HomeMy WebLinkAbout1/1/1966 - ORDINANCES ORDINANCE NO. 728 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 9100 .09 (DEFINITIONS) AND SECTION 9214.00 (P, PROFESSIONAL ZONE) OF DIVISION 9 OF THE PALM SPRINGS ORDINANCE CODE TO CONSIDER REVISING DEFINITION OF THE WORD "ABUT" AND TO AMEND THE "P" ZONE. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS FOLLOWS : SECTION 1. Section 9100 .09-1 of Division 9 of the Palm Springs Ordinance Code is hereby amended to read as follows : I. Abut shall mean as follows: Tow adjoining parcels of property with a common property line are herein considered as one parcel abutting the other, including where two or more lots adjoin only at a corner or corners, and except where the property line is located in a City public street right-of-way. SECTION 2 . Section 9214.00-A (Offices of Uses Permitted) of Division 9 of the Palm Springs Ordinance Code is hereby amended to read as follows: Offices : executive, administrative, and clerical offices (excluding building trade contractors, except those with a state license with an A-1 or B-1 classification) . SECTION 3 . Section 9214.00-D (Yards) of Division 9 of the Palm Springs Ordinance Code is hereby amended by adding the following: 5 . Where the P Zone fronts, sides, or rears on a street which is a boundary with a single family residential zone, there shall be a yard abutting said street of not less than fifty (50) feet for any structure or building with a height greater than fifteen (15) feet and one (1) stony. Not less than the six (6) feet nearest the street shall be land- seeped and maintained. The remainder may be used for parking, provided a wall not less than three (3) feet in height is installed between the landscaped portion and the parking area . SECTION 4. Section 9214.00-K (Storage) of Division 9 of the Palm Springs Ordinance Code is hereby amended to read as follows : K. STORAGE All goods, wares, merchandise, produce and other commodities located upon the property shall be housed in permanent , entirely enclosed buildings unless being transported. _I_, Ordinance No . 728 Page 2 The conducting of an office use allowed in this Zone shall not include any storage, display, sale or exchange of commodities, equipment or trucks three-quarter (3/4) ton I or larger. SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after passage. SECTION 6 . PUBLICATION. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES ORDAIN AS FOLLOWS; SECTION 1. Section 9306 .00-B-2 0£ Division. 9 of the Palm Springs Ordinance Code is hereby amended to read as follows ° 2 . Landscaping of all Parking Areas, except covered parking shall be as follows : a. Interior Planting: A minimum of one- third (1/3) of each parking island shall by landscaped with plant material . Phis one-third landscaping shall be distributed evenly within an island and shall include one. (1) fifteen (15) gallon broadleaf or conifer tree for each fifteen (15) parking spaces . In addition, twenty-five (25) percent of the required shade trees shall be palm trees not less than six (6) feet to the bottom of the first frond, which shall be incorporated into the design of the parking lot. (See sample parking lot plan, p. 146 .) The following areas are excluded: (1) Required planting along the perimeter of a parking area, whether for require screening or general beauti- fication, shall not be considered as part of the landscaping required for the parking islands . (2) Where a parking area abuts the buildings on the subject property, the border plantings adjacent to those buildings shall not be con- sidered as part of the interior landscaping. b . Peripheral Plantias: On the exterior edge of a parking area, one (1) planting area of the dimensions indicated by item 15 on the sample parking lot plan shall be provided at a ratio of one (1) planting area for each ten (10) parking spaces . Said planting areas shall be located to equally divide the exterior portions of the parking lot . Any unused space resulting from the design of park- ing spaces shall be used for planting purposes . Ordinance No . 