HomeMy WebLinkAbout8/1/2001 - STAFF REPORTS (24) DATE: August 1, 2001 TO: City Council FROM: Director of Planning & Building CONDITIONAL USE PERMIT 5,0877 - APPLICATION BY VERIZON WIRELESS FOR A CONDITIONAL USE PERMIT FORTHE INSTALLATION OFA COMMERCIAL COMMUNICATIONS ANTENNA ON A 60-FOOT TALL MONOPOLE DESIGNED TO LOOK LI KE A PALM TREE AND AN ASSOCIATED 230 SQUARE FOOT EQUIPMENT BUILDING WITHIN A 812 SQUARE FOOT LEASED AREA IMMEDIATELY ADJACENT TO THE SOUTH ELEVATION OF AN EXISTING BUILDING LOCATEDAT 1555 SOUTH PALM CANYON DRIVE(PLAZADELSOL),ZONE PD-131, I.L., SECTION 22. RECOMMENDATION: The Planning Commission recommends to the City Council approval of Conditional Use Permit No. 5.0877 for the installation of a commercial communications antenna on a 60-foot tall monopole designed to look like a palm tree and an associated 230 square foot equipment building within a 812 square foot leased area immediately adjacent to the south elevation of an existing building located at 1555 South Palm Canyon Drive,Zone PD-131, I.L., Section 22. The applicant's representative is Dave Leonard. John Wessman is the sublessor of the property and the Agua Caliente Development Authority (ACDA) is the landlord. Sprint's lease is with John Wessman, with the consent of the ACDA. SUMMARY: On July 11, 2001, the Planning Commission voted unanimously(7-0)to recommend thatthe City Council approve Conditional Use Permit No. 5.0877, subject to conditions. BACKGROUND: Verizon Wireless has submitted an application for a Type II Conditional Use Permit to install a commercial communications antenna on a 60-foottall monopole structure designed to look like a palm tree and a 230 square foot equipment building within a 812 square foot leased area immediately adjacent to the south elevation of an existing building located at 1555 South Palm Canyon Drive. A related item appears on the agenda pertaining to Sprint PCS's application for a Type II Conditional Use Permit to install a commercial communications antenna on a 73-foot tall monopole structure designed to look like a palm tree and seven small equipment cabinets located within a 728 square foot leased area,also immediately adjacent to the south elevation of the existing building located at 1555 South Palm Canyon. Verizon Wireless is currently in the process of expanding theirwireless telecommunication services to cover the immediate area as well as the entire Coachella Valley. Verizon Wireless currently has a site in Palm Springs at 1901 East Baristo and one under construction at 2050 Executive Drive. The communication antenna array is proposed to be a three-sided structure typical of wireless of telecommunications antennas, but will be designed to look like a palm tree ("mono-palm") in that the 60-foot pole will be wooden and faux palm fronds will surround the antenna arrays. Planning �C� Case No. 5.0877 -Verizon mono-palm August 1, 2001 Page 2 of 3 Commission has recommended a condition of approval requiring the addition of two live palm trees, tiered in height(i.e,, 50 feet and 40feet in height)and similar in appearance to the proposed mono- palm,within the lease area to provide a more natural looking cluster effect. The applicant proposes to remove some existing trees and vegetation and also proposes to install new landscaping outside the perimeter wall. As a condition of approval, a final landscape plan would be required to be reviewed and approved bythe Directorof Planning and Building priorto issuance of building permits. The associated radio equipment will be housed within a 10-foot high, 230 square foot equipment building. Both the proposed mono-palm and equipment building will be surrounded by a proposed eight-foot high perimeter block wall which will be stuccoed and painted to match the existing building. The proposed perimeterwall is intended to enclose the Verizon mono-palm and 10-foot high equipment building as well as the proposed Sprint 73-foot high mono-palm and associated equipment cabinets. Due to the height of the proposed Verizon equipment building, the Planning Commission recommends that the proposed perimeterwall be of a height sufficient to completely screen the building. As such, Planning Commission has included a condition of approval requiring that the perimeter wall measure 10 feet in height in order to conceal the 10-foot high equipment building and proposed lights associated with the proposed Verizon equipment. ANALYSIS: 1. Airport Impacts: Mike Williams, Deputy Director of Operations for the Palm Springs International Airport,was consulted about the site and indicated that he anticipates that the proposed commercial communications antenna structure is not an obstruction (i.e., the structure does not penetrate air space around the airport), norwould the proposed antenna have any direct or indirect impacts on operations at Palm Springs International Airport. Helicopter tours fly in that area during the season, as well as some private helicopters, and whenever necessary, emergency/rescue aircraft. As a condition of approval, the applicant would be required to obtain all necessary approvals from the Federal Aviation Administration prior to issuance of building permits. 2. Visual Impacts: The applicant has submitted photographs of the existing site as well as photo simulations of the proposed mono-palm and how itwould appearin the currentvisual environment surrounding the site. These photo simulations depict the existing palm trees,the existing building which measures 50 feet at the maximum height,the proposed mono-palm,two additional live palm trees within the leased area pursuant to the proposed conditions of approval, and the proposed ten- foot high perimeter wall. The site is surrounded primarily by commercial zoning designations and commercial uses. