AN ORDINANCE OF THE CITY OF PALM SPRINGS , CALIFORNIA,
ADDING A NEW SECTION 9211.2999-55 TO DIVISION 9 OF THE
"PALM SPRINGS ORDINANCE CODE" TO PROVIDE CHANGE IN
ZONE DISTRICT FOR HEREINAFTER DESCRIBED PROPERTY IN
SECTION 34, TOWNSHIP 3 SOUTH, RANGE 4, EAST, SBB&BM.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS ,
CALIFORNIA, AS FOLLOWS:
SECTION 1. A new Section 9211.2999-55 is hereby added to
Division 9 of the "Palm Springs Ordinance Code", to provide as follows:
9211.2999-55 . ZONE CHANGE
The following lands are hereby rezoned from W, Water Course, to
R-2, Limited Multiple Family District: (in the City of Palm Springs,
County of Riverside, State of California) :
BEGINNING at a point on the east line of the Southwest- quarter(SW4)
of Section Thirty-four (34) , Township Three (3) South, Range Four
(4) East, San Bernardino Base & Meridian, that is the Southeast
corner of Palm Springs, Gateway Estates No. 1, as shown in Map Book
39, Pages 58 and 59, Records of Riverside County, and running thence
S.00008'00" W. along said East. line of the Southwest quarter (SW4)
155.23 feet; thence westerly along a line parallel to and a perpendicular
distance of 150.00 feet from the Southerly Tract Boundary of said Palm
Springs Gateway Estates No. 1 to a point on the centerline of Pamela
Drive extended Southerly a distance of 179 .8 feet, more or less,
Southerly of the intersection of the said Southerly Tract Boundary
and said centerline of Pamela Drive; thence N.0008'00" E. to said point

BEGINNING at the Southwest corner of said Se ction 34; thence N.89043'15"
E. along the South line of Section 34, a distance of 1820.37 feet, more
or less, to the intersection of the North right-of-way line of Route
187 as shown on the "Right of Way Map of District VIII, State Division
of Highways, approved February 2, 1949" , with the South line of said

Basis of bearings for this decription is the South line of Section
Thirty-Four (34) , Township 3 South, Range Four (4) East, San
Bernardino Base & Meridian, taken as N. 89043' 15" E. as shown
in Map Book 39, page 59, Records of Riverside County, California.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force
and effect thirty (30) days after passage.

AN ORDINANCE OF THE CITY OF PALM SPRINGS , CALIFORNIA,
ADDING ARTICLE 171 and SUBSECTIONS TO DIVISION 7 OF THE
"PALM SPRINGS ORDINANCE CODE" , TO REQUIRE CITY-APPROVED
STREET NAMES FOR PRIVATE STREETS IN TRAILER PARKS .

SECTION 1 . A new Article 771 and subsections are hereby added '
to Division 7 of the "Palm Springs Ordinance Code" to read as follows :
ARTICLE 771
ESTABLISHMENT OF STREET NAMES FOR TRAILER PARKS
7711. TRAILER PARK STREET NAMES.
All owners or operators of trailer parks in the City of
Palm Springs shall file a plan with the Director of
Building and Safety showing all private streets in the
trailer park And the names of said streets .
7712. STREET NAMES FOR NEW TRAILER PARKS.
For new trailer parks and those in process at the time of
the effective date of this article, it shall be the
administrative duty of the Director of Building and Safety
to inform the owner or operator of the duty imposed by
Section 7711.
7713. STREET NAMES FOR OLD TRAILER PARKS.
Owners or operators of trailer parks approved and operating
at the effective date of this article shall have three (3)
months from the effective date of this article to comply with
Section 7711. It is the intent of the City Council that
this article have retroactive effect because the police and fire ser-
"'vices are unable to perform their health and safety functions
without the information required by Section 7711.
7714. APPROVAL OF STREET NAMES.
All street names in trailer parks shall first be approved by
the Director of Building and Safety to avoid duplication or
confusion with other street names .
7715 . PRIVATE STREETS AND STREET SIGNS .
Owners or operators of trailer parks shall pay for any private
street signs within the park, and shall maintain said street
signs together with said private streets .
SECTION 2 . EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty (30) days after passage.
SECTION 3. PUBLICATION. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to cause the
same to be published once in THE DESERT SUN, a daily newspaper of
general circulation, printed, published and circulated in the City of

AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AMENDING SECTION 9-415 .5 OF DIVISION 9 OF THE "PALM
SPRINGS ORDINANCE CODE" TO PROVIDE LOT SIZE, WIDTH
AND DEPTH FOR FAIRWAY LOTS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS , CALIFORNIA, AS FOLLOWS:
SECTION 1. Section 9315 .5 of Division 9 of the
"Palm Springs Ordinance Code" is hereby amended to read as follows :
9315 .5 Lot Size: The minimum fairway lot size shall be twelve
thousand five hundred (12,500) feet, with the following
dimensions:
width= minimum,100 feet; depth=minimum, 100 feet.
SECTION 2 . EFFECTIVE DATE. This ordinance shall be
in full force and effect thirty (30) days after passage .

ORDINANCE NO. 630
AN ORDINANCE OF THE CITY OF PALM SPRINGS , CALIFORNIA, AMENDING
SECTION 808.2 AND ADDING SECTIONS 808.21 AND 808.22 TO
DIVISION 8 OF THE "PALM SPRINGS ORDINANCE CODE" REGULATING FILTER
TANKS , PIPING, RE-CIRCULATION AND THE USE OF POLYVINYL CHLORIDE.

AS FOLLOWS:
SECTION 1. Section 808.2 is amended to read as hereinafter
set forth and new Sections 808.21 and 808.22 are hereby added to .
Division 8 of the "Palm Springs Ordinance Code" to read as follows:

808 .2 FILTER TANKS AND PIPING. Underground tanks shall be
steel plate at least 3/16" thick, with a non-
corrosion coating on interior of tank. Pool piping
shall be sized to permit- the rated flows for filtering
and backwashing without exceeding the maximum head at
which the pump will provide such flows .
808.21 RECIRCULATION PIPE REQUIREMENT. An outlet shall be placed
at the deep end in every pool for recirculation and
drainage, where pool recirculation piping passes through
concrete, it shall be copper, with a minimum wall
thickness of type "L" copper tubing, brass or polyvinyl
chloride .
808.22 POLYVINYL CHLORIDE. Polyvinyl Chloride pipe shall be
schedule 40 or 80 and of type 1 or 2. Polyvinyl pipe
shall not be connected directly to the water heater
and shall have flexible connections at ingress and egress
to the circulation pump: All polyvinyl piping to be
continuously identified and to bear the seal of the
"National Sanitation Foundation" .
SECTION 2 . EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty (30) days after passage .
SECTION 3. PUBLICATION. The City Clerk is hereby ordered
and directed to certify to the passage of this ordinance and to

