Ready, City Manager BY: Department of Planning Services SUMMARY The City Council will consider a proposal for a Zoning Code Text Amendment that would modify Section 94.06.01(A)(5), allowing greater front and side yard reductions through the Administrative Minor Modification (AMM) process. The amendment would allow single family dwellings on Major and Secondary thoroughfares to reduce front and side yard setbacks up to what is allowed for single family dwellings on Local and Collector streets. RECOMMENDATION: 1. Conduct a public hearing of the proposed amendment. 2. Waive the reading of the 'text of the Ordinance and introduce by title only 3. STAFF ANALYSIS: On April 11, 2007, the Planning Commission reviewed the Council request to amend the Zoning Code regarding AMMs on Major and Secondary thoroughfare. After ITEM NO. . City Council Staff Report April 18— Page 2 5.1151 ZTA Findings for a Minor Modification consideration of the issue, the Planning Commission voted 7-0-1 (Hutcheson) to recommend the amendment Section 94.06.01(A) as follows- 5- "Reduction of yards (including the placement of antennas in required yards) and distance between buildings, or increase in lot coverage, by not more than twenty (20) percent of the requirement of the zone. Single-family dwellings on Major and Secondary thoroughfares may be allowed reductions of front and side yards up to the amounts allowed for single-family dwellings located on Local/Collector streets in the same zone;" Staff analysis of the request is in the attached Planning Commission staff report. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: This project has been declared categorically exempt from environmental review per Section 15305 (Minor Alterations in Land Use Limitations) of the California Environmental Quality Act (CEQA). WHEREAS, Section 94.06.01(A)(5) of the Palm Springs Zoning Ordinance establishes procedures for evaluating Minor Modifications; and WHEREAS, staff researched that neighborhoods on some Major and Secondary thoroughfares have front and side yard setbacks that are existing and non- conforming; and WHEREAS, currently the front and side yards on Major and Secondary thoroughfares can be reduced up to 20 percent through the Administrative Minor Modification process; the application of this standard makes it difficult to grant reduced front and side yard for single-family dwellings on existing and non- conforming lots located on Major and Secondary thoroughfares; and WHEREAS, Section 94.07.01 of the Zoning Ordinance sets forth procedures for modifying text within the Zoning Ordinance; and WHEREAS, on March 7, 2007 the City Council voted to direct staff to initiate a Zoning Ordinance Text Amendment to revise the regulations for granting administrative minor modifications to yard setbacks; and WHEREAS, on April 11, 2007 the Planning Commission conducted a duly noticed public hearing on said project at which hearing the Commission carefully reviewed and considered all of the evidence presented in connection with the public hearing on the project, including but not limited to the staff report and all written and oral testimony presented; and WHEREAS, this project has been declared categorically exempt from environmental review per Section 15305 (Minor Alterations in Land Use Limitations) of the California Environmental Quality Act (CEQA); on April 11, 2007; and WHEREAS, The Planning Commission hereby finds that adoption of the proposed Zoning Text Amendment would: Ordinance No. Page 2 a. Enable sound criteria and justification to be found in support of minor modifications in the limited conditions for which they may be applied. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS; SECTION 1. Subsection A.5 of Section 94.06.01 of the Palm Springs zoning Code is amended to read: a. Reduction of yards (including the placement of antennas in required yards) and distance between buildings, or increase in lot coverage, by not more than twenty (20) percent of the requirement of the zone. Single-family dwellings on Major and Secondary thoroughfares may be allowed reductions of front and side yards up to the amounts allowed for single- family dwellings located local/collector streets in the same zone; SECTION 2. