BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AS FOLLOWS:
SECTION 1. Sections 9312 .31, 9322.31, 9332 .423,
9332.424, 9415.2, 9342.51 and 9424.2, all in Division 9 of the "Palm
Springs Ordinance Code" are hereby amended to read as follows :
9312 .31 Parking: There shall be at least two (2) private garages,
carports, or parking spaces as an accessory to each and every
dwelling. Garages and carports shall be attached to the main
building.
9322 .31 Parking: There shall be at least one and one-tenth (1 -1/10)
garages , carports or parking spaces as an accessory for each
and every dwelling unit. Such garages or carports may be a
detached accessory building. All parking areas shall be sur-
faced with concrete, brick or suitable asphaltic surface to
prevenr the emanation of dust. Parking stalls shall be demar-
cated with white stripes along the sides a minimum of nine feet
(9') apart, and twenty feet (20') in length.
9332.423 Hotels , Apartment Houses : There shall be one and one-tenth
(1-1/l0) garages, carports or parking spaces as an accessory
for each guest room and apartment unit. Resort hotels with
auxiliary commercial uses shall comply with the following
additional standa5ds:
(a) One parking space for every sixty (60) square feet of-
gross floor area of dining room, bars and dancing areas
and places where the public is served, plus an addition
of twenty per cent (20%) of the above required parking
spaces for the use of employees .
(b) Commercial accessory uses shall be based on the standard
of one (1) parking space for every four hundred (400)
square feet of gross floor area.
(c) Places of public assembly, such as auditoriums, exhibi-
tion halls, theatres, convention facilities, meeting
rooms, and other places of public assembly, excluding
foyers, corridors , restrooms, kitchens, storage and other
areas not used for assembly of people shall be based on
the following standards:
(1) One space for six seats if seats are fixed; or
one apace for forty-eight square feet of assembly
area;
(2) The total requirement for off-street parking for
auditorium, exhibition halls, theatres, convention
facilities, meeting rooms or other places of public
assembly may be reduced by one (1) parking space
for every four (4) guest rooms contained within the
attached hotel.
(paving requirements - See Section 9322.31)
9332.424 Places of Public Assembly:
Churches, auditoriums, exhibition halls, theatres, convention
facilities, meeting rooms , and other places of public assembly
shall provide one (1) off-street parking space for every three
(3) seats if seats are fixed; one (1) space for each twenty-
four (24) square feet of assembly area,, which does not include
foyers, corridors, restrooms , kitchens, storage and other areas
not. used for assembly of people.
Hospitals - one (1) space for every two (2) beds .
9415 .2 Commercial Uses:
Commercial buildings shall provide at least one (1) nine by
twenty foot (9' x 20') off-street parking space for each three
hundred (300) square feet of gross floor area exclusive of floor
area used for air conditioning or other utility equipment.
Special Uses :
Restaurants, cafes, cabarets , cocktail lounges, dining-rooms,
bars, and other food and drink dispensing uses shall provide
one (1) off-street parking space for each forty-five (45) square
feet of gross floor area of dining rooms, bars, and dancing areas and
places where the public is served, plus an addition of twenty
per cent (20%) of the above required parking spaces for use of
the employees .
Offices and Banks : Offices and accessory retail uses and banks
and savings and loan associations shall provide one (1) off-street
parking space per two hundred (200) square feet of gross floor
area exclusive of floor area used for air-conditioning or other
utility equipment.
All parking areas shall be surfaced with concrete, brick or
suitable ,asphaltic surfacing to prevent emanation of, dust. Each
I parking space shall be demarcated with white stripes along the
sides.
9424.2 Commercial Uses : Commercial buildings for this zone dis-
trict shall comply with off-street parking requirements
provided in Sections 9415 .2 and 9415 .21 of this code .
For wholesaling and warehousing uses, one (1) space for
each eight hundred square feet of gross floor area plus
one (1) space for each company truck or vehicle parked
at said operation.
9342 .51 Parking for residential uses :
The same as required in R-1, R-2 and R-3 Districts which-
ever district is appropriate . For, restaurants, the same
requirement as in Section 9415 .2 (Paving requirements -
9322.31)
SECTION 2. Sections 9312 .311, 9322 .311, 9332 .4241,
9415 .21 and 9359 are hereby added to Division 9 of the "Palm Springs
Ordinance Code," to read as follows :
9312 .311 Parking Exception: For that area bounded by Alejo Road
on the North and Ramon Road on the South, including both
sides of Palm Canyon Drive, the East side of Belardo Road,
and the West side of Indian Avenue, parking requirements
I shall be as follows:

space, garage or carport as an accessory for each and every

(b) Places of Public Assembly: At least one (1) parking space
for each five (5) seats of audience seating capacity or, where
seating capacity cannot be measured, at least one (1) parking
space for every three hundred square feet of gross floor area.

(c) Accessory commercial uses for resort hotels: One (1) square
foot of parking area for every one (1) square foot of gross floor

9415 .21 Parking Exception: For that area bounded by Alejo Road on the
North, Ramon Road on the South including both sides of Palm
Canyon Drive, East side of Belardo Road, and West side of Indian
Avenue, parking requirements shall be as follows:
(a) Commercial uses : For commercial buildings at least one (1)
nine by twenty foot (9' x 20') parking space for each four hun-

(b) Cabarets and Cocktail Lounges shall provide one (1) parking

9359. Off-Street Parking: There shall be two (2) off-street parking

SECTION 3. REPEAL, Section 9332.41 and the second paragraph of
Section 9414.8 of Division 9 of the "Palm Springs Ordinance Code" shall be
repealed.
SECTION 4. RENUMBERING. Sections 9312 .3111 and 9322.311 are
hereby renumbered to read as follows :
9312.3111 - Parking of Trucks 9322.3111 - Parking Bays .
SECTION 5 . EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty (30) days after passage.
SECTION 6. PUBLICATION. The City Clerk is hereby ordered and

SECTION 1. Section 226.4 of Division 2 of the "Palm Springs
Ordinance Code" is hereby amended to read as follows :
226.4 The Chief of Police of said City of Palm Springs shall deliver
said blanks to the person from whom said reports are required,
from time to time, at a charge sufficient to cover the cost to
the City for preparation of such forms . The forms shall consist
of an original and a duplicate and the charge for the forms shall
be paid to the City upon receipt of same by the person from whom
the reports are required. The Chief of Police upon receipt of
said reports from any of the persons from whom said reports are
required shall file same in his records, and same shall be open
to inspection only to the Police Department of said City or upon
order of a duly authorized court order made for that purpose.
SECTION 2 . EFFECTIVE DATE, This ordinance shall be in full
force and effect thirty (30) days after passage.

