooms for
the Colony Palms Hotel.

On March 9, 2005, the Plal)pin missio ed 6-0 (1 absent) to approve a the
renovation of om hotel casitas restaurant, spa and construction of
an addition 13 hotel rooms.
On August 5, 2005, building permits were issued for the rehabilitation work at the
Colony Palms Hotel.
On September 21, 2005, staff Issued a stop work order for the property after it was
discovered that demolition of structures on the property had proceeded beyond the
scope of the approved plans. The north wing of Building 1 had been completely
demolished and the restaurant/spa building (Building 2) had also been demolished. The
approved plans showed that the first floor of the north wing of Building 1 was to be
preserved while a second story was added to the building. However, the applicant
indicated that in the process of securing the foundation of the north wing, structural
damage occurred that required the demolition of the building. The applicant provided
no explanation for the demolition of Building. 2,the subject of this application.
BACKGROUND AND SETTING
The subject property is approximately 2.2 acres and is surrounded by streets on all
sides. The restaurant/spa is located in Building 2 on the east side of the courtyard.
Construction of the other buildings on the western and southern portions of the site, not
affected by the demolitions, has been allowed to continue. The applicant is submitting
the application for a Conditional Use Permit in order to reinstate the restaurant/spa use r
in Building 2. The restaurant and spa lost its non-conforming status after the demolition
of Building 2, leaving only the basemen . e applicant proposes to reconstruct
resta ved architectural plans.

General Plan Consistency
The project site has a General Plan designation of H 43/21 (High Density Residential)
which allows, "Hotels and similar types of resort housing...with a threshold of 30 and a
maximum of 43 dwelling units/acre." The proposed project is consistent with this

objective because it proposes a restaurant and spa use that is integrated with the
Colony Palms Hotel. The hotel was approved with a density of approximately 26
units/acre. Therefore, the project is consistent with the objectives of the General Plan.
Zoning Consistency
The Conditional Use Permit is required for a restaurant/spa pursuant to Section
92.04.01 of the zoning ordinance. The CUP is required for, "Restaurants provided they
are an integral part of a hotel which contains from thirty-three te

In addition to the parking spaces provided on-site, the applicant has a
five year lease agreement with the property to the south for 30 parking
spaces for the hours of 5:00 P.M. to 5:00 A.M., seven days a week.
These 30 off-site spaces are intended for the use of the restaurant_ The
lease agreement results in a total of 95 provided parking spaces for the
project.
REQUIRED FINDINGS
The Planning Commission must make certain findings in order to approve this
Conditional Use Permit pursuant to Section 94.02.00 of the zoning ordinance. Those
findings are analyzed by staff as follows:
1. That the use applied for at the location set forth in the application is properly one
for which a conditional use permit is authorized by this Zoning Code.
The R-3 zone authorizes restaurants that are an integral part of a hotel with 33 to
99 guest rooms and spas as an accessory use to a hotel subject to the approval
of a Conditional Use Permit. The Colony Palms Hotel will have 58 rooms and is
located on North Indian Canyon Drive, a major thoroughfare. Therefore, the
proposed project meets the zoning standards to qualify for a Conditional Use
Permit for a restaurant and accessory use spa.
2. That the use is necessary or desirable for the development of the community, is
in harmony with the various elements of objectives of the general plan, and is in
harmony with the various elements or objectives of the general plan, and is not
detrimental to existing uses or to future uses specifically permitted in the zone in
which the proposed use is to be located.
The project site has a General Plan designation of H 43/21 (High Density

such use, including yards, setbacks, walls or fences, landscaping, and other
features required in order to adjust such use to those existing or permitted future
uses of land in the neighborhood-

