Ready, City Manager BY: Office of the City Clerk SUMMARY: The City Council will consider adoption of Ordinance No. 1712, RECOMMENDATION- Waive further reading and adopt Ordinance No. 1712, "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING PARAGRAPH 5 OF SUBSECTION A OF SECTION 94.06.01 OF THE PALM SPRINGS ZONING CODE TO ALLOW FRONT AND SIDE YARD SETBACKS ON MAJOR AND SECONDARY THOROUGHFARES TO BE REDUCED UP TO THE; SAME AMOUNT AS FRONT AND SIDE YARD SETBACKS ON LOCAL/COLLECTOR STREETS THROUGH THE ADMINISTRATIVE MINOR MODIFICATION PROCESS." STAFF ANALYSIS: At its April 18, 2007, meeting the City Council introduced on first reading the proposed ordinance. This report provides for the City Council to waive further reading and adopt the ordinance. The ordinance shall be effective 30-days from adoption. D . i i PROPOSED ORDINANCE NO. 1712 AN ORDINANCE OF THE CITY OF PALM SPRINGS AMENDING PARAGRAPH 5 OF SUBSECTION A OF j SECTION 94.06.01 OF THE PALM SPRINGS ZONING i CODE TO ALLOW FRONT AND SIDE YARD SETBACKS ON MAJOR AND SECONDARY THOROUGHFARES TO BE REDUCED UP TO THE SAME AMOUNT AS FRONT AND SIDE YARD SETBACKS ON LOCAL/COLLECTOR STREETS THROUGH THE ADMINISTRATIVE MINOR MODIFICATION PROCESS. City Attorney's Summary The proposed ordinance and zoning text amendment will allow greater front and side yard reductions for single family dwellings on Major and Secondary thoroughfares through the Administrative Minor Modification process. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS ORDAINS: SECTION 1. Paragraph 5 of Subsection A of Section 94.06.01 of the Palm Springs Zoning Code is amended to read: 5. Reduction of yards (including the placement of antennas in required yards) and distance between buildings, or increase in lot coverage, by not more than twenty (20) percent of the requirement of the zone. Single-family dwellings on Major and Secondary thoroughfares may be allowed reductions of front and side yards up to the amounts allowed for single-family dwellings located on local/collector streets in the same zone; SECTION 2. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