ORDINANCE NO. 589
AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
ADDING SECTIONS 9257 . TIIROUGH 9257.19 TO DIVISION 9
OF THE "PALM SPRINGS ORDINANCE CODE," TO PROVIDE
REGULATIONS FOR HIGH-RISE BUILDINGS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS , CALI-
FORNIA, AS FOLLOWS:
SECTION 1. A new Section 9257 through 9257 .19 is hereby
added to Division 9 of the "Palm Springs Ordinance Code" to read as
follows:
9257. HIGH RISE BUILDINGS.
9257 .1 DEFINITION. For the purpose of this article a high-rise
building is defined, as a building or structure which exceeds
thirty-five feet (35 ') in height from normal ground level .
A high-rise building shall be regulated by the following:
9257.10 ZONE DISTRICT.
High-rise buildings shall be permitted in the R-3 and R-4
Districts subject to a conditional use permit as provided
in this article .
9257 .11 PROCEDURE FOR FILING A HIGH-RISE CONDITIONAL USE PERMIT.
Applicant shall submit the following, in triplicate:
Schematic plans for the high-rise buildings which show the
following:
Phase 1 . Topographic map showing original grading and
proposed grading;
Chart showing maximum shadows on property line
on December 21;
Diagram showing conformance of proposed buildings
to required sight lines ;
Detailed and dimensioned plot plans showing
. proposed buildings ;
Plans showing proposed landscaping and off-
street parking;
Sketches of elevations of proposed building
showing floor plans , color, materials and signs .
Phase 2 . Modifications of Phase 1 required by the Planning
Commission.
9257.12 BALCONIES: Private outdoor living areas of balconies
of not less than six and one-half feet by ten feet
(6,' x 10') in size, and/or patios of not less than
150 square feet shall be provided for a minimum of
fifty per cent (50%) of the units in a high-rise
building.
9257.13 PARIZING. A parking area shall be landscaped with
I trees and other plant material including a landscaped
border around the parking area of not less than three
feet (3') in width and three feet (3') in height, and
a solid masonry wall around the parking lot three feet
(3') in height except where it abuts a residential use,
in which case the wall shall be six feet (6') in height.
In addition to the above a minimum of three per cent
(3%) of the parking lot shall be landscaped in the park-
ing lot interior, with trees and plant material which
shall be distributed throughout the entire parking area
as evenly as possible .
9257.14 OPEN SPACE. A minimum of fifty per cent (50%) of the
site area of a high-rise building, excluding areas re-
quired, in 9257.13 above, shall be developed as usable
landscaped open space and outdoor living and recreation
area. At least fifty per cent (50%) of the landscaped
open space shall be in plant material .
9257.15 HEIGHT LIMIT. Maximum height of high-rise buildings
shall be one hundred feet"(1001):,-: This 'shall_dnclude
all appurtenenaces on such buildings, and this maximum
height shall be measured from any point of the natural
elevation of the ground at the building line, before
grading, up to the maximum projection on the top of the
building at the same point.
9257.16 SHADOW EFFECT. Shadows created by high-rise buildings
shall not extend beyond their property boundaries between
the hours of 9:00 A.M. and 3:00 P.M. as measured on
December 21 .
9257 .17 SETBACR. A high-rise building shall have a minimum
setback from any property line of three feet (3' ) of
horizontal setback distance for each one foot (1') of
vertical rise of the building. This requirement- is to
be measured from a point five feet (5 ' ) above the side-
walk elevation on the opposite side of the abutting
street according to the officially adopted right-of-way,
or from the adjoining property line where there is no
street right-of-way.
9257.18 PROXIMITY TO LOW DENSITY DEVELOPMENT, When a high-rise
building is so located where an R-1 Zone or area desig-
nated in the General Plan as Low Density Residential
Development can have their privacy viewed from the high-
rise building in question, said high-rise building shall
have a minimum setback from the closest part of said
R-1 Zone, or low density residential designation, of six
feet (6' ) of horizontal setback distance for each one
foot (1') of vertical rise of the building as measured in
9257 .17.
9257.19 DESIGNER, High-rise buildings shall be designed by a
licensed architect, and such designs be reviewed by the
Planning Commission and other qualified persons as ap-
pointed by said Planning Commission to insure that such
buildings shall fit into the resort character of the com-
munity, blend in with the natural surroundings, and comply
with all the provisions of this ordinance.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in
full force and effect thirty (30) days after passage.

(1) Applicant shall post a One Hundred Dollar ($100)
cash bond with the City to guarantee removal of-
the political sign or signs ;
(2) The signs shall not exceed three square feet in area;
(3) The signs shall not be placed closer together than
five hundred feet (500') ;
(4) No political signs shall be allowed in Zone
Districts R-1, R-2, R-3 or other residential zone
districts which may be added to the zoning
regulations ;
(5) No signs shall be nailed to trees, fence posts
or public utility poles;
(6) Signs shall be removed within two (2) weeks from
the election date or the bond posted shall be
forfeited and, the City shall use such bond money
to cover its costs of removing the signs;
(7) The $100.00 bond requirement shall apply to signs
for party headquarters ;
(8) No fee or permit shall be required for the right
to erect political signs but the applicant, or his
agent, shall file with the Building Department of
the City, a map or plat showing the locations at
which the signs will be erected.

outside building unless in a special room in accordance
with Section 4.1315 .
SECTION 2 . URGENCY MEASURE. This ordinance is
declared to be an urgency measure to take effect immediately
for the preservation of health and safety of the city pursuant
to the authority granted by the California Government Code Section
36937. The Fire Department of the City of Palm Springs has determined
that Class I liquids should not be permitted to be stored outside
buildings and above ground because of the danger inherent in the
volatile liquids. The Fire Department has determined that Class I
liquids in all cases, except where kept in sealed containers, shall
be stored in storage tanks underground.
SECTION 3. EFFECTIVE DATE. This ordinance shall
become effective immediately upon reading and adoption by the
I majority required by law.