Garden Apartment Multiple District:
The North half of the Northeast quarter of the Northwest
quarter of the Southwest quarter (N,NE4NW4SW4) of
Section Twenty-Six (26) ,' Township Four (4) South,
Range Four (4) East, San Bernardino Base & Meridian.
The applicant for such change of zone shall adhere
to the conditions imposed by the Planning Commission
in Planning Commission Case 5 .380; in addition
applicant shall be entitled to development of the
property at the rate of one(1) unit per forty-five
hundred (4500) square feet.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full

SECTION 1. New Sections 9214.00 through 9214.03 are hereby
added to Division 9 of the. "Palm, Springs Ordinance,,Code"' to provide
as follows :
9214.00 P - PROFESSIONAL ZONE: The "P" Zone is intended to provide
for the development of a professional district with necessary
related retail commercial uses and other compatible facilities.
9214.01 USES PERMITTED: Buildings, structures, and land shall be
used and buildings and structures shall hereafter be erected,
altered, or enlarged only for the following uses . All uses
shall be subject to the property development standards in
' Section 9214.03.
Artist's studios
Conservatories
Hospitals
Libraries
Medical, dental and biological laboratories
Medical, dental, and therapeutic clinics .
Museums
Offices: professional institutional, quasi-public,
governmental
Secretarial and clerical services
The following retail commercial uses, where necessary
to permitted uses:

Medical and sickroom equipment and supplies
Optometrist
' Pharmacy
Coffee Shop or tearoom - operating not earlier than
six (6) A.M. nor later than six (6) P.M.
Accessory uses customarily incident to the permitted
uses and located on the same lot therewith.
SIMILAR USES PERMITTED BY COMMISSION DETERMINATION:
The Commission may, by resolution of record, permit any
other uses which it may determine to be similar to
those listed above and not more obnoxious or detrimental to
the public health, safety, and welfare or to other uses
permitted in the zone. All uses shall be subject to the
standards in Section 9214.03 .
9214.02 USES PROHIBITED: All uses and structures not permitted
in this zone are here deemed to be specifically prohibited.
The following classifications of uses shall not be permitted
in this zone by Commission determination.
Industrial uses
Residential uses
Retail sales, except those listed as necessary to
permitted uses as listed above.
9214.03 PROPERTY DEVELOPMENT STANDARDS: The following standards
shall apply to all land and buildings in the P Zone, except
that any lot shown on an official subdivision map duly
approved and recorded, or any lot for which a bona fide
deed had been duly recorded at the time Ordinance No. 75
became effective on January 12, 1940, may be used as a
building site,
A. LOT AREA: Each lot shall have a minimum area of
twenty thousand (20,000) square feet.
B. LOT DIMENSIONS :
1. Each lot shall have a minimum width of one hundred
and thirty (130) feet.
2. Each lot shall have a minimum depth of one hundred
and fifty (150) feet.
3 . Each building site shall, have a minimum frontage of
one hundred (100) feet on a dedicated and improved street.
C. BUILDING IIEIGHT
1. Buildings and structures shall have a height not
greater than thirty (30) feet, ,except as provided below.
D. YARDS
1 . Where the P Zone fronts, sides, or rears on a street,
there shall be a yard abutting said street of not less than
twenty five (25) feet. Not less than the six (6) feet
nearest the street shall be landscaped and maintained.
The remainder may be used for parking, provided a wall not
less than two and one-half (2z) feet in height is installed
between the landscaped portion and the parking area.
2. Where the P Zone sides or rears directly on property
in a residential zone, there shall be a yard of not . less
than twenty (20) feet. Said yard may be used for parking.
A wall six (6) feet in height shall be installed on the
zone boundary line, with screen landscaping adjacent to it.
3 . Where the P Zone sides or rears on an alley which is a
boundary with a residential zone there shall be a yard of-
not less than thirty (30) feet, measured from the side of
the alley opposite the subject property. Said yard may
be used for parking or loading.
E. WALLS , DENCES, AND LADNSCAPING: Walls shall be erected
as required in Section 9214.03 - D-2 above .
F. VEHICULAR ACCESS: The provisions of section 9453.6
shall apply. I
G. COVERAGE: Lot area by buildings or structures shall not
exceed sixty (60) percent of the total lot area.
H. OFF-STREET PARKING: The provisions of Section 9415 .2
shall apply to the P Zone. In addition, the following
off-street parking standards shall apply:
Hospitals and other uses listed in this definition:
One (1) space for each two (2) beds or one (1) space for
each.one thousand (1,000) square, feet of gross floor area,
whichever provides the greatest number, plus one (1) for
each three (3) employees .
I. OFF-STREET LOADING: The provisions of Section 9402
that are pertinent to C-1 shall apply to P, except that the
following off-street loading spaces shall be provided for
all hospital uses in the P Zone:

SECTION 1. Sections 9411 and 9308.5 Are hereby
added .to Division 9 of the "Palm Springs Ordinance Code", to
read as follows:
9411. DUCT WORK ATOP BUILDINGS.
Buildings erected in all commercial zones, as defined
in Division 9 of the "Palm.Springs Ordinance Code" .
In the above zones no mechancial equipment or, duct, work
may be constructed to extend more than eighteen, (18)
inches above the roof line in the event the parapet
wall is not required. As an alternative, the mechanical
equipment or duct work shall be so placed that it cannot
be seen by a .person of ordinary vision standing at a
distance of two hundred feet (200') from the building upon
which such mechanical equipment or duct work is constructed.
9308.5 DUCT WORK ATOP BUILDINGS TO BE CONCEALED. I
On buildings erected in all residential zones, including
trailer zone as defined in Division 9 of the, "Palm Springs
Ordinance Code": no mechanical equipment or duct work
shall be allowed on the roof unless completely concealed
by the roof structure . This requirement applies to all
buildings in all residential zones, including cabanas and
buildings in trailer parks, but not to trailers.
SECTION 2. REPEAL. Sections 5,01 (A) and 501(B) of
the "Palm Springs ,Ordinance ,Code" are hereby repealed.
SECTION 3. EFFECTIVE DATE. This ordinance shall be
in full force and effect thirty (30) days after passage .