The proposed restaurant and spa will be re-constructed in the same location as
the pre-existing Building 2. The reconstructed Building 2 will comply with the
development standards of the R-3 zone with respect to parking, building height,
and setbacks. Therefore, the site is adequate in size and shape to
accommodate the proposed spa.
4. That the site for the proposed use relates to streets and highways properly
designed and improved to carry the type and quantity of traffic to be generated
by the proposed use.
The subject property is surrounded by streets on all sides with Indian Canyon
Drive to the west, Granvia Valmonte to the north, Via Chica to the east, and the
vacated Via Colusa to the south. Indian Canyon Drive is classified as a major
thoroughfare while all other streets are classified as local streets on the General
Plan Circulation Map. The traffic anticipated to be generated by the restaurant
and spa is not anticipated to exceed the capacity of the surrounded streets. In
addition, the project is participating in a street calmin rp ram that has b
proposed for the area that encompasses the propose project. There ore, it is not
exp sec-that the restaurant and spa use will generate enough additional trips to
constitute a significant impact to traffic.
5. That the conditions to be imposed and shown on the approved site plan are
deemed necessary to protect the public health, safety and general welfare and
may include minor modification of the zone's property development standards.
The proposed project is a reconstruction of a pre-existing structure and use.
Since the architecture of the building has already been previously approved,
conditions of approval are recommended by staff in order to regulate the
operation of the restaurant and spa. These are generally standard conditions of
approval that are intended to minimize impacts that the restaurant and spa may
have on the surrounding neighbourhood.
ENVIRONMENTAL ASSESSMENT
A Mitigated Negative Declaration of environmental impact was previously adopted by
the Planning Commission on October 14, 2003, in conjunction with the approval for the
remodel of the Colony Palms Hotel and addition of 13 hotel rooms, and adequately
addresses all known environmental impacts.
Due to the demolition of Buildings 1 and 2, an addendum to the historical assessment of
the property was prepared because the north wing of Building 1 was identified as an
important feature of the property. The north wing of Building 1 will be rebuilt per the
previously approved elevations. The addendum found that the reconstruction of the 15t
floor of the north wing along with the 2"d story addition would not constitute a substantial

adverse impact to the architectural character of the hotel complex and would help the
property return to its original historic use as a hotel.
Pursuant to Section 15162 of the California Environmental Quality Act (CEQA)
Guidelines, the preparation of a Subsequent Negative Declaration, Addendum Negative
Declaration, or further documentation is not necessary because the changed
circumstances of the project will not result in any new significant environmental effects
or a substantial increase in the severity of previously identified significant effects. These
changes could not result in any new environmental impacts beyond those already
assessed in the adopted mitigated negative declaration.
NOTIFICATION
A public hearing notice was mailed to all property owners within 400 feet of the project
and published in The Desert Sun. As of the writing of this report, staff has not received
any comment.
CONCLUSION
The project is consistent with the goals and policies of the General Plan and zoning
ordinance. With the recommended conditions of approval, the project would comply
with the land use and development requirements of the city and on this basis, staff is
recommending approval of this Conditional Use Permit.

► The issue that approval of the plan was an abuse of
discretion , inappropriate, and in violation of the
relevant provisions of the Palm Springs Municipal Code
93 .06 .00 was raised on April 10, 2007
► Mr. Ohren was instructed to request in a letter to
Edward Robertson , Principal Planner relief from one of
the requirements of section 93 .06 .00 on April 125 2007

Genesis of the appeal to the Planning
Commission
(6) inch PCC vertical curbs may be installed in lieu of curb and gutters if no drainage
is carried along curb line. Where a six (6) inch PCC vertical curb is used, a two (2) foot
wide concrete gutter section shall be installed along drainage lines. Individual
wheelstops shall be prohibited unless approved by the director of planning and
building.
13. Concrete walks with a minimum width of two (2) feet shall be
installed adjacent to end parking spaces or end spaces may be increased to eleven
(11 ) feet wide.
14. Curb radii shall be three (3) feet minimum.
15. One-way drives shall be fourteen (14) feet minimum wide. Two-way

SUMMARY
The appellant, Ken Levin, has appealed a decision by the Planning Commission to
allow a relief from the requirements of Section 93.06.00(E)(4) of the Palm Springs
Zoning Code. This section states that "Curbs shall be installed at a minimum of five (5)
feet from the face of walls, fences, buildings or other structures". The Commission's
action authorized a reduction of the 5-foot separation to 2.5 feet at the Colony Palms
Hotel at 572 North Indian Canyon Drive. A public hearing is required.
RECOMMENDATION
1. Open the Public Hearing and receive any testimony.

