HomeMy WebLinkAbout7/5/2001 - STAFF REPORTS (17) RESOLUTION NO. 20093 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, MAKING CERTAIN FINDINGS AND DETERMINATIONS AND REQUESTING THE CALIFORNIA MOBILE HOME PARK CORPORATION TO UNDERTAKE A MOBILE HOME PARK CONVERSION PROGRAM IN TH E CITY OF PALM SPRINGS, CALIFORNIA WHEREAS, the City of Palm Springs, California (the "City"), does own land on which a mobile home park within the City is located, in order to provide quality low-income housing for the residents of the City; and WHEREAS, the City togetherwith the Redevelopment Agency of the City of Palm Springs (the "Agency") lack the requisite resources and knowledge to successfully undertake a program to alleviate the problems that are currently encountered by the residents in the mobile home parks within the City; and WHEREAS, the California Mobile Home Park Corporation, a California non-profit corporation (the "California Non-profit') has successfully undertaken similar programs on behalf of other cities within the State of California, and has thus far acquired ownership of eight(8) mobile home parks through the use of tax-exempt municipal bond financing and other governmental funds contributed by participating municipalities to assist such municipalities in overcoming their housing problems; and WHEREAS, the City seeks to authorize the California Non-profit to initiate a similar program within the municipal boundaries of the City for the benefit of the residents and to relieve a significant burden upon both the City and the Agency forwhich both the City and the Agency lack the resources to successfully engage in a program similar to that which has already been established by the California Non-profit in other cities; and WHEREAS, the City deems it desirable to take such official actions of this City Council as may be deemed necessary or desirable to permit the California Non-profit to have the requisite jurisdiction and authorization to undertake its established mobile home park conversion program within the City. NOW,THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AS FOLLOWS: SECTION 1. The City Council hereby finds and determines that the recitals contained herein are accurate and correct in all respects. SECTION 2. The City Council further finds and determines that the City and the Agency are within the requisite financial resources and experience to undertake a successful mobile home park conversion program that would allow for a stabilization of the rents charged within the mobile home parks in the City. Both the City and the Agency presently lack a source of funds that would provide for the /y� City Council Resolution No._ California Mobile Home Park Corporation July 5, 2001 Page 3 rehabilitation of both the mobile home parks and the mobile homes located therein. SECTION 3. The City Council further finds and determines that the program as proposed by the California Non-profit will relieve a burden upon the government of the City by solving problems and enhancing the living conditions for a significant number of residents of the City. The City has historically been able to expend only a limited amount of financial resources and City staff expertise upon resolving the numerous issues raised within the mobile home parks. The limited allocation of financial resources and diversion of staff time creates an unsustainable burden upon the other functions and programs of the City and the Agency which cannot be continued except to the detriment of the public, health and safety of all residents of the City. Other program and activities of the City and the Agency could suffer and be jeopardized if the City does not take this action and adoptthis Resolution to authorize the California Non-profitto initiate its successful mobile home park conversion program within the City. SECTION 4. The City Council by this official action hereby requests that the California Non-profit take such actions as it deems necessary to acquire, rehabilitate, convert and finance any and all mobile home parks and mobile homes within the boundaries of the City which the California Non-profit determines to be best situated for acquisition, rehabilitation, conversion and financing to non-profit corporate ownership in the best interests of the City and the residents thereof. SECTION 5. The City Council hereby authorizes the Mayor and the City Manager to deliver such additional letters and certifications as may be necessary to allow the California Non-profit to function within the City under all applicable federal and State laws. The City Manager or his designee is hereby authorized and directed to serve as the official representative of the City on the Advisory Board of the California Non-profit and to represent the interests of the City with the California Non-profit. SECTION 6. This Resolution shall take effect upon adoption and shall be not be repealed as to any activities undertaken prior to the date of any modification or rescission of this Resolution as to the authorizations delegated to the California Non-profit herein. /Y-4 City Council Resolution No._ California Mobile Home Park Corporation July 5, 2001 Page 3 APPROVED AND ADOPTED by the City Council of the City of Palm Springs at a regular meeting held on the_ day of July, 2001.
