SUBJECT: Resolution Requesting CaIPERS Approve Employment Extension for
Retiree Allen Smoot per GCS 21221(h).

SUMMARY
The City of Palm Springs appointed Allen Smoot to the temporary position of
Construction Project Administrator, subject to CaIPERS cap of 960 hours per fiscal
year. Mr. Smoot has been working at the Convention Center on the Kitchen Project and
a Restroom Remodel. In mid November the City Manager asked Mr. Smoot to help with
the Airport Expansion Project that is underway. With the sudden change Mr. Smoot
expects to exceed the 960 hour limitation by the end of March, 2007 and estimates an
additional 350 hours will be necessary to complete the project by the end of the fiscal
year. The attached Resolution seeks CaIPERS approval of such and extension.
RECOMMENDATION:
Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, REQUESTING THE CALPERS BOARD OF
ADMINISTRATION APPROVE AN EMPLOYMENT EXTENSION PER GOVERNMENT
CODE SECTION 21221(h) FOR RETIREE ALLEN SMOOT TO COMPLETE THE
PALM SPRINGS INTERNATIONAL AIRPORT EXPANSION PROJECT."
STAFF ANALYSIS:
The California Public Employees Retirement System (CaIPERS) generally allows a
retired person to work for a municipality as a temporary employee not to exceed 960
hours in a fiscal year. Per GCS 21221(h), the limitation on hours may be extended
under extenuating circumstances if the Municipality seeks approval from CaIPERS via
Resolution prior to the retiree reaching the cap.
Allen Smoot was appointed to a temporary position to provide specialized construction
administration at the Convention Center and more recently to assist at the Airport.

Employment Extension Request-CalPERS
Under normal circumstance the 960 hours would have been more than enough to
complete the Convention Center work, however, with the unexpected and sudden
departures of the previous City Representative and the Assistant Aviation Director, Mr.
Smoot was asked to step in and take over the administrative duties on the Airport
Project. This added work load will require more hours, approximately 350 hours, and
will cause the 960 cap to be exceeded by the end of March, 2007. It is desirable that
Mr. Smoot be able to finish the project for the City to ensure a timely and on-budget
project.
FISCAL IMPACT:
The additional 350 hours will add $31,500 of costs to the project and will be paid via grants or
Airport funds.

WHEREAS, Allen Smoot retired from the City of Palm Springs in the position of
Executive Director of Airports, effective December, 31, 2003; and
WHEREAS, for Fiscal Year 06/07 the City of Palm Springs appointed Allen
Smoot to the temporary position of Construction Project Administrator to
administer a Kitchen Expansion and Restroom Remodel at the Palm Springs
Convention Center, a position deemed to be of limited duration and requiring
specialized skills, an assignment expected to be completed in January 2007, well
within the hourly work restrictions of Calpers; and
WHEREAS, due to the unexpected resignation of the City Representative
assigned to a major Airport Terminal Expansion Project and the resignation of
the Assistant Aviation Director, who was responsible for administering
construction at the airport, the City appointed Allen Smoot to temporarily step in
and oversee the Airport Expansion Project, an assignment with a scheduled
completion date of June 15, 2007. The Airport, which is vital to the economic
well being of the City, has a fixed completion date of June 15, 2007 to
accommodate the needs of the airlines scheduled to occupy this new terminal
area. To become familiar with the complicated project in mid-construction and to
be able to quickly pick-up the administration of the project so as to not incur
delays, Allen Smoot has been and will be required to work many hours; and
WHEREAS, Allen Smoot is now expected to reach his maximum of 960 hours
this fiscal year on or about March 28, 2007; and
WHEREAS, Allen Smoot has specialized construction management skills not
held by other City employees, which include over 30 years of construction
experience, and the necessary detailed financial negotiating skills to complete
this vital Airport Expansion Project on time and under budget; and
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the CWPERS Board of Administration be requested to
approve an extension for the temporary employment of Allen Smoot for 350
additional hours through June 30, 2007.
