SUMMARY 0
The City Council will consider an amendment to an approved Planned Development
District to establish a Special Sign District under Section 93.20.05.C.8 of the Palm
Springs Zoning Code, The Sign District is proposed for the Avalon residential and golf m
course community project at 801 Sunrise Parkway to allow permanent and temporary
signage. A public hearing is required, and notice has been provided. Z

1. Open the public hearing and receive public testimony.

PRIOR ACTIONS: 0
On January 8, 2007, the Architectural Advisory Committee (AAC) reviewed the —1
proposed project and by a vote of 6-0-1 (King absent) recommended approval to the
City Council. The AAC stated that the proposed signage was proportionate given the

magnitude of the project, but requested that if channel letters are used that they be r
internally illuminated. a

Background Z
The Avalon project consists of the development of 1,236 residential units on Ill
approximately 309.39 acres, an 18-hole executive golf course and clubhouse, and 0
dedication of 7.55 acres of land for future development of a park site. The project site is
surrounded by multiple family dwellings, commercial and industrial uses to the west,
single family dwellings to the south and east, and the whitewater watercourse to the
north.

Project Description M
According to the Palm Springs Zoning Code 93.20.5.C.8, "special sign districts" may be C
established by the City Council for commercial and Industrial projects, as follows:

Nothing in this section shall prohibit the city council from adopting special sign r
districts as part of a specific plan, redevelopment plan, planned development 0
district or the like when special sign provisions are necessary or appropriate to
implement general plan provisions and goals.
No similar provision is provided for residential or other types of land uses. Staff has
accepted this application based on the approved Planned Development District for the M
site which includes the golf course and recreation commercial uses in the mixed use Z
development.
The proposed Special Sign District is described in the letter and exhibits attached to this
report, and may be summarized as follows:

Zoning Analysis r
Special Sign Districts are an unusual feature of the City's sign regulations in that they a
provide the City Council free reign to approve any type or amount of signage for
commercial or industrial projects. The only requirement is that a proposed District must Z
fulfill one or more goals of the General Plan. No similar provision is provided for Z
residential projects.

The proposed District for the Avalon Development project would create three permanent 0
main signs and a temporary sign program for use during construction and homes sales
of the mixed use project. The table below briefly describes the above-mentioned
signage categorized within the PSZC's sign ordinance and each signage's consistency
therewith. Detailed analysis of each signage type can be found following the table. 0

The exhibits indicate that there are three proposed Avalon monument identification a
signs located in the center medians at three of the four entrances to the development: Z
1. Indian Canyon Drive at the resident entry Z
2. Sunrise Parkway (newly constructed street) at the main project entry
3. Sunrise Parkway (newly constructed street) at the resident entry m
Each sign will be permanent and is approximately 18.88 square feet per side and eight
feet six inches tall. The sign is categorized as a Main Sign and is permitted pursuant to
Section 93.20.06(A)(1) of the PSZC; however, the total sign area for all identification
signs for the entire project may not exceed fifty square feet in size; the total areas of
the proposed main signs is 113.28 square feet.

2. Recreation Center Signs

The exhibits indicate one proposed permanent Recreation Center sign located within m
the center of the Avalon development at the entrance to the future clubhouse. The sign r
is proposed to be permanent and is approximately 18.88 square feet per side; the sign
is approximately eight feet in height. Pursuant to Section 93.20.06(A)(3) of the PSZC, Q
this sign is permitted; however, the area is limited to one single-faced sign with twenty
square feet maximum or one double-faced sign with ten square feet maximum per face; Mal

The exhibits indicate one temporary Welcome sign and one temporary Thank You sign
by the north entrance off of the newly constructed Sunrise Parkway. This sign is not a
signage type permissible by the PSZC.
5. Kiosk Signs

The exhibits indicate nine Kiosk signs located within the development to direct
automotive traffic to the various areas within the development. This signage type is Cn
closest categorized to "Off-site directional signs" pursuant to Section 93.20.07(7):
Off-site directional signs consisting of panels listing the names of residential
tracts or developments where the original sale of new homes is being conducted �]
shall be permitted within the public right-of-way, provided, they are erected as _
part of a city-sanctioned directional sign program and by the entity (building
industry association) a party to such an agreement with the city which details the
design criteria and other limitations and restrictions of the program... ---�
The proposed signage type is located within the Avalon property and not on public right-
of-way.

6. Future Golf Club Sign and 7. Recreation Center Sian r
The exhibits indicate two temporary Future Golf Club signs at 23.56 square feet each
and one temporary Future Recreation Center sign at 23.56 square feet. These signs Z
are allowed pursuant to Section 93.20.08(A)(2)(a)(iii) of the PSZC; however, the Z
signage size for each building is allowed to be no more than 12 square feet.