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: This Conditional Use Permit is categorically exemptfrom environmental assessment pursuant to Section 15303 of the California Environmental Quality Act (CEQA). Section 15303 states that installation of small new equipment is exempt from CEQA. All property owners within 400 feet of the project site have been notified of the public hearing. As of the writing of this report, no correspondence or inquiries from the public were received by staff. EXHIBIT A Conditional Use Permit No. 5.0877 Verizon Wireless 1555 South Palm Canyon Drive August 1, 2001 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer,the Directorof Planning,the Chief of Police,the Fire Chief ortheir designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code,or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 1 a. The ownershall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers oremployees to attach, set aside, void or annul, an approval of the Cityof Palm Springs, its legislative body,advisory agencies, or administrative officers concerning Case 5.0877. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notifythe applicant of any such claim, action or proceeding orfails to cooperate fully in the defense,the applicant shall not,thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matterfollowing an adverse judgement or failure to appeal, shall not cause a waiver of the indemnification rights herein. 2. Commencement of use or construction under this Conditional Use Permit shall be within two(2)years from the effective date of approval. Extensions of time maybe granted by the Planning Commission upon demonstration of good cause. 3. If the communications antennae, monopole or equipment building are ever proposed to be modified in any manner such as the inclusion of other antennae,satellite dishes and/or other support equipment, the proposed modifications shall be submitted to the Director of Planning and Building for review and approval prior to installation. If the technology regarding the communications antennae changes in where the antennae and/or equipment building as approved become obsolete, then the antennae shall be removed. 5. If the use of the subject property is ever changed, the City reserves the right to modify or revoke this Conditional Use Permit application. 6. The maximum height of the commercial communications antenna and monopole structure shall be 60 feet, as indicated on the conceptually approved plans, as measured from finished grade to the highest point of the antenna. 7. If the antennae and/or monopole are ever abandoned or if this Conditional Use Permit ever expires, the monopole and antennae shall be removed within 30 days. 8. Manufacturer's cut sheets of the proposed antennae shall be submitted to the Director of Planning and Building prior to the issuance of permits for installation of the commercial communications antennae. 9. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code regarding public art.The project shall either provide public art or payment of an in lieu fee. In the case of the in-lieu fee,the fee shall be based upon the total building permit valuation as calculated pursuant to the valuation table in the Uniform Building Code, the fee being 1/2% for commercial projects or 1/4% for residential projects with first $100,000 of total building permit valuation for individual single-family units exempt. Should the public art be located on the project site, said location shall be reviewed and approved by the Director of Planning and Building and the Public Arts Commission, and the property owner shall enter into a recorded agreement to maintain the art work and protect the public rights of access and viewing. 10. Afinal landscape plan shall be submitted for review and approval by the Director of Planning and Building prior to issuance of building permits. A minimum of two (2) live palm trees, tiered in height and similar in appearance to the mono-palm,shall be installed atthe location. The perimeterwall shall measure 10 feet in height and be finished and painted to match the existing building. 11. The applicant shall comply with the requirements of the Federal Aviation Administration. Proof of compliance shall be provided to the Directorof Aviation to the Directorof Planning and Building prior to the issuance of building permits. 12. Not Used. 13. The applicant/operator of the facility shall agreetoallowthe co-location of equipment of other wireless communications providers at this site when applications are received by the City and it is considered feasible, subject to an agreement between the applicant/operator, the other proposed wireless communications provider, and the property owner. Construction shall be in accordance with the 1998 California Fire Code and 1997 California Building Code. 17. Address shall be plainly visible and legible from the street per the 1998 California Building Code. Contact building official. 18. A KNOX key box is required per the 1998 California Fire Code. Contact this office for a KNOX application as soon as possible. 19. Portable fire extinguishers shall be installed in accordance with the 1998 California Code, Article 10, and Standard 10. 20. Pursuantto the Zoning Ordinance, a commercial communications antenna is authorized in the PD-131 zone pursuant to approval of a Type II Conditional Use Permit. b. The use applied for is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna is in harmony with the various elements and objectives of the City of Palm Springs General Plan and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna will not have a significant visual impact on the environment surrounding the site. c. The site for the intended use is adequate in size and shape to accommodate said use, including yards, setbacks,walls orfences,landscaping and otherfeatures required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. The site for the communications antennae, on a 812 square foot leased area immediately adjacent to the south elevation of an existing building located at 1555 South Palm Canyon Drive, is adequate in shape and size to accommodate said use, including all features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. d. The site for the proposed use related to streets and highways is properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. The site forthe proposed communications antennae will not have a direct or indirect impact on streets and highways and is properly designed in the subject area. e. The conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare, including any minor modifications of the zone's property development standards.
