The applicant returns with the second part of its proposed Special Sign District and requests temporary sign billboards. The applicant proposes the following: 1) Two large signs--one at the corner of North Palm Canyon Drive and Alejo Road, and one at the corner of North Indian Canyon Drive and Alejo Road; 2) The size of each sign would be 16 feet x 14 feet. The total square footage of each sign would be 224 square feet; and 3) The signs be able to portray/present interiors of the project. THE AMENDMENT WOULD CREATE A CONSTRUCTION SIGNAGE PROGRAM FOR THE DOWNTOWN "PORT LAWRENCE" RESIDENTIAL / RETAIL PROJECT LOCATED AT THE SOUTHEAST CORNER OF NORTH PALM CANYON DRIVE AND ALEJO ROAD FROM: David H. Ready, City Manager BY: Department of Planning Services SUMMARY The City Council will consider an amendment to an approved Planned Development District to establish a Special Sign District under Section 93.20.05.8 of the Palm Springs Zoning Code. The Sign District is proposed for the mixed use project at 400 N. Palm Canyon Drive (`Rae[' project) to allow temporary construction signage which does not conform to the limits of the Zoning Code for such signage. The temporary signs are six billboards and about 1500 linear feet of five-foot high fence screening. The Code allows the City Council to approve a sign district without review by the AAC or Planning Commission. A public hearing is required, and notice has been provided. RECOMMENDATION: 1. Open the public hearing and receive public testimony. 2. ITEM NO.�� City Council Staff Report March 7, 2007—Page 2 5.1091 PD-324--Amendment for Special Sign District PRIOR ACTIONS: On October 4, 2006, the City Council approved a Planned Development District, Tentative Tract Map and related approvals for a commercial / residential mixed-use project (previously titled "4 One 4 Palm", now "Port Lawrence"). The project had previously been recommended by the Planning Commission on September 13, 2006 STAFF ANALYSIS: Background The project site is surrounded by commercial retail structures on the west and south, Frances Stephens Park on the north, and condominium and commercial structures on the east, across Indian Canyon. The site is identified as the northern gateway for the downtown area in the Downtown Design Guidelines. The approved project includes the condominium units and retail commercial space on a 4.1 acre site bounded on the north by Alejo Road, on the west by North Palm Canyon Drive, on the east by North Indian Canyon Drive, and on the south by existing commercial development. Project Description According to Palm Springs Zoning Code 93.20.5.C.8, "special sign districts" may be established by the City Council for commercial and industrial projects, as follows. 8. Special Sign Districts. Nothing in this section shall prohibit the city council from adopting special sign districts as part of a specific plan, redevelopment plan, planned development district or the like when special sign provisions are necessary or appropriate to implement general plan provisions and goals. No similar provision is provided for residential or other types of land uses. Staff has accepted this application based on the approved Planned Development District for the site which includes commercial uses in a mixed use development. The proposed Special Sign District is described in the letter and exhibits attached to this report, and may be summarized as follows: 1. Billboards. Six free-standing billboards would be located around the edge of the site facing the street. Dimensions will 8 x 11 feet for each of five signs; the sixth sign (facing the intersection of N. Palm Canyon Drive and Alejo Road) will be 12 x 16'/2 feet. Total area of the six signs will be 638 square feet. Three smaller billboards will be exclusively text; two smaller' and the one large billboard will have a combination of text advertising and renderings of the project. City Council Staff Report March 7, 2007—Page 3 5.1091 PD-324—Amendment for Special Sign District 2. Fence Screen. Mesh screening would be attached to portions of the green construction fencing facing the street. The mesh will be five feet high, have a total length of 1,495 feet and a total area of 7,475 square feet. The screening will include text advertising and abstract graphics. Zoning Analysis Special Sign Districts are an unusual feature of the City's sign regulations in that they provide the City Council free reign to approve any type or amount of signage for commercial or industrial projects. The only requirement is that a proposed District must fulfill one or more goals of the General Plan. No similar provision is provided for residential projects. The proposed District for the Rael project would create a temporary sign program for use during construction of the mixed use project. The signs would comprise a "Coming Soon" advertising effort, and would be removed upon completion of the project. Staff has analyzed the proposal in light of both the regulations for such temporary signage (Section 93.20.07.5) and the recent Council action to promote creative temporary construction signs (see attached), as follows: Basic Zoning Council Policy on Proposal for Rael Requirement Temp Signs Project Total Allowed Area 32 sf for all signs - 32 sf for text only - 1,540 sf for text - text and gra hits unlimited for gra hits 6,573 sf for graphics Max. Fence Height 6 feet 6 feet 5 feet The total text area greatly exceeds the Code standard, and other dimensions are either conforming or are not subject to any limitation. The graphics generally comply with the Council's policy on temporary construction signs, in that they suggest the overall vision of the project and do not pose electric colors or metallic surfaces. Maintenance, Use and Termination The size and location of the proposed signs will make them prominent features of the downtown scene. Staff believes that the application raises three issues for Council consideration: Maintenance, Interest and Termination. As regards maintenance, the signs may be subject to defacement or graffiti. The City's graffiti abatement program normally responds to complaints by attempting.to remove graffiti. The signs and mesh screening do not lend themselves to the type of graffiti- removing solvent used by the City. Staff believes that the applicant should be prepared to respond within 48 hours of receipt of a complaint to abate, remove or replace any defaced signage. A condition of approval is included that requires the applicant to provide the name and telephone number of a responsible party that can be contacted 00�113 City Council Staff Report March 7, 2007—Page 4 5.1091 PD-324—Amendment for Special Sign District seven days a week