730 Page 2 C . Landscaping Maintenance: All planting areas shall be well maintained in per- petuity and shall be reviewable annually I by the Planning Commission. SECTION 2. Section 9306 .00-B-4 of Division 9 of the Palm Springs Ordinance Code is hereby amended to read as follows : 4. Choice of Plant Materials: All plant material shall be evergreen unless, due to a special problem, the Architectural Advisory Committee recommends deciduous plants. Plants selected for the design will be checked for suitability in regard to eventual size and spread, susceptibility to diseases and pests, and adaptability to existing soil and climatic conditions . A local landscape architect or local nurseryman is a suitable source for plant material information. SECTION 3 . Section 9306 ,00-C- (15) of Division 9 of the Palm Springs Ordinance Code is hereby amended to read as follows : (15) Peripheral planting areas are required every ten (10) spaces . (Taper planting area as indicated.) One (1) fifteen (15) gallon tree and ground cover shall be installed in each of these planting areas. SECTION 4. Section 9305.00-C-16 & 17 of Division 9 of the Palm Springs Ordinance Code is hereby amended to read as follows : (16) One-third (1/3) of required islands shall be landscaped with trees and ground cover . (17) One (1) fifteen (15) gallon tree shall. be installed for each Fifteen (15) parking spaces . If (3) is less than twenty-two (22) feet, no two-way traffic will be permitted. All parking stall widths shall be nine (9) feet minimum except parallel parking stalls, which shall be a minimum of 8 X 24 feet . Six (6) inch PCC curb and gutters shall be installed, except that six (6) inch PCC vertical curbs may be installed in lieu of curb and gutters if no drainage is carried along curb line. Where a six (6) inch PCC vertical curb is used, a 2-foot wide concrete gutter section shall be installed along drainage line. SECTION 5. This ordinance is declared to be an urgency matter within the meaning of Section 36937 and 65806 of the Government Code of the State of California for the reason that Ordinance No. 728 and Ordinance No. 730 will take effect on. February 10, 1966 and should be amended prior to such date. I SECTION 4. EFFECTIVE DATE. Time Limit for Development Unless otherwise stated by the Commission or Council, the time limit for commencement of construction under a Conditional Use I Permit shall be one (1) year from the effective date of approval. An extension of said time limit may be approved by the Commission upon demonstration of cause by the applicant. SECTION 3. EFFECTIVE DATE. Paragraph "E" of Section 9404.00 of Division 9 I of the Palm Springs Ordinance Code is hereby amended to read as follows : E. NON-CONFORMING OFF-STREET PARKING, LOADING FACILITIES AND TRASH ENCLOSURES . Existing buildings whose off-street parking, loading facilities, or trash enclosures do not conform to the provision of this Code may be expanded or facilities added, provided the requirements for off-street parking, loading space, and trash enclosures shall have been complied with for those facilities added or enlarged. SECTION 7 . A new subsection "D" is hereby added to Section 9307 .00 of Division 9 of the Palm Springs Ordinance Code to read as follows : D. TRASH ENCLOSURES A trash enclosure shall be provided for all uses in each zone district, except single family zones . The requirements of this section I shall not apply in the G M, M-1 and M-1-P Zones when a property is completely enclosed by walls and buildings . Said trash enclosure shall be constructed so that the contents including trash containers shall not be visible from a height of five (5) feet above ground level on any street frontage. The construction of said trash enclosure shall conform to the following standards „ 1 . The enclosure shall be constructed of, masonry block or decorative block. 2 . Height of the enclosure shall be suffi- cient to conceal the contents of the enclosure, including containers, but in no case less than six (6) feet measured from finish grade at the exterior of the enclosure. 3 . Baffled openings to the enclosure are permissible, provided that if all or a portion of the contents are stored in mechanically unloaded steel bins of the Dempster type a double swing gate with a clear opening of nine (9) feet shall be provided for vehicular access to the enclosure. Gate height shall be equal to enclosure height, and the gate shall be equipped with a latch or other device to -2- 2 Ordinance No . 744 Page 3 insure the gate remains closed when not in use. The gate shall be of a material, color, and design which will blend with I the enclosure. Contents of the enclosure shall not be visible when the gate is closed. 4. The enclosure shall be so oriented on the property that convenient access is provided for waste disposal service. If mechanically unloaded steel bins are utilized, paved access to the gate opening shall be provided which will allow entry of, the waste disposal truck without excessive maneuvering. 