RINGLEIN January 17, 2007 Honorable Mayor,Members of the Council In regards to the proposed BID,I spoke at the MainsLreet Merchants Association last week regarding this subject matter and I have included copies of toy comments and suggestions for your review and consideration. When marketing a business,one needs to be properly prepared for the customers and that includes CURB APPEAL.When you visit a new city or a new business or look to buy a new home,what makes the difference between SIMILAR places?The place that SPARKLES AND SHINES!That is what makes the difference. Our city needs to be looked at this way in order to attract QUALITY residents and visitors alike. The new general plan (yet to be adopted) mission statement refers to Palm Springs as a"world class destination",yet our curb appeal does not reflect that. Per prior correspondence with you regarding this issue,our commLu-uty DOES NOT Sparkle& Shine like a world class destination should. Our curb appeal is in need of attention. At our main attraction, the downtown eorndor • The sidewalks are dirty • The trash cans and benches are not regularly maintained • The tree wells are lacking flowers and plantings • Store frontages and buildings are not maintained and lack aesthetics. Examples include Jambi juice,Einstein bagels with their poorly maintained patios, table&chairs or lack thereof, trash, etc.The Town& Country Center, specifically on the Indian Canyon frontage is in need of serious curb appeal improvements regardless of its fuLrue. • Single family homes with dead or nonexistent landscaping throughout the city particularly on out main frontage roads • Vacant lots with trash, etc throughout the city %Vhcn I look around and compare us to our neighboring cities,a few of them are doing a sigrrificandy better job in ibis area then we arc. They are also doing a better job on marketing their conununitics to the LOCAL RESIDENTS of the Coachella Valley Now that we have a fully staffed code enforcement department and a new parks and recreation director joining us, I think it is time that the council members and city staff cake a serious look at the maintenance and cleanliness of our community that will Support the BID efforts; Consider adopting a CRM,Centralized Retail Management program for the downtown corridor in order to provide for a successful experience to the resident and visitor. A CRM would provide a proper retail mix,maintenance requirements,basic hours of operation, a consistent marketing campaign, etc Consider inventorying single family residences and vacant lots and enforce die ordinances that require landscape maintenance and eliminate blight Consider developing a vacant window program that includes artwork displays,promotions of our wonderful attractions,etc so as to masquerade the"vacant"look and use as a medium to share our vision When throwing a party,you clean up your house... CURB APPEAL I have recently met with David Ready, Cathy Van Horn and Joy Meredith to discuss my concerns about the "Curb Appeal" in the downtown corridor. Most specifically, I am teferring to the poor mainrenance of the trash receptacles, benches, sidewalks and curbs. (Please see attached copies of emails sent to the City Council regarding my concerns). Per my meeting with David Ready,it is my understanding that out new Parks and Recreation Director is extremely experienced and he is confident that she will take cue of most of the concerns I have mentioned. However, as the primary organization representing rite downtown merchants, I feel it is acces5a y for you to place this concern at the top of your tadar screen. Our general plan Mission Statement refers to us as a "World Class Destination" yet out city does not "SPARKLE" like a world class destination should_ Visit one of our competitors nearby, namely Palm Desert, and you will see that dirt downtown corridot is much cleaner than otirs. Also per my meeting with Cathy Van I lom, she was going to confirm the status of the rumored "CUP" Conditional Usc Permit that requires individual businesses to maintain their store frontages cleanliness and orderliness. This particular item is something I feel you should be aware of and informing/reminding your membet businesses of their responsibility, namely the restaurant/cafes with outdoor seating. Many of them have very dirty outdoor sidewalk/dining areas and to sightly furniture or lack thereof (xamples would be Jamba Juice, 14,macin bagels, etc... 2. MARKETING OUR DOWNTOWN It is difficult at best to market a shopping district when many of the shops do nor maintain regular business hours, work together on special events, etc, thus, I understand the obstacles you ate up against. Here are a few suggestions for you to consider as you plan for the new BID (Business Improvement District) and other oppoxtuinities: ➢ "MARKET LIKE A MALL" o l have only lived in PS for 6 years and many of you have lived here and been in business downtown for many more years than that. You work tirelessly, particularly,Joy Meredith, to make things a success in out wonderful city. But the thing that I have noticed the