Subject: PALM SPRINGS STORM DRAIN LINES 6A, 8, 20C, AND 20CA, CITY
PROJECT NO 05-20

SUMMARY
Agreement No. 5275 with Engineering Resources of Southern California, Inc., approved
by City Council on May 3, 2006, provides the City with engineering design services for
the construction of various master-planned storm drain facilities in the City. Additional
utility pot-holing is necessary to complete the final design. A Contract Services
Agreement Amendment has been prepared to facilitate the additional scope of work as
part of this project.
RECOMMENDATION:
1) Adopt Minute Order No. "APPROVING AMENDMENT NO. ONE (1) TO
AGREEMENT NO. 5275 WITH ENGINEERING RESOURCES OF SOUTHERN
CALIFORNIA, INC., IN THE AMOUNT OF $46,930 FOR A TOTAL REVISED
CONTRACT AMOUNT OF $342,410 FOR THE PALM SPRINGS STORM
DRAIN LINE 6A, 8, 20C AND 20CA, CITY PROJECT NO. 05-20;" and
2) Authorize the City Manager to execute all necessary documents.
STAFF ANALYSIS.
On May 3, 2006, City Council awarded a contract services agreement to Engineering
Resources of Southern California, Inc., for the design of several master-planned storm
drain facilities in the City: Line 6A (located in Sunrise Way extending from Vista Chino to
Via Escuela), Line 8 (in Sunrise Way extending from Baristo Channel to Tahquitz
Canyon Way), Line 20C (in El Cielo Road extending from Ramon Road to Baristo
Road), and Line 20CA (in Baristo Road extending from El Cielo Road to Compadre
Road). The original contract services agreement included an estimated number of utility
potholing, necessary to physically locate underground utilities that may conflict with the
storm drain lines, and to identify utilities that require relocation or adjustment prior to

construction of our project. The original contract estimated the total number of utility
potholing at 46 locations, based on assuming the presence of a certain number of
utilities (Le, water, sewer, electric), and specifically identified the need for a contract
amendment in the event additional utility potholing was required, Utility potholing was
originally compensated on a unit price per pothole basis of $850, based on fees
charged by Saf-R-Dig, a sub-contractor performing the excavations for utility potholing.
The City's consultant has completed the conceptual design and alignment of the various
storm drain facilities, and has identified locations of all existing underground utilities. As
a result, all potential areas of conflict with proposed storm drain facilities and existing
utilities has been identified. A much greater number of underground utilities were
identified in the City's streets that have the potential of conflicting with the planned
storm drain improvements, requiring an additional 67 utility potholes, for a total of 113.
A contract services agreement Amendment has been prepared to add the additional
utility potholing and survey coordination, with an agreed fee of$46,930. The agreed fee
includes a reduced unit cost per utility pothole of $636.57 (or a fee of $42,650) and an
additional fee of$4,280 for survey coordination.

Task 2.2-Potholing
Afteracceptance of the preliminary alignment for each storm drain,available as-built plans will be obtained
from the utilities to identify potential crossings and conflicts with subsurface utilities. Once the key critical
crossings and conflicts have been identified and marked in the field, Contractor shall locate existing
subsurface utilities by potholing. Based on final conceptual plans prepared by Contractor, all areas of
crossings and conflicts have been identified; the final number of potholes required for the final design of
each storm drain line is as follows

After field survey personnel acquire the horizontal location,the utility data will be used to verifythe location,
size and type of facilities shown on the plan sheets. Vertical data will be used to plot the utilities in profile
and aide in the design of the vertical location of the storm drain and laterals as the construction drawings
advance to 75 percent complete. Once the profile has been developed and various options have been
evaluated, utility conflicts will be identified and summarized in a matrix giving the street name, storm drain
station and type and size of utility impacted by the proposed storm drain.
Plans showing utility conflicts identified as noted above will be provided to the City of Palm Springs, in
addition to the utility company whose facilities require modification or relocation. This will constitute the
second utility notification. Subsequent notifications will be forwarded to affected utilities with the 95 percent
complete and final submittals.

EXHIBIT C is replaced with the following:
Tasks listed below are identical to tasks identified in Exhibit A of this Agreement. Payments to Contractor
shall be made no more frequently than monthly, and shall be based on costs per unit of work as indicated
herein. Lump sum payments shall be made to Contractor based upon completion of tasks, or pro-rata
portions thereof noted below,to a maximum of 75% of the lump sum task item fee until completion of such
task item. Each request for payment shall contain Contractor's statement of the work or tasks completed
or portion performed, with supporting documentation, The determination of payment due shall be made
based upon the reasonable judgement of the Contract Officer.