I SECTION 1. Section 6118 of Division 6 of the "Palm Springs
Ordinance Code" is hereby amended to read as follows:
6118. ADVISORY TRAFFIC COMMISSION. There is hereby established
an Advisory Traffic Commission to serve without compensation.
Said Commission shall consist of the Director of Public
Works or his representative; without vote; Chief of
Police or, in his discretion and as his representative,
the Chief of the Traffic Division, without vote; a member
nominated by the Palm Springs Safety Council but appointed
in the discretion of the City Council; a member nominated
by the Palm Springs Chamber of Commerce but appointed in
the discretion of the City Council; five additional
members appointed by the City Council from the City at
large.
The term of office of the seven appointive members shall
be for four (4) years except that, at the first meeting
of the Commission, the appointive members will determine
by lot four members to serve four years, and three members
to serve for two years, in order to assure appointments
not expiring at the same time.
The Chairman of the Commission shall be appointed by the
- Mayor, and may be removed by him.

7020. TIME LIMITATION FOR USE OF PUBLIC PARKS. No person
shall use any public park of the City of Palm Springs
except as follows:
a. All City Parks shall be open to the public during
the hours from 6 o 'clock in the morning until
12 o'clock midnight for the period from June 1
of each year through the succeeding October 15th.
b. All City Parks shall be open to the public from
7 o'clock in the morning until 10:00 o'clock in the
evening from October 16th through May 31st of the
succeeding year.
7021. VIOLATION, MISDEMEANOR. Any violation of any portion
of this Article 702 shall be a misdemeanor and subject
to the penalties provided in Section 0311 through 0313
of this Code I
7022. SIGNS DESIGNATING HOURS, No person shall be cited or
prosecuted for a violation of this Article 702 unless
and until the City Administration shall have posted
no less than five (5) signs at the City Parks indicating
to the public the hours for use of the parks and the

Palm Springs by Article 801 of the "Palm Springs Ordinance
Code" is hereby amended to read as follows :
3305 (j) . Stairway Construction - Exterior. Exterior stairs
shall be of incombustible material except that on
I buildings not exceeding two stories in height, they
may be of wood not less than two inches (2") in
nominal thickness.
Exterior metal stairways shall not exceed two (2)
stories in height. Exterior stairs shall be
enclosed and protected as required Ear exterior
walls due to location on the lot, as set forth in
Parts IV and V of this Code.
SECTION 2. EFFECTIVE DATE, This ordinance shall be
in full force and effect thirty (30) days after passage.

ORDINANCE NO. 646
AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ADDING SECTION 9252.1 AND AMENDING SECTION 9263 OF
DIVISION 9 OF THE "PALM SPRINGS ORDINANCE CODE", TO
PROVIDE FOR REVIEW BY CITY COUNCIL OF NEGATIVE ACTION
TAKEN BY PLANNING COMMISSION IN CASE OF APPLICATIONS
FOR CONDITIONAL USE PERMIT AND CHANGES OF ZONE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AS FOLLOWS:
SECTION 1. Section 9252. 1 is hereby added to Division 9
of the "Palm Springs Ordinance Code", to read as follows:
9252.1 COUNCILMANIC ACTION.
Upon receipt by the City Council of negative
action by the Planning Commission, the City
Council shall not reverse the action of the
Planning Commission but shall resubmit the
matter to the Planning Commission together
with suggestions by the City Council; there-
after if the Planning Commission once again
denies the application, then the City Council
may reverse the action of the Planning Commis-
sion by a majority vote of the members of the
City Council.
SECTION 2. Section 9263 of Division 9 of the "Palm
Springs Ordinance Code" is hereby amended to read as follows:
9263. HEARING BEFORE THE COUNCIL.
The City Council may reverse a negative ruling of
the Planning Commission only after once resub-
mitting the matter to the Planning Commission
with any suggestions the City Council may have.
On the next consideration by the City Council,
the negative action of the Planning Commission
may be overruled by a majority vote of the
members of the City Council.
SECTION 3. EFFECTIVE DATE. This ordinance shall be

fornia, the Uniform Building Code, 1964 Edition,
Volume I, promulgated by the International
Conference of Building Officials, is hereby
adopted by reference, and said Code, together