On May 9, 2007, the Planning Commission considered an appeal by Ken Levin, MD to
overturn a decision by the Director of Planning Services to allow relief from the
requirements of Section 93.06.00(E)(4) of the Palm Springs Zoning Code for the Colony

Palms Hotel. This section states that "Curbs shall be installed at a minimum of five (5)
feet from the face of walls, fences, buildings or other structures". (On April 13, 2007,
the Planning Department approved a request by the Colony Palms Hotel to allow curb
separation of 2.5 feet from the face of screening walls along Via Colusa.)
At the May 9th meeting, the Commission considered the request and upheld the
decision of the Director of Planning Services (denied the appeal) to reduce the required
5-foot separation from the screening walls to 2.5 feet. Attached to this report is the
Commission's resolution and the appeal letter from Ken Levin, MD dated May 23, 2007.
Background information is provided in the Planning Commission staff report (attached).
In Dr. Levin's appeal letter of May 23, 2007, he asserts that, "...the City's approval of
said parking and curb plan is an abuse of discretion, inappropriate, and in violation of
the relevant provisions of the Palm Springs Municipal Cade, including without limitation,
Zoning Code Section 93.06.00." No evidence has been provided to support this claim.
Staff believes that the relief granted to the Colony Palms Hotel is not an abuse of
discretion, but is specifically allowed by Section 93,06.00(E) of the Zoning Code which
states..."in event of practical difficulties and hardships result from the strict enforcement
of the above standards due to existing permanent buildings, or an irregular shaped
parcel, administrative relief may be granted by the director of planning and building
according to Section 93.06.00(B)(10) and Section 94,06.01 (Minor Modifications).
The separation is from parking curbs to screening walls which provide privacy barriers
to the occupants of the existing buildings of the hotel. The parking lot is located closer
to the hotel as a result of a court ruling involving the hotel and Dr. Levin. Staff and
Commission have determined that the existing buildings are the basis for a finding of
practical difficulties and hardships; that is, strict enforcement of the 5 foot requirement
would eliminate the hotel's screening walls or eliminate the required parking.

WHEREAS, on April 13, 2007, the Director of Planning Services granted relief to the

WHEREAS, on April 20, 2007 Ken Levin of 544 N. Indian Canyon Drive, filed an appeal

and
WHEREAS, on May 9, 2007, the Planning Commission, following a public review of the
appeal request, including all of the evidence presented in connection with the matter,
including, but not limited to, the staff report prepared on the matter, and all written and
oral testimony presented, adopted Resolution No. 6096, denying the appeal and
upholding the decision of the Director of Planning Services, and
WHEREAS, on May 23, 2007 Ken Levin of 544 N. Indian Canyon Drive, filed an appeal
of Planning Commission's May 9, 2007 decision in the matter; and
WHEREAS, on June 13, 2007 the City Council conducted a public hearing on the
appeal by Ken Levin, at which hearing the Council reviewed all of the evidence
presented in connection with the matter, including, but not limited to, the staff report and
exhibits prepared on the matter, and all written and oral testimony presented.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That the decision by the Planning Commission to uphold the decision of
the Director of Planning Services to allow the Colony Palms Hotel at 572 N. Indian
Canyon Drive to reduce the distance between parking curbs and adjacent walls to less
than the required minimum five feet separation of Section 93.06.00(E)(4) meets the
requirements of Palm Springs Zoning Code Section 93.06.00(E) and 93.06.00(B)(10)
for relief from parking standards because-
1. Strict enforcement of the five-foot separation would cause a practical
difficulty in that it would either reduce the size of the parking spaces to an
unacceptably shallow depth or require removal of the privacy walls
surrounding the existing hotel building.
2. Requiring the full five foot separation would result in a hardship to the
property owner and would deprive the property owner of privileges allowed

to others in the zone, namely, the loss of required parking or the loss of
privacy and security for occupants of the building.
3. That special circumstances exist to justify the reduction; namely the
location of the existing buildings near the property lines along Via Colusa
and the proximity of appropriate privacy walls to the parking area.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning
Commission hereby rejects the appeal and upholds the decision of the Planning
Commission to allow the Colony Palms Hotel at 572 N. Indian a reduction from 5 to 2.5
feet the separation between the parking curbs and the adjacent walls along Via Colusa.

