Indian Canyon Dr is apposed to this assessment. It is our belief that this assessment will primarily help the "big players" on Palm Canyon, at a cost to us smaller guys. What is the best way for me to show the meaning of extortion in the next council meeting on Feb 7th. I would like to show the legal terms, in so far as a gross overcharge of money. For my company it goes from $ 96.00 to $396.00, and I would question if it would be of any help to my business, due to no plan on file that shows any plans of how to spend the money. And only a part of the BID law is in this proposal, does that mean that the City of Palm Springs has the right to interpret the laws as they see it. Also go on record as never receiving anything from Main Street or the City of Palm Spring on the meeting of Jan. 17 th. I had to hear about it two days before the meeting from a friend, where as I knew this could not be right, but I was at the meeting and could not believe what I was hearing. John Hughes Mr Canvas — — ry 1/29/2007 a��/o Cindy Berardi �.- .,r: From: Joy Meredith [psca@msn.com] Sent: Tuesday, February 06, 2007 10:49 AM To: cityclerk@palmsprings-ca.gov 20 Subject: BID comments Dear Jay, I would like to comment on some of the discussions at Main Street this morning. 1)There were untrue comments regarding the side street representation made at the meeting- I personally have been to deliver(along with Rebecca Terrill) newsletters, cooperative advertising opportunities or other announcements at least 10 times within the past 12 months to the businesses on Tahquitz- It is true that on the website (www-PalmCanyonDrive.org -a 16-page site listing all downtown and uptown businesses that I do absolutely at no charge including server fees) I list the Main Street reps by block not including the side streets for space and simplicity reasons. They are definitely represented. Before Irene Watson (owner Cosmetique on Tahqutz) had a stroke she was very active in helping to communicate with that block on behalf of Main Street- 2) Each business listed in the Downtown Directory/Map received a letter regarding the BID from Cathy Van Horn and then a follow up letter from me later that week, It also detailed the 4 public meetings we held at various times, days, locations for the convenience of the business owners. Stefanie Frith has also been very cooperative about getting press releases and articles in the Desert Sun regarding Main Street and the BID. Then each merchant with a business license received the Public Hearing Notice from your City Clerk's office. So there were actually 3 written notices. (It does turn out, however, that several businesses did not receive the actual Public Hearing Notice-but that is because they are operating without a Palm Springs business license. I truly feel that we communicated well with the downtown/uptown merchants and I think that the few (under 20 out of over 700 Public Hearing Notices sent)speaks for itself. I am extremely proud of the work Cathy Van Horn and I have done on the Palm Springs Business Improvement District. Please feel free to call upon me for any questions you may have about the process we followed and the contacts we made. I would appreciate it if you would forward my comments to the City Council. Although the idea has merit, I believe it is premature to establish the district as this time for the following reasons: 1. The City of Palm Springs, both elected officials and appointed bureaucrats, are not small business friendly. The City makes it difficult for new businesses to open---and established businesses to thrive and survive. A change of attitude toward small businesses is needed at every level of government---local, county and state. That's why there is an exodus from Palm Spring by both locally owned businesses and national chains (i.e. Hamburger Hamlet, McDonald's, etc-)- In the months expect more store closures in downtown Palm Springs. 2. Local residents do not shop in downtown Palm Springs because of there is little or nothing to attract them. The variety of stores is limited which makes shopping dismal And parking is difficult. To promote downtown Palm Springs as it currently is a waste of our hard earned small business dollars. 3. Activties and special events do not draw local residents or even visitors. Blood drives, talent contests, charity events and even quality entertainment have failed miserably and have do nothing to help our businesses. A. The long-vacant Desert Fashion Mall located in the "heart of downtown" has contributed significantly to the decline of Palm Springs. The City should focus its attention on removing this blight before creating a downtown business improvement district. Again, I am in favor of establishing a Palm Springs Business Improvement District---but sometime in the future when downtown Palm Springs is revitalized, energized and recaptures some of its old glory. I urge the City Council not to adopt the Ordinance creating this special district and to table this topic until sometime in the future. I have a facial business and have been on Palm Canyon since 1998, I work with one client at a time and see -from 1-4 people a day, less in the summer. Advertising won't help me as my business is word of mouth. More people on Palm Canyon won't help me as I can only