AN ORDINANCE OF TIE CITY OF PALM SPRINGS,
CALIFORNIA, ADDING CHAPTER 29. 13 TO DIVISION

ING A TAX UPON TILE PRIVILEGE OF TRANSIENT
OCCUPANCY AND PROVIDING FOR THE COLLECTION
THEREOF
I BE IT ORDAINED BY THE CITY COUNCIL OF TIE CITY OF PALM SPRINGS,
CALIFORNIA, AS FOLLOWS:
SECTION 1. Chapter 29.13 is hereby added to Division
2 of the "Palm Springs Ordinance Code", to read as follows:
29.13-1 This Chapter shall be known as the Uniform Transient
Occupancy Tax Ordinance of the City of Palm Springs.
29.13-2 Definitions. Except where the context otherwise
requires , the definition given in this section govern
the construction of this ordinance:
(a) Person. "Person" means any individual, firm,
partnership, joint venture, association, social
club, fraternal organization, joint stock company,
corporation, estate, trust, business trust,
receiver, trustee, syndicate, or any other group
or combination acting as a unit.
(b) Hotel. "Hotel" means any structure, or any
portion of any structure, which is occupied or
intended or designed for occupancy by transients
for dwelling, lodging or sleeping purposes , and
` includes any hotel, inn, tourist home or house,
I motel, studio hotel, bachelor hotel, lodging house,
rooming house, apartment house, dormitory, public
or private club, mobilehome or house trailer at a
fixed location, or other similar structure or
portion thereof and subject to the business license
provided by Chapter 2 of this Code.
(c) Occupancy. "Occupancy" means the use or possession,
or the right to the use or possession of any room
or rooms or portion thereof, in any hotel for
dwelling, lodging or sleeping purposes.
(d) Transient. "Transient" means any person who exer-
cises occupancy or is entitled to occupancy by
reason of concession, permit , right of access ,
license or other agreement for a period of thirty
(30) consecutive calendar days or less , counting
portions of calendar days as full days. Any such
person so occupying space in a hotel shall be
deemed to be a transient until the period of
thirty (30) days has expired unless there is an
agreement in writing between the operator and
the occupant providing for a longer period of
I occupancy. In determining whether a person is
a transient, uninterrupted periods of time ex-
tending both prior and subsequent to the effective
date of this chapter may be considered.
(e) Rent. "Rent" means the consideration charged,
whether or not received, for the occupancy of
space in a hotel valued in money, whether to be
received in money, goods , labor or otherwise,
including all receipts ; cash, credits and property
and services of any kind or nature, without any
deduction therefrom whatsoever.
(f) Operator. "Operator" means the person who is
proprietor of the hotel, whether in the capacity
of owner, lessee, sublessee, mortgagee in possess-
ion, licensee, or any other capacity. Where the I
operator performs his functions through a managing
agent of any type or character other than an
employee the managing agent shall also be deemed
an operator for the purposes of this Chapter and
shall have the same duties and liabilities as his
principal. Compliance with the provisions of this
Chapter by either the principal or the managing
agent shall, however, be considered to be compliance
by both.
(g) Tax Administrator. "Tax Administrator" means the
City Manager or his designated agent.
29.13-3 Tax Imposed. For the privilege of occupancy in any
hotel, each transient is subject to and shall pay a tax
in the amount of four percent (4%) of the rent charged
by the operator. Said tax constitutes a debt owed by
the transient to the city which is extinguished only
by payment to the operator or to the city. The transient
shall pay the tax to the operator of the hotel at the time
the rent is paid. If the rent is paid in installments , a
proportionate share of the tax shall be paid with each -in-
stallment. The unpaid tax shall be due upon the transient 's
ceasing to occupy space in the hotel. If for any reason the I
tax due is not paid to the operator of the hotel, the Tax
Administrator may require that such tax shall be paid di-
rectly to the Tax Administrator.
29.13-4 Exemptions . No tax shall be imposed upon:
(a) Any person as to whom or any occupancy as to which,
it is beyond the power of the city to impose the
tax herein provided;
(b) Any federal or State of California officer or
employee when an official business;
(c) Any officer or employee of a foreign government who
is exempt by reason of express provision of federal
law or international treaty.
No exemption shall be granted except upon a claim there-
for made at the time rent is collected and under penalty
of perjury upon a form prescribed by the Tax Administrator.
29.13-5 Operator's Duties. Each operator shall collect the tax
imposed by this Chapter to the same extent and at the
same time as the rent is collected from every transient.
The amount of tax shall be separately stated from the
amount of rent charged, and each transient shall receive
a receipt for payment from the operator. No operator of
a hotel shall advertise or state in any manner, whether
directly or indirectly, that the tax or any part thereof
will be assumed or absorbed by the operator, or that it
will not be added to the rent, or that, if added, any
part will be refunded except in the manner hereinafter
provided.
29.13-6 Registration_. Within thirty (30) days after the
effective date of this Chapter, or within thirty (30)
days after commencing business, whichever is later,
each operator of any hotel renting occupancy to
transients shall register said hotel with the Tax
Administrator and obtain from him a "Transient Occu-
pancy Registration Certificate" to be at all times
posted in a conspicuous place on the premises. Said
certificate shall, among other things, state the
following:
I (1) The name of the operator;
(2) The address of the hotel;
(3) The date upon which the certificate was issued;
(4) "This Transient Occupancy Registration Certifi-
cate signifies that the person named on the face
hereof has fulfilled the requirements of the
Uniform Transient Occupancy Tax-Chapter by regis-
tering with the Tax Administrator for the purpose
of collecting from transients the Transient Occu-
pancy Tax and remitting said tax to the Tax Admini-
strator. This certificate does not authorize any
person to conduct any unlawful business or to con-
duct any lawful business in an unlawful manner,
nor to operate a hotel without strictly complying
with all local applicable laws, including but not
limited to those requiring a permit from any board,
commission, department or office of this city.
This certificate does not constitute a permit."
29.13-7 Penalties and Interest. '
I (a) Original Delinquency. Any operator who fails to
remit any tax imposed by this chapter within the
time required shall pay a penalty of 10% of the
amount of the tax in addition to the amount of the
tax.
(b) Continued Delinquency. Any operator who fails to
remit any delinquent remittance on or before a
period of thirty (30) days following the date on
which the remittance first became delinquent shall
pay a second delinquency penalty of 10% of the
amount of the tax in addition to the amount of the
tax and the 10% penalty first imposed.
(c) rraud. If the Tax Administrator determines that
the non-payment of any remittance due under this
Chapter is due to fraud, a penalty of 25% of the
amount of the tax shall be added thereto in addi-
tion to the penalties stated in subparagraphs (a)
and (b) .of this section.
(d) Interest. -In addition to the penalties imposed,-
any operator who fails to remit any tax imposed
by this Chapter shall pay interest at the rate of
one-half of 1% per month or fraction thereof,on
I the amount of the tax, exclusive of penalties,
from the date on which the remittance first became
delinquent until paid-.
29. 138 (e) Penalties Merged with Tax. Every penalty imposed and
such interest as accrues under the provisions of this
section shall become a part of the tax herein required
to be paid.
29.13-9 Failure to Collect and Retort Tax. Determination of Tax
by Administrator. If any operator shall fail or
refuse to collect said tax and to make, within the time
provided in this Chapter, any report and remittance of
said tax or any portion thereof required by this Chapter,
the Tax Administrator shall proceed in such manner as he I
may deem best to obtain facts and information on which
to base his estimate of the tax due. As soon as the Tax
Administrator shall procure such facts and information
as he is able to obtain upon which to base the assess-
ment of any tax imposed by this Chapter and payable by
any operator who has failed or refused to collect the
same and to make such report and remittance, he shall
proceed to determine and assess against such operator
the tax, interest and penalties provided for by this
Chapter. In case such determination is made, the Tax
Administrator shall give a notice of the amount so
assessed by serving it personally or by depositing it
in the United States mail, postage prepaid, addressed
to the operator so assessed at his last known place of
address. Such operator may within ten (10) days after
the serving or mailing of such notice make application
in writing to the Tax Administrator for a hearing on the
amount assessed. If application by the operator for a
hearing is not made within the time prescribed, the tax,
interest and penalties, if any, determined by the Tax
Administrator shall become final and conclusive and
immediately due and payable. If such application is
made, the Tax Administrator shall give not less than
five (5) days written notice in the manner prescribed
herein to the operator to show cause at a time and I
place fixed in said notice why said amount specified
therein should not be fixed for such tax, interest and
penalties. At such hearing, the operator may appear and
offer evidence why such specified tax, interest and pen-
alties should not be so fixed. After such hearing the
Tax Administrator shall determine the proper tax to be
remitted and shall thereafter give written notice to the
person in the manner prescribed herein of such determina-
tion and the amount of such tax, interest and penalties.
At such hearing, the operator may appear and offer evi-
dence why such specified tax, interest and penalties
should not be so fixed. After such hearing the Tax
Administrator shall determine the proper tax to be
remitted and shall thereafter give written notice to
the person in the manner prescribed herein of such de-
termination and the amount of such tax, interest and
penalties. The amount determined to be due shall be
payable after fifteen (15) days unless an appeal is
taken as provided in Section 29. 13-10.
29. 13-10 Appeal. Any operator aggrieved by any decision of the
Tax Administrator with respect to the amount of such
,tax, interests and penalties, if any, may appeal to the
Council by filing a notice of appeal with the City Clerk
within (15) days of the serving or mailing of the deter- I
urination of tax due. The Council shall fix a time and
place for hearing such appeal, and the City Clerk shall
give notice in writing to such operator at his last
known place of address . The findings of the Council
shall be final and conclusive and shall be served upon
the appellant in the manner prescribed above for service
of notice of hearing. Any amount found to be due shall
be immediately due and payable upon the service of notice
of hearing. Any amount found to be due shall be immediately

