FOR A CONDITIONAL USE PERMIT FOR THE INSTALLATION OF A COMMERCIAL COMMUNICATIONS ANTENNA ON A 60-FOOT TALL MONOPOLE DESIGNED TO LOOK LIKE A PALM TREE AND A 200 SQUARE FOOT EQUIPMENT BUILDING WITHIN A 1150 SQUARE FOOT LEASED AREA INSIDE THE EXISTING MAINTENANCE AREA LOCATED NEAR THE POND ON THE 18T" HOLE OF THE CANYON COUNTRY CLUB(NORTH)GOLF COURSE, 1100 MURRAY CANYON ROAD, RGA-8 ZONE I.L., SECTION 35. RECOMMENDATION: The Planning Commission recommends to the City Council approval of Conditional Use Permit No. 5.0865 for the installation of a commercial communications antenna on a 60-foot tall monopole designed to look like a palm tree and a 200 square foot equipment building within a 1150 square foot leased area inside the existing maintenance area located near the pond on the 18"hole of the Canyon Country Club Golf Course, 1100 Murray Canyon Road, RGA-8 zone, Section 35. The applicant is Kim Berry of Nextel Communications, Inc. Canyon Country Club is the sublessor of the property and the Agua Caliente Development Authority(ACDA) is the landlord. Nextel's lease is with Canyon Country Club, with the consent of the ACDA. SUMMARY: On May 9, 2001, the Planning Commission voted 6-0 (Commissioner Matthews absent) to recommend that the City Council approve Conditional Use Permit No. 5.0865, subject to conditions BACKGROUND: Nextel Communications, Inc. has submitted an application for a Type II Conditional Use Permit to install a commercial communications antenna on a 60-foottall monopole structure designed to look like a palm tree and a 200 square foot equipment building within a 1150 square foot leased area inside the existing maintenance area located near the pond on the 18th hole of the Canyon (North) Country Club Golf Course, located at 1100 Murray Canyon Road. Nextel is currently in the process of expanding their wireless telecommunication services to cover the immediate area as well as the entire Coachella Valley. Nextel currently has sites in Palm Springs behind the Boys and Girls Club on Mesquite Avenue, atop the Spa Hotel in the downtown area, next to an office/warehouse building at 2050 Executive Way and at 401 Radio Road in the Storage USA business warehouse. 10 Case 5.0865 CUP Staff Report June 6, 2001 Page 2of3 The communications antenna array is proposed to be a three-sided structure typical of wireless telecommunications antennas, but will be designed to look like a palm tree ("mono-palm") in that the 60-foot pole will be wooden and faux palm fronds will surround the antenna arrays. Additionally, the applicant proposes to plant two, 50-foot tall live palm trees within the lease area to provide a more natural looking cluster effect. The applicant does not propose to remove any of the existing trees or vegetation. There are a variety of palm trees, deciduous trees and shrubs in the immediate vicinity and throughout the golf course. The radio equipment will be housed in a prefabricated 10-foot high, 200 square foot concrete shelter. Both the proposed pole and equipment building will be located within the existing maintenance area. The maintenance area is surrounded by an existing six-foot high chain link fence as well as tall oleanders and bougainvillea. The top portion of the south elevation of the equipment building which will extend above the existing six-foot fence and oleanders will be visible. ANALYSIS: 1. Airport Impacts: Mike Williams, Deputy Director of Operations for the Palm Springs International Airport, was consulted about the site and indicated that he anticipates that the proposed commercial communications antenna structure is not an obstruction (i.e., the structure does not penetrate air space around the airport), nor would the proposed antenna have any direct or indirect impacts on operations at Palm Springs International Airport. As a condition of approval, the applicant would be required to obtain all necessary approvals from the Federal Aviation Administration prior to issuance of building permits. 2. Visual Impacts: The applicant has submitted a photographs of the existing environment as well as photo simulations of the proposed mono-palm and how it would appear in the current visual environment surrounding the site. These simulations depict the existing variety of palm trees, deciduous trees and shrubs, as well as the proposed 60-foot mono-palm,the two proposed 50-foot high live palm trees and the 10-foot high equipment building. A neighborhood meeting was held on April 4, 2001 which was attended by representatives of Nextel, Canyon Country Club, as well as the Planning staff assigned to the project and two residents. The two residents expressed opposition to the proposed use, but didn't have an opinion at that time regarding the visual impact based on the photo simulations presented. Given that the entire maintenance area is protected by a perimeter security fence, the Planning Commission does not see a need for additional security fencing. A final landscape plan would be recommended for review and approval of the Director of Planning and Building prior to issuance of building permits. The Planning Commission has recommended conditions of approval in the resolution of approval pertaining to the removal of the antenna and/or monopole and equipment building in the event the equipment becomes obsolete, are abandoned or the Conditional Use Permit expires. /ygz Case 5.0865 CUP Staff Report June 6, 2001 Page 