Ready, City Manager BY: John Raymond, Director Community & Economic Development SUMMARY This is a Resolution to reinstate the two-hour time limits on Indian Canyon Drive between Saturmino Road and Andreas Road for an indefinite period of time. RECOMMENDATION: Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REINSTATING THE TWO-HOUR TIME LIMITS ON PARKING OF MOTOR VEHICLES ON INDIAN CANYON DRIVE BETWEEN SATURMINO ROAD AND ANDREAS ROAD. STAFF ANALYSIS: The suspension of the parking time limits on Indian Canyon Drive between Saturmino Road and Andreas Road has caused an adverse affect for customer accessibility to businesses directly in the area. These on-street parking spaces on Indian Canyon Drive are being used predominately by employees for long periods of time, reducing customer availability. The business owners in the affected area have requested the two-hour time limit be reinstated. Their request has been reviewed by the Main Street Board and the consensus of the Board was that the reinstatement of the two-hour time limits on Indian Canyon Drive between Saturmino Road and Andreas Road would not be detrimental to the suspensions of time limits in City owned lots or other areas of Indian Canyon Drive and Belardo Road in effect until July 1, 2007. The increased business activity on Indian Canyon Drive and the request by the affected businesses, warrants the reinstatement of the two-hour time limits. ITEM NO.� City Council Staff Report February 7, 2007 — Page 2 Reinstate Two-Hour parking The Main Street Board is requesting that the City Council approve the reinstatement of the two-hour time limits in the area requested by the business owners. The Board also felt this action would be a good faith effort to meet the needs of the affected businesses. Attached is a Resolution reinstating the two-hour parking time limits on Indian Canyon Drive between Saturmino Road and Andreas Road. The temporary suspension of two- hour time limits on other areas of Indian Canyon Drive, Belardo Road and City owned lots would remain in effect until July 1, 2007, as approved by the City Council on September 20, 2007, Resolution #21718. FISCAL IMPACT: IFinance Director Review: / 4 - The fiscal impact of this action will likely be a small increase in parking violation revenue through additional fines. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REINSTATING THE TWO- HOUR TIME LIMITS ON PARKING OF MOTOR VEHICLES ON INDIAN CANYON DRIVE BETWEEN SATURMINO ROAD AND ANDREAS ROAD. The City Council of the City of Palm Springs finds: A. On June 8, 2005 the City Council adopted Resolution 21286 suspending the imposition and enforcement of time limits on parking of automobiles on City owned parking lots between the dates of June 9, 2005 and September 30, 2005. B. On September 21, 2005 the City Council adopted Resolution No. 21414 extending the suspension of the imposition and enforcement of time limits on parking of automobiles on City owned parking lots between the dates of October 1, 2005 and December 31, 2005. C. On December 14, 2005 the City Council adopted Resolution No. 21480 extending the suspension of the imposition and enforcement of time limits on parking of automobiles on City owned parking lots between the dates of January 1, 2006 and June 30, 2006. D. On September 20, 2006 the City Council adopted Resolution No. 21718 extending the suspension of the imposition and enforcement of time limits on parking of automobiles on City owned lots and on Indian Canyon Drive and Belardo Road from Ramon Road north to Alejo Road until June 30, 2007. E. The businesses on Indian Canyon Drive have submitted a request to reinstate two-hour time limits on Indian Canyon Drive between Saturmino Road and Andreas Road for an indefinite period of time. The Main Street Business Association reviewed the request from the business owners and concur that the area is being used predominately by employees, which is affecting customer parking- F. The City Manager, pursuant to Section 12.32.050 of the Palm Springs Municipal Cade, has examined the request by the business owners and determined that the continuation of the suspension of time limits is adversely affecting customer parking in the area of Indian Canyon Drive between Saturmino Road and Andreas and warrants the reinstatement of the two-hour time limits and enforcement of time limits. The City Council of the City of Palm Springs therefore resolves: Section 1. The City Council reinstates the imposition and enforcement of two-hour Resolution No. Page 2 time limits on the parking of motor vehicles on Indian Canyon Drive between Saturmino Road and Andreas Road, effective the date signs are re-installed. Section 2. Except as expressly provided in this resolution, all regulations governing the driving, stopping, parking, or leaving standing of vehicles on City awned parking lots and public streets shall remain in full force and effect.
