Garages and carports shall be attached to the main building. 9322 .31 Parking: There shall be at least one and one-tenth (1 -1/10) garages , carports or parking spaces as an accessory for each and every dwelling unit. Such garages or carports may be a detached accessory building. All parking areas shall be sur- faced with concrete, brick or suitable asphaltic surface to prevenr the emanation of dust. Parking stalls shall be demar- cated with white stripes along the sides a minimum of nine feet (9') apart, and twenty feet (20') in length. 9332.423 Hotels , Apartment Houses : There shall be one and one-tenth (1-1/l0) garages, carports or parking spaces as an accessory for each guest room and apartment unit. Resort hotels with auxiliary commercial uses shall comply with the following additional standa5ds: (a) One parking space for every sixty (60) square feet of- gross floor area of dining room, bars and dancing areas and places where the public is served, plus an addition of twenty per cent (20%) of the above required parking spaces for the use of employees . (b) Commercial accessory uses shall be based on the standard of one (1) parking space for every four hundred (400) square feet of gross floor area. (c) Places of public assembly, such as auditoriums, exhibi- tion halls, theatres, convention facilities, meeting rooms, and other places of public assembly, excluding foyers, corridors , restrooms, kitchens, storage and other areas not used for assembly of people shall be based on the following standards: (1) One space for six seats if seats are fixed; or one apace for forty-eight square feet of assembly area; (2) The total requirement for off-street parking for auditorium, exhibition halls, theatres, convention facilities, meeting rooms or other places of public assembly may be reduced by one (1) parking space for every four (4) guest rooms contained within the attached hotel. (paving requirements - See Section 9322.31) 9332.424 Places of Public Assembly: Churches, auditoriums, exhibition halls, theatres, convention facilities, meeting rooms , and other places of public assembly shall provide one (1) off-street parking space for every three (3) seats if seats are fixed; one (1) space for each twenty- four (24) square feet of assembly area,, which does not include foyers, corridors, restrooms , kitchens, storage and other areas not. used for assembly of people. Hospitals - one (1) space for every two (2) beds . 9415 .2 Commercial Uses: Commercial buildings shall provide at least one (1) nine by twenty foot (9' x 20') off-street parking space for each three hundred (300) square feet of gross floor area exclusive of floor area used for air conditioning or other utility equipment. Special Uses : Restaurants, cafes, cabarets , cocktail lounges, dining-rooms, bars, and other food and drink dispensing uses shall provide one (1) off-street parking space for each forty-five (45) square feet of gross floor area of dining rooms, bars, and dancing areas and places where the public is served, plus an addition of twenty per cent (20%) of the above required parking spaces for use of the employees . Offices and Banks : Offices and accessory retail uses and banks and savings and loan associations shall provide one (1) off-street parking space per two hundred (200) square feet of gross floor area exclusive of floor area used for air-conditioning or other utility equipment. All parking areas shall be surfaced with concrete, brick or suitable ,asphaltic surfacing to prevent emanation of, dust. Each I parking space shall be demarcated with white stripes along the sides. 9424.2 Commercial Uses : Commercial buildings for this zone dis- trict shall comply with off-street parking requirements provided in Sections 9415 .2 and 9415 .21 of this code . For wholesaling and warehousing uses, one (1) space for each eight hundred square feet of gross floor area plus one (1) space for each company truck or vehicle parked at said operation. 9342 .51 Parking for residential uses : The same as required in R-1, R-2 and R-3 Districts which- ever district is appropriate . For, restaurants, the same requirement as in Section 9415 .2 (Paving requirements - 9322.31) SECTION 2. TIIROUGH 9257.19 TO DIVISION 9 OF THE "PALM SPRINGS ORDINANCE CODE," TO PROVIDE REGULATIONS FOR HIGH-RISE BUILDINGS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS , CALI- FORNIA, AS FOLLOWS: SECTION 1. A new Section 9257 through 9257 .19 is hereby added to Division 9 of the "Palm Springs Ordinance Code" to read as follows: 9257. HIGH RISE BUILDINGS. 9257 .1 DEFINITION. For the purpose of this article a high-rise building is defined, as a building or structure which exceeds thirty-five feet (35 ') in height from normal ground level . A high-rise building shall be regulated by the following: 9257.10 ZONE DISTRICT. High-rise buildings shall be permitted in the R-3 and R-4 Districts subject to a conditional use permit as provided in this article . 