3of3 At the May 9,2001 Planning Commission meeting, the applicant expressed concurrence with the staff report and the recommended conditions, with the exception of the portion of Condition No. 10 which requires the installation of up to five live palm trees based upon a site inspection by Planning Department staff following installation of the mono-palm. The applicant indicated that two live palm trees, along with the existing vegetation, would be sufficient landscape screening, and noted that the leased area would not accommodate the addition of more than two live palms. Representatives of Canyon Country Club also voiced objection to the requirement for the addition of more than two live palms, citing unnecessary obstruction of mountain views as a concern. The Planning Commission voted 6-0(Commissioner Matthews absent) to recommend that the City Council approve Conditional Use Permit No. 5.0865, subject to the conditions recommended by staff, and recommended that Condition No. 6 be amended to add that the mono-palm, equipment building, existing landscaping and additional landscaping be maintained in good condition and amended Condition No. 10 to require that the live palm trees be tiered in height and be similar in appearance to the mono-palm. In response to the objection to the portion of Condition No. 10 that requires the installation of up to five live palm trees based upon a site inspection by Planning Department staff following installation of the mono-palm, the Planning Commission voted to maintain that portion of Condition No. 10, and commented that they hoped that staff, in its final determination, would not require more than is absolutely necessary or more than would fit in the leased area. Exhibit A of the attached resolution reflects the conditions as amended by the Planning Commission. ENVIRONMENTAL ANALYSIS AND NOTIFICATION: This Conditional Use Permit is categorically exempt from environmental assessment pursuant to Section 15303 of the California Environmental Quality Act (CEQA). Section 15303 states that installation of small new equipment is exempt from CEQA. All property owners within 400 feet of the project site have been notified of the public hearing. As of the writing of this report, no correspondence or inquiries from the public has been received by staff, with the exception of the comments made by two residents at the April 4, 2001 neighborhood meeting and the May 9, 2001 Planning Commission meeting. CONCLUSION: The Planning Commission recommends that the City Council approve Conditional Use Permit No. 5.0865, subject to the conditions set forth in Exhibit A of the resolution. EXHIBIT A Conditional Use Permit No. 5.0865 Nextel Communications, Inc. 1100 Murray Canyon Road June 6, 2001 CONDITIONS OF APPROVAL Before final acceptance of the project,all conditions listed below shall be completed to the satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. 1. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. la. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 5.0865. The City of Palm Springs will promptly notify the applicant of any such claim,action,or proceeding againstthe City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing,the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgement or failure to appeal, shall not cause a waiver of the indemnification rights herein. 2. Commencement of use or construction under this Conditional Use Permit shall be within two (2) years from the effective date of approval. Extensions of time may be granted by the Planning Commission upon demonstration of good cause. 3. If the technology regarding the communications antennae changes in where the antennae and/or equipment building as approved become obsolete, then the antennae shall be removed. 5. If the use of the subject property is ever changed, the City reserves the right to modify or revoke this Conditional Use Permit application. 6. The maximum heightof the commercial communications antenna and"mono-palm"structure shall be 60 feet,as indicated on the conceptually approved plans, as measured from finished grade to the highest point of the antenna. The "mono-palm," equipment building, existing landscaping and additional shall landscaping be maintained in good condition. 7. If the antennae and/or"mono-palm"are everabandoned or if this Conditional Use Permit ever expires, the "mono-palm" and antennae shall be removed within 30 days. 8. Manufacturer's cut sheets of the proposed antennae shall be submitted to the Director of Planning and Building prior to the issuance of permits for installation of the commercial communications antennae. 9. This project shall be subjectto Chapters 2.24 and 3.37 of the Municipal Code regarding public art. The project shall either provide public art or payment of an in lieu fee. In the case of the in-lieu fee, the fee shall be based upon the total building permit valuation as calculated pursuant to the valuation table in the Uniform Building Code, the fee being 1/2% for commercial projects or 1/4%for residential projects with first$100,000 of total building permit valuation for individual single-family units exempt. Should the public art be located on the project site, said location shall be reviewed and approved by the Director of Planning and Building and the Public Arts Commission, and the property owner shall enter into a recorded agreement to maintain the art work and protect the public rights of access and viewing. 