PALM CANYON THEATER FIRE DAMAGE REPAIR
RECOMMENDATION:
That the City Council reject all bids and authorize readvertisement for bids for the
Palm Canyon Theater Fire Damage Repair, City Project 00-20.
SUMMARY:
Bids received at the scheduled bid opening of May 15, 2001, indicate that three of
the four bidders misinterpreted the bid documents. Chapter 3.12.190 of the
Municipal Code requires that the City Council reject any and all bids presented and
cause for the readvertisement for bids when bids received do not exceed the
authorized budgeted amount.
BACKGROUND:
The City has contracted with Reuel Young of Interactive Design Corporation to
prepare plans and specifications for the Palm Canyon Theater Fire Damage
Repair, City Project 00-20. Bids for this project were received on May 15, 2001,
from four bidders. However, three of the four bidders misinterpreted the bid
documents and submitted bids in error. Furthermore, an addenda was issued from
the consultant, a violation of the bidding process which requires that official
addenda be issued by the City.
In the interest of obtaining a responsive bid for this project, it is necessary to reject
all of the bids that were received and readvertise with a bid opening date of June
12, 2001.

FOR PALM CANYON THEATER FIRE DAMAGE REPAIR

N-1 NOTICE IS HEREBY GIVEN that sealed bids for the Palm Canyon Theater Fire Damage Repair - City
Project No. 00-20 will be received at the office of the Procurement Manager of the City of Palm Springs,
California, until 2:00 p.m. on June 12, 2001, at which time they will be opened and read aloud.
N-2 DESCRIPTION OF THE WORK: The Work comprises the repair of the fire damaged south wing of
an existing historically significant one-story poured in place concrete building at 538 N. Palm Canyon,
Palm Springs, California. The building dates from 1927 and is listed a Class 1 Historic Site. The building is
currently known as Palm Canyon Theater. The Work shall include but not necessarily be limited to:
miscellaneous repair and cleaning of the concrete, construction of new patio slab, heavy timber framing at
the south porch, new roof framing and miscellaneous seismic upgrades to existing roof framing,
installation of new clay roof tile, fabrication and installation of new wood windows and doors, installation
of new gypsum board on walls and ceiling, new HVAC unit and new light fixtures, and various other
work.
N-3 AWARD OF CONTRACT: (a) The City reserves the right after opening bids to reject any or all bids,
to waive any informality (non-responsiveness) in a bid, or to make award to the lowest responsive,
responsible bidder on the basis of the sum of Alternative Bid Schedule A and Additive Bid Schedule B, and
reject all other bids, as it may best serve the interest of the City. Bidders shall bid on all Bid Schedules.
(b) As a condition of award, the successful bidder will be required to submit payment and performance
bonds and insurance.
N-4 BID SECURITY: Each bid shall be accompanied by a certified or cashier's check or Bid Bond in the
amount of 10 percent of the total bid price of Alternative Bid Schedule A plus Additive Bid Schedule B,
payable to the City of Palm Springs.
N-5 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period of 60 calendar
days from the date of bid opening.
N-6 CONTRACTOR'S LICENSE CLASSIFICATION: The Contractor shall possess a valid Class B
Contractor license at the time of submitting bids.
N-7 PREVAILING WAGE RATES NOT APPLICABLE: Funding for the Work is with all local funds and, as
provided under City Charter, will NOT require compliance with the prevailing wage requirements of the State
of California.
N-8 RETAINAGE FROM PAYMENTS: The Contractor may elect to receive 100 percent of payments due
under the Contract Documents from time to time, without retention of any portion of the payment by the
City, by depositing securities of equivalent value with the City in accordance with the provisions of Section
22300 of the Public contract Code.
N-9 PRE-BID VISIT TO WORK SITE: Prospective bidders are required to attend a pre-bid walk through of
the proposed work site and existing facilities that will be conducted by the City at 10:00 a.m. on
Wednesday, June 6, 2001. Failure to participate in the pre-bid walk through will disqualify a bidder as non-
responsive.

from the office of the City Engineer, 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262. No refund
will be made of any charges for sets of Contract Documents.
(c) An additional fee of $25.00 will be charged for sets of documents sent by mail.