work on one person at a time. And at any time my business uses only 2 parking places. I think the $150 is too much for a micro-business such as mine. $500 is too little for places like The Follies, Kaiser Grill, or Las Casuelas Terrazzo. They would benefit more from advertising than a small business would. Please take into consideration the size of the business and the type of business that would be affected by the cost of the BID fees. I went to the city meeting and heard these people whine about having to pay$300 or so towards the BID. These people are looking at the small picture, not the big picture. The small picture is dishing out the money in the first place- I spend about$1200 a month in advertising for my little wine store in Down town. $300 is 1.5 business card size ad in the desert sun or 3 ads in the Desert Entertainer. Not much for$300111 But with $200,000 worth of advertising, we could really pull some people back to Palm Springs that have gone somewhere else in the desert. I just wished people would pull there heads out of the sand & realize that. One lady said that the $300 fee would kill her business, that person then needs to be selling at the swapmeet, not in a district like Palm Springs. BUT, I do hope the commity spends the money wisely and on events that we as a BID can come up with.Advertising is one thing, but creating other events or inviting events to come here would make all the difference in the world. The council would have taken a vote that evening but all electricity went out and the generators did not come on so they postponed the Council vote until February 7, 2007.As I said the public hearing has closed but we still need the council to know that we support the BID. Please take a moment of your time to send an email to our Palm Springs city clerk at CityClerk@palmsprings-ca.gov (attention city council.)Although there has been a very small percentage of protests (over 700 notices sent and 15 written or voice protests)the Council needs to know that there are businesses who really support it and understand the need to promote downtown. Any ordinance that the City Council adopts establishing the BID is required to be substantially consistent with the resolution of the City Council initiating proceedings. Thus, the ordinance cannot expand the BID concept beyond that identified in the resolution of initiating proceedings. The Council can consider a modified ordinance so long as the ordinance does not establish rates in excess of those identified in the resolution or expand the scope of the district beyond that contained in the resolution. Staff has prepared a modified ordinance that does two things. First, the ordinance provides for a voluntary contribution opportunity for restaurants, bars, and clubs with 101 seats or more and hotels with 50 or more rooms that would allow these establishments to provide additional funding towards the BID. The ordinance anticipates that the amount of the voluntary contribution would be equal to the specific amount of the assessment required under the ordinance. Thus, an eligible business would pay the $500.00 assessment required under the ordinance and would have the ability, if it wished, to make an additional voluntary contribution of $600.00 towards funding the BID. (See the last paragraph in Section 3.) Second, the ordinance adds language to expressly prohibit District funds from being used to supplant existing City funded programs within the District, thereby ensuring that the BID funds would not be used to pay for programs or services that are currently paid for by the City, (See Section 5.) City Attorney's Summary This Ordinance establishes the Palm Springs Business Improvement District, authorizes the levy of assessments as specified in the Ordinance to fund the promotional and marketing activities that benefit the businesses in the District, and establishes the Main Street Board of Directors as the Advisory Board to the Council on the District. The City Council of the City Palm Springs finds: A. SECTION 5. The revenue from the levy of assessments provided in this Ordinance, including the voluntary assessments provided in Section 3 above, shall be used for the purpose of funding, providing, or promoting activities which benefit businesses located and operating in the District, to the maximum extent permitted under the Law, except that such revenue shall not supplant existing city funded programs within the District, nor shall the revenues be used to provide improvements or activities outside of the area or for any purpose other than the purposes specified in Resolution 21793 or this Ordinance. SECTION 6. The Main Street Board of Directors, whose members are elected by the local businesses block by block, is designated as the District Advisory Board for the purpose of making recommendations to the City Council pursuant to the Law and generally develop and oversee each program funded by the assessments that would benefit the District. Assessment collections, accounting, and disbursement will be handled by the City's Finance Department. The duties and responsibilities of the Main Street Board shall consist of creating appropriate program budgets which shall be submitted to the City Council on an annual basis for approval. SECTION 7. City Council