10. A final landscape plan shall be submitted for review and approval by the Director of Planning and Building priorto issuance of building permits. A minimum of two(2)and up to five(5)live palm trees shall be installed on site, with the ultimate quantity to be determined by the Directorof Planning and Building based on a site inspection bythe Planning Department staff following installation of the"mono-palm"pole. The live palm trees shall be tiered in height and shall be similar in appearance to the "mono-palm." 12. The applicant shall comply with the recommendations of the Federal Aviation Administration. Proof of compliance shall be provided from the Director of Aviation to the Director of Planning and Building prior to the issuance of building permits. 13. The applicantloperator of the facility shall agree to allow the co-location of equipment of other wireless communications providers at this site when applications are received by the City and it is considered feasible, subject to an agreement between the applicant/operator, the other proposed wireless communications provider, and the property owner. /YA G Case 5.0865 CUP Conditions June 6, 2001 Page 3 of 3 POLICE DEPARTMENT: 14. Address shall be plainly visible and legible from the street per the 1998 California Building Code. Contact building official. 18. A KNOX key box is required per the 1998 California Fire Code. Contact this office for a KNOX application as soon as possible. 19. Portable fire extinguishers shall be installed in accordance with the 1998 California Code, Article 10, and Standard 10. 20. Associate Planner Kim Chafin reported that the proposed location is in an existing equipment area and is well maintained as it is visible from the clubhouse. She reported that the proposed communications antenna array is typical of wireless telecommunications antennas, but will be designed to look like a palm tree with wooden 60' pole and faux fiberglass palm fronds surrounding the antenna arrays and that two 50' live palms clustered with it for a natural look. She reported that the radio equipment will be housed in a prefabricated 10' high, 200 sq.ft. concrete shelter and will also be located within the existing maintenance area, surrounded by an existing six-foot tall chain link fence with tall oleanders and bougainvillea and that, depending on the trimming schedule and time of year, the building may be visible above the fence from time to time. She reported that a neighborhood meeting was held on April 04, 2001 and attended by representatives of Nextel, Canyon Country Club, two residents, and planning staff. She reported that the two residents expressed opposition to the proposed use. She reported that the Tribal Planning Commission supports the project. 2:30 p.m. — Chairman Mills opened the Public Hearing, Ms. Pauline Fluke, resident of Canyon Country Club, addressed the Planning Commission to state her objection to the project and that she understood that the City was required to put utilities underground. She urged the Planning Commission to require cell phone towers to be on non-residential sites and to consider property values. She stated that the proposed tower is 200' from the front of her home. Ms. Jan Hart, General Manager of Canyon Country Club, addressed the Planning Commission to state that the Country Club does not want to detract from the beauty of the course or views Page 5 of 7 Planning Commission Minutes May 09, 2001 and that the proposed location seems ideal. Ms. Kim Berry, Nextel representative, addressed the Planning Commission to state that she agrees with all Conditions of Approval; however, requests that condition no.10 be amended to only require two live trees —that five trees would be excessive screening and that the existing maintenance area is not large enough to accommodate five trees. Mr. Irwin Earl, Canyon Country Club resident and president, addressed the Planning Commission to state that his home is 300'-400' from the proposed site and that he supports the project, explaining that additional palm trees on a course with many other palm trees will not significantly impact views. Mr. Donald Fluke, Canyon Country Club resident, addressed the Planning Commission to question whether or not the building was screened by a fence. There being no further appearances, the Public Hearing was closed. Commissioner Shoenberger stated that he felt the proposed location was ideal, far superior to the previously proposed location at the Royal Sun Apartments, and that the tiered effect of the live palms will prevent it from being noticed. Director explained that the utility ordinance which calls for undergrounding of utilities in new developments is intended to address a broad range of utilities but not cellular towers; however, in this area needed for service, there is no other alternate location due to the low-rise buildings in the area. He stated that the Conditional Use Permit process is an ideal way to continue to review these projects on a case-by-case basis. He also stated that CC&R's and master leases are private documents between homeowners and homeowner associations and that the City does not review or enforce them. Commissioner Shoenberger called the Flukes to the podium. He stated that the Planning Commission is concerned about any impact of development on neighborhood property and that the