5 . The enclosure shall be constructed with a concrete floor and designed so that it can be washed out and kept in a sanitary condition. SECTION 8. A new subsection "E" is hereby added to Section 9307.00 of Division 9 of the Palm Springs Ordinance Code to read as follows : E. NON-CONFORMING 'TRASH ENCLOSURES Properties which do not conform to the provi- I sionsof this Section shall be required to comply on or before December 31, 1967 . Properties which are unable to comply with the provisions of this Section shall be required to apply for a Variance under the provision of Section 9405 of this Code. SECTION 9. EFFECTIVE DATE. All dry, dead shrubs , dead trees , com- bustible refuse and waste, or any material growing upon the streets , sidewalks or upon private property within the City of Palm Springs , which by reason of their size, manner of growth and location constitute a fire 'hazard Ord. Refuse and waste matter as herein- after defined, which by reason of its location and character is unsightly and interferes with the reason- able enjoyment of property by neighbors , detrimentally affects property values in the surrounding neighborhood or community, or which would materially hamper or inter- fere with the prevention or suppression of fire upon the premises is hereby declared a public nuisance. 560103 REFUSE AND WASTE 'DEFINITION, Refuse and waste matter is defined for the purpose of this Chapter as unused or discarded matter and material having no substantial market valve, and which consists of such matter and material as . rubbish, refuse, debris , and matter of any kind including but not limited to rubble, asphalt, concrete, plaster, tile , rocks , bricks , soil, building materials , crates , cartons , containers , boxes , machinery or parts thereof, scrap metal and other pieces of metal, ferrous or non-ferrous , furniture or parts thereof, in- operative vehicles , vehicle bodies and/or parts thereof, trimmings from plants or trees , cans, bottles and barrels . 5601. 4 POLLUTED WATER. Any swimming pool, pond or other body of water which is abandoned, unattended, unfiltered, or not otherwise maintained, resulting in the water becoming polluted, shall constitute a public nuisance. 5601.5 POLLUTED WATER DEFINED, Polluted water is defined for the purpose of this ordinance, as water contained in a swimming pool, pond, or other body of water, which. in- eludes but is not limited to bacterial growth, includ- ing algae, remains of inserts , remains of deceased animals , reptiles , rubbish, refuse, debris , papers , and any other foreign matter or material which because of its nature or location constitutes an unhealthy, unsafe or unsightly condition, ARTICLE 561 DECLARATION OF NUISANCE 56110 CITY MANAGER AUTHORITY, Any employee of the City of Palm Springs who is authorized by the City Manager shall have the right to enter upon private property to deter- mine whether a public nuisance exists . 5612 . NOTICE REQUIRED. Upon determination that a public nuisance exists , as herein defined, on any lot or premises , or upon any sidewalk, parking or street adjacent to such lot or premises , the authorized employee) of the City of Palm Springs shall cause a notice to be i issued to the proper person or persons to abate such nuisance, Ord.No. 747 Page 3 5613. NOTICE -• FORM AND CONTENTS, Such notice shall be headed- "NOTICE OF PUBLIC NUISANCE" in letters not less than one.. inch (1") in height and which shall, in legible characters , direct the abatement of the nuisance referring to this Chapter I for particulars . Notices served by means other than posting as required by this Chapter shall contain a description of the property in general terms reason- ably sufficient to identify the location of the nuisance. 5614. SERVICE 0'F NOTICED The notice required by Section 5613 of this Chapter may be served in any of the following methods - A, By personal service on the owner, occupant or person in charge or control of the property, B. By posting at a conspicuous place on the land or premises or abutting public right of way. Co By sending a copy of such notice by certified mail addressed to the owner or person in charge or control of the property, at the address shown on the last available assessment roll, or as otherwise known. ARTICLE 562 I APPEAL 5621. APPEAL AND HEARING, Within ten (10) days from the date of posting, mailing or personal service of the required notice, the owner or person occupying or controlling such lot or premise affected may appeal to the City Council of Palm Springs . Such appeal shall be in writing and shall be filed with the City Clerk. At the regular meeting of the City Council not more than thirty (30) days thereafter, it shall proceed to hear and pass upon the appeal. The decision of the City Council thereupon shall be final and conclusive. ARTICLE 563 REMOVAL AND ABATEMENT 5631, OWNER TO ABATE, Any nuisance found by the City Council to be such 'hereunder shall be abated by the owner, his agent or occupier of the premises forthwith, or as soon thereafter as practicable after the order to abate becomes final, but in no case more than ten (10) days after said final order. I 5632 . CITY TO ABATE AND REPORT. If the owner fails or neglects to remove or otherwise take action to