SECTION 1. A new Article 521. is hereby added to Division 5
of the "Palm Springs Ordinance Code," to provide as follows:
ARTICLE 521 I
PARK AND RECREATION COMMISSION.
5211 . COMMISSION ESTABLISHED. A Park and Recreation Commission of
the City of Palm Springs is hereby established.
5212 . MEMBERSHIP: APPOINTMENT. The Palm Springs Park and Recrea-
tion Commission shall consist of seven (7) members , none of
whom shall be officials or employees of the City of Palm Springs;
and the said seven (7) members shall be appointed by the Mayor
with the approval of the City Council. Of the seven (7) members
first appointed under this ordinance, two (2) shall be appointed
for, terms of four (4) years ; two (2) for terms of two (2) years ,
and one (1) for a period of one (1) year from and after their
appointment, respectively. Their successors shall be appointed
for the term of four (4) years . All members serving on said
Commission at the time of passage of this ordinance shall serve
for the remainder of their term. All of said commissioners shall
serve without compensation.
5213 . POWERS AND DUTIES. The Park and Recreation Commission shall hold
one (1) regular meeting each month on a date and at an hour to be
fixed by the Commission, and hold adjourned regular meetings and
special meetings at such time as circumstances shall require. The
Recreation and Special Events Director and the Director of Public
Works, or a representative, shall attend all regular meetings of
the Park and Recreation Commission, furnish necessary information,
data and records, submit proposals and recommendations, and provide
technical assistance and advice as required. In addition, the
City Manager, City Attorney and Director of Finance shall attend
meetings of the Park and Recreation Commission as specifically
requested.
THE PARR AND RECREATION COMMISSION SHALL HAVE THE DUTY
AND POWER TO:
1. Initiate matters pertaining to operation, acquisi-
tion and use of park and recreation facilities .
2. Study, consider and develop long range plans for
ultimate development of the Palm Springs Parks,
giving due regard to any Master Plan adopted by
the City, and to federal and state regulations .
3. Reep up on park and recreation developments, local
and world wide, so as to be able to inform the
City Council of all pertinent matters in the
proper growth of a sound park system.
4. Study and recommend on matters relating to park
improvements, and including methods of financing
and acquisition.
5 . Review and recommend on special permits and pro-
posals, as required, that deviate from the park
development plan.
6. Submit to the City Council such plans as may seem
desirable to the present and future operation of
the Palm Springs Park and Recreation program,
excluding the golf course .
7 . Submit each year an annual report of activities
to the City Council and make information available
to other commissions and officials of the City as
required.
I 8. Coordinate planned activities with other Park and
Recreation agencies not under jurisdiction of the
City of Palm Springs .
9 . Perform other related duties as directed by the
City Council .
10. The Park and Recreation Commission shall review
contracts pertaining to City-owned facilities,
under the jurisdiction of the Park or Recreation
Departments, for recommendation to the City Council.
11. Any item pertaining to parks, recreation and special
events shall first be reviewed by the Park and
Recreation Commission before going to City Council.
12 . The Park and Recreation Commission_ shall have a
separate place on the City Council agenda and shall
be notified of results of recommendations made to
the City Council.
13. The Park and Recreation Commission shall receive
copies of the City Council Agendas .
SECTION 2. Presently existing Article 521 of Division 5 of the
"Palm Springs Ordinance Code" is hereby repealed.