Staff Report January 17, 2007 — Page 2 Palm Springs Business Improvement District Upon opening the Public Hearing Council will receive testimony from interested parties about the adoption of the ordinance. The Public Hearing is a protest procedure in which any interested party may protest the formation of the BID either in writing prior to the Public Hearing date or during the Public Hearing comment period. On December 22, 2006 a Public Hearing Notice packet was mailed to 720 businesses located within the geographic boundaries of the BID and identified by the City's business license database. The packet contained a cover letter, the Public Hearing Notice, a copy of Resolution No. 21793, and a Q &A fact sheet. At the January 4, 2007 Main Street Executive Board meeting a discussion was held regarding the objectives and strategies of developing a promotion and marketing program, including the accountability component. The Board clearly understands the concerns expressed by the City Council at their December 20 meeting regarding the relationship with the Palm Springs Bureau of Tourism. The consensus of the Board is to establish a working partnership with the Palm Springs Bureau of Tourism whereby, on behalf of Main Street, PSBT would oversee the development of the promotion and marketing campaign. The Board also discussed the importance of the uptown and downtown stakeholders involvement in the development process to ensure there is consensus about the program. The Palm Springs BID will initially focus on developing a long-term sustainable promotion and marketing program for the downtown and uptown areas. The assessments will be collected with business license applications and renewals within the BID area, paid at the time the business license application is submitted or renewed through the City. All businesses located within the specified BID boundaries and that are subject to the city's business license will participate in the BID program, including retail, restaurant, theater, hotel and professional, service, and miscellaneous office businesses. The assessment will vary based on the type of business and the square footage and/or number of seats or rooms. Revenues collected will be maintained in a separate fund and dedicated to the defined area. The response from the majority of the business owners and managers has been very positive resulting in a decision by Main Street to move forward with the recommendation to implement a Business Improvement District. FISCAL IMPACT: Finance Director Review: Establishing the BID District will not negatively impact the general fund. BID assessments will create a funding mechanism for funding marketing programs for downtown and uptown Palm Springs, which do not currently exist. It is estimated that the BID will generate $150,000 to $200,000 annually. The Finance Department will be minimally impacted upon implementation of the Ordinance to calculate and collect the fees of the affected businesses. For the purpose of this Ordinance, the term "business" includes each establishment, firm, medical office, or similar entity doing business within the District and it does not include each professional responsible for the payment of a business license pursuant to Section 3.90.200 of the Palm Springs Municipal Cobb Ordinance No. Page 3 Code, so long as each such professional is within or a member of a business paying an assessment as provided in this Ordinance. SECTION 5. The revenue from the levy of assessments provided in this Ordinance shall be used for the purpose of funding, providing, promoting, and marketing activities which benefit businesses located and operating in the District to the maximum extent permitted under the Law. The revenue from the levy of assessments shall not be used to provide improvements or activities outside of the area or for any purpose other than the purposes specified in Resolution 21793 or this Ordinance. SECTION 6. The Main Street Board of Directors, who members are elected by the local businesses block by block, is designated as the District Advisory Board for the purpose of making recommendations to the City Council pursuant to the Law and generally develop and oversee the promotion and marketing program that would benefit the District. Assessment collections, accounting, and disbursement will be handled by the City's Finance Department. The duties and responsibilities of the Main Street Board shall consist of creating a promotion and marketing program and budget which shall be submitted to the City Council on an annual basis for approval. SECTION 7. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage. CURB APPEAL I have recently met with David Ready, Cathy Van Horn and Joy Meredith to discuss my concerns about the "Curb Appcal" in the downtown corridor- Most specifically, I am referring to the poor maintenance of the trash receptacles, benches, sidewalks and curbs. (Please see attached copies of emails sent to the City Council regarding my concerns)- Per my meeting with David Ready,it is my understanding that out new Parks and Recreation Director is extremely experienced and he is confident that she will take care of most of the concerns I have menihoned. However, as the primary organization representing the downtown merchants, I feel it is necessary for you to place this concern at the top of your radar screen. Our general Plan Mission Statement refers to us as a "World Class Destination" yet our city does not "SPARIU.1 " like a world class destination should. Visit one of our competitors nearby, namely Palm Desett, and you will see that their downtown corridor is much cleaner than ours. Also per my meeting with Cathy Van Horn, she was going to confirm the status of the rumored "CUP" Conditional Use Pettnit that requires individual businesses to maintain their store frontages cleanliness and orderliness- This paxticulax item is something I feel you should be awatc of and informing/reminding your member businesses of their responsibility, namely the restaurant/cafes with outdoor seating. Many of them have very duty outdoor sidewalk/dining areas and unsightly fuu- Lure or lack thereof. Examples would be jamba Juice, Einstein bagels, etc... 2. MARKETING OUR DOWNTOWN It is difficult at best to market a shopping district when many of the shops do not maintain regular business hours, work together on special events, etc, thus, I understand the obstacles you are up against. Here are a few suggestions for you to consider as you plan for the new BID (Business Improvement District) and other opportunities: "MARKET LIKE A MALL" o I have only lived in PS for 6 years and many of you have lived here and been in business downtown for many more years than that. You work tirelessly, Particularly,joy Meredith, to snake things a success in out wonderful city. But the thing that I have noticed the most about business downtown and throughout the valley is this; generally, the businesses that focus on the local residents first and foremost and the tourists second are the businesses experiencing longevity and prosperity. They understand that the locals are the bread and butter and the tourists are the icing on the cake. As we move further towards a year round community, this theory will prove to be more true. Mainstreet merchants need to remember this as we go through the process of redeveloping downtown and try to eliminate the perception that there is no shopping...if businesses are closed during prime shopping hours then there is in fact NO SHOPPING or a lack thereof! 2 ➢ ADOPT AN ORDINANCE FOR THE DOWNTOWN CORRIDOR THAT REQUIRES THE FOLLOWING: o Specific "minimum" hours of operation for tetailers and testaulants (hours may differ) that include prime weekend hours, evening hours, etc_ (see attached copy of email to the City Council referencing a very poor experience on a prime shopping day wherein many shops were closed in the iniddle of the afternoonl) o As a tesident, we need to be confident that what shopping there is downtown, that they will be open for business. As a tourist, we need to pto-u7de an "experience" which can only be done by out businesses being open during pthne titne. We need to rid 0UryL'lve5 of dne bad reputation we have for shopping when there is in fact very nice shops here already (yes we do need mote). o Interestingly, I learned from Marvin Roos that there was a movement towards a CRNI (Centralized Retail management) concept for downtown. The basic tenet was to evolve a cooperative atmosphere among ptopetty owners to move the individual properties more toward the management concepts of a shopping center—hours of operation, service standatds, maintenance, parking, tenant tnix, etc. The idea has been implemented elsewhere so concrete examples would have to be researched. There may be something in practice in Santa Momca concerning their 3" Street Promenade, or perhaps Old 'Town Pasadena. WHAT IS THE COMPETITION DOING? )�, Rancho Mirage just authorized a $55,000.00 "Shop Rancho Mirage" campaign > Palm Desert has its own magazine, 92260 and a significant marketing campaign > La Quinta has their own newspaper and a significant marketing campaign 5 Emails sent to City Council on September 18, 2006 Greetings Council Members, ' About 3 months ago, I had a very discouraging experience downtown wherein a friend and I were enjoying an ice cream at Coldstone Creamery and when we went to sit on a bench to leisurely enjoy our ice cream it was SO FILTITY that we could not use it-As we started to look closer at other benches and trash receptacles, I was actually embarrassed by what T saw. At a following planning comtission meeting eluting commission tcquests, I told of this incident and requested information about a maintenance schedule for these items. I have yet to receive any information but prior to Scott Miskell's retirement he informed me that there was no specific schedule of maintenance. This concerns me and should be an item of consideration when hittng a new director. If there is not a schedule for regular maintenance,what else is NOT being attended to? Interesting to note that,very shortly after my request, they panted the park benches and trash receptacles downtown. I had the opportunity to speak with Scott about this matter futthex before he retired wherein he was able to alleviate "some" of my concerns and kindly reminded ine of what the parks and rec department DOES DO without accolades'- however, two items we discussed are worth bringing to your attention: 1. Brick pavers: IIe told me that when the city decided to use pavers, he recommended against it due to maintenance issues and instead suggested stamped concrete. Per Scott, the pavers are required to be cleaned at least once a year and have only been cleaned once since their installation many years ago. Upon inspection,you will find them unattractive, stained and dirty. I am certain this is a budget issue but to be a World Class Resort Destination we need to maintain our curb appeal... 