abate the nuisance as herein defined, within the time speci- fied in this ordinance, the City Manager, through the City employees authorized by him, shall cause such nuisance to be abated. The abatement work may be done by City crews or by private contractor. A report of the proceedings and an accurate account of the cost brd.No. 747 Page 4 5632 (con' t) of abating the nuisance on each separate property shall be filed with the City Council. ARTICLE 564 REPORT AND HEARING ON ASSESSMENT I 5641. HEARING ON ASSESSMENT. The City Clerk shall thereupon set the report and account for 'hearing by the City Council at the first regular meeting which will be held at least seven (7) calendar days after the date of filing, and shall post a copy of said report and account and notice of the time and place of hearing in a conspicuous place in or near the entrance of the Palm Springs City hallo The owner who is affected by such report and account, or the person occupying or controlling such lot or premises , shall be sent a notice advising him of the date, time and place of the hearing and said notice shall be served as provided for in Section 5614 of this Chapter. 5642. RESOLUTION ASSESSING LIEN, The City Council shall consider the report and account at. the time set for hearing, together with any objections or protests by any interested parties . Any owner of land or person interested therein, may present a written or oral pro- test or objection to the report and account. At the conclusion of the hearing the City Council shall either approve the report and account as submitted, or as modified or corrected. The amounts so approved shall I be liens upon the respective lots or premises , The City Council shall adopt a resolution assessing said amounts as liens upon the respective parcels of land as they are shown upon the last available assessment roll, before the determination that a public nuisance exists , 5643a RECORDING, The City Clerk shall prepare and file with the County Auditor of the County of Riverside a certi- fied copy of the: said resolution of the City Council. 5644. PAYMENT. The Finance Department of the City of Palm Springs may accept payment of any amount due at any time prior to the City Council hearing, as called for in Section 5621 of this Chapter. ARTICLE 565 ASSESSMENT 56.51, ASSESSMENT AND COLLECTION.-. PENALTY, The owner, occupant, or agent of any lot or premises within the City of Palm Springs who shall permit or allow the existence of a public nuisance as defined in this Chapter, �-upon any lot or premises owned, occupied, or controlled by him, or who shall violate any of the provisions of this Chapter, shall be guilty of a misdemeanor and upon conviction thereof shall be subject to a fine of not more than Five Hundred Dollars($500. 00) , or to imprisonment for a period not exceeding six (6) months , or both, such fine and imprisonment. In the City of Palm Springs, California, with its I population consisting of people of every race, color, creed, national origin and ancestry, there is no greater danger to the health, morals , safety and welfare of the City and its inhabitants than the existence of such groups prejudicial against one another and antagonistic to each other. The City Council hereby finds and declares that acts of prejudice , intolerance, bigotry, discrimination and disorder occasioned thereby threaten the rights and proper privileges of its inhabitants and menace the institutions and foundations of a free democratic community. For this reason a commission is hereby created through which the City of Palm Springs, Calif- ornia, officially may encourage and bring about mutual under- standing and respect among all groups in the City, and eliminate prejudice, intolerance , bigotry, discrimination and any disorder occasioned thereby. Within the scope of its operation the commission shall also guarantee equal rights for all assured by the Constitution and the laws of this State and of the United States of America. 5102. HUMAN RELATIONS COMMISSION. There is hereby created a Human Relations Commission for the City of Palm Springs , California. It shall consist of seven members, serving without compensation, to be appointed by the Mayor with the approval of the City Council, one of whom shall be designated by the Mayor as its chairman. Each successive year hereafter on May 1st the Mayor I shall appoint a chairman from the members. Four (members) of said commission shall constitute a quorum for the transaction of business. Of the seven members first appointed, three shall be appointed for the term that expires April 30, 1967, and Ordinance No. 749 Page 2 four shall be appointed for the term that expires April 30, 1968. Thereafter all appointments to the commission shall be for a I term of two years. Any