of said districts and provide for the election of seven
members of the city council by district, are hereby repealed.
Section 2 . Municipal Ordinance No. 526 of the City
of Palm Springs approved by the voters on December 12, 1961,
is hereby repealed.
Section 3. Resolution No. 6681 of the City
Council of the City of Palm Springs is hereby repealed.
Section 4. The provisions of all other ordinances
of the City of Palm Springs and the provisions of all other
resolutions of the City Council of the City of Palm Springs,
relating to the division of the City into districts, defining
the boundaries of said districts, and providing for the
election of city councilmen by district are hereby repealed.
I Section 5 . Henceforth the City of Palm Springs shall
be governed by the applicable provisions of the California
Government Code, exclusive of the provisions of Article 2
of Chapter 7, Part 1, Division 2 of said Code .
Section 6. Two city councilmen shall be elected at
the general municipal election first succeeding the effective
date of this ordinance, to be held in April of 1964, and
three city councilmen shall be elected at the general
municipal election second succeeding the effective date
of this ordinance, to be held in April of 1966.
- Section 7. Provisions to the contrary notwithstanding,
nothing in this ordinance contained shall affect in anyway
the powers, duties or terms of office of the persons who
are serving as members of the City Council of the City of
Palm Springs as of the effective date of this _ordieance,
and said members shall retain their offices as councilmen
until the expiration of their respective current terms .
SECTION 2. That the polls for said election shall be
opened at 7:00 o'clock a. m. of the day of said election and shall
remain open continuously from said time until 7:00 o,'clock p.m. ,
I of the same day, when said polls shall be_,closed, except as pro-
vided in Section 14436 of the Elections Code of the, State of
California.
SECTION 3. That the ballots to be used, at said special
municipal election, in addition to any other matters as required

CALIFORNIA, AS FOLLOWS:
SECTION 1. New subsections (k) and (1) are hereby added
to Section 3806 of the Uniform Building Code, to read as follows:
3806 (k) . FIRE ALARMS:
At the same location as the above mentioned hose cabinets ,
there shall be installed an approved automatic or 'manually
operated fire alarm system designed to warn the occupants
of the building in the event of fire . Such fire alarm sys-
tem shall be of sufficient intensity that all occupants of
the building may be warned simultaneously.
No signal system or intercommunicating system used for any
purpose other than fire warning, meets with the requirements
of this part.
Installation, inspection and maintenance of the fire alarm
system shall be according to the standards of the National
Board of Fire Underwriters .
Stations for operating any manually operated fire alarm
system shall be placed immediately adjacent to the telephone
switchboard in the building, if there is a switchboard, and
at such other locations as may be required by the Fire De-
partment or the Department of Building and Safety.
3806 (1) PORTABLE FIRE EXTINGUISHERS:
In all group "II" occupancies there shall be at least one (1)
two and one-half (2,) gallon fire extinguisher on every story
of the building, and the distance of travel to any fire ex-
tinguisher from any point shall not exceed seventy-five feet (75 ') .
Where hose and reel cabinets are required by this section, fire
extinguishers shall be located in same cabinet as the fire hose.
SECTION 2. URGENCY. This ordinance is hereby declared
to be an urgency matter affecting the health and safety of the
residents and visitors of the City of Palm Springs, pursuant to
Section 36937 of the State Government Code. The sections re-
late to fire alarm systems and portable fire extinguishers to
supplement the presently existing provisions in the State Housing
Laws . It is necessary that more specific provisions be made whereby
the fire alarm system requirements are more clearly spelled out .
The City is in the midst of a large building program, and proper
fire alarm systems and fire extinguishers in these buildings must
I be provided.
SECTION 3. EFFECTIVE DATE. This ordinance shall become
effective immediately upon reading and adoption by the majority
required by law.

AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AMENDING SECTION 8232.1 TO DIVISION 8 OF THE "PALM
SPRINGS ORDINANCE CODE" TO PROVIDE FEES FOR PUMPING

SECTION 1 . Section 8232.1 of Division 8 of the "Palm Springs
Ordinance Code" is hereby, amended to read as follows : I
8232.1. APPLICATION FOR PERMIT: FEE. The owner or agent shall
make application to the pumping inspector for a permit to
pump the sewage system. Said application shall be accom-
panied by a fee of $5 .00 for each load which is to be
dumped into the city sewage system; each such load not
to exceed 1250 gallons .
SECTION 2 . EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty (30) days after passage.
SECTION 3 . PUBLICATION. The City Clerk is hereby ordered