OTHER BUSINESS:
q, Case 5,1093 CUP — An appeal by Ken Levin of a decision by the Director of
Planning Services for the parking and curb plan approved on April 13, 2007, for
the Colony Palms Hotel located at 572 North Indian Canyon Way.
Recommendation: To deny, and uphold the decision of the Director of Planning
Services
Craig A. Ewing, Director of Planning Services, provided background information as
outlined in the staff report dated May 9, 2007. He stated staff granted the reduction to
accommodate the relocation of the parking spaces as a consequence of a court order
reducing the five foot separation to 2 1/2 feet.
Commissioner Hutcheson requested the owner of Colony Palms address any impact
which may be caused as a result of a delay to allow the-appellant more time. Steven
Ohren stated they are working hard at completing the balance of work to open the
hotel. He stated the, area in question is small section consisting of only about six
parking spaces. He-requested this item be heard today since he cancelled a trip to New
York to be present.
Further discussion was made pertaining to buildings under construction and the delays
due pending an exact count of parking spaces.

which states that "Curbs shall be installed at a minimum of five (5) feet from the face of
walls, fences, buildings or other structures", On April 13, 2007, the Planning Department
approved a request by the Colony Palms Hotel to allow curb separation of 2.5 feet from
the face of screening walls along Via Colusa. The property in question is the Colony
Palms Hotel located at 572 N. Indian Canyon Drive.
Mr. Levin is a resident of the Heavenstone Development located to the immediate south
of the subject site, addressed at 544 N. Indian Canyon Drive. The Colony Palms Hotel
and the Heavenstone Development share a common private road; Via Colusa; the
parking area and the walls are located along the northerly side of Via Colusa.

According to Mr. Levin's letter dated April 20, 2007 (attached), staffs decision to
approve a relief to the Colony Palms Hotel from the Zoning Code's requirement was
"without merit and not a valid conclusion."
BACKGROUND:
On March 9, 2005, the Planning Commission approved Case No. 5.1093-CUP for the
remodeling and operation of the Colony Palms Hotel. The original site plan included
parking spaces, screening walls and landscaping along Via Colusa- The site plan also
showed that a portion of the private road which is approximately 25 feet wide,
designated as Lettered Lot E will be vacated to accommodate the installation of
designated parking along Via Colusa.
On March 22, 2007, a revised site plan was submitted to the Engineering Department;
according to Steven Ohren of the Colony Palms Hotel, the revision was required by a
decision rendered by the Superior Court of California (attached as Exhibit 4) in the case
of The Heavenstone Collections Homeowners Association, plaintiff, versus The Pacifica
Colony Palms, defendants. According to the information provided by the Colony Palms
to the City, the Superior Court made a ruling in favor of the plaintiffs requiring the
Colony Palms to move the curbs and parking ten (10) feet away from the original
location.
On April 12, 2007, Steven Ohren of the Colony Palms formally requested for a relief
from the five feet separation requirement due to the reasons stated above.
ANALYSIS
In analyzing this request staff considered the applicable Zoning Code parking
standards. Section 93.06.00(E)(4) of the Palm Springs Zoning Code states that "Curbs
shall be installed at a minimum of five (5) feet from the face of walls, fences, buildings or
other structures. This requirement excepts driveways that are not a part of the
maneuvering are for parking"
Relief from this standard may be allowed by Section 93.06.00(E) which states..."/n
event of practical difficulties and hardships result from the strict enforcement of the
above standards due to existing permanent buildings, or an irregular shaped parcel,
administrative relief may be granted by the director of planning and building according
to Section 93.06.00(B)(10) and Section 94,06-01 (Minor Modifications).
Section 93.06.00(B)(10) states: The director of planning and building may grant a
reduction of width of required parking spaces by not more than six (6) inches and
modification of other design standards subject to the finding that special circumstances
would deprive the subject property of privileges enjoyed by other properties in the
vicinity. Administrative relief from the number of parking spaces required by this section
may be granted by the director of planning and building in the manner set forth in
Section 94,06.01 (Minor modifica tion).