member may be removed by the Mayor for failure to attend meetings or for inattention to duties. In the event of the death, resignation, or removal of any member, his successor shall be appointed by the Mayor to serve for the unexpired period of the term for which such member had been appointed, provided , however, that whenever possible , all members shall continue in office until their successors shall have been appointed . The Mayor, City Manager, City Attorney, President of the School Board , and the Superintendent of Schools shall serve as ex-of-ficio members of the commission, shall be authorized to attend all meetings of the commission and shall take part in all discussion but shall not be impowered to vote on matters before the commission. ARTICLE 511 OFFICERS AND MEETINGS 5111. OFFICERS - COMMITTEES. The commission at its organizational meeting, and annually thereafter, shall elect- from its member- ship a vice-chairman. The chairman and the vice-chairman shall have and perform such duties as are commonly associated with their respective titles. The commission shall be further authorized to appoint and fix the membership of such member of .standing and temporary committees as it may find expedient for the performance ' of its duties. The City Manager may appoint an executive secretary and other staff and provide such compensation for their services as may be authorized by the City Council and by the annual City budget of expenditures. 5112. MEETINGS : REGULAR AND SPECIAL. The Human Relations Commission shall meet at least once each month at such time and place as shall be fixed by the commission by its standing rules. Special meetings shall be called by the chairman, or in his absence by the vice-chairman, or upon the written request of any three (3) members of the commission. All such requests shall state the purpose or purposes for which such special meeting is to be called and shall be filed with the secretary at least 24 hours before the time set for the special meeting. Such request and call for a special meet- ing shall be read at the meeting and entered in the minutes , and no business shall be transacted except that stated in the request for such special meeting. The commission shall prepare its own agenda for all meetings and establish its own rules of order or adopt, Robert's Rules of Order for the conduct of its meetings . ARTICLE 512 FUNCTIONS, POWERS AND DUTIES 5121. FUNCTIONS. The functions of the commission shall be : I 5121. 1 To foster mutual understanding and respect among all racial , re- ligious and ethnic groups in the City of Palm Springs , California. 5121.2 To encourage equality of treatment for and prevent discrimination against any racial, religious or ethnic group or its members. 5121.3 To cooperate with governmental and non-governmental agencies and organizations having like or kindred functions. The powers and duties of the commission shall be : 5122. 1 To coordinate with federal, state, county and city agencies in developing courses of instruction for presentation to City employees and in public and private schools , public libraries, museums and other suitable places, on techniques for achieving harmonious intergroup relations within the City of Palm Springs , California. 5122.2 To enlist the cooperation of various racial, religious and ethnic groups , community organizations, labor organizations, fraternal and benevolent associations and other groups in Palm Springs, California, in programs and campaigns devoted to eliminating group prejudice , intolerance, bigotry and discrimination. 5122.3 To study and make recommendations to the City Council concerning the problems of prejudice , intolerance, bigotry and discrimina- tion and disorder occasioned thereby in all or any fields of human relationship. 5122.4 To receive complaints of (1) racial, religious and ethnic group tensions, prejudice, intolerance , bigotry and any disorder occasioned thereby occurring within the City of Palm Springs, I California; (2) discrimination against any person, group of persons, organization or corporation, whether practiced by private persons, associations, or corporations and to refer appropriate matters to the proper federal , state or county agency having jurisdiction. 