8. Neighborhood Identification Signs 0
The exhibits indicate one 36.82 square foot temporary Neighborhood Identification sign
for each of the eleven Planning areas within the Avalon Project. Pursuant to Section
93.20.07(5) of the PSZC, these signs are allowed subject to the provisions outlined v
herein:
Land Subdivision/Model Building Complex Signs. m
In-lieu of, but not in addition to any other sale, lease, or exchange sign C
permitted under the sign ordinance, signs advertising land
subdivisions/model building complexes shall be permitted upon m
recordation of the final subdivision map subject to the following provisions: r
a. One (1) double-faced sign which shall not exceed thirty-two (32)
square feet per side (forty-eight (48) square feet if the land is Q
adjacent to Interstate 10), and may be perpendicular to the street; �
or
b. Two (2) single-faced signs as follows:
i. The size of each sign shall not exceed thirty-two (32) square m
feet (forty-eight (48) square feet if the land is adjacent to
Interstate 10) and the signs shall be parallel to the street; Z
ii. Such signs shall be a minimum of two hundred (200) feet apart;
iii. Placement of such signs shall be approved by the director of
planning and building.
c. Such signs shall not be illuminated.
d. In the case of land subdivisions, such signs shall be removed when
property is no longer offered for sale, lease or exchange by an O
original owner. In the case of model building complexes, such signs --
shall be removed when on-site sales of structures cease. Cn
The number of proposed Neighborhood Identification signs is consistent with the
PSZC; however, the total area for each (36.82 square feet) exceeds the �]
maximum of thirty two square feet permitted by the PSZC. _
9. Model Tour Signs 0
The exhibits indicate sixteen temporary Model Tour directional signs at six square feet
each. These signs are located at various locations throughout the Avalon Development.
This sign is not a signage type permissible by the PSZC.

The exhibits indicate a total of two hundred fifty-one banners/flags at six square feet a
each. This type of signage is prohibited pursuant to Section 93.20.04(1) of the PSZC. Z
12. Construction Fence Wrap z
m
The proposed construction fence is proposed to be wrapped with text, graphics and 0
perspectives of the construction. It appears this signage type exceeds the maximum
amount (thirty-two square feet for text and thirty percent maximum for graphics)
permitted pursuant to Section 93.20.08(A)(2)(b)(i) of the PSZC and determination;
however, the applicant has stated materials will be available for the Council to review
the day of the public hearing. 0

Maintenance and Termination C
The applicant has stated that the size and location of signage will enable the marketing
of the project while under construction. Staff believes that the application raises two m
issues for Council consideration: Maintenance and Termination. r
As regards maintenance, the signs may be subject to defacement or graffiti. The City's 0
graffiti abatement program normally responds to complaints by attempting to remove
graffiti. The signs and mesh screening do not lend themselves to the type of graffiti-
removing solvent used by the City. Staff believes that the applicant should be prepared
to respond within 48 hours of receipt of a complaint to abate, remove or replace any m
defaced signage. A condition of approval is included that requires the applicant to
provide the name and telephone number of a responsible party that can be contacted Z
seven days a week for sign maintenance.
Staff believes that the sign program should be terminated and removed upon
completion of the developer homes sales. In order to provide clear direction, staff
recommends that the signs and fence screening be removed ninety (90) days following
issuance of the last certificate of occupancy on the project. Staff believes that an C7
additional three months following the last C of O would provide adequate time for the --
applicant to conclude the final selling of phase two homes. A condition to this effect is Cn
included in the draft resolution.
General Plan "Provisions and Goals"
As noted above, Special Sign Districts may be approved by the Council when,
"...necessary or appropriate to implement general plan provisions and goals." Staff has �
reviewed the General Plan and identified the following goal statements might affect the
request:

Objective — 3.3a — Sound, healthful and attractive residential areas based on the
low-density space and occupancy standards appropriate for Palm Springs and

Policy — 3.3.2 — Encourage developers to achieve a high level of architectural n
and community design of all residential development, using high-quality building Z
materials and achieving long-term desirability, which is reflective of the City's Z
design heritage_ Ensure that new development is compatible with and
complements, in scale and architecture, the natural surroundings. Ill
The sign district will support the sound, healthful and attractive residential areas
by creating an identification district through the use of limited temporary signage
within and outside the development and permanent main signage as core identity
to the three entrances of the development. Furthermore, the proposed signage v
was reviewed and approved by the Architectural Advisory Committee to ensure
the finished product is a high-quality design. m

PARKWAY, SECTION 35.
WHEREAS, according to Palm Springs Zoning Code 93.20.5.C.8, "special sign districts"
may be established by the City Council for commercial and industrial projects, "...as
part of a specific plan, redevelopment plan, planned development district or the like
when special sign provisions are necessary or appropriate to implement general plan
provisions and goals"; and
WHEREAS, SunCal Companies (the "Applicant') has filed an application with the City
pursuant to Section 94.03.00 (E) of the Palm Springs Zoning Code, for an amendment
to Planned Development District 290 to establish a Special Sign District for temporary
construction signage; and
WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to
consider an amendment to Case Number 5.0982 consisting of an amendment to
Planned Development District 290, was given in accordance with applicable law; and
WHEREAS, on January 8, 2007, the Architectural Advisory Committee (AAC) reviewed
the proposed project and by a vote of 6-0-1 recommended approval to the City Council;
and
WHEREAS, on April 18, 2007, a public hearing on the application was held by the City
Council in accordance with applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the meeting on the project, including but not limited to the
staff report, and all written and oral testimony presented.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1: Pursuant to the California Environmental Quality Act (CEQA), the project
is Categorically Exempt under Section 15311(a)(Accessory Structures).
Section 2: Pursuant to Section 93.20.5.C.8 of the Palm Springs Zoning Code, the
City Council finds that the proposed Special Sign District includes special sign
provisions that are necessary or appropriate to implement general plan provisions and

