Ready, City Manager BY: Planning Department SUMMARY The Well in the Desert has identified a new location for its food distribution service — 188 W. San Rafael Road — and must obtain a Conditional Use Permit prior to initiating the use. The application fees for a Type II CUP total $5,932. The Well in the Desert, has requested that the City Council waive these fees. The Council may waive any fee at its discretion and no public hearing is required. RECOMMENDATION Consistent with past practice, staff does not recommend a waiver or a transfer of the Conditional Use Permit Fee. STAFF ANALYSIS: Attached to this report is a letter from Vic Gainer requesting either a transfer of the existing Conditional Use Permit fee or a waiver of the application fee for a new CUP. The letter notes that The Well in the Desert intends to establish its food give-away program at the new location and close the facility at 181 N. Indian Canyon Drive. There is no adopted policy on fee transfers or waivers — staff believes that the request should be treated as a request to waive the fee for the new application. The Council may exercise its discretion in the matter, including a full or partial waiver of fees. The request is for a waiver of the entire fee of $5,932. The Well in the Desert is a non-profit provider of community services and any waiver or other financial contribution by the City would not be deemed a gift of public funds. ITEM NIQ.
