Ready, Executive Director BY: Community & Economic Development Department SUMMARY: It is recommended that the Agency approve the Second Amendment to a Restated and Amended Disposition and Development Agreement with Hacienda Sunset Affordable Housing Associates, a California Limited Partnership, and Coachella Valley Housing Coalition (CVHC), amending the terms of the Agency assistance to provide an additional $236,281 in Agency assistance to close out the construction of the project. The Agency had previously agreed to provide $1,100,000 in Agency financial assistance for the construction of a 66-unit low-income apartment complex, south of the Coyote Run Apartments on Sunrise Way and San Rafael Road. RECOMMENDATION: 1. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, CONCURRING WITH THE AGENCY'S APPROVAL OF AMENDMENT NO. 2 TO A RESTATED AND AMENDED DISPOSITION AND DEVELOPMENT AGREEMENT, PROMISSORY NOTE, AND DEED OF TRUST WITH ASSIGNMENT OF RENTS WITH HACIENDA SUNSET AFFORDABLE HOUSING ASSOCIATES, A CALIFORNIA LIMITED PARTNERSHIP TO APPROVE ADDITIONAL FUNDING IN THE AMOUNT OF $236,281 STAFF ANALYSIS: This resolution amends a previously amended Restated and Amended Disposition and Development Agreement with the developers of the Coyote Run Apartments to provide an additional $236,281 in Agency assistance to close a financing gap to assist the project to close on its construction- and permanent financing. The Agency previously contributed a 6.25 acre parcel of Agency-owned land (valued at $250,000) and made an Original cash contribution of $750,000 which was increased in December, 2004 by $350,000 due to rising materials costs. Coyote Run II Apartments, which now houses 66 low-income families, was approved by the Council on July 3, 2002. The Agency, through a Regulatory Agreement approved as an attachment to the original Disposition and Development Agreement, restricted the rents on 49% of the proposed units (32) to levels affordable to families with incomes no more than 60% of Area Median Income (AM[). The entire project, however, is restricted due to the restrictions from other funding sources such as HOME and MHP funds. On December 3, 2003, the Agency approved an Amended and Restated DDA to restructure the promissory note for the $750,000 in Agency Low Income Housing Setaside funds, and the land contribution, to conform to the requirements of the project's primary financing program, the State of California's Multifamily Housing Program (MHP). The Developer had also received HOME funds for the project nearly adequate to begin construction, but was faced with a shortfall of $350,000 in the project budget. They had expected to be able to cover the $350,000 shortfall with a grant from the Affordable Housing Program (AHP) of the Federal Home Loan Bank Board, but after bidding the construction project they discovered that the steep escalation in lumber prices drove the cost of the project up by $500,000, necessitating that they receive the AHP grant and additional Agency assistance. The Developer made up the difference. Prior to completion of the project (August, 2006), the Developer had requested additional funding to be able to close out the books on the project to cover items such as: (1) additional wrought iron fencing along Garnet Road; (2) wrought iron fencing along the perimeter of the proposed public park on the site; (3) an additional drywell on the project, requested by the City to reduce the risk of mosquito-borne illnesses; (4) improvements on the Sunrise Way median that were due to the lag in approvals between this project and the adjacent Four Seasons project; (5) additional City- requested service valves; and (6) the significant increase in the price of asphalt and concrete. Staff worked through a satisfactory design fix to the issue on Garnet Road, where the code required 42 inch wall created consternation in the adjacent Sunrise Norte neighborhood. In the end, the main objection was that the wall was too easy to climb and made Sunrise Norte uncomfortable. Working with Planning and Parks & Recreation staff, staff recommended the additional 14" wrought iron along that wall. Likewise, the issue of the median island created additional cost to the project, as the difference in timing between the installation of the median by K. Hovnanian and the Coyote Run development plan, which came one year later, required that Coyote Run relocate the driveways along Sunrise Way at their cost. Finally, the issue of the 1/4 acre park at the entrance is still being negotiated between staff and the developer. Recent staff changes in the City have delayed the resolution and ultimate design of the park. The total Agency contribution, then, would be $1,586,281, comprised of $1,336,281 in cash, as well as the land value of $250,000. These additional funds are available in the Low/Mod Housing Fund. FISCAL IMPACT: This action increases the Agency's cash contribution to the project from $1,100,000 to $1,336,281. The land contribution remains the same at $250,000. The per unit Agency subsidy (including the value of cash and land) per restricted unit would rise to $49,571 per restricted unit, or $24,034 per unit calculated against all the 66 units (since all the units are restricted, just not by the Agency). NOW THEREFORE BE IT RESOLVED by the Community Redevelopment Agency of the City of Palm Springs, as follows: SECTION 1. The above recitals are true and correct and incorporated herein. SECTION 2. This Amendment No. 1 to the Restated and Amended Disposition and Development Agreement ("RADDA") with Sunset Hacienda Affordable Housing Associates, a California Limited Partnership, is hereby approved and incorporated herein by this reference. SECTION 3.