most about business downtown and throughout the valley is this; genetally, the businesses that focus on the local tesidents fast and foremost and the tourists second are the businesses experiencing longevity and prosperity. They understand Char the locals are the bread and butter and the tourists are the icing on the cake. As we move further towards a year round community, this theory will prove to be more true. Mainstreet merchants need to remember this as we go through the process of redeveloping downtown and try to clitniaatc the perception that there is no shopping...if businesses are closed during prime shopping Hours then there is in fact NO SHOPPING or a lack thexcofl 2 ➢ ADOPT AN ORDINANCE FOR THE DOWNTOWN CORRIDOR THAT REQUIRES THE FOLLOWING: o Specific "minimum" hours of operation for retailers and restaurants (hours may diffet) that include prime weekend houts, evening hours, etc. (see attached copy of email to the City Council tcferenci ng a very poor experience on a prime shopping day wherein many shops were closed in the middle of the afternoonl) o As a resident, we need to be confident that what shopping there is downtown, that they will be open for business. As a tourist, we need to provide an "exTetience" which can only be done by our businesses being open during prime ttmc. We need to rid ourselves of the bad reputation we have for shopping when there is in fact very nice shops here altcady (yes we do need snore). o Interestingly, I learned from Marvin Roos that there was a movement towards a CRM (Centralized Retail management) concept for downtown. The basic tenet was to evolve a cooperative atmosphere among property owners to move the individual properties more towatd the management concepts of a shopping ccntct--hours of operation, service standards, maintenance, parking, tenant mix, etc. The idea has been implemented elsewhere so concrete e%atuples would have to be researched. There may be something in practice in Santa Monica concerning their 3`1 Street Promenade, or perhaps Old Town Pasadena. The economic strategy piece was removed from the General flan before it was adopted in 1993- 1 strongly believe that this idea should be seriously considered again. ➢ KIOSKS o On each block with main businesses listed and a map of their location • Benefits locals and tourists ➢ NEW BUSINESS GUIDE o Outstanding collateral item o Suggestion: Designate/identify the block to correspond to addresses • 100 block, 200 block, etc o Food for thought... • How does a resident obtain one of these guides? ➢ DEVELOP A"CONFERENCE" CAMPAIGN o A plan needs to be developed to accommodate conferees with information and "oppottunities" for the PS Experience. Tnstead of putting something together on an individual basis or "on the fly" for each conference, develop a standard program to make it easy and efficient to execute, provide consistency and achieve success. • The "PASSPORT" being designed for an April conference is a perfect example of a collateral piece to be updated and used annually as parr of a conference program. 3 ➢ MAGAZINE o Publish a Pahn Springs Specific tnagazinc (absolutely NO other communities featured) that is delivered to ALL permanent PS residents. Advertising dollars could pay for it as a break even and possibly a for profit opportunity. Pursue opportunities for possible partnership with the Desert Sun of other entity to publish it. The magazine should be published at least Quarterly and can feature; • Special Events • Shopping Dining • Resident interviews • Photo displays • T3vents • Residents • Attractions • Prize drawing survey in each issue • Ask questions about articles, features in the magazine • Requires magazine to be read to answer questions • Make prize worth the effort • Editorials and articles • About our parks ' • Educational o Issues on height o Issues about conservation • City information &announcetnents • New developments (advertorial ) O Rael project o Linneken Project O Fashion Mall o Hard Rock Hotel • Architectute • Etc, etc, etc ➢ EVENTS: o Prepare an Annual Calendar Weekly Events • Monthly Events • yearly hvents o Ptcpatc a marketing plan for the entire year of scheduled events Retail focused • Restaurant Focused • Work in conjunction with the PSHA • All Business focused o Create and unplement a "summer" incenttve program for residents and visitors alike. • Incentive to shop and spend dollars. • Win a GRAND prize 4 3. WHAT IS THE COMPETITION DOING? ➢ Rancho Mirage just authorized a $55,000.00 "Shop Rancho Mirage" campaign ➢ Palm Desert has its own magazine, 92260 and a significant marketing campaign ➢ La Quinta has their own newspaper and a significant marketing campaign 5 Emails sent to City Council on September 18,2006 Greetings Council Members, About 3 months ago, I had a very discouraging experience downtown wherein a friend and I wets enjoying an ice cream at Coldstonc Creamery and when we went to sit on a bench to leisurely enjoy out ice cream it was SO PIMHY that we could not use it- As we started to look closer at othet benches and trash receptacles, I was actually embarrassed by what I