AMENDMENT NUMBER ONE TO CONTRACT SERVICES AGREEMENT WITH
DOZIER APPRAISAL COMPANY FOR PROPOSED PARKING STRUCTURE
RECOMMENDATION:
That the Community Redevelopment Agency amend an existing contract
with Dozier Appraisal Company of Palm Desert, California in the amount
of $15,500.00 for Appraisal services to determine "as is" market values
for properties to be included in the proposed construction of a downtown
parking structure along the west side of the 200 South Indian Canyon
Drive block, between Arenas Road and Baristo Road.
SUMMARY:
Based upon a presentation on behalf of the "Downtown Parking Think
Tank" on April 25, 2001, the City Council has expressed a desire to
receive more detailed cost and design information in regard to a
proposed parking structure at the referenced location, and has asked staff
to retain the necessary professional expertise to provide this information
in a timely manner. This specific contract amendment would provide
current Appraisals of land acquisition costs for project alternatives.
BACKGROUND:
City Council at its Study Session on April 25, 2001, gave direction to staff
and the "Downtown Parking Think Tank" to undertake two work tasks in
regard to the feasibility of a potential parking structure along the west side
of the 200 South Indian Canyon Drive block, between Arenas Road on the
north and Baristo Road on the south. These tasks included: 1) an
Appraisal for the purpose of estimating property acquisition costs; and 2)
preliminary parking structure layouts and conceptual engineering designs
for the purpose of estimating project construction costs. This report is
submitted for consideration in regard to the first of these tasks.
On April 18, 2001, the Community Redevelopment Agency approved a
Contract Services Agreement with Dozier Appraisal Company for an
Appraisal associated with the Desert Fashion Plaza. Prior to this, the City
Engineer undertook an informal bid process in August, 2000 seeking
qualified appraisers to do this work. Dozier Appraisal Company of Palm
Desert was the low bidder and was recommended by staff to do this work.

Since this downtown parking structure Appraisal work is very similar to the
scope of services being performed by Dozier Appraisal Company for the
nearby Desert Fashion Plaza, staff recommends that the Contract
Services Agreement approved by the Community Redevelopment Agency
for Dozier Appraisal Services in regard to the Desert Fashion Plaza be
amended to included the project area for the proposed downtown parking
structure along the west side of the 200 South Block of Indian Canyon
Drive. Amendment Number One contract sum equals $15,500.00.
Sufficient funds are available in account number 811-8191-50000
(Community Redevelopment Agency, Merged Project Area #1,
Unscheduled Capital Projects).

SCOPE OF SERVICE
The purpose of this work effort is to estimate the "as is" market value of the
Adamo property as a full taking and the "before" and "after" market values of the
remaining five (5) partial taking properties (Lewin, Frank, Franks, Talala, and
Mezrahi). In addition, the Adamo property full taking will indicate the allocation of
the Lease Fee (landlord's interest) and the Lease Hold (tenant's interest) of the
total property's market value. Finally, the appraisal will indicate the estimated
cost to relocate any displaced tenants as a result of the takings. Included within
the five partial taking appraisals will be a "Parking Garage Benefits Study" for use
as a potential value offset against any Severance Damage accruing to the
remainder property as a result of the partial takings The date of each appraisal
will the appraiser's date of inspection.
The purpose of the appraisals is to report findings of any value loss in a manner
usable to those charged with the responsibility of computing "just
compensation" based on the State rule of condemnation.
The property rights being appraised represent the "lease fee interest" of all
future benefits that may be derived from each property's present or possible use,
except for existing easements, rights-of-way of record, and existing lease(s) at
the time of taking.
The appraisal is to be made according to the current Uniform Standards of
Professional Appraisal practice (USPAP); and the requirements of the Code of
Professional Ethics and Standards of Professional Practice of the Appraisal
Institute.
The client will be provided complete appraisals, reported in separate self-
contained report formats which will lead the reader to the appraiser's
conclusions of values.

SPECIAL REQUIREMENTS
Section 5.3 "Performance Bond" is deleted.
The Contractor has requested that the following be provided to him:
(a) existing leases;
(b) area of partial takings;
(c) history of leases and access instructions; and
(d) profit and loss statements of leased properties (two years).
The Agency does not warrant that it possesses all of the information requested
above but shall endeavor to obtain the requested items. If the lack of information
creates a gap in the analysis that is filled by an assumption, Contractor shall
make explicit in the report where the assumption was used, what the
assumption was, and how different data if it became available at a later date
would affect the appraised value(s).

SCHEDULE OF COMPENSATION
The Contractor shall perform the Scope of Services on a lump sum fee basis of
Fifteen Thousand Five Hundred Dollars ($15,500.00). Payment of the Contract
Sum shall be made upon the completion of the Scope of Services and delivery of
two (2) report originals of six (6) individual self-contained reports.

WHEREAS the "Downtown Parking Think Tank" has issued its parking recommen-
dations, including a proposed parking structure located along the west side of Indian
Canyon Drive between Arenas Road on the north and Baristo road on the south;
and
WHEREAS City Council as well as the business and property owners in the area
affected by this project require more detailed design and cost information in order to
evaluate the feasibility of this project; and
WHEREAS City Council has expressed a desire to receive more detailed design
and cost information in regard to the feasibility of this parking structure,
NOW THERE BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT
AGENCY of the City of Palm Springs, California that Amendment Number One of
a contract with Dozier Appraisal Services of Palm Desert, California in the amount of
$15,500.00 for Appraisal Services in regard to a proposed parking structure to be
located along the west side of the 200 South Indian Canyon Drive block in down-
town Palm Springs is approved, and the Executive Director or his designee is
authorized to sign any documents related to the Contract.