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage. RECOMMENDATION: That the Planning Commission recommends approval to the City Council a zoning ordinance text amendment to modify Section 94.06.01(A)(5), as follows (added text in bold): "Reduction of yards (including the placement of antennas in required yards) and distance between buildings, or increase in lot coverage, by not more than twenty (20) percent of the requirement of the zone. Single-family dwellings on Major and Secondary thoroughfares may be allowed a reduction of front and side yard up to the amount allowed for single-family dwellings located on Local/Collector streets in the same zone;" PRIOR ACTIONS TAKEN ON THE PROJECT: On March 7, 2007, the City Council initiated a Zone Text Amendment to Section 94.06.01(A)(5) of the Palm Springs Zoning Code regarding setbacks on Major and Secondary thoroughfares. Planning Commission Staff Report April 11, 2007 Case 5.1151 —Zoning Text Amendment Page 2 of 4 BACKGROUND AND SETTING: The Zoning Code has been created with two mechanisms - the variance and the minor modification - to address conditions that need relief from the standards set forth in the ordinance. Both endeavor to ensure consistency of development in a particular zone, protection of a standard of public health, and application of the ordinance such that it does not grant special privilege to any particular property owner nor cause injury or detriment to adjacent properties and their owners. The City Council requested an amendment to the zoning Code regarding setback modifications for single-family dwellings located on Major and Secondary thoroughfares. The current wording of the AMM allows only limited relief for single family dwellings on Major and Secondary thoroughfares whose front and side yard setbacks are existing but non-conforming. ANALYSIS: As it stands, residential dwellings on Major thoroughfares are allowed front and side yard reductions through the AMM to no less than 40 feet on all single-family zones and lot location. On Secondary thoroughfares, under the same AMM process, front and side yard reductions shall be no less than 20 feet depending on the zone and lot location. In contrast, dwellings on Local and Collector streets may receive an AMM to 16 feet for front and side yard (on the side yards of lots zoned R-1-D, it may be reduced to 12 feet). The intent of this text amendment would be to establish wording that would grant greater front and side yard reductions for single family dwellings located on Major and Secondary thoroughfares. Under the General Plan Policy Section 7.1.3, Major and Secondary thoroughfares fall under the designation of "Arterial Streets and Highways'. To emphasize the distinction from Local and Collector streets, the General Plan establishes the following standards for Major and Secondary thoroughfares: • Proscribes single-family residential access and on-street parking • Road widths are approximately 33 percent to 50 percent wider than Local or Collector streets. • Minimum of four lanes and few cross streets to facilitate fast and heavy traffic. Street hierarchy seems to play a part in establishing the current yard setbacks for single-family residences. The chart below shows the relationship of larger yard setbacks and the street type on which the lots front. Without the new language, it is not possible for existing non-conforming residential properties to enjoy the AMM privileges reserved for others in the city. Staff conducted research throughout the city identifying areas where the setbacks of single-family dwellings on major and secondary thoroughfares are less than what the code requires. These areas of concern tend to have the General Plan designation of Low-Density Residential and adjacent to major and secondary thoroughfares. On Sunrise Way, north of Alejo Road, single family houses with yard setbacks of approximately 25 feet abut one of the city's major thoroughfares. Another major thoroughfare, Vista Chino, east of Sunrise Way, also have houses that have approximately 25-30 feet setbacks. The houses on El Cielo Road, a secondary Planning Commission Staff Report April 11, 2007 Case 5.1151 --Zoning Text Amendment Page 4 of 4 thoroughfare, between Ramon Road and Mesquite Avenue, typically have yard setbacks found on local and collector streets. Consequently, these are the areas where the proposed zoning text amendment will have the greatest impact. Single-family dwellings that need relief may not experience the same traffic impacts as anticipated by the General Plan. Staff believes that these areas of Major and Secondary thoroughfares should have the same AMM privileges as dwelling units located on Local/Collector streets on the same zone. Local/Collector streets are intended to carry localized traffic and traffic load that are lighter than any other city circulation designation including Major and Secondary thoroughfares. Adopting the -modified -text amendment will give the City a discretionary role in determining the appropriateness of greater front and side yard reductions for single family dwellings on Major and Secondary thoroughfares. Since such applications are subject to AMM findings, it is expected that the intended character of Major and Secondary thoroughfares will be preserved.