saw. At a following planning commission meeting during commission requests, I told of this incident and requested information about a maintenance schedule for these items. I have yet to receive any information but prior to Scott Miskell's retirement he informed roe that there was no specific schedule of maintenance. This concetns me and should be an item of consideration when hiring a new director- If there is not a schedule for regular maintenance,what else is NOT being attended to? Interesting to nore that, very shortly after my tequesr, they painted the park benches and trash receptacles downtown. I had the opportunity to speak with Scott about this matter further before he retired wherein he was able to alleviate "some" of my concetns and kindly reminded me of what the parks and rec department DOf:S DO without accolades;however, two items we discussed are worth bringing to your attention: 1. Brick pavers: He told me that when the city decided to use pavers, he recommended against it duc to maintenance issues and instead suggested stamped concrete. Per Scott, the pavers are required to be cleaned at least once a year and have only been cleaned once since their insrallation many years ago- Upon inspection, you will find them unattractive, stained and duty. I am certaun this is a budger issue but to be a World Class Resort Destination we need to maintain our curb appeal... 2. CUP ordinance: It is my understanding from staff that there is an ordinance for businesses in the downtown corridor that requires them to dean and maintain their street frontage/patio areas. You can surely sec that, if to fact this ordinance exists, it is not being enforced. Examples would be Peabody's,,Jamba Juice, Einstein Bagels, etc- Ilene, if such an ordinance exists, can we alert code enforcement to tits issue so rhat may efficiently attend to it at the same time they are addressing the sign ordinance,rack ordinance, etc. I am appreciative of your efforts and I am willing to assist in any way to help make out City better and brighter. Having never seen this newsletter before I asked her where it came from. She informed that it can be found on our city wcbsire. With all the negative publicity the city gets for its "perceived" lack of communication with residents, I am concerned about du accessibility of this newsletter to residents and the lack of effectiveness it has. How many of our residents actually visit the website,particularly looking for a newsletter, how many of out tesidents do not use computers or the internet and, last bur not least,how many of our residents do not receive of read the desert sun or Other local papers. i think for our newsletter to be most effective,it should be a direct mail piece to all permanent residents of our city. Although i do not have the budget facts, I am certain that this is a budget issue, however, a quarrerly newsletter could take the place of paid for but non-required advertisements in The Desert Sun, therefore, reducing advertising costs to those publications and putting it towards out own publication. As an active member of the community, I didn't know this newsletter existed so I can safely assume nnosr residents do nor lnnow either. Additionally, I believe the newsletter could be a very effective tool to inform residents of what is happening in our community if it were published and delivered in a different way. Upon thinking about it further I had a brief discussion about it with Lee Husfeldt. I asked about who markets out city to our residents and her answer was the Bureau of Tourism. I suggest that the bureau markets ro other communities, states and countries and not to our residents as their charge is a completely different focus. It is my belief that we need to get"buy in" from our residents about the change and growth our community is experiencing. The newsletter is an ideal source in which we can effectively inform and educate the citucns about out community. [t could be a quarterly publication that is DIRECT MAILED to all full time residents therefore guaranteeing that they receive pertinent information about our community. Additionally, the newsletter could include event highlights, special events calendar, resident features, encourage voting, etc. Again, as before, I am available and willing to assist the city in any way I can so please don't hesitate to ask. The assessments do not take into account the geographic locations of the businesses, but rather lump sum them all together;the area proposed to be affected holds sections of disproportional flow of traffic and clientele. Also there is a disproportion in fees between the hospitality industries and retailers. 2. To shift responsibility of marketing to improve business from the City to a defined group of Merchants in a downtown location, makes no sense. The Convention Center,The airport, Bureau for tourism have appointed positions, that supposed to coordinate& promote main tourism influx. 