9613.31 ACREAGE FEE. When acreage is involved, such

ORDINANCE NO. 606
I AN ORDINANCE OF THE CITY OF PALM SPRINGS , CALIFORNIA,
REPEALING ARTICLE 944 OF DIVISION 9 OF THE "PALM
SPRINGS ORDINANCE CODE" AND RE-ENACTING A NEW
ARTICLE 944
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AS FOLLOWS:
SECTION 1. Presently existing Article 944 of Division 9
of the "Palm Springs Ordinance Code" is hereby repealed.
SECTION 2 . A new Article 944 is hereby added to Division 9
of the "Palm Springs Ordinance Code" to read as follows :
9441 . The W-Watercourse Zone is intended to apply to certain areas
in the City of Palm Springs which, under present conditions,
are not suited for permanent occupancy or residence for the
reason that they are subject to periodic flooding and other
hazards.
The provisions of this Section are temporary in nature,
awaiting detailed plans of development for the lands so
I classified. Regulations of this article shall apply
to lands so classified only until either a drainage and
storm water control plan approved by the City Council upon
recommendation by the Commission shall have been carried
out and put into effect, or until the lands have been
subdivided with applicable State and City regulations . In
either of such instances the properties included therein
shall automatically be classified in the R-1-A Zone, and
thereafter may be classified in any proper zone through the
usual change of zone procedure,
9442. USES PERMITTED
A. Growing of plants, shrubs and, trees for the purpose of
propagating and cultivating only, provided no commercial
or business activities shall be carried on upon the site .
In addition, there shall be no structures or buildings
permitted nor shall there be any storage or vehicles or
equipment, fertilizers or other soil conditioners,
boxes or crates, or any other outdoor storage. All
uses shall be subject to the property development
standards of the R-1-A zone insofar as they shall apply.
USES PERMITTED BY CONDITIONAL USE PERMIT
B. The following uses may be- permitted subject to approval
of a Conditional Use Permit, providing Commission and
Council determines that a drainage or storm water control
plan which is executed provides the particular property
with reasonable safety from flood hazards and providing
such use is necessary for the promotion of the welfare of
the community and not detrimental to the district- or
neighborhood in which it is to be located, all in
accordance with the provisions of Article 925 of this code
governing the issuance of conditional use permits . .

Farming
Golf Courses and driving ranges
Greenhouses
Public Riding stables
Quarries , sand pits and gravel pits , subject to the
following standards:
a. The application for a"-Conditional Use Permit
for a quarry, sand pit or gravel pit shall
include a contour map indicating operating
sites, structures and all improvements,
including the extremities of the proposed
quarry. The applicant shall further submit
a report in detail indicating the method
of quarry operation, which shall include an
outline of the sequence and pattern of mineral
excavation. This shall include the number,
spacing, depth of drill holes and amount of
explosives to be used per hole . The maximum
size of quarry face for mining and blasting
purposes shall be twenty-five (25) -feeL.
The Planning Commission upon receipt of this
plan may, at its discretion, require at the
operator's expense, a geophysical survey to
determine the seismic effects of the proposed
blasting pattern, which may be the basis for
limiting the size of blast.
b. Quarries , sand pits, and gravel pits shall
comply with the following provisions in addi-
tion to zone provisions and conditions imposed
in a Conditional Use Permit.
(1) No rock or mineral crushing or treatment of-
minerals shall be permitted.
(2) Accessory buildings shall be used solely
for the storage and maintenance of equipment
and operating offices .
(3) No building may be closer than one thousand
feet (1000 ft.) from any approved public
street or highway.
(4) Quarry operations shall not be closer than
one-half (,) mile from any residence zone.
(5) The hours of operation shall be limited from
8:00 A.M. to 6:00 P.M. from Monday through
Friday, excluding national holidays .
(6) Removal of minerals pursuant to this section
shall be conducted so as to limit the
emanation of smoke and dust as provided by
the standards set forth in Sections 9220.04-F
and 9220.04-F of this Code.
(7) All operations excepting blasting shall not
exceed sixty-five (65) decibels as measured
from any approved public street or highway.
(8) All drill holes shall be tamped to minimize
the sonic effects of blasts. No charges may
be exposed to the air during detonation.
(9) All roads from the site to any public street
or highway shall be paved with suitable
asphaltic material on a prepared base as per
specifications of the Director of Public Works
to a width of twenty-eight feet (28 ft.) to
prevent the emanation of dust.
(10) Upon completion of all operations , or opera-
tions at any one point, all excavations,as
well as mounds of waste material which may
I be seen from any public street or highway
shall be graded and the premises restored as
near as possible to original conditions and
contours .
C. All operations shall be covered by public liability
and property damage insurance as required by the
City of Palm Springs .
d. Upon cessation of operations for a period of six
(6) months, this permit shall terminate and all
structures and equipment shall be removed.
e. Bond Requirement: To guarantee compliance with
conditions set forth in this section and in the
Conditional Use Permit, the operator shall post
and maintain with the City of Palm Springs, a
performance bond of One Hundred Thousand Dollars
($100,000.00) , conditioned that the City may
enter and restore the premises and recover all
its Costs .
9443. USES PROHIBITED,
All uses and structures not permitted in 9442. are here deemed
to be specifically prohibited.
I9444. PROPERTY DEVELOPMENT STANDARDS
The property development standards of the R-1-A Zone shall apply
insofar as these pertain to the uses permitted in this Zone.
9445 . SITE PLAN REVIEW.
There shall be site plan review of all uses permitted in this
Article 944.
SECTION 3. EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty (30) days after passage.