Objective—3.3a — Sound, healthful and attractive residential areas based on the low-

subject to the Conditions of Approval attached hereto as Exhibit A.

CONDITIONS OF APPROVAL
April 18, 2007
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning Services, the Chief of Police,
the Fire Chief or their designee, depending on which department recommended the
condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
PROJECT SPECIFIC CONDITIONS
Administrative
1. All conditions of City Council Resolution No. 20920 (PD-290) shall be in full force
and effect, except as modified below.
2. The proposed development of the premises shall conform to all applicable
regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other
City Codes, ordinances and resolutions which supplement the zoning district
regulations.
3. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its
agents, officers, and employees from any claim, action, or proceeding against the
City of Palm Springs or its agents, officers or employees to attach, set aside, void
or annul, an approval of the City of Palm Springs, its legislative body, advisory
agencies, or administrative officers concerning Case 5.0982 PD — 290 (SP 06-
114). The City of Palm Springs will promptly notify the applicant of any such claim,
action, or proceeding against the City of Palm Springs and the applicant will either
undertake defense of the matter and pay the City's associated legal costs or will
advance funds to pay for defense of the matter by the City Attorney. If the City of
Palm Springs fails to promptly notify the applicant of any such claim, action or
proceeding or fails to cooperate fully in the defense, the applicant shall not,
thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm
Springs. Notwithstanding the foregoing, the City retains the right to settle or

abandon the matter without the applicant's consent but should it do so, the City
shall waive the indemnification herein, except, the City's decision to settle or
abandon a matter following an adverse judgment or failure to appeal, shall not
cause a waiver of the indemnification rights herein.
4. That the property owner(s) and successors and assignees in interest shall
maintain and repair the improvements including and without limitation sidewalks,
bikeways, parkways, parking areas, landscape, irrigation, lighting, signs, walls, and
fences between the curb and property line, including sidewalk or bikeway
easement areas that extend onto private property, in a first class condition, free
from waste and debris, and in accordance with all applicable law, rules, ordinances
and regulations of all federal, state, and local bodies and agencies having
jurisdiction at the property owner's sole expense. This condition shall be included
in the recorded covenant agreement for the property if required by the City.
Environmental Assessment
5. The mitigation measures of the Initial Study shall apply to the proposed project-
Mitigation measures are included in the Initial Study made part of the original
Planned Development District adopted October 4, 2006, and hereby incorporated
into these conditions by reference.
6. The developer shall reimburse the City for the City's costs incurred in monitoring
the developer's compliance with the conditions of approval and mitigation
monitoring program, including, but not limited to inspections and review of
developers operations and activities for compliance with all applicable dust and
noise operations, and cultural resource mitigation. This condition of approval is
supplemental and in addition to normal building permit and public improvement
permits that may be required pursuant to the Palm Springs Municipal Code.
Planning Department
7. Prior to installation of the signs of the Special Sign District, the applicant shall
provide to the Director of Planning Services the name and telephone number of an
agent or party responsible for maintenance of the affected signs. Such agent or
party shall be available seven days a week and any changes to the contact
information shall be reported to the Director immediately.
8. Ninety (90) days following issuance of the last Certificate of Occupancy for phase .
two of the Planned Development District, all signs approved as part of this District
shall be removed except the three project monument entry signs and the
monument recreation center sign.

9. Prior to any construction on-site, all appropriate permits must be secured.
Fire Department
10. Fencing Required: Construction site fencing with 20 foot wide access gates is
required for all combustible construction over 5,000 square feet. Fencing shall
remain intact until buildings are stuccoed or covered and secured with lockable
doors and windows. (8.04.260 PSMC)

public hearing at its meeting of April 18, 2007. The City Council meeting begins at 6:00 p.m., in the
Council Chamber at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs.
The purpose of this hearing is to consider an application by SunCal Communities for an amendment
to Planned Development District 290 for the establishment of a Special Sign District as provided by
Section 93.20.5C8 of the Palm Springs Zoning Code. The amendment would create a signage
program for the Avalon residential/golf course project located at 801 Sunrise Parkway.
ENVIRONMENTAL. DETERMINATION: Pursuant to the California Environmental Quality Act
(CEQA), the project is Categorically Exempt under Section 15311(a)(Accessory Structures).
REVIEW OF PROJECT INFORMATION: The staff report and other supporting documents regarding