29.13-11 Records. It shall be the duty of every operator liable
for the collection and payment to the city of any tax
imposed by this Chapter to keep and preserve, for a
period of three years, all records as may be necessary
I to determine the amount of such tax as he may have been
liable for -the collection of and payment to the city,
which records the Tax Administrator shall have the right
to inspect at all reasonable times.
29. 13-12 Refunds.
(a) Whenever the amount of any tax, interest or penalty
has been overpaid or paid more than once or has been
erroneously or illegally collected or received by the
City under this Chapter it may be refunded as provided
in subparagraphs (b) and (c) of this section provided a
claim in writing therefor, stating under penalty of
perjury the specific grounds upon which the claim is
founded, is filed with the Tax Administrator within
three years of the date of payment. The claim shall
be on forms furnished by the Tax Administrator.
(b) An operator may claim a refund or take as credit
against taxes collected and remitted the amount overpaid,
paid more than once or erroneously or illegally collected
or received when it is established in a manner prescribed
by the Tax Administrator that the person from whom the
tax has been collected was not a transient; provided,
however, that neither a refund nor a credit shall be
I allowed unless the amount of the tax so collected has
either been refunded to the transient or credited to
rent subsequently payable by the transient to the operator.
(c) A transient may obtain a refund of taxes overpaid or
paid more than once or erroneously or illegally collected
or received by the City by filing a claim in the manner
provided in subparagraph (a) of this section, but only
when the tax was paid by the transient directly to the
Tax Administrator, or when the transient having paid the
tax to the operator, establishes to the satisfaction of
the Tax Administrator that the transient has been unable
to obtain a refund from the operator who collected the tax. ,
(d) No refund shall be paid under the provisions of this
section unless the claimant establishes his right thereto
by written records showing entitlement thereto.
29. 13-13 Actions to Collect. Any tax required to be paid by ,any
transient under the provisions of this Chapter shall be
deemed a debt owed by the transient to the City. Any
such tax collected by an operator which has not been
paid to the City shall be deemed a debt owed by the
operator to the City. Any person owing money to the
I City under the provisions of this Chapter shall be liable
to an action brought in the name of the City of Palm
Springs for the recovery of such amount.

29. 13-14 Violations:_Misdemeanor. Any person violating any of
the provisions of this Chapter shall be guilty of a mis-
demeanor and shall.be punishable therefor by a fine of
not more than ,five hundred dollars ($500.00) or by im-
prisonment in ,the City jail for.a_period.of not more
than six.months or by both such fine and imprisonment.
Any operator or other,person who fails or refuses to
register as required herein, or to furnish any return
required to be made, or who fails or refuses to fur-
nish a supplemental return or other data required by
the Tax Administrator, or who renders a false or frau-
dulent return or claim is guilty of a misdeameanor, and
is punishable as aforesaid. Any person required to make,
render, sign or verify any report or claim who makes
any false or fraudulent report or claim with intent to
defeat or evade the determination of any amount due
required by this Chapter to be made, is guilty of a
misdeameanor and is punishable as aforesaid.
29. 13-15 Severability. If any section, subsection, subdivision,
paragraph, sentence, clause or.phrase of this Chapter
or any part thereof is for any reason held to be un-
constitutional, such decision shall not affect the
validity of the remaining portions of this Chapter or
any part thereof. The-City-Council hereby declares
that it would have passed each section, subsection,
subdivision, paragraph, sentence, clause or phrase
thereof, irrespective of the fact that any one or more
sections, subsections , subdivisions , paragraphs , sen-
tences, clauses or phrases be declared unconstitutional.
29.13-16 The City is empowered to enter into a joint powers
agreement with other cities and the County of Riverside,
and if such agreement or agreements can be made wherein
central collection for the County of Riverside is pro-
vided, then it, shall be done upon approval by the City I
Council.
29.13-17 The expenses for staff and collection of the tax herein
provided shall be paid from the gross receipts.
29.13-15 The net proceeds from the tax imposed herein shall be
used exclusively for advertising, publicity and promotion
of the City and shall be placed in a special fund to be
known as the Room Tax Advertising, Publicity and Promo-
tion Fund.
29.13-19 Effective Date. This Chapter shall be effective thirty
(30) days from and after the date of its passage except
that the tax imposed by this Chapter shall become opera-
tive and be imposed on October 1, 1964, and shall not
apply prior to said date.
SECTION 2. PUBLICATION. The City Clerk is hereby ordered and
directed to cause the same to be published once in THE DESERT SUN,
a daily newspaper of general circulation, printed, published and
circulated in the City of Palm Springs, California.

provide as follows:
9211.2999.63 ZONE CHANGE: The following lands are hereby
=e rezoned from Zone T-Trailer Park District to
C-2, General Commercial District: An area
approximately twelve (12) acres in size, and
rezoning an additional two (2) acres from
T-Trailer Park District to G-R Guest Ranch
Zone District; both of said properties gene-
rally fronting on the South side of the exten-
sion of Matthew Drive 415 feet East of the
Southerly extension of Cherokee Way. The two
(2) acres hereby rezoned G-R, Guest Ranch,
will automatically become a portion of the
"0" Zone when the new Zoning Ordinance is
adopted. Reference is made to Planning
Commission Case 5.268 (March 11, 1964) and
the maps therein showing changes of zone as
set forth herein, together with the conditions
upon which the above change of zone are con-
tingent , except that, the green belt required
on the North side of the property is eliminated
as a condition.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in
full force and effect thirty (30) days after passage.

