HomeMy WebLinkAbout8/1/2001 - STAFF REPORTS (34) DATE: August 1. 2001 TO: City Council FROM: City Manager & City Clerk 2001 GENERAL MUNICIPAL ELECTION — BALLOT MEASURES RECOMMENDATION: That the Council consider calling a Special Election to be consolidated with the General Municipal Election to be held Tuesday, November 6, 2001, to place one advisory vote only measure, one measure and one Charter Amendment on the ballot, concerning the Convention Center refinancing Bonds, Transient Occupancy Tax increase, and commencement of terms of Office for newly elected Members of the City Council. BACKGROUND: The attached resolution provides for the call of the special election to place an "Advisory Vote Only" measure concerning the Convention Center refinancing of bonds. The second resolution would also place, a City Council initiated measure, a question seeking voter approval of a measure concerning a possible increase in the Transient Occupancy Tax, increasing the tax on group meeting hotels from 10.8 to 12.5 percent and all other hotels from 10 to 11.5 percent. The third resolution would also place, a City Council initiated measure, a question seeking voter approval of a charter amendment to change the commencement of terms of Office for newly elected Members of the City Council, Section 301 from: "the current terms of each member of the city council shall commence on the fourth Tuesday following his or her election" to "the term shall commence no later than five days from the Certification of the election results by the City Clerk." Three resolutions are attached, to respective measures, if the Council desires to authorize any, or all, of its members to file primary/rebuttal written arguments. If the resolution is not adopted prior to the date set for the filing of the arguments (mid-August), a member of the Council could only sign an argument as an individual. PATRICIAA. I WAS SO THOROUGHLY DISGUSTED, AT THE LAST STUDY SESSION, WITH ALL OF THE BICKERING THAT WENT ON BETWEEN COUNCIL MEMBERS AND COUNCIL MEMBERS & MANAGEMENT & STAFF, THAT I WALKED OUT OF THE MEETING. The first major development assignment for the Community Redevelopment Agency (CRA) , in 1974, was a parking structure on the Liebling/Tackett Trust properties in downtown Palm Springs . 2 . $35 ,000. was spent by CRA to local architects for conceptual studies (see appendix) . 3 . Over the years various other studies , concepts as well as a parking study done by the Economic Development Committee were authorized by the CRA. . 4. Howard Lapham spent over $15 ,000 ., iof his own money in 1983 on a complete development concept , cost 1 analysis and suggested financial structuring of IIII the project. Lapham then made a presentation of the project to the Economic Development Commission and to the Trustees of the Liebling Trust. Un June 22 , 1983 a letter from the CRA Director was sent to Lapham stating "This letter authorizes you within a 4 month period from July 1 , 1983 to contact the Trustees of the Tackett Trust and show them your concept. If they have the same degree of interest as shown by the Trustees of the Liebling Trust you will put together a project pro-forma that would reflect the cost/benefits to each of the parties , 1 . Tackett Trust 2 . Liebling Trust ' 3 . Redevelopment Agency of Palm Springs .. You will also submit several methods of financing same " (See Appendix) . Upon receipt of this letter Lapham contacted John W. Hough , in Chicago , a Tackett Trustee , and arranged a meeting at City Hall with all of the Co-Trustees of the Liebling/Tackett Trusts along with the CRA Director. 5/l/90 At this meeting the total concept was unanimously approved. . .However, La,t:er_Co-Trustee Henry Frank of the Liebling Trust withdrew his support and with no more follow-up by CRA the project did not proceed any further . 5 . 1985/86/87/88/89 studies were made by various architects for both the Owners and the CRA. The CRA appropriated a considerable amount of money to out of town architects for design studies again on this project . 6 . Here it is 1990 . . . 16 years later and NO parking structure . 7 . Once more Lapham is submitting an alternative precise concept plan , cost analysis , cost benefits and suggested financial structuring of the project (at his OWN expense) to the CRA '.and the Council 'for their consideration and determination if this project will help achieve the stated goals of the City in revitalizing the core of downtown Palm Springs . 8. This development concept plan on the Liebling Trust property called "Renaissance for Downtown Block Five" (which includes a parking structure, "The Marketplace" and ,Cafe Gardens" WITH "Teatro del Mercardo" ) that I presented to the Council back in May, 1990. . .which was enthusiastically endorsed by the Council would have been the catalyst to start bringing night life back into the very heart of downtown. However,- when I asked for a signed Memorandum of Understanding (by both the the Liebling Trust and the City) this was not forthcoming and I could not proceed further with this project . NOTE: The CITY, THE COMMUNITY REDEVELOPMENT AGENCY AND OWNERS AND ltl PRIVATE PARTIES HAVE SPENT HUNDREDS OF THOUSANDS OF DOLLARS FOR PLANS, COST ANALYSIS, PARKING STUDIES BY CONSULTANTS ! ! WHEREAS a Special Municipal Election is to be held in the City of Palm Springs, Califortia,November 6, 2001 at which there will be submitted to the qualified electors of said City, the following measure: [ ] Shall the City of Palm Springs Charter be amended to change the tern of each Member of the City Council to commence no later than five days from the Certification of the election results by the City Clerk NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, that the City Coimcil, being the legislative body of said City, hereby authorizes: Devna Hodges James Jones Ronald Oden Jeanne Reller-Spurgin William G. Kleindienst member of said body, to file written arguments in favor of the Charter Amendment set forth in the recitals hereof in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California, and to change said arguments until and including the date fixed by the City Clerk after which no arguments for or against said City measure may be submitted to the City Clerk.