5122.5 To submit an annual report to the City Council. SECTION #2. SEVERABILITY. The City Council of the City of Palm Springs, after extensive research, conferences, meetings and public hear- ings by both the City Council and the Planning Commission, hereby finds that construction in hillside areas involves unusual pro- blems of fire hazard, drainage and construction problems. It is therefore necessary that specific regulations be enacted for development and construction in the hillside areas of the City. The regulations set forth in this ordinance shall apply in addi- tion to all other applicable ordinances and regulations of the City of Palm Springs . SECTION 2. Section 9313 .00, (The General Conditions Section of the Ordinance) Hillside Developments, is hereby added as follows ° Section 9313 .00 : HILLSIDE DEVELOPMENTS This section of the ordinance is intended to provide for the safe, orderly and aesthetically appealing development of hillside areas. A. DEFINITION 1. For the purposes of this ordinance, the term "hillside area" is hereby defined as : Any parcel of land within the City of Palm Springs which contains any portion thereof with a grade of. ten (10) percent or more. B. SITE PLAN APPROVAL 1. Site plan approval by the Planning Commission shall be required for all developments for hillside areas . 2 . The following procedure shall apply for site plan approval: -1- 3-C Ordinance No. 751 Page 2 a. Applicant may submit tentative and preli- minary plans to the Planning Commission for approval before detailed engineering and architectural plans are prepared. I b. In approving final plans, the Planning Commission may require conditions which in their opinion are necessary to protect the public health, safety and general welfare, and may include the following : (1) Architectural Approval, as governed by Section 9403 .00 of the Zoning Ordinance. Such Architectural Approval shall con- sider, but shall not be limited to, the following: (a) Rock and soil exposure. (b) Size of building pads . (c) Design considerations, such as supporting stilts, colors and building arrangement . (d) Screening of parking areas . (e) Landscaping plans . (2) Accurate topographic maps with a I contour interval of not more than five (5) feet indicating existing and proposed topography. (3) Protective devices such as guard rails, fences and walls. (4) Yards and buffers . (5) Sewerage treatment facilities . (6) Appropriate bonds guaranteeing installa- tion of facilities required. (7) And such other conditions that will make possible the development of the City in an orderly and efficient manner in conformity with the intent and purposes set forth in this Ordinance. C. DENSITY 1. The density and lot dimensions of the zone in which the property is located shall apply. I 2 . Density calculation for large scale developments . In order to encourage a more creative approach in the development of land and to allow for more usable open space areas, large scale residential developments may be permitted on sites of. not -2- 3 Ordinance No. 751 Page 3 less than four and one-half (4 1/2) acres of land. The land shall be developed as an I integrated unit, conforming to density and all other property standards, except that lot area, lot dimensions and yards may be modified to allow "cluster" and "row" housing, provided the overall development equals the general quality of development in this zone. Density shall be determined by net area . The area of both public and private streets shall be excluded in calculating the net area of the site. In order to insure permanent retention of the "open space", a covenant approved by the City Attorney shall be recorded dedicating all building right to the City of Palm Springs and insuring that said open space shall remain as shown on plans approved by the City of Palm Springs. Any area of the site having a degree of slope of 33 .7 degrees or more shall be excluded from the allowable area that may be allowed in computing total density. D. STREET '.IMPROVEMENTS I 1. Hillside Collector Streets (streets serving more than four lots) . Maximum grade is twenty (20) percent, provided all grades over fifteen (15) percent shall be improved with six (6) inches of PCC pavement. Streets with grades in excess of fifteen (15) percent shall only be allowed for short distances . a . No building site shall be approved for con- struction which does not have provisions for conducting water drainage from the site to a natural drainage course, a drainage channel or a public street in accordance with good engineering practice and in a manner approved by the Director of Public Works . F. SEWERAGE TREATMENT 1. Special sewerage treatment facilities such as local sewerage lines to carry sewage to local treatment plants may be required rather than individual septic tank and cesspool installa- tions, if deemed necessary by the Director of Building and Safety. G. EXCAVATIONS 1. The following requirement shall supplement I and/or supersede the requirements of Chapter 70, Excavation and Grading of. the 1964 Uniform Building Code, the Grading Ordinance of the City of Palm Springs. -4- Ordinance No. 751 Page 5 a. No excavation shall be permitted on any I hillside area prior to the approval of a site plan and a grading plane bo A grading plan shall be submitted as a part of the