2. CUP ordinance: It is my understanding from staff that there is an ordinance for businesses in the downtown corridor that requires thetn to clean and maintain their street frontage/patio areas. You can surely see that, if in fact tills ordnance exists,it is not being enforced. Examples would be Peabody's,Jamba f uice, Einstein Bagels, etc. Hence, if such an ordinance exists, can we alert code enforcement to this issue so that may efficiently attend to it at the same time they ate addressing the sign ordinance,rack ordinance, etc. I am appreciative of your efforts and I am willing to assist in any way to help make our City better and brighter- Thank you for your attention to this matter. Having never seen this newsletter Mote I asked her where it catne from. She unformed that it can be found on our city website. Widi all the negative publicity the city gets for its "perceived"lack of communication with residents, I am concerned about die accessibility of this newsletter to residents and the lack of effectiveness it has- How many of our tcsidents actually visit the website,particularly looking for a newsletter, how many of our residents do not use computers or the internet and,last but not least, how many of our residents do not receive or read the desert sun or other local. papers. I think fox our newsletter to be most effective, it should be a direct mail piece to all permanent residents of our city. Although T do not have the budget facts, I am certain that this is a budget issue, howcvct, a quarterly newsletter could take the place of paid for but non-required advertisements in The Desert Sun, therefore,reducing advertising costs to those publications and putting it towards our own publication. As an active member of the community, T didn't know this newsletter existed so I can safely assume most residents do not know either. Additionally, I believe the newsletter could be a very effective tool to inform residents of what is happening in our community if it were published and delivered in a different way. Upon thinking about it further I had a brief discussion about it with Lec I lusfeldt. I asked about who markets our city to our tcsidents and her answer was the Bureau of Tourism- I suggest that the bureau markets to other communities, states and countries and not to out residents as their charge is a completely different focus- It is my belief that we need to get"buy in" froth our residents about the change and growth our comin nnity is experiencing. The newslettet is an ideal source in which we can effectively infonn and educate the citizens about our community. It could be a quarterly publication that is DIRE=MAILED to all full time residents therefore guaranteeing that dhey receive pertinent information about our community-Additionally, the newsletter could include event highlights, special events calendar, resident features, encourage voting, etc- Again, as before, I am available and willing to assist the city in any way I can so please don't hesitate to ask- Thank you for your consideration and I look forward to hearing from you about this suggestion. It is a reasonable question as to why the economic development objectives the proposed district, can not be accomplished via the existing organizations and their respective resources. Further to this, if it is the City's goal to revitalize the downtown and uptown district, it would be prudent for the City to implement improvements such as increased street lighting along N. Palm Canyon Drive and relaxing the extreme business restrictions with respect to certain signage limitations and the prohibition of sidewalk cafes. In conclusion, I thank the Honorable Mayor and Council Members for taking my concerns into account. To shift responsibility of marketing to improve business from the City to a defined group of Merchants in a downtown location, makes no sense. The Convention Center,The airport, Bureau for tourism have appointed positions, that supposed to coordinate 3 promote main tourism influx. 90% of the businesses downtown have a secondary or tertiary role in supporting tourism. While hospitality and restaurants handle the direct needs, entertainment would be next and shops/retail hold a third position. You market a destination, and the destination has to offer a full package product. If the appointed positions would be measured on results and not on appointment or a payroll check,this resolution would be moot. 3. The erosion of downtown is partially due to high retail space rents. 6 Months out of the year,you have hardly any activity,while 2 months are transitional and 4 months high season. Based on those statistics, your cost per sq/ft is in reality a lot higher, because you only can offset this with the season sales. If you look at it 616, and you pay$1.5 sq/ft monthly ... actually your cost is$3.00 sq/ft, and if it's $3.00 sq/ft it is actually$6.00 sq/ft.