FIXING THE AMOUNT OF MONEY TO BE RAISED BY TAXATION
FOR THE FISCAL YEAR BEGINNING JULY 1, 1963
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES IIEREBY ORDAIN
AS FOLLOWS:
SECTION 1. The amount of money necessary to be raised by
taxation upon the taxable property within the City of Palm Springs
as a revenue to carry on the various departments of said City and
to pay the bonded and other indebtedness of the City for the fiscal
year beginning July 1, 1963, is hereby fixed as follows:
(a) For the carrying on of the various departments of the
City other than herein stated, Lhe. sum of Seven IIundred
Fifteen Thousand Five Hundred Forty-One Dollars ($715,541.00)
(b) For the maintenance and operation of park and recreation
facilities of the City of Palm Springs , said maintenance
and operation not otherwise being provided for, the sum
of One Hundred Forty-Two Thousand, Six Hundred Ninety-
Eight Dollars ($142,698.00) ;
(c) For the purpose of providing and maintaining parks and I
music, and for advertising purposes, to be used and ex-
pended for such purposes in accordance with Ordinance

(d) For the maintenance, support and purchase of property
necessary for the public library, known as the Welwood

(e) For the maintenance and operation of the sewage disposal

and as provided by this ordinance has been established pursuant to a budget
prepared by the City Manager and approved by resolutions of the City Council,
in accordance with the requirements of the "Palm Springs Ordinance Code."
Pursuant to the authority granted by the statutes of the State of California,
the budget referred to is hereby adopted, and items for purchase provided for
by such budget may be purchased and paid by the City Treasurer prior to audit
by the City Council.
SECTION 3. This is an ordinance fixing the amount of money to be
raised by taxation. The City Council therefore determines and declares
that the same shall be effective immediately by authority of the provi-
sions of Section 36937 of the 'Government Code of the State of California.

hereby added to the Uniform Building Code heretofore adopted by
the City of Palm Springs, California to read as follows :
302 f : Certificates of occupancy shall be withheld for
buildings in new subdivisions and records of survey
that require street paving, curbs, sidewalks, and
other street improvements, until such work has been
accepted by the Department of Public Works .
501 b : On buildings erectedin R-1, R-2 or R-3 Zones, as I
defined in Division 9 of the "Palm Springs Ordinance
Code," no mechanical equipment or duct work shall be
allowed on the roof unless completely concealed by
the roof structure.

