DATE: August 1, 2001 TO: CITY COUNCIL FROM: DIRECTOR OF PLANNING AND BUILDING REQUEST BYALAN SEYMOUR FOR THE ADOPTION OFA RESOLUTION OF CONVENIENCE AND NECESSITY IN ORDER TO SELL BEER AND WINE A NIGHTCLUB LOCATED AT 611 S. PALM CANYON DRIVE #16, PD-77, C-2 ZONE, SECTION 22. RECOMMENDATION That the City Council consider the adoption of a Resolution of Convenience and Necessity in order to sell beer, wine and liquor at a nightclub located at 611 South Palm Canyon Drive, in the Sun Center. SUMMARY The Planning Commission approved an application for a Conditional Use Permit for a nightclub at this location in the Sun Center on May 23, 2001. The applicant seeks to operate a nightclub and desires to sell beer, wine and liquor at this location. The State Department of Alcoholic Beverage Control will not issue a license for such a sale unless the City Council provides a letter indicating that the premises will provide for the public convenience and necessity. BACKGROUND In accordance with Section 23958.4 of the Business and Professions Code which took effect on January 1, 1995, the State Department of Alcoholic Beverage Control will not issue a license for the sale of beer and wine at this location without a letter from the City Council indicating the premises will provide for the public convenience and necessity. A finding of"Public Convenience and Necessity" means that the applicant premises will provide for the convenient patronage of the public whereby the convenience does not already exist in the immediate area. Necessity implies that the premises is needed by the community. The proposed cocktail lounge will occupy approximately 4,928 square feet (including a 928 square foot mezzanine area) of an existing 48,000 square foot retail building that is one of three commercial buildings existing on the site; additionally, a 14,294 square foot office building is located on the western portion of the site, "behind" the retail buildings and with frontage at 610 South Belardo Road. The proposed floor plan depicts a first floor of 4,000 square feet to include seating, three bars, dance floor with raised platform, restrooms, and cooler and storage areas. An approximately 928 square feet mezzanine area (proposed) will be utilized for the D.J , office and additional storage space, and limited seating. The overall seating capacity of the nightclub will be 67 seats. The nightclub is proposed to have an industrial warehouse look. The facility will host disc jockeys featuring live and recorded music and a light show. The proposed hours of operation are Thursday through Saturday evenings 9:OOpm to 2:00 am and Sundays 4:00 pm to 2:00 am. 3[A Other businesses located within the same building include a dry cleaner and a Mexican goods import shop (adjacent on either side), a bicycle shop, cosmetology school, a lock shop, a pet store, a restaurant, and a pharmacy. Businesses within the two remaining buildings on the site include a watch store, a mailbox rental store, and a Goodwill retail store. The office building located on this site was not constructed as part of the original shopping center and is therefore not tied architecturally to the center. The building is a tan stucco block with entry to the offices accessed from Belardo Road and with truck delivery docks accessed off of an internal driveway located behind the retail complex. Building improvements proposed as a part of this project include the addition of an approximately 928 square foot interior mezzanine area, and the construction of a block wall (matching the existing building wall materials) to fill in an existing overhead roll-up door at the rear (south) elevation of the building. Commissioner Raya abstained due to a conflict of interest. Alex Meyerhoff, Principal Planner, reported that the Type 1 Conditional Use Permit is for a 4,928 sq.ft. facility(in an existing 48,000 sq.ft. building)which, based upon State law, must be considered by the City Council if approved by the Planning Commission due to the Alcoholic Beverage Control Board licensing requirements. He stated that the proposed first floor plan is approximately 4,000 sq.ft. and will include seating, three bars, dance floor, restrooms, and cooler and storage areas. A second floor of approximately 928 sq.ft. is proposed to be utilized for D.J., office, and additional storage space,with overall seating capacity of 67. He reported that the nightclub(which is accessed from Belardo Road) is to have an industrial warehouse look and will have live and recorded music and a light show. Proposed hours of operation are Thursday through Saturday from 9:00 p.m. to 2:00 a.m. and Sundays from 4:00 p.m. to 2:00 a.m. and, because peak hours for this use will be after most other uses have closed, staff considers the parking plan requirement of 23 spaces sufficient. He reported that adjacent uses are commercial and that the area to the south is vacant. 314500", Page 3 of 5 Planning Commission Minutes May 23, 2001 He reported that proposed building improvements include the addition of the second floor area, construction of a block wall to fill in an existing overhead roll-up door at the back of the building. He clarified that an existing standard door at the back of the building will be used for emergency access only. He stated that noise levels may exceed code maximums; therefore, all doors and windows must be kept closed during times when amplified music (recorded or live) is being played and that a double door entry system be required. He reported no correspondence from neighborhood residents or business owners in response to the public hearing notice and that business center tenants were notified by property owner. He reported that the paved area at the rear of the building is not in good repair but no access is proposed or permitted in this area. Chairman Mills opened the Public Hearing. Mr. Gerald Newman, neighborhood resident, addressed that Planning Commission to state that, though he is unfamiliar with the applicant, he supports the proposal. Mr. Dean Carlson, project designer, addressed the Planning Commission to state that the applicant is willing to review lighting and noise, that the DJ space overlooks the dance floor, and that notices were hand-delivered to tenants; most of whom supported the use. Mr. Dick Hascamp addressed the Planning Commission to state that, as an adjacent business owner to another one of the applicants businesses (Hunters) he feels the applicant will be an excellent neighbor and is a cooperative and proactive business owner involved in charities. Mr. Marshall Pearcy addressed the Planning Commission to state that the applicants are very involved in AIDS charities and the community and are good business site managers. Ms. Victoria Rendall addressed the Planning Commission to urge their support as the DJ dance club is needed and not provided elsewhere in the Coachella Valley. She stated that she felt the use would be a positive addition to the entertainment market. There being no further appearances, the Public Hearing was closed at 2:20 p.m. Chairman Mills called the applicant to the podium to obtain additional information. Mr. Alan Seymour stated that the rear exit is intended only for emergency and deliveries. Planning Commissioners expressed concerns that, due to the location of the business(away from the Central Business District) there would be less Police security and that lighting levels may not be sufficient. Applicant stated that at Hunters there are four security guards on duty and that additional lighting has been added at that existing facility. Commissioners agreed that the applicant has a record of running this type of business well and established a level of trust in the community. Arenas Road Palm Springs , CA. 92262 n RESOLUTION 20151 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING A RESOLUTION OF CONVENIENCE AND NECESSITY IN ORDER TO OPERATE A NIGHTCLUB AND SELL BEER, WINE AND LIQUOR 611 SOUTH PALM CANYON DRIVE, #16, PD-77, C-2 ZONE, SECTION 22. WHEREAS, Dean Carlson ("applicant"), on behalf of Mark Seymour and Alan Seymour('owners") has requested the adoption of a Resolution of Convenience and Necessity in order to sell beer, wine and liquor at a nightclub 611 North Palm Canyon Drive, C-2 Zone, Section 22; and WHEREAS, the City Council is being asked to adopt a Resolution of Convenience and Necessity pursuant to the requirements of the Alcoholic Beverage Control Board; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the project, including but not limited to the staff report and conditions of approval; and NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby adopts a Resolution of Convenience and Necessity.
