MID-VALLEY PARKWAY PHASE-3 DESIGN AMENDMENT NO, 12
RECOMMENDATION:
That City Council approve Amendment No. 12 to consultant services contract with Robert
Bein, William Frost & Associates (RBF Consulting) in the amount of $3,590 for expanded
engineering services (Construction Survey Staking,etc.)for the Mid-Valley Parkway(Phase
3) Construction, and revising RBF's contract to a new total of$105,790 (for Phase 3) and a
new combined total of$1,099,681 for all three phases of the Mid-Valley Parkway Engineering
Services Contract with RBF Consulting; City Project No. 99-13
BACKGROUND:
On November 3, 1993 City Council approved a consultant services contract with RBF
Consulting for traffic engineering and design consulting services for the City of Palm Springs
(Minute Order 5277-Agreement No. A3298).
RBF Consulting was then hired to design MVP Phase-1 (Dinah Shore Bridge and Mesquite
Avenue from Gene Autry Trail to east City limits). Next RBF was hired to design MVP Phase-
2(Vella Road Traffic Signal and Airport entrance off Ramon Road).Then on February 5, 1997
City Council approved RBF Design Amendment No.4 in the amount of$53,200 to design the
street widening at Gene Autry Trail and Ramon Rd. (MVP Phase-3). Design Amendment No.
8 (9/16/98-MO 6230) increased RBF's contract by$19,200 to$72,400; Amendment No. 10
(4/5/00- MO 6594) increased the design contract by $5,700 to $78,100 for the MVP Ph.-3
design and Amendment No. 11 (additional survey work) increased the contract by $24,100,
bringing the contract total to $102,200 which was approved by Council on August 2, 2000.
The design work is complete and the MVP Phase 3 construction phase is completed as well.
The City Engineer had requested a proposal from RBF Consulting to provide additional
construction staking services for the Lowe's Project at SE corner of Ramon and Gene Autry
as well as additional Utility Work and Storm Drain Catch Basin Work. On June 1, 2001 RBF
Consulting submitted a written proposal totaling $3,590 for the requested extra work. The
additional work increases the MVP Ph.-3 contract to $105,790. This work, combined with
Phase-1 and Phase-2 of the MVP Project design increases the master Purchase Order No.
606095 with RBF Consulting to $1,099,681.
Sufficient Funds are available forthe RBF Consulting design contract in Measure A accounts
134-4497-50133 (Regional Measure A portion from CVAG) and 1 34-4498-50 1 33 (Local
Measure A match portion) and all costs are 50% reimbursable from CVAG.

AGREEMENT#3298 - TRAFFIC ENGINEER CONSULTING SERVICES
THIS TWELFTH AMENDMENT TO THE MASTER AGREEMENT FOR CONTRACT SERVICES
NO. 3298 (approved by City Council on November 3, 1993 - Minute Order 5277) (herein
"Agreement"), is made and entered into this 18th day of July, 2001, by and between the CITY OF
PALM SPRINGS,(herein"City")a Municipal Corporation,and Robert Bein,William Frost Consulting
(RBF Consulting), (herein"Contractor"),and is hereby amended effective July 18,2001, as follows:
1.0 SECTION 2.1, Contract Sum, is hereby amended to provide an increase of THREE
THOUSAND FIVE HUNDRED AND NINETY DOLLARS($3,590)forexpanded engineering
services for the Mid-Valley Parkway (Phase-3), City Project No. 99-13, increasing RBF's
current MVP-Ph. 3 contractto$105,790 and increasing RBF's overall contract(on Purchase
Order No. 606095) to new grand total of$1,099,681 (Note: Previous Amendment No. 11
approved by City Council on September 18, 2000 (Minute Order No. 6677).
2.0 EXHIBIT "A", Scope of Services, is hereby amended by adding the RBF proposal for
amended engineering services as detailed in Exhibit"B"to this Amendment(RBF Proposal
dated June 1, 2001),and summarized by memorandum from Marcus Fuller,Associate Civil
Engineer on June 25, 2001 as Exhibit "A".
3.0 EXHIBIT "C", Schedule of Compensation, is hereby amended by adding the following:
ENGINEERING (EXTRA WORK) FOR MID-VALLEY PARKWAY (MVP-PH 3) PROJECT
CHANGES IN WORK AND FEES:
1. SURVEY STAKING FOR UTILITY VAULTS/ BASINS, MISC.- CP#99-13: $3,360
2. SURVEY STAKING FOR LOWE'S CENTER @ RAMON & GENE AUTRY: $5,760
S.T. $9,120
(Less credit for Staking- See Exhibit "A"): 5 530)
NET COST: $3,590
4.0 Corporate Authority. the persons executing this Agreement on behalf of the parties
hereto warrant that (i) such party is duly organized and existing, (ii) they are duly authorized to
execute and deliver this Agreement on behalf of said party, (iii) by so executing this Agreement,
such party is formally bound to the provisions of this Agreement, and (iv) the entering into this
Agreement does not violate any provision of any other agreement to which said party is bound.
5.0 Except as expressly provided herein, all other terms and conditions of the Agreement shall
remain unchanged.

I HEREBY CERTIFY that this Minute Order, approving Amendment No. 12 with
RBF Consulting, in the amount of $3,590, for expanded engineering services
(construction staking for Lowe's, etc.), for the Mid-Valley Parkway (Phase-3)
construction and revising RBF's contract to a new total of $105,790 (for Phase-
3), and a new combined total of$1,099,681 for all three phases of the Mid-Valley
Parkway Engineering Services Contract with RBF Consulting, City Project No.
99-13, was adopted by the City Council of the City of Palm Springs, California, in
a meeting thereof held on the 18th day of July, 2001.