application for site plan approval for a hillside development . A preliminary grading plan shall be filed in compliance with the procedure set forth in Article 964 of the City Subdivision Ordinance. co No dirt or rock shall be allowed to be used for fill except in those locations approved by the excavation plan. Excess dirt and rock shall be carried to a disposal area designated on the grading plan or to an approved off-site location. H. FIRE PROTECTION 1. In areas where there will be a fire hazard, in the opinion of the Fire Chief of. the City of Palm Springs, unobstructed fire protection equipment access easements shall be required. The Fire Chief shall recommend to the Planning I Commission where such easements are needed. 2. Water mains and water systems shall be sized to provide sufficient water to meet the fire fighting requirements of the area involved. The Fire Chief shall review proposed systems in relation to the National Board of Fire Underwriters standards for water systems and make recommendations to the Planning Commission. SECTION 3 . Chapter 96, Article 960 (Subdivision Ordinance) of Division 9 of the Palm Springs Ordinance Code, is hereby amended by adding the following: Section 9600.33 : HILLSIDE DEVELOPMENTS The provisions of Section 9313 .00, Chapter 93 of Division 9 of the Palm Springs Ordinance Code shall apply. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DOES ORDAIN AS FOLLOWS : SECTION to . SHORT TITLE. This Ordinance shall be commonly known as the "Convention and Visitors Bureau Ordinance . ' SECTION 2. PURPOSE. The purpose for this Ord- inance is to implement and facilitate the formation and operation of a non-profit corporation to be known as the "Palm Springs Convention and Visitors Bureau, Inc." The corporation shall operate through a seven member board I of directors, which, upon its creation, shall forthwith proceed to employ an executive vice president, other necessary staff, set up and equip the operation and do all other things necessary or proper to achieve the stated purposes of the program. The corporation shall have the principal duty of establishing and operating the City of Palm Springs advertising, promotion and publicity program as recommended in the Booz, Allen and Hamilton Report and as approved or modified by the City Council. SECTION 3 . BUDGET. The board of directors of the corporation shall prepare annual budgets for the cor- poration sufficient to implement and operate said program which shall be financed out of the Uniform Transient Occu- pancy Tax proceeds and other gifts , donations , contributions or sources approved by the City Council, and shall submit such annual budgets to the City Council for review, modi- fication as necessary, and approval. SECTION 4. . DUTIES OF THE CITY'MANAGER AND THE CITY ATTORNEY. The City Manager and the City Attorney shall immediately proceed to have said corporation formed and put into operation. The City Attorney shall be specifically responsible for the following: I A. The City Attorney shall prepare the articles of incorporation for said corporation pursuant to the laws applicable thereto. Said articles of incorporation shall be reviewed and approved by the City Council before being filed with the Secretary of State of the State of Califor- nia. The articles shall provide that the name of the corporation shall be the "Palm Springs Convention and Visitors Bureau, Inc . " Said corporation shall be organized pursuant to Part 1 of Division 2 of Title 1 of the Corpora- tion Code of the State of California. The principal office -1- Ord. No. 767 1 Page 2 for the transaction of the business of the corporation shall be in the City of Palm Springs , County of Riverside, Calif- r ornia. B. Upon the formation of said corporation, the ' City Attorney, will immediately proceed to draft the corporate I by-laws , and contracts necessary or proper for the -corpora- tion' s functioning and shall provide such other legal services as may, from time to time, be approved by the City Council. C. The City Manager and City staff shall further aid and advise said corporation toward its appropriate ends as directed by the City Council, SECTION 5 , DUTIES OF THE BOARD OF DIRECTORS . The powers and duties of the board of directors of said corpora- tion shall be those provided by law, the articles of incor- poration, by-laws and contracts entered into by said corpora- tion. . Before adoption, the by-laws of said corporation shall be first approved by the City Council. Upon formation of the corporation the board of directors thereof shall immediately hire an executive vice president and do all other things necessary and proper to effectuate the recom- mendations of the Booz, Allen and Hamilton Report as approved or modified by the City Council, SECTION 6 .