for sign maintenance. The issue of "interest" is based on staffs concern that the project's eighteen to twenty- four month time of construction could make these prominent billboard signs uninteresting (or "tired") if not updated periodically. Staff has included a condition that the billboard illustrations be replaced with new project renderings at least every six months to maintain interest and freshness to the both project and the signs. Finally, staff believes that the sign program should be terminated and removed upon completion of the project. In order to provide clear direction, staff recommends that the signs and fence screening be removed ninety (90) days following issuance of the first certificate of occupancy on the project. First occupancy may occur with either residential or commercial units, but would not be granted until landscaping, lighting and other exterior features are installed. Staff believes that an additional three months following the first C of O would provide adequate time for the applicant to conclude the `coming soon' phase of the project. A condition to this effect is included in the draft resolution. Precedent Staff believes that this is the first Special Sign District requested for temporary construction signs in the City. Since any commercial or industrial Planned Development District— or, potentially, any commercial / industrial project approval — may petition for a similar program, the Council's decision on this request may set a path that others will follow. The Council should consider at this time if sign programs of this type at several sites around the City is acceptable. Staff again notes that the Code limits Special Sign Districts to commercial and industrial projects; PDD's granted for exclusively residential projects will not qualify for such Districts. General Plan "Provisions and Goals" As noted above, Special Sign Districts may be approved by the Council when, "...necessary or appropriate to implement general plan provisions and goals." Staff has reviewed the General Plan and identified the following goal statements might affect the request: Downtown / Central Business District Goal--- D.3.A — Establishment of the areas along Palm Canyon Drive and Indian Canyon Drive between Alejo and Ramon Roads as the principal activity center of and "downtown" to the City by the intensification of commercial/entertainment- related uses and urban design improvements to achieve economic, physical and visual unity. The sign program will support the intensification of downtown uses through the use of six billboards and multiple text panels along the construction fencing. The sign program will add drama and energy to the north part of the downtown, adding to a festive atmosphere for shoppers and pedestrians. As a temporary sign program, the request appears to support elements of the General Plan goals for the downtown area- Environmental Determination A Mitigated Negative Declaration for this project was previously adopted by the City Council on October 4, 2006. Pursuant to Section 15162 of the California Environmental Quality Act (CEQA), the preparation of further documentation will not be necessary since the circumstances surrounding this project have not changed. That the property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation sidewalks, bikeways, parkways, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, including sidewalk or bikeway easement areas that extend onto private property, in a first class condition, free from waste and debris, and in accordance with all applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owners sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. Environmental Assessment 4. The mitigation measures of the Initial Study shall apply to the proposed project. Mitigation measures are included in the Initial Study made part of the original Planned Development District adopted October 4, 2006, and hereby incorporated into these conditions by reference. 5. The developer shall reimburse the City for the City's costs incurred in monitoring the developer's compliance with the conditions of approval and mitigation monitoring program, including, but not limited to inspections and review of developers operations and activities for compliance with all applicable dust and noise operations, and cultural resource mitigation. This condition of approval is supplemental and in addition to normal building permit and public improvement permits that may be required pursuant to the Palm Springs Municipal Code. Planning Department 6. Prior to installation of the signs of the Special Sign District, the applicant shall provide to the Director of Planning Services the name and telephone number of an agent or party responsible for maintenance of the affected signs. Such agent or party shall be available seven days a week and any changes to the contact information shall be reported to the Director immediately. 7. Six months following installation of the billboard signs, and no less than every six months thereafter, the applicant shall replace the billboard illustrations with new illustrations depicting elements of the project. As you are aware, the Port Lawrence project will be a prenner residential/retail site. The proposed construction signage program will reflect the first-class nature of the project and,while construction is in progress, enhance the appearance of that important and visible location in downtown Palm Springs. Fencing The mesh screening the construction project will appear painted. It will feature modernistic artwork and some signage within its panels that Identifies the project. The mesh will be 5 feet high and the total linear feet of the signage portion of the mesh is 247.5, which for the mesh signs represents 17%of the total of 1,496 feet of fencing. A copy of the artwork and signage proposed on the mesh is provided. Reading from left to right from the copy: the linear feet on Palm Canyon will be 34.5, 15, 15 and 34,5; the linear feet for Alejo will be 34.5 and 34.5; and the linear feet for Indian Canyon will be 15, 15, 15 and 34.5 feet. Signs There will be up to six free-standing signs located on the construction site. Five of the signs will not exceed 8ft X 11ft. The other sign will not exceed 12 ft. x 16.5 ft. The signs will be located at each comer of the parcel and at the approximate half-way point between the comers on both Indian Canyon and Palm Canyon. The large sign will be located at the corner of Alejo and Palm Canyon. The signs will be located closely behind the construction fencing. A copy of the proposed signage design concept is provided as well as a site plan identifying the approximate location of each sign.
