MUNICIPAL EMPLOYEE RELATIONS REPRESENTATIVE (MERR)
AND THE PALM SPRINGS POLICE MANAGEMENT ASSOCIATION
OF PALM SPRINGS (PSPMA) REPRESENTING THE POLICE
MANAGEMENT UNIT
i 1. The City of Palm Springs (hereinafter the "City") and the Palm Springs
Police Management Association (hereinafter "PSPMA") previously entered
into an agreement entitled Memorandum of Understanding (MOU)
between the Municipal Employee Relations Representative (MERR) and
The Management Association of Palm Springs (MAPS) representing the
Police Management Unit which was approved by City Council on October
19 , 2005.
2. The City's representatives and PSPMA representatives have reached
agreement wherein PSPMA members will return their City provided cell
phones and will receive a $50.00/month Cell Phone Allowance instead_
This will ease the City of the responsibility of maintaining an account,
reviewing monthly billing statements and obtaining and replacing City
issued cell phones. This will also create one consistent Cell Phone Policy
for the Palm Springs Police Department since the Palm Springs Police
Association (PSPOA) negotiated and implemented this change effective
February 1, 2007 for members of their Unit.
3. Therefore, the parties have met and conferred in good faith and have
jointly prepared this Side Letter of Agreement.
4. The City's representatives and the PSPMA representatives have reached
the understanding reflected by this Side Letter and agreed to recommend
same to their respective representative bodies. The parties jointly urge
City Council to adopt this Side Letter by Minute Order which will provide
for the MOU changes contained herein. The parties hereto acknowledge
that this Side Letter shall not be in full force and effect until adoption by
the City Council.

Subject to the foregoing, this Side Letter is hereby executed by the
authorized representatives of the City and MAPS and entered into this thirteenth
day of January, 2007.

SUMMARY
Staff is requesting that the City Council approve a Side Letter of Agreement with the
Police Management Unit which would provide a $50 Cell Phone Allowance in lieu of
receiving a City provided cell phone effective February 1, 2007.
RECOMMENDATION:

FISCAL IMPACT: 9)k-
The General Fund cost for 2006-2007 is estimated at $3,300. The cost to implement
the Cell Phone Allowance for this Unit is $3,000 annually. There is an approximate
savings of$300.00 a year to the City.

I HEREBY CERTIFY that this Minute Order, approving a Side Letter of
Agreement of the July 1, 2005 to June 30, 2007 Memorandum of
Understanding (MOU) between the Municipal Employee Relations
Representative (MERR) and the Palm Springs Police Management
Association (PSPMA) representing the Police Management Unit, was
adopted by the City Council of the City of Palm Springs, California, in a
meeting thereof held on the 17th day of January 2007.