AN ORDINANCE OF THE CITY OF PALM SPRINGS
CALIFORNIA, PROVIDING FOR THE ISSUANCE
OF GENERAL OBLIGATION BONDS OF SAID CITY
IN THE AMOUNT OF $100,000
WHEREAS , pursuant to Ordinance No. 307 of the City of Palm
Springs , California, a special municipal election was duly
I and regularly held in said city on the 14th day of February,
1956, at which election there was submitted to the qualified
voters of said city the following bond proposition, to wit:
BOND PROPOSITION NO, 7: Shall the City of Palm
Springs incur a bonded indebtedness in the princi-
pal sum of $100,000 for the acquisition and- con-
struction by said city of a certain municipal im-
provement, to wit: storm drains to control
Tachevah Canyon flood waters, with appurtenances
and appurtenant work, including the acquisition
of land, easements, rights of way, apparatus,
equipment and other property necessary therefor?
and
WHEREAS, said proposition received the affirmative vote and
assent of more than two-thirds of all of the qualified voters
of said city voting on said proposition, and said city is now
authorized to issue bonds in the amount and for the purpose
set forth in said proposition:
NOW, THEREFORE, the City Council of the City of Palm Springs,
California, DOES ORDAIN as follows:
SECTION 1. That bonds of the City of Palm Springs,
1 California, in the principal sum of $100,000 be issued and
sold for the purpose set forth in the bond proposition in
the recitals hereof. Said bonds shall be designated
MUNICIPAL IMPROVEMENT BONDS, 1964, shall be one hundred in
number, numbered 1 to 100 both inclusive, and shall be of
the denomination of $1,000 each. Said bonds shall be dated
July 1, 1964, and shall be payable in consecutive numerical
order $10,000 on July 1 in each of the years 1965 to 1974,
both inclusive.
Said bonds shall bear interest at a rate or rates to be
hereafter fixed by resolution, but not to exceed per cent
(6%) per annum, payable annually the first year and semi-
annually thereafter. Said bonds and the interest thereon
shall be payable in lawful money of the United States of-
America at the office of the City Treasurer of the City of
Palm Springs, California, in said city, or at any fiscal
agency of the City of Palm Springs in Los Angeles , California,
at the option of the holder thereof.
SECTION 2. That the Mayor and the City Treasurer of
said city are hereby authorized and directed to sign all of
said bonds by their printed, lithographed or engraved fac-
simile signatures , and the City Clerk of said City is hereby
authorized and directed to countersign said bonds and to
affix thereto the corporate seal of said city, and the City
Treasurer of said city is hereby authorized and directed to
sign the interest coupons of said bonds by his printed,
lithographed or engraved facsimile signature, and to number
said interest coupons of each of said bonds consecutively.

SECTION 351 That the proceeds of the sale of said bonds
(except premium, if any, and accrued interest) shall forth-
with be turned over to and placed in the municipal treasury
of said city to the credit of a fund hereby created and
designated "MUNICIPAL IMPROVEMENT BONDS, 1964, CONSTRUCTION
FUND" and the moneys in said fund shall be applied exclusively
to the acquisition and construction of the municipal improve-
ment described in the bond proposition in the recitals
hereof, except as provided in Section 43628 of the Government
Code.
SECTION 4_ That any premium or accrued interest received I
from the sale of said bonds shall forthwith be turned over to and
placed in said treasury in the interest and redemption fund herein-
after created. That for the purpose of paying the principal and
interest of said bonds the City Council of said city shall at the
time of fixing the general tax levy, and annually thereafter until
said bonds are paid or until there is a sum in the treasury of said
city set apart for that purpose sufficient to meet all payments of
principal and interest on said bonds as they become due, levy and
collect a tax sufficient to pay the interest on said bonds as it
falls due and such part of the principal thereof as will become
due before the proceeds of a tax levied at the next general tax
levy will be available. Said tax shall be in addition to all other
taxes levied for municipal purposes and shall be levied and collected
as other city taxes , and shall forthwith be turned over and paid into
a fund of the city to be known as "MUNICIPAL IMPROVEMENT BONDS, 1964,
INTEREST AND REDEMPTION FUND." Said fund shall be used for no other
purpose than the payment of said bonds and interest thereon until
said bonds and interest are fully paid.
SECTION 5. That said bonds and the coupons for the interest
thereon shall be issued in substantially the following form:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AS FOLLOWS:
SECTION 1. Sections 9233.5 and 9234 of Division 9 of the "Palm Springs
Ordinance Code" are hereby amended to read as follows :
9233.5 Use Abandoned: Where no use of a non-conforming building or improve-
ment shall be made for a period of one (1) year, or said premises
shall be used for a conforming use for a period of one (1) year,
. said non-conforming building or improvement may be used only for the
particular use or uses in their zoning district which requires the
least amount of off-street parking.
9234. Non-Conformity: Performance Standards : The use of land, building
or structures which does not meet the standards of performance not
heretofore mentioned in this ordinance for said uses or the standards I
for equipment employed in the operation of said uses as required by
this ordinance, shall be brought into conformity with said standards
within a period of five (5) years from the effective date of this
ordinance, otherwise the non-conforming use shall be discontinued.
Upon compliance with the required performance standards the Director
off Building & Safety shall issue a Certificate of Compliance, a copy
ofwhich shall be filed by the City Clerk. No permit or license shall
be issued to any use not conforming with said performance standards
at the end of five (5) years from the effective date of this ordinance.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty (30) days after passage.

