SUBJECT: BURNETT COMPANIES / PRIME URBAN — REQUEST FOR COUNCIL
RECONSIDERATION OF ITS PRIOR DIRECTION REGARDING CASE
-NO. 5.1113 GENERAL PLAN AMENDMENT, TO VACATE A PAPER
STREET, PLANNED DEVELOPMENT DISTRICT 329, AND TENTATIVE
TRACT MAP 34829, FOR THE DEVELOPMENT OF 174 CONDOMINIUM
UNITS AND APPROXIMATELY 32,300 SQUARE FEET OF
COMMERCIAL / RETAIL SPACE ON 15.12 ACRES, LOCATED ON THE
SOUTH SIDE OF RACQUET CLUB ROAD BETWEEN NORTH PALM
CANYON DRIVE AND INDIAN CANYON DRIVE.

SUMMARY
On March 21, 2007, the City Council conducted a continued public hearing on a
residential / commercial mixed use project (Planned Development District No. 329). By
a vote of 3 to 2 (McCulloch and Oden opposed), the Council remanded the project to
the Planning Commission and Architectural Advisory Committee for additional review.
The applicant has submitted a request that the Council reconsider its remand and retain
review of the project.
RECOMMENDATION.
1. Direct staff to prepare the application for review by the City Council (instead of
the Planning Commission) upon re-submittal of a revised development plan.
STAFF ANALYSIS:
Staff has considered whether or not it would be better to remand the project to the
Planning Commission and AAC or for the Council to retain the project for its own review.
Since the Commission and AAC have already recommended the project in its current
form, there would need to be specific direction adopted by the Council by which the
Planning Commission and AAC could seek project changes. No such Council direction
was forthcoming at the recent hearings.

Staff is concerned that this project might be more expeditiously processed by the
Council retaining control on the PDD process. The project's current status is similar to
Mesquite Village, which was referred to the Commission and AAC by Council.
Subsequently, neither body recommended any changes after giving the project a
second look. Only when the Council kept the project, did any project amendments
come forward that were satisfactory to a Council majority.
The current project is very similar in both design and character to Mesquite Village, and
staff believes that Council retention of the project is appropriate. The applicant has
committed to making modifications to the plan (see attached letter) and staff would not
schedule the item for Council review until a revised plan and elevations are submitted
by the applicant.

As a part of this request, we understand that some
modifi ations may be necessary to secure final approvals

better understand said changes in an attempt to present a
projec that best reflects the desire of the Council and a
respon zveness to certain market conditions favorable to
