ACCEPTANCE OF "RAINMAKER' SCULPTURE AND WATER FEATURES, SIDEWALK
AND LANDSCAPING
RECOMMENDATION:
That the City Council accept the "Rainmaker" sculpture and water features, sidewalk
and landscaping by DCM Studios, Ltd., located at the Frances Stevens Park, allowing
final payment to DCM Studios, Ltd. in the amount of$32,400.02.
BACKGROUND:
The original agreement for the sculpture wands and interactive water features was in
the amount of $221,000. Upon completion of the water features, two amendments to
the agreement were approved by Council. The first amendment in the amount of
$51,000 completed all sidewalk areas adjacent to the fountain. The second amendment
approved irrigation and landscaping for the park area adjacent to the fountain. All work
is now complete and all payments have been made except for the 10% retention which
is awaiting approval and acceptance of the project by Council prior to release of the
remaining funds.
The 10% retention for the original agreement is $22,100.02 to be paid from the Public
Arts Fund Account# 550-4408-50015. The retention from Amendment #1 is $5,100 to
be reimbursed to the Public Arts Fund per the Reimbursement Agreement executed by
the Agency and the City from Community Redevelopment Agency fund account# 811-
8191-65133. And, the retention from Amendment #2 is $5,200 to be paid from
Community Redevelopment Agency fund account # 811-8191-65139 under a similar
agreement. The total amount of final payment due to the Artist is $32,400.02. No
general fund money has been used for this project.
The Arts Commission approved the completed project June 4, 2001. Council approval
and acceptance of the completed project will authorize release of the final payment to
DCM Studios, Ltd. and transfer ownership of the fountain from the artist to the City.

I HEREBY CERTIFY that this Minute Order, accepting the `Rainmaker" sculpture and
water features, sidewalk and landscaping by DCM Studios, LTD., located at Frances
Stevens Park, allowing final payment to DCM Studios, LTD., in the amount of
$32,400.02, was adopted by the City Council of the City of Palm Springs, California, in
a meeting thereof held on the 20th day of June, 2001.