OF THE "PALM SPRINGS ORDINANCE CODE" TO PROVIDE FOR REGU-
LATIONS GOVERNING HIGH RISE BUILDINGS AND REPEALING PRESENTLY
EXISTING SECTIONS 9257. 1 THROUGH 9257. 19
I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AS FOLLOWS:
SECTION 1. Sections 9257. 1 through 9257. 19 are hereby added to
Division 9 of the "Palm Springs Ordinance Code" to read as follows:
9257. 1 DEFINITION. For the purpose of this article, a high-rise building is
defined as a building or structure which exceeds thrity-five feet
(35 ft) in height from normal ground level.
The High-rise ordinance standards are intended to provide for open
space, preservation of views, enhancement of the resort character
of the City, and insurance that such buildings will not deteriorate
adjoining properties,
REGULATIONS: A high-rise building shall be regulated by the following:
9257.10 Zone District: High-rise buildings shall be permitted in the R-3 and I
R-4 Districts and shall be permitted for apartment or hotel use in
other zoning districts where R-3 and R-4 uses are permitted. In all
cases high-rise building shall be subject to a Conditional Use Permit
and to all regulations in this article.
9257.11 Procedure for filing a High-Rise Conditional Use Permit: The appli-
cant shall submit the following schematic plans in triplicate:
Phase 1. Topographic map showing original grading and proposed grading;
Chart showing maximum shadows on property line on December 21;
Diagram showing conformance of proposed buildings to required sight
lines;
Detailed and dimensioned plot plans showing proposed buildings ;
Plans showing proposed landscaping and off-street parking;
Floor plans and elevations of proposed buildings showing colors,
materials, and signs; said plans drawn to scale.
Phase 2. Modifications of Phase 1 required by the Planning Commission.
9257. 12 Balconies: Private outdoor living areas or balconies of not less than I
six and one-half feet by ten feet (6z ft x 10 ft) in size, and/or
patios of not less than One Hundred Fifty (150) square feet shall
be provided for a minimum of fifty percent (50%) of the units in
a high=rise building.
9257. 13 Parking: A parking area shall be landscaped and improved in accord-
ance with Article 930. 1.
9257 . 14 Open Space: A minimum of fifty percent (50%) of the site area of a
high-rise building, excluding areas required in 9257.13 above, shall
be developed as usable landscaped open space and outdoor living and
recreation area. At least fifty percent (50%) of the landscaped
open space shall be in plant material.
9257. 15 Height Limit: Maximum height of high-rise buildings shall be one
hundred feet (100 ft) . This shall include all appurtenances on
such buildings, and this maximum height shall be measured from any
point of the natural elevation of the ground at the building line,
before grading, up to the maximum projection on the top of the building
at the same point.
9257. 16 Shadow Effect: Between the hours of 9:00 a.m. and 3:00 p.m. as
measured on December 21, 1964, shadows created by high-rise buildings
shall not extend on to any adjacent property boundaires, except onto I
streets or rights-of-way, but shall not extend onto the adjacent
opposite curb or future curb line.
9257. 17 Setback: A high-rise building shall have a minimum setback of three
feet (3 ft) of horizontal setback distance for each one foot (1 ft)
of vertical rise of the building. This setback requirement is to be
measured from the adjoining property line where there is no street
right-of-way; or when the site in question abuts a street, it shall
be measured from a point five feet (5 ft) above the sidewalk eleva-
tion at the right-of-way line on the opposite side of the abutting
street according to the officially adopted right-of-way, but not
to exceed a distance of 100 feet fromthe site in question.
9257. 18 Proximity to low density development: When a high-rise
building will be viewed from an R-1 zone or properties in an
area designated in the General 'P1an for low density residential
development, said high-rise building shall have a minimum setback
from the closest part of said R-1 zone, or low density residential
designation, of six feet (6 ft) or horizontal setback distance for
each one foot (1 ft) of vertical rise of the building as measured
in 9257.17 above.
9257. 19 Designer: High-rise buildings shall be designed by a licensed
architect, and such designs be reviewed by the Planning Commis-
sion to insure that such buildings shall fit into the resort
character of the community, blend in with the natural surround-
ings, and comply with all the provisions of this ordinance.

by metes and bounds shall employ a competent engineer or surveyor

SECTION L. Subsections "C" and "D" of Section 9214.03 of
Division 9 of the "Palm Springs Ordinance Code" are hereby amended
to read as follows:
Section 9214.03 - "C" Building Height: Buildings and structures
shall have a height of not greater than thirty
(30) feet, except that no buildings or structures
may exceed fifteen (15) feet and one story (1)
within fifty (50) feet of an R-1 or R-2 zone or
street which abuts on and R-1 or R-2 zone.
Section 9214.03 - "D" Yards:
1. Where "P" zone fronts, sides or rears on a
street, there shall be a yard abutting said street
of not less than twenty-five (25) feet. When said
"P" zone fronts, sides, or rears on a street which
abuts a residential zone, the entire twenty-five
(25) foot yard shall be landscaped with plant
material including trees, shall include a complete
irrigation system and maintenance in perpetuity,
and that no more than 20% of said landscaped area
shall be in gravel. When said "P" zone fronts,
sides, or rears on a street which abuts on a
non-residential zone, not less than the six (6)
feet nearest the street shall be landscaped and
maintained. The remaineder may be used for parking,
provided a wall not less than two and one-half (2z)
feet in height is installed between the landscaped
portion and the parking area.
Z. Where "P'' zone sides or rears directly on prop-
erty in a single family zone, there shall be a
landscaped yard of not less than twenty(20) feet
with complete irrigation system, and maintained
in perpetuity. A masonry wall six (6) feet in
height shall be installed on the zone boundary line,
with screen landscaping adjacent to it.
3. Where the "P" zone sides or rears on an alley
which is a boundary with a residential zone, there
shall be a yard of not less than thirty (30) feet,
measured from the side of the alley opposite the
subject property. Said yard may be used for parking
or loading.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full
force and effect- thirty (30) days after passage .

9241.2 Administration: All business matters before the Commission
shall be administered by the Planning Director in his capacity
of Zoning Administrator.
9242 Authority of the Commission: The Commission shall have the

from regulations and requirements of said ordinance if it
finds:
9243. 1 He shall investigate all such applications and submit his
written findsing and recommendations to the Commission;
9243.3 Determination Effective:, All determinations of the Administrator
shall be in writing and copies shall be submitted to the Building
Inspector, to the Commission and to the applicant. Slight modi-
fications may be granted without public hearing and shall become
effective 10 days from the date of the written determination,
during which time an appeal may be taken to the Commission.

9211.2999.66 Zone Change: The following described lands are hereby rezoned
from G-R, Guest Ranch, to R-3, Hotel and Apartment District:
The East half of the Southwest quarter of the Southwest quarter
of Section Two (2), Township Four (4) South, Range Four (4)
East, San Bernardino Base and Meridian, excepting therefrom
the Southerly Fifty (50) feet(which is Vista Chino) , the

SECTION 2. CONDITIONS. The above set forth zone change is subject
to the following conditions:
1) There shall be a twenty-five (25) foot setback along Via Escuela
and Via Miraleste which shall be landscaped in plant material;
2) The buildings shall be limited to one story, twenty (20) feet I
in height, within 150 feet of the center line of the streets
Via Escuela and Via Miraleste;
3) The applicant shall be required to dedicate a ten (10) foot
wide easement along Vista Chino from Via Miraleste due West
to the North/South line of the application, and the said area dedi-
cated shall be improved to City standards;

4) Road openings on Via Miraleste and Via Escuela shall be
as approved by the Director of Public Works.
SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full

ORDINANCE NO. 665
AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ESTABLISHING AN ECONOMIC DEVELOPMENT COMMISSION FOR
THE CITY AND PROVIDING FOR ITS MEMBERSHIP, POWERS
AND DUTIES