7. The development plans shall show landscaping in front
of the buildings as shown on the plan heretofore pre-
sented to the City Council;
8. The development shall show that there is a completely
enclosed storage area for wrecked cars . The enclosed
area shall be sufficient so that the wrecked cars will
not be visible from any direction;
9. The City Council has directed the Planning Commission
to provide for new and used car sales in the C-1 zone
district subject to a Conditional Use Permit. When
such zone district has been established permitting
new and used car sales in the C-1 district, then the
lands involved herein and above described shall become
zoned C-1 .

Springs Ordinance Code" is hereby amended to read as follows : -
9408.51 OPEN STORAGE OTHER THAN JUNK (M-l' only) :
Outdoor storage and activities associated with permitted
uses shall be entirely enclosed along all street frontages
by building walls or a six f-oor (6') high greenbelt or a
six foot (6') high solid decorative masonry wall, plus
landscaping;
On all other property lines, said storage and activities
shall be enclosed by a sic foot (6') high solid fence or
I masonry wall or by a greenbelt not less than six feet (6')
in height, or by a chain link fence with painted aluminum
slats not less than six feet (6') in height, approved by
the Variance Board, to screen view of storage from external
boundaries of property.
Materials or equipment shall not be stacked or stored higher
than six feet (6') . The storage of lumber, coal or other
combustible materials shall be not less than twenty feet(20')
from any interior lot line and a roadway shall be provided,
graded, surfaced and maintained from the street to the rear
of the property to permit free access of fire trucks at any
time.
All enclosures required in this section are to be well
maintained by the applicant or his successor in perpetuity.
SECTION 2. Section 9408.52 is hereby added to Division 9 of the
"Palm Springs Ordinance Code,"- to read as follows :

business to place or deposit garbage or rubbish in any container
placed upon the public street by public authority, and meant
primarily for the disposal of rubbish by pedestrians using the
sidewalk. Such persons and business houses shall contract
separately with the City for removal of garbage and rubbish in
containers maintained by the person or business house .
SECTION 2 . EFFECTIVE DATE. This ordinance shall be in full
force and effect thirty (30) days after passage.

permit would apply. The street improvements shall also include
requirements for sidewalks in accordance with standards to be
developed by the Director of Public Works . Except in single family
residence districts, fire hydrants shall be installed by the
developer for all construction and in accordance with requirements
of the Fire Department.

granted by the Commission shall not become effective until
the purchaser tiles with the administrator a copy of the deed

33201 thereof, that said public body, corporate and politic shall
not transact any business or exercise any powers unless, by resolu-
tion, the City Council of the City of Palm Springs, California,
declares there is a need for such agency to function; and
WHEREAS Section 33983 of the Community Redevelopment Law provides
that the provisions for urban renewal provided by Chapter 6 of said
Law shall not become operative in any community until the legisla-
tive body of the community declares by resolution that there is
need for urban renewal in the community;
NOW THEREFORE BE IT ORDAINED by the City Council of the City of
Palm Springs, California, as follows :
SECTION 1. It is hereby found and declared, pursuant- to
Section 33201 of the Community Redevelopment Law, that there is a
need for the agency created by Section 33200 of said Law to function
in the City of Palm Springs, California, and said agency is hereby
authorized to transact business and exercise its powers under the
Community Redevelopment Law.
SECTION 2. It is hereby further found and declared, pursuant
to Section 33983 of the Community Redevelopment Law, that there is a
need for uban renewal, as defined in Chapter 6 of said Law, in the
City of Palm Springs, California, and that all of the provisions of said
Chapter 6 are operative in the community and applicable to the agency
provided by Section 1 hereof.
SECTION 3. Pursuant to the provisions of Section 33231.5 of
the Coimna,nity,.P.edevelopment Law, this body hereby declares itself
to be the agency provided in Section 1 hereof, and that all rights,
powers, duties, privileges, and immunities vested by the Community
Redevelopment Law in such agency shall be, and are, vested in this body.
SECTION 4. EFFECTIVE DATE. This ordinance shall be in full force
and effect thirty (30) days after passage.
SECTION 5 . PUBLICATION. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to cause
the same to be published once in THE DESERT SUN, a daily newspaper
of general circulation, printed, published and circulated in the
City of Palm Springs, California.