90% of the businesses downtown have a secondary or tertiary role in supporting tourism. While hospitality and restaurants handle the direct needs,entertainment would be next and shops/retail hold a third position. You market a destination,and the destination has to offer a full package product. If the appointed positions would be measured on results and not on appointment or a payroll check,this resolution would be moot. 3. The erosion of downtown is partially due to high retail space rents. 6 Months out of the year,you have hardly any activity,while 2 months are transitional and 4 months high season. Based on those statistics, your cost per sq/ft is in reality a lot higher, because you only can offset this with the season sales. If you look at it 616, and you pay$1.5 sq/ft monthly .., actually your cost is$3,00 sglft, and if it's $3.00 sq/ft it is actually$6.00 sq/ft. Based on that and you operate 1,000 sq/ft,your sales have to exceed $6000 during season to cover your rent only. And that does not address the cumulative utility costs, nor the NNN , nor the insurance which also apply. For a retail merchant who markets everything 200%,that would require min.$12,000 worth of product in order to pay the rent. In order to reduce the operational costs,or the town focuses on being operational 12 months/yr or takes in account the'/z year effectiveness of doing business. Furthermore it is time that property managers,who hold real estate licenses, give a fair and honest disclosure about the seasonal element of downtown PSP, instead of avoiding the issue or flat out lying. No need to say that this proposed additional burden of$200 and up only will hurt, in particular for the ones that use their savings to keep afloat and keep hoping for business and therefore again is an unnecessary evil. 4. Nor it does address the direct influence of developers,whose massive construction projects will cause more business erosion the coming years. Hereby faulting the City and Main Street,to not demand from the developers an interim plan to avoid or limit damages to the downtown business district. Nor it does address that in the redevelopment plans are any attempts to make this town shopping or destination friendly, during the heat of the summer months, and make it a 12 month destination. 5. Destination marketing should start with the entire Coachella Valley,as one united voice. It should be a continuous program. If the appointed companies directly involved with tourism would integrate their efforts,to include the downtown area and the media companies of the Coachella Valley shoulder some of the burden, and the Chamber of Commerce would present a more pro-active program towards downtown merchants instead of mixers and meetings that cater to the service industries looking like a cigar club,we would have results. 6. The way this resolution is presented is unfair and inappropriate in its validation method.Since this affects EVERY business in the proposed area, a mandatory ballot should have been sent by certified mail to every business owner,so the true accounting would be reflected in regards to this proposal. Ready, City Manager BY: Community & Economic Development SUMMARY The City Council will consider an ordinance to form the Palm Springs Business Improvement District (BID) in the downtown and uptown areas of Palm Springs_ This special benefit assessment district only affects businesses located in a specific geographic area. The assessment will range from $150 to $500 depending the type and size of the business and will be administered through the city's business license process. RECOMMENDATION: 1. Waive reading of the ordinance text and introduce by title only and; 2. Introduction of first reading Ordinance No. , "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, ESTABLISHING THE PALM SPRINGS BUSINESS IMPROVEMENT DISTRICT IN THE DOWNTOWN AND UPTOWN AREAS OF PALM SPRINGS AND AUTHORIZING THE LEVY OF ASSESSMENT PURSUANT TO THE PARKING AND BUSINESS IMPROVEMENT AREA LAW OF 1989." STAFF ANALYSIS: On December 20, 2006 the City Council adopted Resolution No. 21793 declaring its intention to establish the Palm Springs Business Improvement District and set a Public Hearing date for the adoption of an ordinance establishing the district and authorizing the levy of assessments. ITEM NO. k L City Council Staff Report January 17, 2007 — Page 2 (Palm Springs Business Improvement District Upon opening the Public Hearing Council will receive testimony from interested parties about the adoption of the ordinance. The Public Hearing is a protest procedure in which any interested party may protest the formation of the BID either in writing prior to the Public Hearing date or during the Public Hearing comment period. On December 22, 2006 a Public Hearing Notice packet was mailed to 720 businesses located within the geographic boundaries of the BID and identified by the City's business license database. The packet contained a cover letter, the Public Hearing Notice, a copy of Resolution No. 21793, and a Q &A fact sheet. At the January 4, 2007 Main Street Executive Board meeting a discussion was held regarding the objectives and strategies of developing a promotion and marketing program, including the accountability component. The