SUBJECT: Airport Hold-room Project - Special Testing and Inspection Services
Agreement No. 5167, Amendment No. 2.

SUMMARY
This action would approve an amendment with Southern California Soil & Testing, Inc.
for additional Special Inspection and Testing work at the airport Hold-room project.
RECOMMENDATION:
Adopt Minute Order No. approving Amendment No. 2 to Agreement No. 5167,
with Southern California Testing & Inspection, Inc. for additional special inspection and
testing for the Airport Hold-room project in an amount not to exceed $80,371.
STAFF ANALYSIS:
Southern California Soil & Testing, Inc. was hired by the City to conduction special
testing and inspection at the airport for both the Checkpoint project and the Hold-room
project. The hold-room project still requires special inspection for the sprayed
fireproofing and the allocated dollars have been expended. It is estimated that an
additional $20,675 will be need for that inspection activity. The Security wall is about to
be added back into the project and with its relocation, to provide for a wider walkway, it
i has now become a retaining wall. The retaining wall requires continuous inspection
while it is constructed. It is estimated that $59,696 will be needed for this new
i inspection activity. The total change order requested is $80,371 which will bring the
total contract to $214,776. In both instances the contractor will be monitored closely to
try and expend less if possible.
At the last Airport Commission meeting staff advised the Commission that with the
i number of components of the project not yet under contract or in need of amendment,
that items will need to go directly to City Council for approval to avoid potential delays;

Commission at their 2/14/07 meeting
FISCAL IMPACT: Finance Director Review-
The special inspection and testing work that is needed for the Hold room and security
wall is eligible for grant reimbursement and will be 95% funded from AIP-38 and
charged to Account415-6600-56063.

Minute Order approving Amendment No. 2 to Agreement No. 5167 with Southern
California Soils & Testing, Inc. for special inspection and testing services related to the
Airport IIold-room and security wall project was adopted by the Ciiy Council of the City
of Palm Springs, California in a meeting thereof held on the 7th day of February 2007.

AMENDMENT NO. 2
AGREEMENT NO 5167— SPECIAL TESTING & INSPECTION SERVICES
THIS SECOND AMENDMENT to Agreement No. 5167 for contract services, (herein
"Amendment") made and entered into on the day of 200 , by
and between the CITY OF PALM SPRINGS (herein "City") and SOUTHERN
CALIFORNIA SOIL & TESTING, INC. (herein "CONTRACTOR") is hereby amended
effective as follows:
RECITALS
The City and Contractor entered into that certain Contract Services Agreement No 5167
for Special 'testing & Inspection Services ("Agreement"), as duly amended from time to
time.
The parties wish to amend the Agreement pursuant to the terms of this Amendment to
add additional services to be performed by the Contractor and increase the Contract Sum
to authorize payment for such additional services.
NOW, THEREFORE, the parties hereto agree as follows:
Section 1
Exhibit "A" Scone of Services, is hereby amended by adding the attachments `A' and `B'
defining the work included in this amendment. Attachment `A' is additional services for
City Project 2005-10 (Holdroom) and Attachment 'I3' is the scope of services for City
Project 2005-10 (Landscape and Security Nall),
Section 2
Compensation:
2.1. Contract Stun — The contract sum is amended to reflect total compensation
:for initial agreement amount ($23,500), Change Orders and Amendments to date
($110,905) and the additional amounts for Attachment `A' ($20,675), Attachment `B'
($59,696). New contract amount is NTE $219,776.00
Exhibit"C" Schedule of Compensation. is amended by addine the following:
• Attachment `A' (Passenger Holdroom) shall be a lump sum, not to exceed
$20,675. Actual compensation shall be based on hours worked times the hourly
rate (see Exhibit C), but not exceeding the S20,675. Contractor shall submit
invoices monthly based on the actual number of hours worked in completion of
Work for reimbursement.
• Attachment `B' (Landscape and Security Wall) shall be a lump sum, not to exceed
$59,696. Actual compensation shall be based on hours worked times the hourly

rate (see Exhibit C), but not exceeding the S59,696. Contractor shall submit
invoices monthly based on the actual number of hours worked in completion of
Work for reimbursement.
Section 4
1. Full Force and Effect. Except as previously modified herein, all other provisions
of the Agreement shall remain unmodified in full force and effect.
Section 5
Corporate Authority. The persons executing this Amendment on behalf of the parties
hereto warrant that (i) such party is duly organized and existing, (ii) they are duly
authorized to execute and deliver this Amendment on behalf of said party, (iii) by so
executing this Amendment, such party is formally bound to the provisions of this
Amendment, and (iv) the entering into this Amendment does not violate any provision of
any other agreement to which said party is bound.