Commission has carefully weighed the need for this utility and the impact of the proposal. The Flukes thanked the Planning Commission for their consideration. Commissioner Raya stated that he felt the location was good but that he was concerned about the design and size of the building; suggesting texturizing the stucco. Chairman Mills called Ms. Berry to the podium. She confirmed that the monopalm will be designed to look like a date palm as there are other date palms in the area. She distributed a photo simulation of the monopalm; explaining that the Mexican Fan palm fronds are shorter and do not cover the antenna as well. She reported that the finish on the building is exposed aggregate stone and not concrete block. Chairman Mills thanked Nextel for their efforts toward satisfying requirements for balancing Page 6 of 7 Planning Commission Minutes May 09, 2001 neighborhood livibility, technology, and business interests without negative impacts to the City and its residents and that their example, through this application, will serve as a model for the industry and future projects. FOR THE INSTALLATION OF A COMMERCIAL COMMUNICATIONS ANTENNA ON A 60-FOOT TALL MONOPOLE DESIGNED TO LOOK LIKE A PALM TREE AND A 200 SQUARE FOOT EQUIPMENT BUILDING WITHIN A 1150 SQUARE FOOT LEASED AREA INSIDE THE EXISTING MAINTENANCE AREA LOCATED NEAR THE POND ON THE 18T" HOLE OF THE CANYON COUNTRY CLUB GOLF COURSE, 1100 MURRAY CANYON ROAD, RGA-8 ZONE, SECTION 35, AND MAKING FINDINGS IN SUPPORT THEREOF. ------------- WHEREAS, Nextel Communications, Inc. ("Applicant") has filed an application with the City pursuant to Section 94.02.00 of the Zoning Ordinance for the installation of a Commercial Communications Antenna on a 60-foot tall monopole designed to look like a palm tree and a 200 square foot equipment building within a 1150 square foot leased area inside the existing maintenance area located near the pond on the 181"hole of the Canyon Country Club Golf Course, 1100 Murray Canyon, RGA-8 zone, Section 35; and WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to consider Applicant's application for Conditional Use Permit No.5.0865was given in accordance with applicable law; and WHEREAS, on May 9, 2001, a public hearing on the application for Conditional Use Permit No. 5.0865 was held by the Planning Commission in accordance with applicable law; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to consider Applicant's application for Conditional Use Permit No.5.0865 was given in accordance with applicable law; and WHEREAS, on June 6, 2001, a public hearing on the application for Conditional Use Permit No. 5.0865 was held by the City Council in accordance with applicable law; and WHEREAS, the proposed Conditional Use Permit(Case No. 5.0865) is categorically exempt from the provisions of the California Environmental Quality Act(CEQA)pursuant to Section 15303(New Construction or Conversion of Small Structures); and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented. Case 5.0865 Resolution June 6, 2001 Page 2 of 3 THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: This Conditional Use Permit is categorically exempt from environmental assessment per Section 15303 of the California Environmental Quality Act (CEQA) in that Section 15303 states that installation of small new equipment is exempt from CEQA. Section 2: Pursuant to Zoning Ordinance Section 94.02.00, the City Council finds that: a. The use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by the City Zoning Ordinance. Pursuant to the Zoning Ordinance, a commercial communications antenna is authorized in the RGA-8 zone pursuant to approval of a Type II Conditional Use Permit. b. The use applied for is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna is in harmony with the various elements and objectives of the City of Palm Springs General Plan and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is to be located. The proposed communications antenna will not have a significant visual impact on the environment surrounding the site. c. The site for the intended use is adequate in size and shape to accommodate said use, including yards,setbacks,walls orfences, landscaping and otherfeatures required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. The site for the communications antennae, on a 1150 square foot leased area inside the existing maintenance area located near the pond on the 181h hole of the Canyon Country Club Golf Course at 1100 Murray Canyon Road, is adequate in shape and size to accommodate said use, including all features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. d. The site for the proposed use related to streets and highways is properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. The site for the proposed communications antennae will not have a direct or indirect impact on streets and highways and is properly designed in the subject area. The conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare, including any minor modifications of the zone's property development standards. All proposed conditions of approval are necessary to ensure public health and safety. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves Conditional Use Permit No. 5.0865, subject to those conditions set forth in Exhibit A, on file in the Department of Planning and Building, which are to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise specified.