Staff granted the reduction to accommodate the relocation of the parking spaces that
was a consequence of the Superior Court decision. Staff concluded that requiring the
full five-foot separation would either reduce the size of the parking spaces to an
unacceptably shallow depth or require removal of the privacy walls surrounding the
existing hotel building. Either outcome would be a hardship to the property owner. In
addition, either result would deprive the property owner of privileges allowed to others in
the zone, namely, the loss of required parking or the loss of privacy and security for
occupants of the building. Finally, staff believes that special circumstances are present
to justify the reduction: The location of the existing buildings near the property lines and
the proximity of appropriate privacy walls to the parking area.
The appellant asserts that reduction is "without merit and not a valid conclusion".
However, the appellant has provided no information with which to justify this argument.
Staff continues to believe that this reduction is reasonable and appropriate given the
site conditions and the authority allowed for granting such relief.
RECOMMENDATION
Staff is recommending that the Planning Commission uphold the decision of the Director
of Planning Services and deny the appeal.

DECISION OF THE DIRECTOR OF PLANNING SERVICES
AND DENYING AN APPEAL BY KEN LEVIN REGARDING
THE COLONY PALMS HOTEL LOCATED AT 572 N.
INDIAN CANYON DRIVE
WHEREAS, on April 13, 2007, the Director of Planning Services granted relief to the
Colony Palms Hotel to the requirement for a five-foot separation between parking
curbing and an adjacent wall (Palm Springs Zoning Code Section 93.05.00(E)(4)), and
WHEREAS, on April 20, 2007 Ken Levin of the Heavenstone Development at 544 N.
Indian Canyon Drive, filed an appeal of a decision by the Director of Planning Services
regarding the approval of a relief from Zoning Code Section 93.04.00(E)(4); and
WHEREAS, Sections 93,06-00.13.3.c and 94.05.03.Q of the Palm Springs Zoning Code
allow decisions by the Director of Planning Services regarding non-conforming
structures to be appealed to the Planning Commission; and
WHEREAS, on May 9, 2007, the Planning Commission conducted a public review of
the appeal request, including all of the evidence presented in connection with the
matter, including, but not limited to, the staff report prepared on the matter, and all
written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: That the decision by the Director of Planning Services to allow the Colony
Palms Hotel at 572 N. Indian Canyon Drive to reduce the distance between parking
curbs and adjacent walls to less than the required minimum five feet separation meets
the requirements of the Palm Springs Zoning Code for relief from parking standards
because
1. Requiring the full five feet would either reduce the size of the parking
spaces to an unacceptably shallow depth or require removal of the privacy
walls surrounding the existing hotel building.
2. Requiring the full five foot separation would result in a hardship to the
property owner and would deprive the property owner of privileges allowed
to others in the zone, namely, the loss of required parking or the loss of
privacy and security for occupants of the building.
3. That special circumstances exist to justify the reduction; namely the
location of the existing buildings near the property lines and the proximity
of appropriate privacy walls to the parking area.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning
Commission hereby rejects the appeal and upholds the decision of the Director of
Planning Services to allow the Colony Palms Hotel at 572 N. Indian a reduction from 5
to 2.5 feet the separation between the parking curbs and the adjacent walls along Via
Colusa.

Dear Ed,
Pursuant to our conversation this morning, please consider this letter as a formal
request for relief by the City of the requirement to provide 5 feet of clearance
from the parking curb to the edge of the wall screening the patio of our Easterly
most Casitas.
This wall is primarily an existing wall and the curb is located in the original
location as of the time we purchased the Property in 2004.
1 appreciate your consideration in this matter since this configuration of wall and
curb is located on a private street, which is essentially a driveway between our
hotel and the Heavenstone townhouses.
Inasmuch as we are hotel is booked for the Coachella Music Festival
commencing on Thursday, April 26, we are extremely anxious to have this matter
behind us so that we may immediately finish installing our parking spaces on
Via Colusa.