9257 .11 PROCEDURE FOR FILING A HIGH-RISE CONDITIONAL USE PERMIT. Applicant shall submit the following, in triplicate: Schematic plans for the high-rise buildings which show the following: Phase 1 . Topographic map showing original grading and proposed grading; Chart showing maximum shadows on property line on December 21; Diagram showing conformance of proposed buildings to required sight lines ; Detailed and dimensioned plot plans showing . proposed buildings ; Plans showing proposed landscaping and off- street parking; Sketches of elevations of proposed building showing floor plans , color, materials and signs . Phase 2 . Modifications of Phase 1 required by the Planning Commission. 9257.12 BALCONIES: Private outdoor living areas of balconies of not less than six and one-half feet by ten feet (6,' x 10') in size, and/or patios of not less than 150 square feet shall be provided for a minimum of fifty per cent (50%) of the units in a high-rise building. 9257.13 PARIZING. A parking area shall be landscaped with I trees and other plant material including a landscaped border around the parking area of not less than three feet (3') in width and three feet (3') in height, and a solid masonry wall around the parking lot three feet (3') in height except where it abuts a residential use, in which case the wall shall be six feet (6') in height. In addition to the above a minimum of three per cent (3%) of the parking lot shall be landscaped in the park- ing lot interior, with trees and plant material which shall be distributed throughout the entire parking area as evenly as possible . 9257.14 OPEN SPACE. A minimum of fifty per cent (50%) of the site area of a high-rise building, excluding areas re- quired, in 9257.13 above, shall be developed as usable landscaped open space and outdoor living and recreation area. At least fifty per cent (50%) of the landscaped open space shall be in plant material . 9257.15 HEIGHT LIMIT. Maximum height of high-rise buildings shall be one hundred feet"(1001):,-: This 'shall_dnclude all appurtenenaces on such buildings, and this maximum height shall be measured from any point of the natural elevation of the ground at the building line, before grading, up to the maximum projection on the top of the building at the same point. 9257.16 SHADOW EFFECT. Submit to the City Council such plans as may seem desirable to the present and future operation of the Palm Springs Park and Recreation program, excluding the golf course . 7 . Submit each year an annual report of activities to the City Council and make information available to other commissions and officials of the City as required. I 8. Coordinate planned activities with other Park and Recreation agencies not under jurisdiction of the City of Palm Springs . 9 . Perform other related duties as directed by the City Council . 10. The Park and Recreation Commission shall review contracts pertaining to City-owned facilities, under the jurisdiction of the Park or Recreation Departments, for recommendation to the City Council. 11. Stations for operating any manually operated fire alarm system shall be placed immediately adjacent to the telephone switchboard in the building, if there is a switchboard, and at such other locations as may be required by the Fire De- partment or the Department of Building and Safety. 3806 (1) PORTABLE FIRE EXTINGUISHERS: In all group "II" occupancies there shall be at least one (1) two and one-half (2,) gallon fire extinguisher on every story of the building, and the distance of travel to any fire ex- tinguisher from any point shall not exceed seventy-five feet (75 ') . Where hose and reel cabinets are required by this section, fire extinguishers shall be located in same cabinet as the fire hose. SECTION 2. URGENCY. This ordinance is hereby declared to be an urgency matter affecting the health and safety of the residents and visitors of the City of Palm Springs, pursuant to Section 36937 of the State Government Code. The sections re- late to fire alarm systems and portable fire extinguishers to supplement the presently existing provisions in the State Housing Laws . Presently existing Article 944 of Division 9 of the "Palm Springs Ordinance Code" is hereby repealed. SECTION 2 . A new Article 944 is hereby added to Division 9 of the "Palm Springs Ordinance Code" to read as follows : 9441 . The W-Watercourse Zone is intended to apply to certain areas in the City of Palm Springs which, under present conditions, are not suited for permanent occupancy or residence for the reason that they are subject to periodic flooding and other hazards. The provisions of this Section are temporary in nature, awaiting detailed plans of development for the lands so I classified. Regulations of this article shall apply to lands so classified only until either a drainage and storm water control plan approved by the City Council upon recommendation by the