Ready, City Manager BY: Human Resources SUMMARY Staff is requesting that the City Council approve a Side Letter of Agreement with the Fire Management Unit to amend Article 17 of the Memorandum of Understanding to provide that no more than four shift employees are scheduled off at the same time. RECOMMENDATION: 1) Adopt Minute Order No. approving "A SIDE LETTER OF AGREEMENT TO THE MEMORANDUM OF UNDERSTANDING (MOU) WITH THE PALM SPRINGS FIRE MANAGEMENT ASSOCIATION (PSFMA) FOR THE PERIOD JULY 1, 2006 THROUGH JUNE 30, 2009 AMENDING ARTICLE 17 ANNUAL LEAVE TO PROVIDE THAT NO MORE THAN FOUR SHIFT EMPLOYEES ARE SCHEDULED OFF." 2) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: Changes to the City's Memorandum of Understanding (MOU) with the Fire Management Unit (PSFMA) regarding annual leave usage had an effect on the Fire Safety Unit's provision for Annual Leave Usage. As a result, the City and the Fire Management Unit (PSFMA) have met and conferred regarding this provision and have agreed to modify Article 17 Annual Leave to read: ITEM NO. LP City Council Staff Report May 2, 2007 -- Page 2 Minute Order-PSFMA Side Letter Agreement The practice of allowing two Unit Shift employees and Two Fire Management shift employees per shift to be on scheduled vacation simultaneously is to be continued; but in the event that one Fire Management employee schedules a given day for vacation, one additional Fire Safety Unit employee (3 total) will be allowed to schedule that day off provided that no more than four shift employees are scheduled off. If no Fire Management employees are scheduled off, two additional Fire Safety Unit employees will be allowed to schedule that day off (4 total) provided that no more than four shift employees are scheduled off. As reflected by the Side Letter of Agreement, the City's representatives and the PSFMA's representatives have reached agreement. FISCAL IMPACT: There is no fiscal impact. usan E. James Thompson, City Clerk 00-C3 SIDE LETTER OF AGREEMENT BETWEEN THE CITY OF PALM SPRINGS AND THE PALM SPRINGS FIRE MANAGEMENT ASSOCIATION 1. Pursuant to the provisions of the Meyers-Milias-Brown Act ("MMBA"; Gov't Code § 3500 et seq.), the City of Palm Springs ("City") may adopt reasonable rules and regulations for the administration of employer-employee relations. In addition, the City must meet and confer in good faith regarding wages, hours, and other terms and conditions of employment with representatives of recognized employee organizations- 2- Changes to the City's MOU with the Fire Management Unit regarding Annual Leave had an effect in the Fire Safety Unit provision for Annual Leave Usage, therefore a change in the annual leave provision is being agreed upon. 3.