CALIFORNIA, AS FOLLOWS:
SECTION 1. A new Chapter 19. 1 is hereby added to Division 1 of
the"Palm Springs Ordinance Code" to read as follows:
ARTICLE 19. 10
APPOINTMENT
19. 10 The Palm Springs Economic Development Commission shall consist of
nine (9) members none of whom shall be officials or employees of the City
of Palm Springs, and said nine (9) members shall be appointed by the Mayor
with the approval of the City Council. A quorum of the Commission shall
consist of four (4) members. Of the nine members first appointed under
this ordinance, five (5) shall be appointed for a period of two (2) years,
and four (4) shall be appointed for a period of three (3) years. Their
successors shall be appointed for terms of two (2) years. The members of
the Commission may be removed prior to the expiration of their office by
a majority vote of the City Council. The City Manager, or his designated
representative, shall also serve as the Secretary to the Commission for
the purpose of expediting the Commission's work and keeping appropriate
minutes. The City Manager shall have no vote.
ARTICLE 19. 11
POWERS AND DUTIES
19. 11 The Economic Development Commission shall hold one regular meeting
each month on a date and at an hour to be fixed by the Commission, and
hold regular meetings, adjourned meetings and special meetings at such
time as circumstances shall require. The City Manager shall attend all
regular meetings and furnish necessary information, data, maps and records
as required by the Commission. With the consent of the City Manager, the
Commission may also call upon the services of any of the departments of
the City and Department Heads shall respond to the request' for attendance
by the Commission.
THE ECONOMIC DEVELOPMENT COMMISSION SHALL HAVE THE DUTY AND POWER TO:
1) To stimulate the growth of existing businesses and enterprises within
the City limits of the City;
2) Locate and stimulate growth of new industries within the City, which said
industries are compatible to the area and within the framework of the
zoning law.
3) Develop, compile and coordinate information regarding available sites
suitable for the said industrial or commercial development.
4) Work so as to retain the unique quality of the City's resort economy,
with the need for industrial development and year-round employment.
5) Advise and encourage the Planning Commission to zone in an orderly
fashion the lands within the City so as to create the maximum benefit
to the City and to retain its essential resort character.
6) Recommend to the City Council the sale, lease or other use of City-owned
property for industrial, commercial or other uses.
7) Confer with and advise the City Council and the City Manager on all matters
concerning the industrial and commercial development of the City and
surrounding area.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full
force and effect thirty (30) days after passage.

SECTION 1. Sections 7121 and 7123 of Division 7 of the
"Palm Springs Ordinance Code" are hereby amended to read as
follows :

Section 7121. SWEEPING AND WASHING OF DEBRIS AND PETRO-
LEUM PRODUCTS INTO STREET. No person, firm or corporation shall wash,
sweep or brush any waste, trash or rubbish, grease, oil or similar
petroleum products from sidewalks, driveways, courtyards, service
yards, or service station premises, or from any private premises,
into the public streeets, roadways, or gutters, and allow same to
remain there.
Section 7123 . WASHING OF PAVEMENT ADJOINING STREET.
Between the hours of five and nine o'clock each morning, water may
be used to cleanse paved surfaces of public and private premises I
located within Commercial Zone Districts as presently or hereafter
established by ordinance, provided it is used only in such quantity
and with such pressure that may be necessary to remove dirt or
foreign matter from the paved surfaces; and provided that no grease,
oil or other petroleum products are washed into the public streets,
roadways or gutters and allowed to remain there.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full force
and effect thirty (30) days after passage.

person shall propel a skate-board on any public or private
street or sidewalk as follows:

SECTION 1. Sections 1534, 1801 and 1802 of Division 1 of the
"Palm Springs Ordinance Code" are hereby amended to read as follows :
1534 APPROVAL OF DIRECTOR OF FINANCE: All demands approved by
the City Manager shall be presented to the Director of-
Finance who shall satisfy himself whether the money is
legally due and remains unpaid, whether the payment thereof
from the City treasury is authorized by law, and out of what
fund, shall cause the same to be compared with the requisition
and order, and to the prices and computations checked, and I
transmit same to the Finance Committee of the City Council.
Prepayment of demands prior to audit by the Finance Committee
and the City Council may be made by the Director 6f Finance
in conformity with the authority provided by Section 37208

1801 DIRECTOR OF FINANCE : The office of Director of Finance is
hereby created and established. The Director of Finance
shall be the chief fiscal officer of the City.

AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPT-
ING A UNIFORM FIRE CODE RECOMMENDED BY THE CALIFORNIA FIRE
CHIEFS' ASSOCIATION, BEING PARTICULARLY THE 1961 EDITION
THEREOF, AND THE WHOLE THEREOF SAVE AND EXCEPT SUCH PORTIONS
AS ARE SPECIFICALLY DELETED, MODIFIED OR AMENDED: SAID FIRE
CODE GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY
FROM FIRE OR EXPLOSION ESTABLISHING A BUREAU OF FIRE PREVEN-
TION AND PROVIDING OFFICERS THEREFOR, AND DEFINING THEIR
POWERS AND DUTIES: REPEALING CHAPTER 42, EXCEPT ARTICLE 425,
AND DIVISION 4.1 OF THE "PALM SPRINGS ORDINANCE CODE" AND
ADOPTING APPENDICES A, B, C; AMENDED APPENDICES D, E, F;
APPENDIX G AS SET FORTH IN THE UNIFORM FIRE CODE, AND
APPENDIX H AS MODIFIED HEREIN
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AS FOLLOWS :
SECTION 1. There is hereby adopted by the City of Palm Springs,
for the purpose of prescribing regulations governing conditions
hazardous to life and property from fire or explosion, that certain
Code known as the Uniform Fire Code recommended by the California
Fire Chiefs ' Association, being particularly the 1961 Edition there-
of, and the whole thereof save and except such portions as are
hereinafter deleted, modified or amended, of which Code not less
than three (3) copies have been and now are filed in the office of
the Clerk of the City of Palm Springs and the same are hereby adopted
and incorporated as fully as if set out at length herein, and from
the date on which this ordinance shall take effect, provisions
thereof shall be controlling within the limits of the City of Palm
Springs.
SECTION 2. ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE
PREVENTION.
a. The Uniform Fire Code shall be enforced by the Bureau of
Fire Prevention in the -'Fire Department of the City of Palm Springs
which is hereby established and which shall be operated under the
supervision of the Chief of the Fire Department.
b. The Chief in charge of the Bureau of Fire Prevention shall
be appointed by the Fire Chief and the City Manager on the basis as
set forth by the Personnel System and Regulations Rule VII - 3/12/63.
C. The Chief of the Fire Department may detail such members
of the Fire Department as Fire Prevention Officers as shall from
I time to time be necessary. The Chief of the Fire Department shall
recommend to the City Manager the employment of technical inspectors,
who when such authorization is made, shall be selected as set forth
by the Personnel System and Regulations Rule VII - 3/12/63, for the
position.
d. A report of the Bureau of Fire Prevention shall be made
annually and transmitted to the Chief executive officer of the Fire
Department and of the Municipality; it shall contain all proceedings
under this Code, with such statistics as the Chief of theFire
Department shall also recommend. The Chief of the Fire Department
and/or the Chief of the Bureau of Fire Prevention shall also
recommend any amendments to the Code which, in their judgment, shall
be desirable.