Commission shall have been carried out and put into effect, or until the lands have been subdivided with applicable State and City regulations . In either of such instances the properties included therein shall automatically be classified in the R-1-A Zone, and thereafter may be classified in any proper zone through the usual change of zone procedure, 9442. USES PERMITTED A. Growing of plants, shrubs and, trees for the purpose of propagating and cultivating only, provided no commercial or business activities shall be carried on upon the site . In addition, there shall be no structures or buildings permitted nor shall there be any storage or vehicles or equipment, fertilizers or other soil conditioners, boxes or crates, or any other outdoor storage. All uses shall be subject to the property development standards of the R-1-A zone insofar as they shall apply. USES PERMITTED BY CONDITIONAL USE PERMIT B. The following uses may be- permitted subject to approval of a Conditional Use Permit, providing Commission and Council determines that a drainage or storm water control plan which is executed provides the particular property with reasonable safety from flood hazards and providing such use is necessary for the promotion of the welfare of the community and not detrimental to the district- or neighborhood in which it is to be located, all in accordance with the provisions of Article 925 of this code governing the issuance of conditional use permits . . Commercial Plant Nurseries Farming Golf Courses and driving ranges Greenhouses Public Riding stables Quarries , sand pits and gravel pits , subject to the following standards: a. The application for a"-Conditional Use Permit for a quarry, sand pit or gravel pit shall include a contour map indicating operating sites, structures and all improvements, including the extremities of the proposed quarry. The applicant shall further submit a report in detail indicating the method of quarry operation, which shall include an outline of the sequence and pattern of mineral excavation. This shall include the number, spacing, depth of drill holes and amount of explosives to be used per hole . The maximum size of quarry face for mining and blasting purposes shall be twenty-five (25) -feeL. The Planning Commission upon receipt of this plan may, at its discretion, require at the operator's expense, a geophysical survey to determine the seismic effects of the proposed blasting pattern, which may be the basis for limiting the size of blast. b. Quarries , sand pits, and gravel pits shall comply with the following provisions in addi- tion to zone provisions and conditions imposed in a Conditional Use Permit. (1) No rock or mineral crushing or treatment of- minerals shall be permitted. (2) Accessory buildings shall be used solely for the storage and maintenance of equipment and operating offices . (3) No building may be closer than one thousand feet (1000 ft.) from any approved public street or highway. (4) Quarry operations shall not be closer than one-half (,) mile from any residence zone. (5) The hours of operation shall be limited from 8:00 A.M. to 6:00 P.M. from Monday through Friday, excluding national holidays . (6) Removal of minerals pursuant to this section shall be conducted so as to limit the emanation of smoke and dust as provided by the standards set forth in Sections 9220.04-F and 9220.04-F of this Code. (7) All operations excepting blasting shall not exceed sixty-five (65) decibels as measured from any approved public street or highway. (8) All drill holes shall be tamped to minimize the sonic effects of blasts. No charges may be exposed to the air during detonation. (9) All roads from the site to any public street or highway shall be paved with suitable asphaltic material on a prepared base as per specifications of the Director of Public Works to a width of twenty-eight feet (28 ft.) to prevent the emanation of dust. (10) Upon completion of all operations , or opera- tions at any one point, all excavations,as well as mounds of waste material which may I be seen from any public street or highway shall be graded and the premises restored as near as possible to original conditions and contours . C. All operations shall be covered by public liability and property damage insurance as required by the City of Palm Springs . d. Upon cessation of operations for a period of six (6) months, this permit shall terminate and all structures and equipment shall be removed. e. Bond Requirement: To guarantee compliance with conditions set forth in this section and in the Conditional Use Permit, the operator shall post and maintain with the City of Palm Springs, a performance bond of One Hundred Thousand Dollars ($100,000.00) , conditioned that the City may enter and restore the premises and recover all its Costs . 9443. USES PROHIBITED, All uses and structures not permitted in 9442. are here deemed to be specifically prohibited. I9444.