Board clearly understands the concerns expressed by the City Council at their December 20 meeting regarding the relationship with the Palm Springs Bureau of Tourism. The consensus of the Board is to establish a working partnership with the Palm Springs Bureau of Tourism whereby, on behalf of Main Street, PSBT would oversee the development of the promotion and marketing campaign. The Board also discussed the importance of the uptown and downtown stakeholder's involvement in the development process to ensure there is consensus about the program. The Palm Springs BID will initially focus on developing a long-term sustainable promotion and marketing program for the downtown and uptown areas. The assessments will be collected with business license applications and renewals within the BID area, paid at the time the business license application is submitted or renewed through the City. All businesses located within the specified BID boundaries and that are subject to the city's business license will participate in the BID program, including retail, restaurant, theater, hotel and professional, service, and miscellaneous office businesses. The assessment will vary based on the type of business and the square footage and/or number of seats or rooms. Revenues collected will be maintained in a separate fund and dedicated to the defined area. It is proposed that the Main Street Board of Directors, who are elected by the local businesses block by block, will develop and oversee the promotion and marketing program that would benefit the businesses in the BID District. City staff will assist the Main Street Board with the administration of the program, including project development and budget oversight to carry out the goals and objectives of the BID. Assessment collections and disbursements will be handled through the City's Finance Department. The response from the majority of the business owners and managers has been very positive resulting in a decision by Main Street to move forward with the recommendation to implement a Business Improvement District. My concerns stem from the Fact that existing similar organizations have previously been formed, such as the Downtown 1Wleichants Association,the Main Street Association and the Board of Tourism,with the primary goal of promoting economic development within the City's business core. Therefore, it would appear that the formation of the proposed Palm Springs Business Improvement District is not only duplicitous, but a costly action to be born by the already heavily burdened district business owners. It is a reasonable question as to why the economic development objectives the proposed district, can not be accomplished via the existing organizations and their respective resources. Further to this, if it is the City's goal to revitalize the downtown and uptown district, it would be prudent for the City to implement improvements such as increased street lighting along N. Palm Canyon Drive and relaxing the extreme business restrictions with respect to certain signage limitations and the prohibition of sidewalk cafes. hi conclusion, I thank the Honorable Mayor and Council Members for taking my concerns into account. I remain opposed to approval of the proposed Resolution and more specifically the levying of any new related assessments, until such time as the City can provide tangible evidence that implementation of such will result in visibly concrete economic benefit to the business owners. As a business owner I look forward to what marketing advantages we could have with the money from an improvement District. I do have concerns about the amount of the assessment fees. would like to see a cap put on the fee. I do not agree to an open amount with no maximum fee given. Also in Section 4 at the bottom it states "New Business shall be exempt from the payment of any applicable assessment". Shouldn't it be followed with -"forthe first-- year" or something similar? Or the definition of "New Business" clarified? would also like to see a set time limit to the Improvement District so it may be readdressed at the end of the time period. I feel the money from the Improvement District should stay with the businesses in the District and the funds disbursement be made only by these businesses. The City of Palm Springs should not have a say in the spending of Improvement monies. I attended the meetings regarding this business improvement district Not one idea the business community proposed was incorporated into what is being presented tonight. The assessment schedule is patently unfair. A retail Micro-businesses with tinder 500 sq feet will pay an unfair share_ Why should a theater or hotel or a store with over 2,000 sq feet be assessed$500, compared to a retail micro-business being assessed$2507 There is no marketing plan being proposed_ I do not want a drunken free fox all celebrating the new year nor do I want spring break to return, however these are the ideas that are being proposed. Two bit maps or general "shop downtown"advertisements in the Desert Sun are not going to bring business into my store.
